Handicare Inc., would like to inform you of our interest in locating a new
facility site. This would allow our program to expand from 15 children at
one time to 25 children. We are searching areas currently zoned R2 in
Coralville and Iowa City. We would prefer residential over a commercial
site. We desire to be more centrally located for the Coralville, Iowa City
and University Community.
When a possible site is located, we will inform you further regarding our
plans and request required permits.

Dear Mr. Terry:
Subsequent to my letter to you on March 13, 1984, 1 have had
occasion to further review the provisions of the Franchise
Ordinance No. 78-2917 establishing regulations and procedures
for the cable television franchise in Iowa City.
Section 14-64, subsection (2)(a) indicates that the Broadband
Telecommunications Commission has 60 days to review an
application or request from the grantee and at the expiration
of that 60 days must make a recommendation to the City
Council. Since the request for the transfer of the franchise
was filed on February 10, the 60 days would, therefore, expire
on April 10.
If this time frame is in accord with your understanding, that
would seem to modify our plans somewhat, but would still move
the request forward within a reasonable time frame.
Please let me hear from you if you believe that the time
requirements are different than I have outlined.

Dear Mr. McDonald and Members of the City Council:
At its meeting on Tuesday, March 27, 1984, the Committee on Community
Needs discussed the proposed changes in the Human Rights Ordinance. The
Committee reviewed the changes with regard to the effect they might have
on housing opportunities for lower income persons.
The Committee noted that the majority of low-income persons are renters
and do not have the option of buying a home. Housing opportunities for
these lower income renters in Iowa City are meager at best, and any
restrictions on dependents in particular, reduces these opportunities
further. In addition, restrictions on dependents in certain multi -family
complexes tends to concentrate lower income persons at specific locations.
For these reasons CCN voted unanimously in support of the proposed changes
in the Human Rights Ordinance.

The Iowa Department of Transportation let the Bridge Deck Repair
project on Primary Road No. I-80 on November 1, 1983. This pro-
ject lies within the City of Iowa City and involves both east and
westbound bridges over the Iowa River.
Cramer Brothers Construction Company of Des Moines, Iowa, was the
low bidder and has been awarded the contract. The contractor's
proposed schedule is to start on or about May 7, 1984, and com-
plete the project by mid-June.

I recommend denial of the above -referenced application for
Class C liquor license in its present form. This recommendation is
based on Section 123.40 of the Code and considerations resulting
from revocation of a license to Ciristopher S. Wilke d/b/a Wilke's
for the same premises which revocation was effective April 10, 1983.
Applicant proposes to do business as Wilkes --the same business
name previously licensed and revoked. Applicant's lease with Mr.
Wilke specifies that he, as Mr. Wilke's tenant, has the right to use
that name. If that business name was a factor in the rent agreed
to, Mr. Wilke would, in my view, have an interest in the license
which is proscribed by Section 123.40 until April 9, 1985. Further,
no trade name statement is on record at the Johnson County Recorder's
office which would establish that Mr. Wilke has no interest in the
business for which license is sought.
I should interject that Mr. Chait has been forthcoming and
cooperative in responding to my questions and concerns and has pro-
vided me with copies of both the lease between Mr. Wilke and Wright
Street, Inc. and the articles of incorporation.
Section 123.40 of the Code is not as complete as would be helpful
in this situation and it wou13—be helpful for the Department to adopt
regulatory provisions which define the nature of the "interest" pro-
scribed by the second sentence of that section. For example, IAC
150--4.10(123) delineates a supplier's interest proscription in a
license in a fashion that, if applied by analogy to the instant case,
would arguably preclude a license being issued for a building owned
by Mr. Wilke for one additional year.
Because this is a "turn -key" lease, I believe Mr. Wilke has an
interest in the license. This conclusion is reached on the implicit
assumption that "turn -key" readiness has been considered in arriving

at the stated rental. Thus, if Mr. Wilke's lease return is
enhanced by occupancy by a license holder, he may well have a
financial interest in the business being licensed.
Upon a showing by the Applicant that the leasehold arrangement
is based on fair market rent without consideration for the turn -key
factor and upon change of the business name from that of the re-
voked license, the grounds upon which I have recommended denial
would be satisfied and approval would be in order.

Re: Application for Liquor License by lJrig Street, Inc.
Wright Street, Inc. has applied for a Class C Liquor License to do
business under the trade name "Wilke's" at 122 Wright Street, Iowa City,
Iowa. The application lists Chris Wilke as the owner of the building on
the premises to be licensed. The application lists Benjamin Chait as
manager and 100% owner of the business to be licensed. Mr. Chait has
supplied our office with a copy of Articles of Incorporation of Wright
Street, Inc. which were filed with the Secretary of State on February 29,
1984. According to said Articles of Incorporation, the incorporator and
sole director of said corporation is Benjamin Chait. Further, Mr. Chait
is listed as the only initial office holder of the corporation.
In February, 1983, the City filed an administrative hearing complaint with
the Iowa Beer & Liquor Control Department regarding the liquor license
held by Christopher S. Wilke, d/b/a/ Wilke's at 122 Wright Street, Iowa
City, Iowa. In the complaint, the City alleged various Iowa Code viola-
tions involving gambling having occurred at "Wilke's" in November, 1982.
After an evidentiary hearing in Ankeny, Iowa, the State hearing officer
held that illegal gambling activity had occurred on said premises and he
ordered revocation of Christopher Wilke's liquor license effective April
10, 1983. Because of the revocation, Christopher Wilke cannot hold a
liquor license or beer permit in Iowa until April 10, 1985, and a liquor
license or beer permit cannot be issued to anyone until April 10, 1984,
for the premises at 122 Wright Street, which was covered by Mr. Wilke's
liquor license. Furthermore, no business in which Mr. Wilke has a
financial interest can be issued a liquor license or beer permit until
April 10, 1985. These sanctions are pursuant to Section 123.40, Code of
Iowa, as set forth below:
123.40 Effect of Revocation
Any liquor control license or beer permittee whose license or permit
is revoked under this chapter shall not thereafter be permitted to
hold a liquor control license or beer permit in the state of Iowa for
a period of two years from the date of such revocation. The spouse
and business associates holding ten percent or more of the capital
stock or ownership interest in the business of a person whose license
or permit has been revoked shall not be issued a liquor control
license or beer permit, and no liquor control license or beer permit
shall be issued which covers any business in which such person has a
financial interest for a period of two years from the date of such

revocation. In the event a license or permit is revoked the premises
which had been covered by such license or permit shall not be
relicensed for one year.
Section 5-38, city Code, provides for identical sanctions when a liquor
license is revoked.

Mr. White's recommendation of denial is based, in large part, on his view
that Christopher Wilke would have a "financial interest" in the proposed
business in that Mr. Wilke has leased his building at 122 Wright Street to
Wright Street, Inc. to be used as a bar and that the lease permits the
applicant to do business as "lJilke's", the same trade name of the business
previously licensed to Christopher 1 ilke at the same location prior to
revocation.

initial issuance of a liquor license, the fact that the local authority
determines that no license shall issue shall "not be held

1. I have entered into a lease with Chris Wilke, the owner
of a building at 122 Wright Street, for the rental of the tavern
named Wilke's, formerly run by Chris Wilke.
2. The lease calls for $2,000 per month rent for the
premises and equipment.
3. Mr. Wilke .:ill have no part in managing this

as an employee.

this bar, other than the fair market rent I am paying.
5. The $2,000/month rent is, according to my experience in
the tavern business, a fair and reasonable rent and represents
the product of arms -length negotiations between Chris Wilke and
me.
6. The rent is in no way contingent on any factors.
7. I have decided that retaining the name "Wilke's" is a
sound financial decision based on my belief that the name is well

ADVISORY BOARD/COMMISSION APPLICATION FORM
Individuals serving on Boards/Commissions play an important role in advising the
Council on matters of interest to our community and its future. Applicants must reside
in Iowa City.
The City Council announces Advisory Board/Commission vacancies 90 days prior to the
date the appointment will be made. This period provides for a 30 -day advertising period
and a 60 -day training period for new members. The training period allows new members to
become familiar with the responsibilities and duties of the advisory board/commission
before becoming a full voting member.
After a vacancy has been announced and the 30 -day advertising period has expired, the
Council reviews all applications during the informal work session. The appointment is
announced at the next formal Council meeting. Appointees serve as unpaid volunteers.
Council prefers that all applications must be submitted to the City Clerk no later
than one week prior to the announced appointment date. PLEASE USE A BLACK INK PEN.

EXPERIENCE:
It is the activities that I'm involved with, and the experience
that I've gained from them that I believe has made me well qualified for
this commission.. I am currently serving my third term on the UI Student
Senate, this year in the capacity of Treasurer. This job requires
organization, detail work, and an in depth knowledge of our budgetary
process, bylaws., and constitution.
I have also been active in the Senate State Relations Committee
where I've chaired a subcommittee on voter registration. As one aspect
of this, I was certified in February, 1984 as a Public Notary in order to
assist students.returning absentee ballots.
While these activities and several others are very important to me,
they are only examples of my interest in government. It is an interest
that I've had for many years, and each year I've found that interest
reaching a higher level. This commission is an opportunity for me to get
involved with city government in a way that I would be effective.
On the whole, I believe I have the experience and skills needed for
the commission, but more importantly, I have the desire and the interest.
PRESENT KNOWLEDGE:
The Charter Review Commission is a 9 member last organized in late
1972 whose purpose it is to review the charter, and thus the authority,
of the City of Iowa City.
CONTRIBUTIONS:
Because of my backround, there are several contributions I feel I can
make to the commission. First of these is a fresh approach toward city
government. I'm not set it the status quo of the city. Secondly, I am
inquisitive. When anything is unclear, I will ask questions until it is clear.
Thirdly, I am hard working. When something needs to be done by a certain
time, I try to make sure that it is. Lastly, because I am a 'student, and
a student representative in my capacity as Treasurer, I can represent a
large portion of the Iowa.City population by being on the commission.
