COMMENT: This resolution would accept sanitary sewer for BDI First Addition, as constructed by Sulzberger Excavating, Inc. of Muscatine, Iowa. This item was deferred from the agenda of December 13 because bond had not been posted. Bond has now been posted and Public Works recommends approval of this resolution. Correspondence: (1) Letter from Procter & Gamble expressing concern about I pedestrian and motorist safety at Lower Muscatine, Fairmeadows, and Highway 6 intersection. This letter has been referred to the City Manager for reply. (2) Letter from Dick Braverman of Hawkeye Wholesale Grocery Co. regarding CRANDIC Railroad underpass on Iowa Avenue. Consider recommendations of the Planning and Zoning Commission: (1) That the final plat for Windsor Heights, Part V, be approved with 7th Avenue extended, with the contingency that the proper legal papers be provided and the utility companies signatures be added (S-7751). The Planning and Zoning Commission, at a regular meeting held on December 15, 1977, recommended by a 5-0 vote approval of the subject subdivision located east of Hickory Hill Park and north of Rochester Avenue, subject to the contingencies noted. I There are, in fact, two final plats which have been submitted, one which shows the 'extension of Seventh Avenue north to the north boundary line common with the Regina Property and the other which shows the termination of Seventh Avenue within the subdivision. The Planning and Zoning Commission recommended that the plat showing the extension of Seventh Avenue north: to the north boundary line be approved, but also indicated that the termination of Seventh Avenue would be satisfactory, if the City acquires the Regina Property. Their recommendation is consistent with the Staff's recommendation presented in a`Staff Report dated December 1, 1977, which is attached to this agenda This item will be placed on the Council agenda for consideration at the next regular meeting, if the above noted deficiencies and discrepancies have been corrected. However, should the City : y, p J Council decide that Seventh Avenue ,should be terminated within the subdivision, the',Staff would suggest that the Council defer consideration of the plat until after an appraisal of the Regina property has been obtained. (2) That it would be satisfactory to Planning and Zoning for Seventh Avenue to be a cul-de-sac if the City acquires the Regina property (5-7751). (3) That the preliminary plat of E.L. Kessler Subdivision, Part 1I, be approved (5-7753). The Planning and Zoning Commission, at a regular meeting held on December 15, 1977, recommended by a 5-0 vote approval of the subject preliminary plat located 1-1/3 miles west of Morman Trek Boulevard off Rohret Road and south 600 feet of the City limits, with the contingency that storm water management be included with the final plat. As this subdivision consists of three lots and it is located in the Old Man Creek Watershed, the Commission did not see the need for requiring storm water management. However, contrary to a subsequent legal opinion, it was believed that the City Engineer was the only person that could waive this requirement. In a subdivision in the county, however, the Council, does have the prerogative to waive ; water management. According to the Council's policy this subdivision will be deferred for one week for Council review. (5) That the City Council recommend to Coralville that Nob Hill Subdivision be approved providing they meet our list of deficiencies and note that our requirement for a legal description , is different (5-7155). As the City Council did not hold a meeting at which to review the subdivision prior to Coralville's' consideration of the plat, any action at this point might perhaps be redundant. MEADOW MNCROr ILMCD BY Comment: The Planning and Zoning Commission at a regular meeting held h 7 on October 20, 1977, recommended by a 5-0 vote approval of subject subdivision located north of Muscatine Avenue i i 1 and west of South Lawn Drive. This recom- mendation was not entirely consistent with the Staff's CEDAR RAPIDS - DES MOINES recommendation presented in a Staff Report dated October 6, 1977, which was attached to the agenda of November 1, 1977. The Staff had recommended the continuity be provided from Muscatine Avenue to Meadow Street at Friendship Street (see memorandum from the Traffic; Engineer which ' was attached to the agenda of the same date) in lieu of, the two near right angle turns proposed within the subdivision. Specifically, as Meadow Street and Brookside Drive are the only streets which cross Ralston Creek between First Avenue and proposed Scott Boulevard on the east, the Staff is of the opinion that a more direct access to the neighborhood should be provided.' This item was previously deferred ar^+ pending an appraisal for the cost of the right- of -way for extending the street from this subdivision t u approximately 200 feet south across adjoining property to Muscatine Avenue.
