and exemplary performance in furthering Fair Housing.
The Omaha Office appreciates the emphasis which the City places on the
Fair Housing law.
We are recognizing you for the activities you have undertaken to further 7
Fair Housing. The activities are as follows:
1. -Designed a Poster on housing discrimination and placed it on Mass
Transit buses.
2. Designed housing flyer for landlords on Fair Housing.
3. Developing and printing of brochures and pamphlets.
4. The hiring of a half-time Civil Rights Assistant to handle Fair
Housing related'activities.

We would like to take this opportunity to express a sincere thank -you
to you for your response to our concerns of the safety of our
schoolchildren who daily cross Sycamore Street in order to attend school at
Grant Wood. The implementation of a crossing guard at the corner of
California and Sycamore Streets is a decision particularly appreciated by
those parents and students who live on the west side of Sycamore Street.
The Grant Wood Elementary Parent-Teacher Organization is active in the
concerns of not only the education of our children, but their well-being
while at school and enroute and as a result our concerns had grown with the
increase in traffic in our area of the city. Thank you again for your very
fine support.

Re: Revisions of the IRB Policy
Dear Mayor McDonald and Members of the City Council:
At the CCN meeting on April 17, 1984, the City's Industrial Revenue Bond
(IRB) policy with regard to housing was discussed. CCN member Karen Kubby
advised the Committee that the City's IRB policy was currently under
review. The present policy requires that the developer make 20 percent of

Re: Urban Renewal Legal Services
Dear Mayor McDonald and Members of the Council':
I am writing to request an increase in the hourly
rate for legal fees charged by my office to the City
for urban renewal work. I have served the-City.as special
counsel for urban renewal since 1970 and would very much
like to continue doing the -City's urban renewal work.
At the current time I am charging the City $43.80
per hour for office work and $48:80 per hour for litigation
in connection with urban renewal matters. These hourly
rates were established in July of,1980 and have not been
increased since that time. In the almost four years
since my.hourly rates were last increased there has been
a substantial increase in'the cost of living and a sub-
stantial increase in the costs incurred by our law firm
in doing business.
I am therefore asking the City Council to authorize,
by motion or appropriate resolution, an increase in my
hourly billing rates to $50.00 per hour for non -litigation
legal services and $70.00 per hour for litigation legal
services.
If.you would like to discuss this request with me
further, please let me know and I will be happy to attend
one of your work sessions for that purpose.

It has recently come to my attention that a concern exists
regarding Preucil School of Music using the Mann Elementary School
parking lot. Although the district does not have a written or
verbal agreement with the Preucil School of Music to use the Mann
school parking lot, the district does not object to the public
using any of the district's parking facilities during late
afternoons, evenings and weekends when there are no school
functions.
If you need any additional information regarding this issue, do not

Ladies and Gentlemen:
! This letter is written in response to a request made by you at your
informal meeting on April 23, 1984. The value of the City of Iowa City's
CATV system assets, as established by an offer to purchase by Heritage
Cablevision, Inc., is $11,680,000; this is the price the City would need to
pay if it decides it is interested in purchasing the cable system.
Hawkeye has requested that you transfer the franchise to Heritage
Cablevision. Heritage is a solid company, well respected in the cable
industry, and has extensive operating experience in the state of Iowa. I
believe the people of Iowa City would be very happy with Heritage
ownership and operation of the system in their city. Heritage would like
to complete the transfer process and commence operations under its
ownership as soon as is reasonably possible.
Please let me know if you do have interest in pursuing a purchase of the
Iowa City cable system. Otherwise, I will assume that Hawkeye and the
City will each use its best efforts to expedite the transfer of the cable
television franchise to Heritage.

Re: Offer of Sale from Hawkeye CableVision Corporation
The letter to the City Council from Thomas W. Binning of Hawkeye
CableVision Corporation, dated April 25, 1984, appears to constitute the
grantee's offer of sale to the City of the broadband telecommunications
network required by Sec. 14-71(c), City Code. Mr: Binning states in said
letter that $11,680,000 is "the price the City would need to pay if it
decides it is interested in purchasing the cable system."
This offer does not trigger the 90 day time -frame in which the City may
exercise the right of first refusal to purchase the network. That time-
frame commences "on the day the fair market value of the system is
determined either through negotiation or the arbitration procedure." Sec.
14-71(c). Thus, if the City Council decides that it is interested in
considering a purchase of the network, the next step is to negotiate the
"fair market value" of the system with Hawkeye.- Should negotiations fail,
said value "shall be determined by an impartial arbitration procedure
pursuant to State law." Sec. 14-71(c).
If the City decides not to pursue a purchase of the system or if it
exercises the right of first refusal after a determination of fair market
value, the City must then consider the proposed transfer of the franchise
Hawkeye wkeye to Heritage Communications, Inc. Such a transfer cannot be
consummated without prior consent of the City Council and "then only under
such conditions as the Council may establish." Sec. 14-90(a) [See our
memo to you of March 19, 19841.

We write to support the zoning request necessary for improving
the facilities of the Preucil School of Music. Both of our children
study piano at the Preucil School, and one now goes to preschool
there as well. But we write also as neighborhood parents, with one
child already attending the Horace Mann Elementary School and the
other soon to follow.
You have heard from supposed representatives of parents with
children at Horace Mann that parking and traffic near the two
schools is sometimes a problem. But the troubles are small and
basically do not result from the Preucil School. Its regular
classes involve only a few people at any particular time, and
collecting its activities under one roof would not significantly
change that.
Instead, area congestion is a virtually unavoidable result of
the location. Traffic is heavy because the Mann School site on two
exceptionally busy streets, including the major thorough -fare of
North Dodge. Traffic is busy also because there is a major grocery
store directly across the street from the Mann building. If the
traffic situation were too dangerous for Horace Mann children with
the Preucil School, it would continue to be too dangerous were that
school to move altogether.
Similarly, the minor parking problems stem from the fact that
the area is used extensively by staff and students of the University
of Iowa, for whom it provides decently close but no -pay parking.
The same goes for employees and visitors of Mercy Hospital.
Presumably, the new parking facilities for Mercy may improve parking
in the Mann area. But again, even the least reflection reveals that
the Preucil remodeling would not have a significant effect on
parking patterns largely determined by other factors.
As neighborhood residents, we simply do not see the Mann area
as much busier or more dangerous than those of other schools; and we
certainly do not see bow the Preucil rezoning would make the
situation materially worse. To be blunt, we resent the claims to
the contrary made by people who purport to speak for Mann parents
without ever speaking to them in any significant way.
The Preucil School is making a major contribution to the
quality of life in Iowa City. A number of Horace Hann parents feel
especially fortunate to have it so close to our elementary school.
As our neighborhood continues to experience a growth in young
families with school—age children, the Preucil School should become
an even greater source of stability, opportunity, and pride for us.
It uses a landmark building in an extraordinarily fine way to
benefit the full community. To sit in the Preucil recital hall
listening to children play and love music is an experience worth
treasuring. To support and expand the school that makes this
possible is something thoroughly in the interest of our neighborhood
-- and all of Iowa City.

ANALYSIS
Background:
The applicants are requesting the downzoning of an approximately ten acre
area from RM -44 to.RS-5. This would include all of Weeber's Third
Addition, the land lying immediately north of Weeber's Third Addition and
the land lying between the southern boundary of Weeber's Third Addition
and Highway 1 (see attached location map). The majority of this land is
currently undeveloped. However, six existing lots in Weeber's Third
Addition have been developed, four for multi -family dwellings at a density
of one dwelling unit per 1,000 square feet (the maximum allowable density
in RM -44 zoning), and the other two for a single family dwelling and a

duplex. Also, the land north of Weeber's Third Addition proposed for
downzoning is developed for multi -family development (16 units) at a
density of 1 unit/3,581 square feet of lot area. The developed land area
represents abcut 2.42 acres cut of the cveral', ter. era proposal.
Neighbors' Reasons for Rezoning:
In the attached application for rezoning, the neighbors state two main
reasons for approving the rezoning:
1. "The access to the land for which rezoning is requested would be
through an RS -5 neighborhood on streets that are inadequate for
current traffic loads. Proposed use of Harlocke Street for RM -44
housing would have the effect of raising the RS -5 zoning of the Weeber
area because of the greatly increased impact of any development along
Harlocke Street."
2. "The current RM -44 zoning...is inappropriate for its location..' -.With-
.
providing for transition zone from RS -5 to RM -44, the present
Harlocke zoning has the effect of destroying the single family nature
of the Weeber neighborhood area. By eliminating all high density
traffic from Harlocke Street and its logical extensions, a buffer zone
iis created."
Impact on Density:
Under the existing RM -44 zoning, multi -family development is allowed at a
ratio of one unit per 1,000 square feet of lot area. A maximum of 435 ,
dwelling units could be constructed on the ten acre tract in question.
However, given the topographic constraints, the need for a vehicular cir-
culation system and off-street parking requirements, actual density would i
probably be much less than this. As proposed,_ the Harlocke Ridge
development would have a density of one unit per 1,613 square feet of lot
area (RM -20 requires 1,800 square feet per unit). Also, the existing
Benton Manor complex will have an overall density upon completion of one i
unit per 1,750 square feet of lot area.
Under the RS -5 zoning proposed by the applicants, a maximum of 54 single
family units could be developed on the ten acre tract. However, because
single family development does not allow for clustering units, and as a
result of topographic problems, land lost for a vehicular circulation
system and siting problems created by the requirement of providing
frontage for each lot on a street, it is unlikely that the maximum density
could be reached.
For comparison purposes, the following maximum densities would be possible
under other zoning categories: RS -12 - 145 units; RM -12 - 159 units;
RM -20 -242 units. These maximum densities do not take into account the
constraints to full development cited above.
Traffic Generation:
To get some indication of what amount of traffic would be generated by
different types of residential dwelling units "trip generation rates" from
the Institute of Traffic Engineers Trip Generation Manual were used to

calculate total trip generation. These were applied to the maximum number
of dwelling units as described above (realizing that the unit figures are
high):
Based on these factors, multi -family development would generate a greater
number of trips on a daily basis than would single family development.
For comparison purposes, a traffic count was taken on Benton Drive, 30'
south of its intersection with Benton Street for a one week period from
February 28 to March 6, 1984. Benton Drive is a private street which
serves both the Benton Manor development and the Hillsboro Apartments.
These two complexes currently contain a total of 178 dwelling units
certified for occupancy. Based on the daily traffic counts, an average
number of weekday trips was established at 1,362. Dividing this number by
178 dwelling units results in a generation rate of 7.65 trips/unit. This
results in a higher number of trips generated than does the factor of 6.1
trips/unit used above. This difference can probably be attributed to the
occupancy of a high percentage of these dwelling units by students, each
of whom may own a vehicle. It is assumed that the factors for single
family and duplex/townhouse development would not be similarly altered by
the student population. Using this generation factor for multi -family
uses, the number of daily trips would be as follows:
RM12 1,216.3 trips
RM20 1,851.3 trips
RM44 3,327.7 trips
Using these numbers, it appears that the existing trafficway network in
this neighborhood, including Benton Street, will be highly impacted by
further development at an RM -44 density, particularly without provision of
Transitional Zone:
The 1978 Comprehensive Plan report "Land Use Concepts" states: "Transi-
tional uses between two very dissimilar land uses can be effective in
developing and redeveloping areas. An intermediate use which shares some
of the characteristics and requirements of two very different uses
provides a less abrupt transition from high intensity to low intensity."
In this case, a transition from high density multi -family to single family

It should also be noted that some transition between the existing single
family and multi -family uses is already provided along the rear lot lines
of the single family dwellings located on Weeber Court. Although in this
case it may not be the best means of creating a transition, bordering
different uses along the rear lot lines is one means of transitioning
between those uses. Since the existing multi -family development which is
located between the undeveloped portion of the ten acre tract and the
single family development will not be eliminated, a downzoning will not
act to improve that transition. However, development of multi -family
dwellings on the large areas of undeveloped land still remaining will have
a much greater impact then do the existing eight-plexes on Harlocke
Street. Therefore, on a broad scale, a downzoning could improve the
Comprehensive Plan:
The Comprehensive Plan Land Use Update, adopted in 1983, recommends
residential development for this site at a density of from 16-24 dwellings
units per acre for the northern half of the tract, and a density of 8-16
dwelling units per acre for the southern half. However, the plan also
states that "the maps presented in the Comprehensive Plan outline in a
general fashion the location of different land uses; it is the zoning
map,... which specifically sets forth the uses and densities of the use
possible on any particular site. The Comprehensive Plan maps will be
interpreted with flexibility at the boundaries of the designated uses to
allow appropriate transitions between areas." Because the request area,
in fact, represents the boundary of two designated uses. (i.e. single
family residential and multifamily residential), a transitional use would
conform with the recommendations of the Comprehensive Plan. However, the
proposed RS -5 zoning would not conform with the Comprehensive Plan. It
does not serve in a transitional capacity and would only act to increase
the conflict between existing multi -family development and future single
family development.
The next question, then, is what is the most appropriate zone, or zones,
to serve a transitional function and subsequently, what area, if any,
should be rezoned. Since an "intermediate" zone is appropriate, the
alternatives include RS -12, RM -12 or RM -20:
1. RS -12. This zoning would allow development of duplex or townhouse
type units. According to the traffic generation factors, development
of this type of unit could result in a rate of traffic generation
which is not much lower than either RM -12 or RM-20Also, because of
the topographic features of this site, which includes slopes of
10-30%, cluster type development appears to offer the best possibili-
ties for the development of this land in a reasonable fashion. Cluster
development would be possible through multi -family development, or
approval of a Planned Development Housing (PDH) Plan.
2. RM -12. This zoning would allow development of the land for multi-
family dwellings at a density of one unit per 2,725 square feet of lot
area. It would represent a reduction in the maximum number of units

possible of 276 units from 435 units at RM44 density to 159 units at
RM12 density. RM -12 zoning could serve effectively as a_transition
zone and would offer a lower rate of traffic generation. It also
would conform with the recommendations of the Comprehensive Plan for
the southern portion of the tract.
3. RM -20. This zoning would allow development of the land for multi-
family dwellings at a density of one unit per 1,800 square feet of lot
area. It would represent a reduction in the maximum number of units
possible of 193 dwelling units from 435 units at RM44 density to 242
units at R1420 density. It would also appear to serve effectively as a
transitional zone since it would reduce by almost half the number of
possible units and does not have a rate of traffic generation, based
on 7.65 trips/unit, significantly greater than RM12 zoning. It also
falls within the Comprehensive Plans' recommended density of 16-24
dwelling units per acre for the northern half of the tract.
Another option might be RNC -20 zoning, which would leave the existing
multi -family structures as conforming uses while reducing the poten-
tial development capacity of undeveloped or underdeveloped land within
the area in question. This would also be consistent with the intent
section of the RNC -20 zone which states: "It is the purpose of this
zone to preserve the character of existing neighborhoods and is
designed to prevent existing multi -family uses within the neighborhood
from becoming nonconforming."
Property Owners' Comments:
Attached is a letter from William Tucker, attorney for Viggo M. Jensen
Co.,.which owns the 4 acre tract proposed for the Harlocke Ridge develop-
ment. Mr. Tucker raises the following points in objection to the proposed
downzoning:
1. "The property was acquired for development purposes. The properties
on the north, east and south sides are presently zoned and generally
developed for high density apartments."
2. "The present zoning of RM -44 was made after extensive review and
public hearings without any objections from any adjoining owners and
the land is best suited for high density construction."
3. "It is recognized that possible considerations do or could exist in
reference to means of access to and from said property solely through
Harlocke Street and efforts are being made to continue said street
through to the south to Highway 1, as well as a possible third access
through the private roads on the northeast corner of this property.
These matters do need studied consideration but should not be used as
a basis for downzoning this property."
In reference to the above comments, staff agrees that this land is best
suited for cluster development (e.g. multi -family), primarily because of
the topographic limitations on the site and the existence of surrounding
multi -family development. However, a great deal of undeveloped land zoned
RS -5 exists immediately south of the present termination point of Weeber
Street. The ultimate subdivision of this land and construction of single
family dwellings will probably result in a substantial increase in traffic

on Weeber Street. This traffic, in conjunction with the traffic which
will be generated by uses along Harlocke Street, will result in a high
volume intersection at Weeber and Benton Streets. Given the limitations
placed on the expansion of the trafficway network in this area by existing
development, a serious question is raised as to the advisability of the
existing high density development. Therefore, staff recommends that this
area be downzoned in accordance with the density recommendations of the
Comprehensive Plan (i.e.' RNC -20 zoning on the northern portion of the
tract (including all of Weeber's Third Addition), and RM -12 zoning on all
undeveloped land currently zoned RM -44 lying south of Weeber's Third
Addition and Benton Manor Condominium (see attached zoning map). This
would include a piece of land not included in the current downzoning
proposal and would, therefore, require a new notice.
STAFF RECOMMENDATION
Staff recommends that the requested rezoning of RS -5 be denied. As an
alternative, staff would propose that all of Weeber's Third Addition be
zoned RNC -20 and that the undeveloped land to the south of Weeber's Third
Addition and Benton Manor be zoned RM -12.

REASONS FOR REZONING:
Your applicants are all residents of the single-family
residential area immediately to the west of the property for
which rezoning is requested. The area immediately to the west is
zoned RS -5 from Benton Street to the Highway One right-of-way.
: The access to the land for which rezoning is requested would be
through an RS -5 neighborhood on streets that are inadequate for
current traffic loads. Proposed use of Harlocke Street for RM -44
housing would have the effect of raising the RS -5 zoning of the
Weeber area because of the greatly increased impact of any
development along Harlocke Street. Also the traffic through the
Weeber area would use the intersections of Harlocke and Weeber
Street and Benton and Weeber Street, which are dangerously
designed and insufficient to handle any increased traffic from a
higher-uoe residential area. Since it dean not appear feasible
to cut off access to Harlocke and Weeber Streets from the land
for which zoning is requested, lower -use zoning is the only
reasonable way to handle the problems created.

The rezoning request attempts to duplicate the present
pattern of zoning on the west end of Harlocke Street.
The current RM -44 zoning of the land subject of this
application is inappropriate for its location. Your applicants
believe it was an inadvertent aspect of the city's comprehensive
rezoning . Without providing for a transitional zone from RS -5 to
RM -441 the present Harlocke are zoning has the effect of
destroying the single-family nature of the Washer area
neighborhood. By eliminating all high density traffic from
Harlocke Street and its logical extensions, a buffer zone is
created.

I am writing to you on behalf of Viggo M. Jensen Company,
contract vendor to Loren Hershberger, in connection with the
above property. It is my understanding that a request has
been made by a number of property owners in the adjacent
area to the-west••to downgrade the existing zoning on such -
property from its present RM -44 zoning. I do not know the
specifics of the rezoning request, but I do plan on being
present at your informal meeting on April 2 and hope to be
allowed to speak to you at such time.

The property known as Weeber's Third Addition was acquired
f by Viggo M. Jensen Company from Herbert Spitzer and his wife
by deed dated December 13, 1968. It consisted of 6.39 acres
and had been sold under contract by the Spitzers on May 9,
1966, which contract was assigned the Viggo M. Jensen Company.
At the time of sale the property was zoned R3A and
retained such zoning until the overall revisions in the Iowa
City Zoning Ordinance. I assisted the Jensen Company in the
acquisition and platting of such property, which originally
had six lots located on the west side of what is now known
as Harlocke Street, with the remaining acreage being the
single large lot now under consideration.
This property was acquired for development purposes.
The properties on the north, east and south sides are presently
zoned and generally developed for high density apartments.

Final Plat
The above-named subdivision is located within Coralville's two mile extra-
territorial jurisdiction and east of the "line of jurisdiction" established
by a mutual agreement between Iowa City and Coralville (see attached location
map). The, agreement establishes areas where annexation by either jurisdic-
tion would be permitted, with all that land lying east of the line being that
which could only be annexed by Iowa City. By this agreement, Iowa City is
giving "reasonable time" to comment on subdivisions located in this area
before Coralville takes any action.
As a matter of policy, the Planning and Zoning Commission has indicated in
the past that they are only interested in reviewing those subdivisions in
Coralville's extraterritorial jurisdiction which may potentially be annexed
by Iowa City at some point in the future. In September, 1982, the Commission
reviewed the final plat of Block 6 of the replatting of Lot 1 of Rocca
Subdivision, which is located immediately to the southeast of the property in
question. A determination, was made at that time that no potential for
annexation existed at any time in the future, and the Commission therefore
forwarded to the Council no recommendation regarding that item. For that
reason, staff has not reviewed this final plat, and recommends that, in
accordance with previous action, the Commission forward this item to the City
Council with no recommendation for approval or denial due to the fact'it has
no potential for annexation.

RESOURCES CONSERVATION COMMISSION
One vacancy - Unexpired term
May 8, 1984 - January 1, 1985
The duties of members of the Resources Conservation
Commission will include serving as an advisory body
to the City Council of Iowa City. They shall re-
search, review, and recommend policies, rules, reg-
ulations, ordinances, and budgets relating to mat-
ters of energy and resource conservation and pro-
vide recommendations and reports to the City Coun-
cil on the activities of the Commission. The Com-
mission shall exercise broad responsibility for
development of resource conservation policies and
shall pay special attention to long-range planning
and programming. The Commission shall, for the
public welfare, make recommendations on energy
matters. These recommendations may relate to local
governmental and quasi -public agencies, private
residences and investment properties, and office,
commercial and industrial properties.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City. The persons appointed to this Commission
shall be, by training, education, experience, or
demonstrated interest, knowledgeable in matters
pertaining to energy use and conservation.
This appointment will be made at the May 8, 1984,
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for this position should contact the City
Clerk, Civic Center, 410 East Washington. Applica-

The duties of the Urban Environment Ad Hoc Com-
mittee shall be to recommend to the Council a
policy for protecting fragile areas and historic
sites, and any other policies relating to the
urban environment which the Committee shall deem
appropriate; to promote wider responsibility for
protecting natural and historic amenities; to
increase public awareness of the historic and
natural features of our landscape; to refer to
and assist, as necessary, the Planning and Zoning
Commission or any other appropriate board or com-
mission in developing appropriate standards for
protecting fragile areas, for the review of sub-
division plans as they relate to the concerns of
the Committee, and for the implementation of any
other policies recommended by this Committee and

approved by the City Council.
Membership of this Committee shall be comprised
of two members of the City Council, two members of
the Planning and Zoning Commission, one member of
the Riverfront Commission, one member of the His-
toric Preservation Commission, a citizen represen-
tative of environmental interests, a citizen rep-
resentative of development interests, a member of
the Design Review Committee, and one non-voting
I member representing the Chamber of Commerce
Environmental Committee. All members must be
qualified voters of the City of Iowa City.
These appointments will be made at the May 8, 1984
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for these positions should contact the City

Regarding the bids received by the City on April 26, 1984 in connection with the
above referenced project, we are providing herewith our evaluation, analysis,
and recommendations. A total of nine bids were received. We have reviewed the
bids submitted and are enclosing a tabulation which lists the names of the
bidders and their respective bid prices.
Based on our analysis of the bids received, we recommend the City award the
contract for this project to Sulzberger Excavating, Inc., 5th Avenue, Muscatine,
Iowa, 52761. In lieu of making the award on the basis of the base bid
submitted, we recommend the award include the following base bid and alternate
bid items as submitted on the bid form received:

The total value of the above recommended contract price for this project is
approximately 4 percent below our engineers estimate.
As noted in the bid tabulation, an addition error was made on the bid proposal

the total bid price as submitted and we therefore recommend this technicality or
irregularity be waived.
The current schedule for this project indicated the contract should be awarded
by the City on May 8, 1984. However, in order to allow sufficient time for
easement documents to be obtained which correspond with the alternate bid route
selected and the issuance of the IDOT permit, we recommend the award of the

Engineer. Proposals will be acted upon
by the City Council at a meeting to be
held in the Council Chambers at 7:30 P.M.
on May 8, 1984, or at such later time

The work will involve the following:
Construction of a sanitary sewage pumping
station; approximately 2,800 lineal feet
of 6 -inch diameter sewage force main;
approximately 3,400 lineal feet of 8 -inch
diameter sanitary sewer; manholes; surface
restoration; and miscellaneous associated
work:
All work is to be done in strict
compliance with the plans and specifica-.
tions prepared by Shive-Hattery Engineers,
of Iowa City, Iowa , which ave ha- eretofore
been approved by the City Council, and
are on file for public examination in the
Office of the City Clerk.
Whenever reference is made to the
"Standard Specifications", it shall be
the "Standard Specifications for High-
way and Bridge Construction", Series
of 1977, Iowa Department of Transporta-
tion, Ames, Iowa.
Each proposal shall be made on a
form furnished by the city and must be
accompanied by a bid bond or cashier's
or certified check drawn on an Iowa
bank and filed in a sealed envelope
separate from the one containing the
proposal, and in the amount of $26,000.00
made payable to the Treasurer of t e
City of Iowa City, Iowa, and may be cashed
by the Treasurer of the City of Iowa City,
Iowa, as liquidated damages in the event
the successful bidder fails to enter into
a contractwithin ten (10) days and post
bond satisfactory to the City insuring
the faithful performance of the contract.
Checks of the lowest two or more bidders
may be retained for a period of not to
exceed fifteen (15) days until a contract

and tabulation of bids is completed and

Payments to the Contractor will
be made monthly as specified in the
"Standard Specifications", Article
1109.06. The Contractor will be paid
in cash from any combination of available
funds which may legally be used, or at the
option of the City, in warrants authorized
by Section 384.57 or the Code of Iowa,
drawn on any fund or funds from which pay-
ment for the work may be made. The
warrants, unless paid upon presentation,
shall draw interest at a rate of eleven
percent per annum from and after the date
of presentation for payment.
Under Section 384.68(4) of the Code
of Iowa, as amended, if no bids are re-
ceived for the special assessment bonds
at public sale, the bonds may be delivered
to the Contractor in payment of the cost
of the public improvement and shall bear
interest at the highest rate of interest
permitted by law to be paid on the special
assessments on the date of levy. If
(384.57) construction warrants or cash
funds of said City are used by the City
during construction in making progress
payments, such warrants or cash payments
shall be exchanged for the bonds. If no
legal bids are received at public sale
of special assessment bonds for the
Project, the City may find it necessary
to rely on this provision of the Code and
reserves the right to do so.
The successful bidder will be
required to furnish a bond in an amount
equal to one hundred percent (100%) of
the contract price, said bond to be issued
by a responsible surety approved by the
City Council and shall guarantee the prompt
payment of all materials and labor and
protect and save harmless the City from
claims and damages of any kind caused by
the operation of the contract, and shall
also guarantee the maintenance of the im-
provement for a period of 4 years from
and after its completion aniacceptance
by the City.
