ZONING ORDINANCE NO. 17A
AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY ENACTING
ARTICLE XVI (B) AND ARTICLE XXXV; AMENDING ARTICLE V, ARTICLE XXII,
ARTICLE XXVI, ARTICLE XXXIII; AND BY REPEALING ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
SECTION I. PURPOSE. The purpose of this ordinance is to further the stated
purposes at the zoning ordinance by amending certain of its provisions and by
adding provisions to provide for the review of specific development plans when
approving the location of certain commercial businesses.
SECTION II. AMENDMENTS.
A. Article V. Districts and Boundaries Thereof, is amended as follows:

ARTICLE XVI (B)
CP1 an CP2 - PLANNED COMMERCIAL DISTRICT
INTENT:
The purpose of *the CP1 and CP2 Planned Commercial District is to provide for
the location of commercial businesses in a manner which permits the review of
specific development plans in order to ensure the adequate provision of
necessary services and a compatibility between adjoining land uses.
CP1 - PERMITTED USES:

Clubs and lodges
Office buildings `
Printing and/or publishing houses
Hotels and motels
Restaurants, eating and drinking establishments
CP2 - PERMITTED USES
Restaurants, eating and drinking establishments
Filling stations and truck terminals
Automobile, motorcycle, truck and boat hire and sales

Warehouse and wholesale distribution facilities
Manufactured housing sales and service
Greenhouses, nurseries and the sale of plants and related products
Plumbing, heating, or electrical contractors
Lumber yards, carpenter or cabinet shops

customarily incidental and subordinate to the permitted uses, unless otherwise
excluded.

SPECIAL PROVISIONS:

1. A Site Plan Review in accordance with the provisions of Article XXXV
shall be required to obtain a building permit in the CP1 and CP2 -
Planned Commercial District.
C. Article XXII SUBDIVISION REGULATIONS, Section 5.7.f. is amended by adding the
following:
(4) Commercial Service shall provide a slow speed, high volume access to
abutting conmercia and higher density residential properties and shall be
constructed in substantial compliance with the following design standards:
a. Right-of-way, minimum width: 40 feet
b. Traffic surface, minimum width: 22 feet
c. Traffic surface, maximum vertical grade: 10 percent
d. Grading, maximum'slope: 3:1 ratio
e. Traffic surface, intersection turning radius: 50 feet
f. Traffic surface shall be constructed of a
permanent dustfree surface.
D. Article XXVI, OFF-STREET PARKING SPACE REQUIREMENTS, Section 2.2. is amended by
adding after "in a front yard":
unless a screening or buffer yard has been provided for in accordance with the

E. Article XXXV, is added as follows:
INTENT
ARTICLE XXXV
SITE PLAN REVIEW REQUIREMENTS
The intent of the Site Plan Review Standards is to provide a uniform set of
requirements for the review of site development in the Planned Commercial
Districts. Approval of a development proposal will depend on its conformance
to the General Design and Performance Standards of this ordinance.
1. Plan Required. Whenever the owner of a tract of land wishes to obtain
approval or a building permit within a Planned Commercial District the
owner shall submit to the County for approval an application and ten (10)
copies of the development plan in accordance with the following provi-
sions:
A. Development Plan
1) A location map.
2) A site plan of the planned commercial development drawn to a scale
of one inch equals 50 feet.
a. The specific arrangement of proposed buildings and other
structures including the location, approximate size and
proposed use of the buildings.
b. The location of proposed traffic facilities including en-
trances onto the primary or secondary road system, interior
streets and pedestrian walkways, including a cross section of
each proposed facility.
c. The location and type of utilities proposed to serve develop-
ment including gas and electric, telephone, water, sewer, and
solid waste disposal.
d. The location of proposed parking facilities including the
estimated capacity and type of surfacing.
e. The location, size and type of proposed outdoor advertising,
signage, and lighting for the development.
f. The location and method of screening or buffering between the
proposed development area and adjoining land uses (walls,
fences, planting strips, open spaces, etc.).
g. The development plan shall also show information of general
interest including: the legal description of the tract, the
name of the development and name of the owner, north arrow,
scale and date.

2. General Design Standards. The general design standards set forth in this
articie shall be held as the minimum standards considered for review and
approval of a planned commercial development.
A. The proposed location, design, construction, and operation of a
particular use shall adequately safeguard the health, safety and
general welfare of persons residing on or working in adjoining or
surrounding property.
B. The design and operation of the proposed use shall not unduly increase
congestion of public streets or the public danger of fire.
C. The proposed development shall provide for or have existing adequate
utilities, access roads, drainage and other necessary facilities.
D. The proposed development shall provide sufficient off-street parking
and loading space to serve the development.
E. A screening or buffer yard will be required to limit access and
provide visual separation between the proposed development and any
adjoining property which is either zoned or used for agricultural,
residential or industrial purposes. The Board of Supervisors may
waive this requirement when existing conditions otherwise limit access
and provide visual separation.
3. Performance Standards.
A. All entrances shall be onto a paved Primary or Secondary Road. The
Board of Supervisors may approve a development plan which proposes
entrances onto a non -paved surface provided that a satisfactory
agreement between the County and the developer has been entered into
for construction of a paved surface or for financial participation
with the County for construction of the required paved surfacing.
B. The best practical means known for the treatment or disposal of sewer
wastewater, refuse and solid waste shall be employed. All means of
waste treatment shall be approved by the County Health Department
prior to the approval of a development plan.
C. A screening or buffer yard shall'consist of an area no less than five
(5) feet wide with a planting screen of Arbor Vitae or other evergreen
variety three (3) feet high spaced four (4) feet on center. Where a
planting screen is not expected to thrive a solid fence or earthen
berm with low shrubs or other plant materials may be used to provide
visual obscurity to a height of six (6) feet. All screening shall be
completed prior to the commencement of an approved use.

Topography: Flat to gently sloping.
ANALYSIS
The proposed subdivision is for four developed lots on the east side of
Iowa City. The property was developed under the old zoning ordinance as
duplexes with the intention of converting the dwellings to zero -lot line
structures when that option became available. The duplexes were connected
by a garage with a common wall in early 1984. The applicant wishes to be
able to convey these structures as four single-family zero -lot line
dwellings at this time.
The preliminary and final plats conform substantially to the subdivision
requirements. Contours are not shown on the preliminary plat. However,
since these are developed lots, it is suggested that this requirement be
waived. There are no internal streets in this subdivision and access is
provided along existing streets. The existing structures comply with the
zero -lot line requirements in that sufficient yards are provided and
construction standards are met. An easement to retain a ten foot mainte-
nance area between portions of Lots 2 and 3 will be necessary.
These plats may be considered to be appropriate at this time within the
context of the Council's development policy for the east and northeast
portions of Iowa City, since development via the building permit process
has already taken place and no additional effluent will be added to the
sewer system due to this subdivision.
STAFF RECOMMENDATION
The staff recommends that the preliminary and final subdivision plats of
Amhurst Subdivision Part 1 be approved upon resolution of the deficiencies
listed below.

2. Submission of a ten foot maintenance easement upon portions of Lots 2

CHANGING THE USE REGULATIONS OF CERTAIN
PROPERTY LOCATED EAST OF FIRST AVENUE
EXTENDED
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
SECTION I. That the property described

AN ORDINANCE AMENDING SECTION 23-189 OF
THE MUNICIPAL CODE OF IOWA CITY TO CHANGE
SPEED LIMITS ON PARTS OF SYCAMORE STREET.

SECTION I. PURPOSE. The purpose of this
ordinance is to amend Section 23-189 of
the municipal code of Iowa City to reflect
i changes in the speed limit of Sycamore
Street as determined by engineering
studies conducted by the Traffic Engineer-
ing Division.
SECTION II. AMENDMENT. Ordinance 84-3168
is hereby repea e,-- Section 23-189 is
hereby deleted and the following is
adopted in lieu thereof:
Sec. 23-189. Exceptions to speed
limits.
Upon the basis of an engineering and
traffic investigation, the following
