Jefferson Iowa City, Iowa 52240 Dear Mayor McDonald and Members of the Council: I am writing to express my concern over the proposed sale and renovation of the Paul -Helen building. According to newspaper reports, these actions will jeopardize plans to rejuvenate the Black Hawk Mini -Park. Last fall when the area of the pedestrian walkway which is now the hotel was being torn up I contadhd Mayor Neuhauser and asked her why we were losing that park area when the hotel could be constructed further to the east. Her .response was that it was because the people would now get to keep the mini -park as a permanent park. She assured me that this area would not be jeopardized and that the city was committed to making it a permanent park area. According to the D.I., Phil Mears stated that developing the western face of the Paul -Helen building would ensure that the mini -park remains a permanent park. However) in light of the fact that the city was willing to grant large sums of money for the park's renovation, it seems that the future of the park was secure in its own right. In fact, if the plans .to renovate the Paul -Helen building are carried out, the mini -park will be considerably altered in form and function. The west wall of the building, referred to as a "blank wall" in the press, is covered with a mural of Chief Black Hawk. This reflects the theme of the park and has artistic and historic significance to many. of the citizens of Iowa City. Further, if the west wall of the building is to be converted into an entrance"then the park will no longer function as a park, but as a backdrop for a building entrance. Traffic to and from the building will also disrupt the purpose of the part; which is to allow people to -relax and socialize in a somewhat secluded setting off the main walkway. The mini -park has not functioned in this capacity for several years as it has not been kept up or furnished with benches. The plans to renovate the mini -park will once again restore life to this area. The Black Hawk Mini -Park was the first piece of land in downtown Iowa City to be set aside for the enjoyment of pedestrians. It is a unique area of the down- town and has historic significance to many. However, maintaining the mini -park as a park has required a series of struggles. It is my wish that the city council will arrive at a solution which will allow the rejuvenation of the mini -park to continue unimpeded and thus avoid another such struggle. I have multiple disabilities. As result, I am a consumer of the S.E.A.T.S. service on a regular basis ftr trips to and from dialysis treatments at `ie University of Iowa Hospitals and Clinics. My experience with Hawkeye in the past has been less than satisfactory for three reasons, all of which have implications for my disabling corditions. The first two reasons relate to the timeliness of the cabs; on numerous occasions I was made to-wai,60 an hour or -more' and was often taken on circuitous trips home as other fares were picked up and depositied. At first glance this may seem like a mere inconvenience until one realizes that as a diabetic regularly scheduled meals are important to avoid insulin shock and possible coma. I am scheduled for a meal immediatley after dialysis at homawith my in home aide (who is, incidentally, also inconvenienced). Furthermore, dialysis itself is debilitating. Low blood pressure and frequent nausea make for a very uncomfortable tour of the town. My third reason relates to an attitude by Hawkeye employees that has been condescending, and,occasionally, hostile in dismissing my complaints. This, too, has possible health implications. I need support to walk from and automobile to my apartment door, which is, of course, more difficult after dialysis. I am blind, and it is important that whoever is assisting me walk on my right,_:fdr the sake of my balance, and to help me relate to the space around me. One of the Hawkeye drivers insists on walking on my left. I have taken a tumble on more than one occasion. Even the smallest wound or injury heals slowly and requires constant attention to avoid amputation in my condition. I do not need this added injury risk. I am quite happy with the service A71 has provided„(do not look forward to the possibilityof being forced by my financial situation to patronize Hawkeye again. Please show some concern for the people for whom this service is intended, by maintaining thecurrent arrangement. Such a fee for both electric and gas service, if applied to all Iowa City sales, would amount to approximately $406,000 per year or $8,012,000 over the life of the franchises assuming no inflation or growth. This figure is subject to refinement since our records are not kept in accordance with city boundries. As a result of our review, there are a number of questions that need to be answered before we can reach a decision regarding the issue. For the protection of both the Company and the City, we request that you ask the City Attorney to provide a legal opinion for the following: I. Does the City have authority to impose a franchise fee which exceeds the cost of administration? 2. Can certain classes of customers, as determined by the City, be exempted from the provisions of a franchise fee? 3. In the event franchise ordinances which include a franchise fee are, after enactment, subsequently successfully challenged, is such provision severable from the balance of the ordinances? There are several additional questions of a policy nature that also need to be answered. These are: 1. What classification of electric or gas customers will be subject to a proposed franchise fee--i.e., residential, commercial and industrial, State University of Iowa, state and federal governmental agencies, churches, schools, and any other such tax exempt institutions? 3. Will the City support the application to the Iowa State Commerce Commission to include any such fee as a surcharge to Company's Iowa City rates? 9. In the event franchise ordinances which include a franchise fee are rejected by the voters, will the City pass and resubmit ordinances in identical form but absent the franchise fee provision? As you can see, our concern goes to both the electric and gas franchise ordinances which should be considered together at this time. At our June 25 meeting we obligated ourselves to respond to your concerns in a couple of weeks. However, without answers to the above, we find it difficult to give you a final answer regarding the imposition of a franchise fee. We would hope that you would consider the legal and other issues presented above and provide us with your responses promptly. If you have any questions with regard to our concerns, we would be happy to meet with you or the City Attorney in an effort to clarify.
