'Consider recommendations of the Planning and Zoning Commission: (1) To adopt the Flood Plain Management Ordinance with the modifica- tions:as suggested: Comment: A public hearing on this ordinance has been set for April 12, 1977. ;The modifications recommended by the Planningr and Zoning Commission were furnished to the Council with the agenda of March 22, 1977., The ordinance will be discussed at the informal session of March 28, 1977! A copy of the revised ordinance is attached to the agenda. The maps which the Council requested have not been included, for this, information is in a format which is not easily, reproduced. ° The maps are available in the Conference Room.' The Director of Public` Works, will review the, maps with the City Council on Monday, March 28, 1977.` (2) To approve the request to rezone the east seven feet of Lot 6, - Block 42 of the Original Town of Iowa City (522 East Burlington Street) from a C2 Zone. to an R3A Zone. Comment: A public hearing on this rezoning request has been set ' - for.April 12, 1977. " (3) To approve S-7709, final plat of Bryn Mawr Heights, Part VIII, located west of Sunset Street extended rsouth,'and south of Penkridge Drive' and Denbigh', Drive, subject to a'minor modification in ;the legal agreement CONSIDER RESOLUTION TO APPROVE THE FINAL PLAT OF BRYN MAWR HEIGHTS, PART VIII. S-7709. ' Comment: The Planning and Zoning Commission, at a', regular meeting held on March 17, 1977, recommended by a 5-0 vote approval of thelsubject'-final plat located'' west of Sunset Street extended south; and south of Penkridge"Drive and i, Denbigh Drive subject to a minor modification in the legal agreement. This recommendation is consistent with the staff's recommendation presented in a Staff Report dated March 17, 1977, which is attached to this agenda. The legal papers have been modified but at this time they; have not been I« signed. The applicant's attorney, however, has assured us that they will be ';.., signed by'the'time the City Council considers the plat. I Comment: The Planning, and Zoning Commission, at a regular meeting held on March 17 1977, recommended by a 5-0 vote approval of the subject final plat located west'of Bryn Mawr Heights, Part VIII (see item above),subject to a minor - modification `in the legal agreement. This recommendation is consistent " with the Staff's recommendation presented in a'Staff Report dated March 17,1977; which is attached to this agenda. (6) To approve 5-7712, preliminary plat of 4lendram Bluff located north of Linder Road and east of Old Highway 218 in Johnson County,subject to the following contingencies: (a) that the distance between pavement centerlines of Linder Road and Pendale Terrace be a minimum of 125 feet and indicated on the plat; (b) that the lot lines in Lime Kiln Farm Estates Addition, which intersect the easterly boundary line, be shown on the plat; ,i (c) that a complete', legal description of the subdivision be included; on the plat, (d) that the', preliminary plat be revised to show the location ofl the fire hydrants as recommended by ,the Fire Chief,, and that; the water supply system be designed'to'provide a minimum flow' of 500 gallons per minute for a one=hour duration; (e) that the size and location of all existing'storm pipes bordering the subdivision be indicated on the ,'plat; (f) that the street 'name "Lawrence Drive" be changed to "Lawrence Court" on the plat; and P„ (g) hat the sideslopes to proposed streets be ata minimum of a 6/1 slope, six feet from the paved surface, and noted in the street cross section detail on the plat. City Attorney I Item No. >9 - CONSIDER AN ORDINANCE DEFINING AND PROHIBITING CERTAIN DISCRIMINATORY PRACTICES IN EMPLOYMENT, HOUSING, PUBLIC ACCOMMODATIONS, AND CREDIT TRANSACTIONS,, ESTABLISHING A HUMAN RIGHTS COMMISSION, PROVIDING PROCEDURES ` FOR.INVESTIGATION AND CONCILIATION OF COMPLAINTS, PROVIDING FOR PUBLIC HEARINGS IN CONTESTED CASES, AND FURTHER PROVIDING FOR JUDICIAL REVIEW OF ORDERS OF THE COMMISSION. (first consideration) Comment: This ordinance makes major changes in the substance and procedure of the existing,Human Relations Ordinance. Item No.' 10 - CONSIDER ORDINANCE AMENDING ZONING ORDINANCE '2238 BY CHANGING THE USE REGULATIONS OF- COURT `HILL, SCOTT BOULEVARD, ADDITION NO. 5, FROM RIA AND R3A'TO R1B,AND R3A'ZONES (first consideration)._, Comment: The Planning and Zoning Commission, at`a regular meeting held on ',September' J, 2, 1976, recommended by a 5-O, vote with two abstentions approval of an application' submitted by Plum'Grove Acres, Inc., to rezone the above i - parcels"located west of Scott Boulevard and north of the easterly,' extension of.Washington Street. :At the request of the Commission,` approval of the application would result in the change in location of an existing RW, Zone.. The Commission's recommendation is not consistent with the staff's recommendation as presented in a Staff Report dated August 30,-1976, and is attached to this agenda. Comment: This item was deferred from the meeting of March 22, 1977. The Planning and Zoning Commission; at a regular meeting held on March 3, 1977, recom- 7 - 3 mended by a;6 -O vote approval of the final plat of Oakridge Estates Addition located of Linder Road and east Highway 218 north of old in Johnson County subject to the following contingencies: i (1) that a waiver of the angle of side lot lines to the street be granted; (?),that a waiver of the construction of public improvements be granted;,; and. (3) that a minor modification in the legal papers be made. The minor modification in the legal papers has been made. This recommendation is consistent with the staff's recommendation as presented in 'a Staff Report dated March l3, 1977, which wasfurnishedto the Council with "the ',agenda 'of March 15, 1977. Also attached is a memorandum of March 24,.1977; from the Director of. Community, Development. Action: � pp , l>a� l 40 w"V_ 7w - 2-2 U Item No. '12 - CONSIDER A-RESOLUTION,DESIGNATING THE PARKING AREA LOCATED IN UPPER CITY.: PARK"AS:A FOUR-HOUR'PARKING AREA AND AUTHORIZING THE CITY MANAGER TO INSTALL AND; MAINTAIN SIGNS STATING AS SUCH. Comment:" Upper City Park is currently being used by some people for parking for long periods of time for purposes other than park use. 'It;appears that these long-term;parkers are employees and students located,in Hancher.'° This resolution will 'provide parking for people who are visiting the City Park to make use of the recreational facilities available,there. The Police " Department,,the Department of, Public Works, the Department of Parks and Recreation, and the City Manager recommend approval of this resolution. Action: Item No. 13 - CONSIDER RESOLUTION TO ESTABLISH AND CHARGE A FEE FOR THE ACCEPTANCE OF ANIMALS TO ALL',PERSONS'RESIDING ;,OUTSIDE THE CITYLIMITS 'OFiIOWA CITY. Comment: This:item was deferred from the meeting ,of March 22, 1977. It is no longer acceptable for the.City of Iowa City_to support the costs of maintaining," (boarding and euthanasia) animals acquired from outside the Iowa City limits We feel a minimum fee of $2.00',. per animal and maximum of $10.00 per litter be charged to all persons delivering animals to the Iowa..City Animal Shelter.. , It has been our experience during ,the past three years that persons residing outside ,Iowa City have limited alternatives and will readily agree to the l " above mentioned fees'..
