The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's property occasioned by any construction or maintenance operations on said highway. 6. I have lived in Iowa City for fourteen years and'£eel that these changes will make this city a better place in which to live. I have also rented apartments for most of those years so I feel I understand the problems apartment living can entail. When the Human Rights Commission held public hearings on this proposal, one of the key issues that came from those opposing the revisions was that children make too much noise and are too destructive thereby driving away other potential renters who preferred peace and quiet. If the council decides to oppose the ordinance on this basis I would like to point to the already existing situation of noise problems in many high apartment density areas such as South -Johnson street which is near my apartment on Burlington Street. At least children are in bed at reasonable hours. I have yet to be awakened by children at 2 AM as I am now on most weekend nightsby large noisy groups who throw empty bottles crashing into the streets etc. To allow one and not the other is in- consistent. The inclusion of children in apartment complexes promotes a diverse neighborhood atmosphere which I view as healthy to everyone. If there are special living units such as housing for the elderly that wish to be excluded from the requirements, variances seem to be an acceptable and established means of doing so. As a person who has worked for many years for I&ian and gay rights, I feel the provisions further protecting these people are long overdue. To those who would say we do not have a problem in this area because no formal complaints have been made I would respond that unless the law is there to already protect an individual he or she is going to be very hesitant to further threaten his or her situation with a complaint. It is very difficult to dispel the fearthat homophobia engenders in people. As someone who has counseled many gays and lesbians, I have seen and felt this fear time and'time again. As a gay man I have been a victim of this fear and hatred. This revision will help more than you who do not have to walk my path can realize. Thank you for your considertion of these points. Page two March 15, 1984 Mayor & Council In further discussion with City officials, we were informed that this situ- ation exists all over Iowa City and that specific moratoriums exist in cer- tain areas of the City and subdivision plats are simply refused in other parts of the City because of the inability of the City to furnish sewer service. Various alternatives were proposed by the Kennedys but none of these proposals for providing sewer service were acceptable to the City. Consequently, as a practical matter, Mr. & Mrs. Kennedy have 14 acres of ccmrerically zoned land in Iowa City which they are not able to use for any purpose, let alone for the purposes permitted under the zoning ordinance. I what is equally frustrating to Mr. & Mrs. Kennedy is that there appears to be no clear evidence that the sewer lines which would normally service the Kennedy tract are in fact used beyond their re=mended capacity. Rather, it appears to be possible, even according to the City, that the inability to use this sewer is caused by excessive run-offs from other areas of the City which flow into the sewage disposal plant and then flow back out of the sewage disposal plant into the sewer serving the southern area of Iowa City in which the Kennedy tract is located. Nevertheless, it appears that development is allowed to proceed in those other.areas of the City that may in fact be contributing to the problems in the sewer lines serving the Kennedy tract. Over the past dozen years, the City has reviewed over and over again the problem of inadequate sewer linecapacity or inadequate plant capacity. It appears at this time that the problem is of crisis proportions in the i City of Iowa City and that large areas of the City are no longer capable of being developed because of inadequate sewer capacity. It is vitally important to Mr. & Mrs. Kennedy and to other property owners similarly situated, that the City initiate a program of action to increase the capa- city of its sewer system. Secondly, until steps are actually taken so that the Kennedy tract and similar tracts are capable of being used, it seems to us that the City has an obligation to notify the City Assessor of the fact that these properties can not be used for any purpose within the City and ask that the property valuation of these tracts be lowered substantially. I stmffi oppose this Proposal.., in the interest of JUSTICE., TRUTH, and IMPARTIALITY! especially after the way I have been treated by both the city and county attorney offices. On June 27, 1983, I went to both offices trying to simply obtain the form to make my citizen complaint. Assistant County Att. Steve Regenwether seemed to know of my case already. He snickered at me and told me he had more important things to do than talk to me about filing charges on Officer Schultz. He repeatedly refused to give me the form and ignored me as if I had no rights. Again, on July 59 he told me I did not have the right to file a complaint, that only they make that decision. This must violate my legal civil rights! This same lack of cooperation came from City Att. Bob Jansen when he also refused me the forms, saying, "EVEN IF YOU DO GET THE CHARGES •FILED, IT'S NOT GOING TO DO YOU ANY GOOD BECAUSE NO ONE IS GOING TO PROSECUTE THEM FOR YOU,! "WHAT YOU WAIT HERE MR. HARRISON, IS A PINT OF BLOOD." Well, my pet lost a lot of blood, along with her first litter of pups inside of her and she didn't hurt anyone or anything! She was.shot and killed while lying in the grass, inside a friend's fenced in yard where she had permission to be. PLEASE.see the attached copies of the affidavits, already on file, but enclosed for your convenience. Attached,you will find, in order, 1.) The supporting.affidavits of my allegations, 2)The criminal complaints themselves, and 3)A transcript of Officer Schultz's own recorded admissions. (Very Important!) and 4)A copy of the formentioned letter sent to me, from the City Attorney to the County Attorney, requesting him to conduct the prosecution. For these reasons, for the sake of JUSTICE, I respectfully request a special prosecutor be employed to try this case, impartially and thoroughly, just as you or I would be tried should the terms be reversed. I can understand the citys' reluctance to prosecute one of its own policeman, however, a magistrate has deemed probable cause for a hearing already. It was set fair March 19, until recently moved back. The problem is.; The city has not doneanything about getting a prosecutor even though it is their responsibility, not mine! my attorney, Dennis Currell, said he would offer his services if needed. Another viable alternative is, The Assistant Attorney General Area Prosecution attorney. In any case, due to the conflict of interest. in this case, a prosecutor, independent of this city,must be employed. Please inform me of any action taken in this case as I am the accuser and I shall pursue this matter until an impartial pub is tris as been settled. This action will take place on or shortly after March 8, 1984 COMMENT: It appears that the current prohibition was installed to protect school children crossing Clinton Street at its intersection with Harrison Street when the Sabin Elementary School functioned as an elementary school. With the closing of Sabin Elementary School the need for the restriction of parking no longer exists. This action will take place on or shortly after 14 March 1984. COMMENT: This action is being taken to better identify the metered parking area on the south side of Jefferson Street. The area in which the prohibition exists lies between the last metered parking stall and the northbound sidewalk. This area is too small to accommodate a parked vehicle without encroaching into the northbound sidewalk. bdwl/10 r City of Iowa City MEMORANDUM DATE: March 22, 1984 TO: City Council FROM: James Brachtel, Traffic Engineer RE: Referral on Taxicabs Attached to this memorandum is a drawing of the west half of the 400 block of east College Street. Prior to March 1, the date when taxicab stand permit rental fees became due, three stalls had been rented by three different taxi- cab companies. Stall C-131 had been rented by the Hawkeye Cab Company, stall C-133 had been rented by the A-1 Cab Company, and stall 126 had been rented by the City/Yellow Cab Company. It is my understanding that Hawkeye Cab Com- pany went out of business sometime in February 1984. A-1 CAB INC REQUEST RECEIVED JANUARY 31, 1984 The A-1 Cab Company has requested two taxistands - stall C-131 in addition to the currently rented stall C-133. A review of the history of renting parking stalls to cab companies would suggest that past City Councils have specific- ally directed that only one stall be rented to each cab company. Resolution #877 which was passed by the Council in July of 1968 and resolution #77-283 passed in August of 1977 are attached to this memorandum. Based upon this, expressed intent of the City Council I would recommend that we deny A-1 Cab Inc.'s request for two rented stalls. A discussion with City Clerk Karr indicates that A-1 Cab Inc. would prefer stall C-131 in lieu of C-133. Therefore, I would recommend that the City receive A-1 Cab Inc.'s taxicab stand permit renewal and allow it to be applied toward stall C-131 instead of C-133. HAWK -I CAB COMPANY REQUEST RECEIVED FEBRUARY 7, 1984 Hawk -I Cab Company has requested three taxicab stands. One of these stands to be located in the southeast corner of East College and South Gilbert Streets. I would recommend that the City approve this request for a taxicab stand and designate stall C-133 as a taxicab stand for the Hawk -I Cab Company. Hawk -I Cab Company has also requested two stands to be located as space becomes available on South Dubuque Street just north of East Burlington Street. I would recommend that the request for these two stands be disap- proved. This recommendation is based upon the information noted above and also upon the limited space that will be available for traffic flow in the block south of the new hotel when the hotel opens. There are several alternatives that can be explored to accommodate not only common carriers but also incoming or outgoing hotel guests in private vehicles. This portion of Dubuque Street will become very busy when the hotel opens and I believe it to be inappropriate to reserve and designate space in City right-of-way for the purpose of one user. City and county elected officials in the six -county area served by HACAP are entitled to one-third of the seats on our thirty -member board. The City of Iowa City has the opportunity to designate one of those public sector members, and has always done so. However we have not had a representative of the City of Iowa City attend a board of directors meeting in over two years. As a board member from Johnson County I am concerned that Iowa City and Johnson County be represented fully on the HACAP board. Since the City does provide financial support to the Iowa City HACAP service center,the city's representative to our board provides a valuable link betweenthe city council and our board. I would like to extend to the city council an invitation to participate in the policy setting for our organization. The council may designate any of its members to serve on our board, or may select any city official or a concerned citizen to serve as their representative. I have been approached by Ms. Jeanne Snow from the Elderly Services Agency of Johnson County who expressed an interest in serving on the HACAP board. There is no official vacancy from Johnson County, though the council could designate her as their new representative.
