Comment: This, gives the State a small strip of land on
Highway 218 directly adjacent to the service building. The
strip of land is shown as the shaded portion on a drawing
attached: to the agenda. It is intended that the land be
transferred to the State at no charge. Improvement of
the
intersection mutually benefits both the City and the State.

land located at the northwest corner of Rochester Avenue and
Seventh Avenue. Sr17816.
Comment: The Planning and Zoning Commission, at a regular
meeting held on April 20, 1978, recommended by a six to zero
vote approval of a
preliminary
and final.
Planned Area Development
Plan and subdivision plat of Hickory Corner to develop four lots
' at the above address for single family dwellings. Contingent
upon this recommendation was that the legal papers: be reviewed
by the legal 'staff, that the side yard for one,of the dwellings
be adjusted,and that signatures', to the legal papers be provided.
These contingencies have now been resolved. This recommendation
is consistent with a staff recommendation presented in a Staff
Report dated April 20, 1978, which is attached to this agenda.
The purpose of this Plan is to allow flexibility, in the provisions
of the Zoning Ordinance by placing single family'dwellings'on
smaller ,lots and maintain the integrity of the setback of dwellings.

Comment: The Planning and Zoning Commission, at a regular
meeting held on April 20, 1978, recommended by a',6/0 vote
approval of an application submitted by Gary Abrams to rezone
a 1.4 acre tract located at the above address from an existing
C2 to CBS zone to develop an apartment complex on the site.
This recommendation is consistent'with the staff's recommendation
presented in a Staff Report dated March 23, 1978, which was
attached to the agenda of May 16,``1978. This item was 'deferred
at the
regular g r Council meeting of May 30, 1978, because of an
apparent discrepancy in the legal description of the site being
rezoned and'the legal ownership of the property.The staff has
been informed that the applicant will be transferring title to
the land to Sam Abrams (see next item), so that the legal owner-
ship corresponds to the area being rezoned. Should these !I h se trans-
actions be made by Tuesday lnight's Council meeting, this item `

Comment: The City staff has reviewed the utilization of the Municipal
Parking Lot (located on Blocks 64 and 65). The fees to be charged
in this lot were modified in 'order to increase the availability
of short-term shopper parking. P arkin . The Municipal Lot is heavily used
prior to 9:00 a.m. This resolution changes the hours of operation
to start at 8:00 a.m. rather than 9:00 a.m. The staff, recommends
approval of this resolution.

Item No. 11 -'RESOLUTION AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE
OF INTENT TO ACCEPT A PROPOSAL TO PURCHASE AND REDEVELOP CERTAIN

M Comment: The City solicited offers to purchase Urban Renewal land in July,
1976 and received offers on September 15, 1976. Old Capitol
r�. Associates submitted an offer on Parcel 103-3 and the adjoining
parking lot. OCA''. and Midstates'Development, Inc. as a joint venture

have received a Section 8 subsidy allocation for this 'site. This
resolution authorizes the publication of notice of intent to sell
this site to Capitol,States Associates (the joint venture). The

Item No. 12 CONSIDERI,A,RESOLUTION AUTHORIZING THE MAYOR TO'EXECUTE AND THE
CITY CLERK TO CERTIFY ON BEHALF OF THE CITY AN EASEMENT FOR
ELECTRICAL LINES TO THE IOWA -ILLINOIS GAS AND ELECTRIC COMPANY f
- a OVER CERTAIN MUNICIPAL PROPERTY. ;
Comment: On October 21, 1977; the City purchased certain property from the
Shower's Estate for park purposes. This land lis known today as
Napolean'Park. The, purchase was, made subject to'a11'recorded
easements. There exists upon the premises an ',easement held by
the Iowa -Illinois Gas and Electric Company for electrical lines.
However, the legal, description of the easement does not properly
describe its location as it exists upon the property. The Legal
Department has negotiated an'agreement _wherein the City would grant
a new easement for a release of the old easement. In this manner,
the easement as recorded would properly reflect the actual location
of the electrical lines.

Item No. 13 - CONSIDER RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND THE IOWA CITY LIBRARY BOARD OF TRUSTEES AND THE AMERICAN
'2 / FEDERATION OF STATE, COUNTY'; AND MUNICIPAL EMPLOYEES, LOCAL #183,
AFL-CIO; TO BE EFFECTIVE JULY 1. 1978 THROUGH JUNE 30, 1980.
Comment: This item, which was deferred 'from the agenda of May 30, 1978, is
the collective bargaining agreement between the City, the Library
Board and AFSCME; Local #183. It provides for an increase to
wages based on changes in; the Consumer Price Index which has been
part of this agreement for three years. It increases employee
benefits, by instituting a longevity pay system to reward longer
term employees.' The average cost when compared to total bargainingg
unit costs is 5% for wages, 2% other benefits (longevity and, merit).
The agreement will be effective between July 1, 1978 and June 30,,1980.

Item No. 14 - CONSIDER A RESOLUTION AMENDING A CONTRACT WITH CITY CARTON FOR i
NEWSPRINT PICKUP BY'PLACING',SUCH CONTRACT IN ABEYANCE UNTIL SUCH
TIME AS BOTH PARTIES MUTUALLY AGREE TO REINITIATE PERFORMANCE
i ON SUCH CONTRACT. `
Comment: City Carton has requested that they be allowed to terminate
newsprint pickup. The bad publicity on the fire hazards of i
cellulose insulation has completely terminated the newsprint
market. Neither City, Carton nor Capitol oil Company will accept
newsprint from any source. This precludes the City from having
the refuse crews pick up newsprint at .this time. City. Carton
has cooperated fullywith the City, and Public Works believes it
is desirable to allow them to terminate their arrangements for the
