k� )City of Iowa Citi; MEMORANDUM Date: March 20, 1984 To: City Council From: Karin Franklin, Planner Re: Off-street Parking Requirements The enclosed ordinance was initiated by the Planning and Zoning Commission in response to a concern the Commission had regarding the density of uses which were permitted to have parking spaces backing into an alley. The Commission wished to permit only lower density uses to exit directly into an alley. The regulations currently state that no parking area with more than eight spaces can be designed in such a way that cars must back directly into an alley. The ordinance permits more than one parking area on a lot; if two locations for parking on a single lot are not integrated, they are treated in terms of design as two separate parking areas. Under the existing ordinance, a hypothetical parking area of 16 spaces and a separate area of eight spaces may exist on one lot, with the eight spaces exiting directly into the alley but with the 16 spaces requiring access via a drive to an alley or a street. Under the proposed change, if more than eight spaces are required or provided on a lot, regardless of whether they are in separate parking areas, no spaces may exi�ctly into an alley. Only those uses which require eight or fewer parking spaces may use the alley for direct access to a parking space. The second part of the proposed revision deals with the proximity of parking spaces to doors and windows of dwelling units. The existing ordinance prohibits spaces to be within five feet of a ground floor door or window of any structure. The revision clarifies this provision to state explicit'�that the five foot distance is required only in cases involving dwelling units. bdw2/3 Enclosure -2vs- ORDINANCE NO. The Zoning Ordinance of the Cites Iowa City is hereby amended by deleting Section 36-58(c)(2)g and inserting in lieu thereof the following: If the number of parking spaces required or provided for a use or a combination of uses on a lot is greater than eight (8) spaces, none of those spaces may be located in such a manner that would require backing into an alley. The Zoning Ordinance is amended further by deleting Section 36-58(c)(3)a.4 and inserting in lieu thereof the following: No parking space shall be located closer than five (5) feet to a ground floor doorway or a window of a dwelling unit. SECTION II. REPEALER: All ordinances and pars of or nances in conflict with the provision of this ordinance are hereby repealed. SECTION III. SEVERABILITY: If any section, provision or part of the Ordi- nance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. BACKGROUND: In the spring of 1983, the Planning and Zoning Commission and the City Council reviewed and approved the resubdivision of Lot 62, MacBride Addition Part 2 and an amendment to the Planned Area Development (PAD) plan for the addition. The approved amendment permitted the construction of nine 12-plexes and one 8-plex around a cul-de-sac off of Melrose Avenue (see attached plan). Lots 6 and 7 of the resubdivision are shown for the develop- ment of two 12-plexes. Recently, Northwestern Bell ascertained that due to increased development on the west side of Iowa City, additional electronic telephone equipment would be necessary to serve the area. In order to have this equipment, Northwest- ern Bell proposes the construction of a building located on Lots 6 and 7. The structure is 10' x 20' and reaches an exterior height of 1113". The facade of the structure may vary to match other buildings on the site (see specifi- cations attached). The building is located to permit access to the building from Mormon Trek with the least disturbance to the principal multi -family use of the property. The phone company proposes placement of a gravel drive from the enclosure to the sidewalk along Mormon Trek; no curb cut will be made. The plan for MacBride Addition, Part 2, must be amended again to permit the placement of the structure on any of the lots. A statement from Earl Yoder, the owner of the PAD, consenting to the amendment is attached to the staff report. ANALYSIS: Evaluation of this amendment entails determining the effect the placement of the Northwestern Bell building will have on the use of adjoining properties and on the uses approved for Lots 6 and 7, and whether or not the proposed structure will adversely effect development of the area. The structure is relatively small, 200 square feet and approximately 11 feet high. The facade can be chosen to match existing structures in the area. There will be one external light at the entryway and the phone company states that no noise, static or other disturbing emissions will come from the building. Little or no traffic will be generated by this building since it does not house personnel. Its function is to house electronic equipment. Construction will consist of the pouring of a concrete foundation pad, placement of a gravel drive, and installation on the pad of a pre -fabricated building housing the equipment. Monitoring and repairs are expected to be minimal. The company has indicated that landscaping will be provided, however, a landscaping plan has not been submitted. From the above information received from Northwestern Bell, it does not appear that in terms of the structural qualities and the function of the building the proposed structure will adversely affect the use of the sur- rounding properties. The effects of the proposed location of the building must also be investigated. W 3 The proposal suggests placement of the building 20 feet off the rear property line of resubdivided Lot 62. This means that the building will be within the multi -family portion of the MacBride Addition Part 2 PAD and 20 feet from the lot lines of the single family portion of MacBride Part 2 PAD. On the approved amendment from the spring of 1983, the distance between the multi -family building closest to the single family lots and the lot line is 45 feet; this building is the 12-plex on Lot 6. The minimum required rear yard in an RS -8 zone, the zone underlying the PAD, is 20 feet. With approval of the multi -family residences in the PAD, it was determined that the multi -family dwelling should be as far from the single family development as possible to lessen the impact of the more dense use. Since the structure proposed by the phone company will not be occupied, the 20 foot yard should be a sufficient setback to avoid conflicts between the single family use and the electronics building. The distances of the phone structure from the multi -family uses are 90 feet and 103 feet from the buildings proposed on Lot 7 and Lot 6, respectively. As proposed, the structure will be located over the shared lot line of Lot 6 and Lot 7. The phone company will buy an easement on each of these lots. It does not appear that this easement will detract from the full use of Lot 7 or Lot 6 for the multi -family development approved in the plan. STAFF RECOMMENDATION: It is the conclusion of the staff that given the nature of the structure proposed, its placement on Lots 6 and 7, and the facade modification and landscaping Northwestern Bell is able to provide, the building proposed will not adversely effect uses in the approved development or surrounding uses. It is recommended that the amendment to the MacBride Addition Part 2 Planned Area Development to place a Northwestern Bell electronic equipment enclosure on Lots 6 and 7 be approved. DEFICIENCIES: 1.
