For the information of your Honorable Body ,I am inclosing a copy
of my March 27 letter to.the Iowa City Planning and Zoning Commission
and the reply of Ms. Karen Franklin dated April lo. These letters are
self explanatory.
Mrs Franklin took care of the FOYER -entrance Hall question very
nicely, as well as answering my other questions.
According to fde. Franklin.'e letter, Me Phyllis Williams told her
ppthaad1tt the legal staff is reviewing 'the definitions in the Human Rights.

exemption¢,'foam the. Human rights Ordinance for those who are
entitled to exemption.
This Ordinance does not need to Ve revised or amended. That part
regarding exemptions wee taken care of by the legal staff that wrote
the Ordinance, -and it was done right.
..•That part of - the -Ordinance covering exemptions provides that an owner
living. in apart of a dwelling .unit: is exempt from the Human Rights
ordinance if he rents 'or leases four'or fewer'roomsto roomers who pass
through,the.owner'a living area. in order to gain access to the rooms
which they.rent,and occupy.
The definition of a "Dwelling Unit" as given in the 1983 Zoning
Ordinance of Iowa, City reaae as, follows;
"Any habitable room or group of adjoining habitable rooms forming
a single unit with facilities which are used or inteded to be used for
living sleeping cooking andapting of meals."

An adjoining-babitable/used as a foyer or entrance hall is just
as much a part of a dwelling.unit as any add all of the other adjoining
habitable rooms.
Many Iowa Citians who rent four or less rooms in a dwelling they
occupy.are•Yio'doiMtrexempt from the Human Rights Ordinance but do not
know it because the general public may not have been given adequate
information regarding exemptions from the Ordinance.
Now that you'have studied the Recommendations of the Ad Hoc
Committee, has your Honorable Body considered getting some SECOND
OPINIONS from perhaps such organizations as the Council of Governments.
the Iowa City Housing Commission, Citizens for a Better Iowa City, the
Council of Elders, the Iowa.City Real Estate Boar�,the Multiple Listing
Bureau, the Iowa City and Coralville Chambers of Commerce, the Junior
Chamber of Commerce, and the local Bar Association?
All of the above organizations should be interested in the
problems we face, because when and if the City Council amends the
present Human Rights Ordinance they will be taking Iowa City with them.

I contend that they do, It would not be possible for me to have
adjoining rooms for living sleeping cjoking and eating of meals unless
there was also a place for ingress and egress. The law requires that
there be at least two of those mn the first floor of every dwelling
a fffmt door and either a back door or a grade door.

I am writing in response to your letter of March 27, 1984' at the request of the Planning
and Zoning Commission. Your house at 1530 Sheridan Avenue is zoned RS -8. A duplex in an
RS -8 zone requires 8,700 square feet of lot area and a single family residence requires
5,000 square feet of lot. If you or a subsequent buyer were to take in roomers, you
would be permitted to have one roomer in addition to the family in residence. A family
may be either a traditional family with an indeterminant number of members or a family
may be two unrelated individuals. The maximum number of unrelated individu7as who can
reside at your house would be three: A total of three parking spaces would be required -
one for the roomer, and two for the family. Since you would not be able to have a duplex
on the 67'x 100' lot you describe, I have not indicated the number of roamers permissible
for duplexes.
In answer to your last question, the foyer you described would be considered part of a
single dwelling unit by the definition included in the Zoning Ordinance. I understand,
however, that your concern relates to the application of�man Rights Ordinance.
I spoke with Phyllis Williams, the Civil Rights Specialist with the City; who works
closely with the Human Rights Ordinance. She said that the definitions in the Human
Rights Ordinance are being reviewed by the legal staff to broaden the circumstances under
which an exemption from the ordinance is appropriate. Revisions to the Human Rights
Ordinance definition of habitable area are being considered to include foyers or hallways
which provide access to living space as part of the habitable area. This change in the
definition would more clearly exempt from the Human Rights Ordinance the situation you
described in which a potential roomer would not have a separate entrance but would use
the foyer you use to gain access to a sleeping room. You should contact Phyllis Williams
(356-5022) for more information on this proposed revision.

Some thoughts on requiring landlords to rent to those who have
children:
1. As a childless adult, I feel I should have the option of
renting from a landlord who can promise me that all of the
other tenants are childless adults as well. This has nothing
to do with a dislike for children. There are many reasons
for a person who likes children to prefer living in a childless
setting.
2. As a landlord, I feel I should have the final choice in whether
I rent my property to those who have children or not. A land-
lord not only has his/her own interests to think of but also
those of the other tenants. ( See above. )
3. As a citizen, I feel that if government is so concerned about
dictating rental terms and conditions to landlords, then per-
haps it should build and maintain property that has rental
units devoid of any restrictions. Such units would be open
to all.
4. And as a taxpayer, I feel that when government has finally
legislated privately owned rental property out of existence,
it will find itself hard pressed to replace the tax money
that private property formerly generated.
I realize that there are no easy answers, and I do think that the
Council is trying hard to be fair to everyone. I just wanted to
add a few thoughts for ,your consideration.

I am enclosing herewith a proposed Partial Vacation of
Sturgis Corner Addition Part II together with a Consent to
such Partial Vacation by the City of Iowa City. The matter
of this partial vacation has been discussed with members of
the Planning and Engineering Staffs and I believe the Staff
is in agreement that there is at this time no meaningful
purpose to be served by the extension of Sturgis Corner
Drive along the Easterly lines of Lots 9 and 10 in Sturgis
Corner due to the fact that there is no reasonable possibility
that the street can be connected to Benton Street which was
the original purpose of the stub street.
My client, Myles Development, Inc., would upon vacation
of the area described, replat the area in a more reasonable
configuration which replatting would include that portion of
Lot 10 which has not already been sold, Lot 9 and the vacated
street and Lot 6.

In addition to the replatting my client, Myles Development,
Inc., prior to such replatting intends to make a gift to the
City of Iowa City, Iowa, of that area roughly approximating
