HomeMy WebLinkAbout1984-05-08 Ordinance1 ORDINANCE NO. 84-3181 ORDINANCE AMENDING THE ZONING ORDINANCE BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY LOCATED AT 524 N. JOHNSON STREET FROM P TO RM -12. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: SECTION I. That the property described be o- w is hereby reclassified from its present classification of P to RM -12, and the boundaries of the R14-12 zone as indicated upon the zoning map of the City of Iowa City, Iowa, shall be enlarged to include the property located at 524 N. Johnson Street which is legally described as follows: The south sixty (60) feet (more or less) of Lot Four (4), Lot Thirty(30), original Town of Iowa City, Iowa, according to the recorded plat there- of. SECTION II. The building inspector is hereby authorized and directed to change the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval and publica- tion of this ordinance as provided by law. SECTION III. The City Clerk is hereby auau o�nd directed to certify a copy of this ordinance to the County Recorder of Johnson County, Iowa, upon final passage and publication as provided by law. SECTION IV. REPEALER: All ordinances and parts of or nances in conflict with the provisions of this ordinance are hereby repealed. SECTION V. SEVERABILITY: If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitu- tional such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: SECTION I. The Zoning Ordinance of the CitCit— Iowa City is hereby amended by deleting Section 36-58(c)(2)g and inserting in lieu thereof the following: If the number of parking spaces required or provided for a use or a combination of uses on a lot is greater than eight (8) spaces, none of those spaces may be located in such a manner that would require backing into an alley. The Zoning Ordinance is amended further by deleting Section 36-58(c)(3)a.4 and inserting in lieu thereof the following: No parking space shall be located closer than five (5) feet to a ground floor doorway or a window of a dwelling unit. SECTION II. REPEALER: All ordinances and pars of or tnances in conflict with the provision of this ordinance are hereby repealed. SECTION III. Date published 5/16/84 4al ORDINANCE NO. 84-3103 AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF IOWA CITY, IOWA, BY CREATING AN EXCEPTION TO THE MINIMUM BEDROOM SIZE IN TWO BEDROOM MOBILE HOMES. SECTION I. PURPOSE. The purpose of this ordinance is to -create an exemption to accommodate two (2) bedroom mobile homes having one (1) bedroom at least 70 square feet in area and often having a second bedroom at less than the required 70 square feet. SECTION II. ESTABLISHMENT. Chapter 17 of e Code of Ordinances of Iowa City is hereby amended by deleting Section 17-5(n)(3) and inserting the following in lieu thereof: 17-5(n)(3) Slee in roams. In every dwelling unit of two 2) or more rooms and every rooming unit, every room occupied for sleeping purposes by one occupant shall contain at least seventy (70) square feet of floor space and every room occupied for sleeping purposes by more than one occupant shall contain at least forty (40) square feet of floor space for each occupant thereof. Exception: Two bedroom mobile homes shall be required to have only one bedroom in compliance with this section. SECTION III. REPEALER: All ordinances and parts of or nances in conflict with the provision of this ordinance are hereby repealed. SECTION IV. Jansen AP RE: Human Rights Ordinance - Revised Ordinance The Council gave first reading to the revised Human Rights Ordinance two weeks ago. At that time the ordinance was not in the proper format due to changes approved at the informal session the night before. We are now presenting the ordinance to you in proper form. There were a large number of changes of a minor nature made as well as the major changes discussed by you. To add to the existing ordinance the large number of changes made by amending it would require a great deal of time on the City Clerk's part, my time and the Code editors. Accordingly, I am recommending that Council repeal the present ordinance and enact the new ordinance which has incorporated all of the changes. None of the provisions of the present ordinance have been deleted or overlooked in the new version. The changes ordered by Council are as follows: 1. Article I definitions - page 2 - Elderly definition added. 2. Article III discriminatory practices - housing exceptions page 7 (5), (6) and (7) covering exemptions for owner -occupied 4 -unit housing; owner -occupied and owning at least 50% interest in the property; and specifically designated elderly or disabled housing. Because you are being asked to repeal the existing ordinance it will be necessary to have the first reading again. I suggest that you give the first two readings Tuesday night and the third reading two (2) weeks from next Tuesday. This will permit you to keep to the original schedule. UD
