The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current Iowa Department of Transportation Utility Accommodation Policy. 2. The installation shall meet the requirements of local municipal, county, state, and federal lases, franchise rules, and regulations. regulations and directives of the Iowa State Commerce Commission. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's property occasioned by any construction or maintenance operations on said highway. 6. The permit holder shall take all reasonable precaution during lheconstruction and maintenance ofsaid installations to prolect:nd safeguard the lives and property of the traveling public and adjacent property owners. 7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention III snit construction on the highway right-of-way. Said notice shall he made in writing to the Engineer whose name is shown below. 8. The permit holder agrees to atall times give the Iowa Department of Transportation timely notice of intention to perform routine maintenance within the right-of-way. The permit holder shall idemnify and save harmless the State of Iowa, and the Iowa Department ofTransportation from any and all causes of action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for, on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, representa- tives, contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public highway under this permit. 13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is assured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of noncomplying construction will be assessed against the permit holder. 14. A copy of the approved permit shall be available on the job site at all times for examination by Department of Transportation officials. 15. Box 5521 Coralville, Iowa 52241 (319) 351-2000 Dear Council Member, The Iowa City Community Band is considering having a stage built in which to perform its future concerts. !When folded, t;:e trailer will measure no more than 40' x B' and 10' in height. This shell will improve the sound of the band, therebv increasinc the interest of the audience, and will give the band a portable "home". There is a possibility that the band could play in parks other than College Green, other possibilities would be City Par;: and Willow Creek Parks. The Iowa City Community Band Board asks that the city of Iowa City consider paying for the following: 1. Title, licensing fee, and insurance for the ICCB trailer - shell. 2. Provision for indoor storage of same. 3. Transportation of the structure to the concert site as needed. Six concerts are planned for the 1985 summer season. The following are understood: 1. The shell may be used by other organizations, assuninn that the Iowa City Community Band will be able to use shell for its concerts. 2. The shell will be designed according to specifications which meet the demands of the Iowa City Community Band, Inc. 3. J84 CITY CLERK 9 Buena Drive Iowa City, IA 52240 July 31, 1984 To The Iowa City Council: This letter is in response to the bug zapper issue which was a brief issue at the informal city council meeting on Monday, July 30. We are "pro" bug zappers. We have two children who react badly to biting bugs, be it flies, mosquitoes, or gnats. We have had our zapper on a timer which turns it on at 9:00am and off at 9:00pm. We have tried to compromise with our neighbors who, for the most part, have no adverse feelings toward the zapper. Our problem has arisen with one neighbor, Mrs. Veda Brenner, who has made one phone call to us in the two months we have had the zapper. We have had two separate police calls on this matter and have resorted to spending $630.00 to put up a 5' wooden fence to help block the noise from our zapper and to block our trees from Mrs. Brenner's yard, as she also informs us they are diseased and a nuisance to her. She has also informed the City Forester and Iowa -Illinois Gas & Electric of our trees, since we let them grow into the wires. As I hope you are surmising, this is clearly a civil matter. This is a matter we have tried to compromise on with the fence and the timer. We only hope that these steps will help Mrs. Brenner with her problems. We hope that whatever action the Iowa City Council takes will also help Mrs. Brenner with her plight. We thank you for your time and effort on this matter and hope that you, as a body, may continue to do your job as a city council and get on to more important matters. Mr. Frantz was correct when he told you that this matter is not covered by the noise ordinance. At the time this ordinance was written as well as at the time the new zoning ordinance was enacted, it was determined by the City Council that placement of air conditioning units would not be regulated. Council has directed staff to further research the matter. We will be contacting other cities to determine if and how they may have developed effective ways of dealing with similar problems. This information will be forwarded to the City Council in the next several weeks and I will ensure that you receive a copy at that time. The residents of the Weeber Street area are currently involved in discussions with the Planning and Zoning Commission concerning the zoning of property east of Harlocke Street. I am writing to you because of a related issue which I think should be resolved regardless of the zoning outcome. There are no sidewalks connecting Weeber Street to Benton Street. Also there are sections of the sidewalk along Harlocke Street which are not installed. I am requesting that the City Council use its authority to cause sidewalks to be built in these areas. There are a significant number of our residents and residents from neighboring apartments and condominiums who walk to work or to school in the downtown area. Most all of the residents go east on Benton Street and north on Capitol Street. There are a number of places along Capitol Street which do not have sidewalks particularly on the west side. The Public Works Department has compiled a list of areas where sidewalks are missing and has estimated the cost of installation. A Capital Improve- ment Project financed with special assessments will be proposed for inclu- sion in the FY 86 Capital Improvement Program for construction between July and November 1985. Additional requests will be added to this project until January 1, 1985. At that time letters will be sent to the affected property owners informing them of the special assessment project and allowing appropriate time for the owners to install the sidewalks. During the last several years, our church has sponsored and encouraged group housing of single people of the same sex from our fellowship. We consider this group housing i a vital part of our ministry to the single people in our fellowship. During the past year, one of the group housing units has been located at 1010 Hudson Ave. The house is owned by our assistant pastor, John Johnston. The girls living in the house have found this living arrangement very beneficial. However, due to the recent passage of the new rental ordinance, this type of housing arrange- ment and therefore, this vital ministry of our church is in jeopardy. We strongly urge you to grant an exemption from the ordinance i in regards to the number of allowable people per residence for this house. We are not asking to establish a new housing unit, but only to continue what we have done in the past. West - single family residential and RS -8 - July 9, 1984 BACKGROUND This application represents a nearly identical request to that submitted for 1010 Hudson Avenue (V-8409). The applicant, Joe Kennedy, has submitted the request on behalf of the Good News Bible Church, which leases this property as a group housing unit for four single male members of the church. The property is classified as a duplex and each unit may be used as a residence by a family and a roomer. A family is defined as "one (1) person or two (2) or more persons related by blood, marriage, adoption or placement by a governmental or social service agency, occupying a dwelling unit as a single housekeeping organization. A family may also be two (2), but not more than two (2), persons not related by blood, marriage or adoption" Section 36-4(f)(1). Three unrelated individuals, two of whom would constitute a family and one of whom would be a roomer, may legally reside in the subject dwelling unit. Afor On November 30, 1983, the Zoning Ordinance was amended to reduce the number of roomers permitted in single family residential zones from two to one. A one year grace period was given to allow those dwellings with more than one roomer to come into compliance. Therefore, as of November 30, 1984, the applicant will be required to reduce the number of unrelated individuals occupying 817 Clark Street to three. He is, on behalf of the Good Hews Bible Church, requesting a variance to allow the continued occupancy of this dwelling by more than three unrelated individuals. Under Section 36-91(g)(3) of the Zoning Ordinance, the Board is empowered to grant variances from the terms of the Zoning Ordinance "...as will not be contrary to the public interest, where owing to special conditions there are practical difficulties or particular hardships in the way of achieving strict compliance with the provisions of this chapter." The ordinance provides that the Board shall not grant a variance unless the applicant demonstrates that such action is not contrary to the public interest and that without such action the applicant will suffer unnecessary hardship. To show that a variance is not contrary to the public interest, an applicant must demonstrate that granting the requested variance will not adversely affect the neighborhood, will be in harmony with the purpose and intent of the Zoning Ordinance, and will not contravene the objectives of the Compre- hensive Plan. In order to demonstrate unnecessary hardship, the applicant must show that the property in question cannot yield a reasonable return if only used for a purpose allowed in the RS -8 zone, that the owner's situation is unique or peculiar to the property in question and not shared with land owners in the area, and that the hardship is not of the land owner's own making or that of a predecessor in title. ANALYSIS The applicant has applied for this variance on behalf of the tenant, which feels it is necessary to be able to have more than the permitted number of roomers in this dwelling. However, while reducing the number of roomers permitted may be inconvenient for the church, it does not result in a hardship for the applicant. He is permitted a reasonable use of the property since each dwelling unit may be rented to up to three unrelated individuals. Further, the impact of the change in permitted roomers applies equally to all one and two family dwellings in the RS -5 and RS -8 zones. All dwellings which are currently occupied by more than one roomer will be required to comply with this provision as of November 30, 1984. It does not appear, therefore, that the owner's situation is unique or peculiar to the property in question. Nor is it clear that this property will be burdened more than all others who must also comply. The intent of this statute was to reduce the occupancy of single family and duplex residences by persons who were unrelated to the resident family. To permit a variance to the ordinance where hardship is not demonstrated and the circumstances are not unique is contrary to the intent of the law. STAFF RECOMMENDATION Since hardship, as defined strated, the staff recommends three unrelated individuals denied.
