(1) Consider setting a public hearing for September 25, 1984, to amend Section 18-32(b)(2) of the Human Rights Chapter of the Code of Ordinances of the City of Iowa City, [owa. Comment: The Human Rights Commission at its regular meeting of August 27, 1984, unanimously recommended approval of this amendment. The proposed amendment deletes the exemption that "renters pass through the owner's living area" and clarifies the type of housing covered by the exemption. Under the existing ordi- nance, the exemption presents a practical problem in interpreting whether or not "renters pass through the owner's living area." (1) Letter from Olive Pearl Ritter regarding problems associated with the Delta Tau Delta Fraternity House at 322 North Clinton. Memoranda from the Police Chief and Housing Inspector regarding this matter are attached to Ms. Ritter's letter. (2) Letter from Mrs. Paul Webber regarding problems caused by black walnut trees. This letter will be referred to the City Manager for reply upon receipt of direction from the City Council. g. Applications for the Use of Streets and Public Grounds. Applications for City Plaza Use Permit. (1) Application from the Downtown Association for the use of City Plaza for a "Roll out the Gold Carpet" event planned for September 7. (approved) END OF CONSENT CALAR ITEM NO. 4 - PLANNING AND ZONING MATTERS. Public hearing on an ordinance to amend the flood hazard overlay zone, Section 36-31(c) to adopt new flood maps and a new flood insurance study. Comment: A preliminary Flood Insurance Rate Map, Flood Boundary and Floodway Map, and Flood Insurance Study, dated May 17, 1984, have been provided by the Federal Emergency Management Agency. These documents reflect changes in the floodplain resulting from construction of the Ralston Creek stormwater detention areas and improvements in the lower Ralston Creek channel. The Planning and Zoning Commission, at a meeting held August 16, 1984, recommended by a vote of 5-0 adoption of the revised maps. A memorandum from the Director of Public Works, outlining the revisions to the previous maps, was furnished to the Council in the information packet of June 1 and is attached to the agenda. The maps are available at the City Engi- neer's office for review by the public. Agenda `-`, Regular Council Meeting September 11, 1984 Page 5 Consider an ordinance Ordinance to establish and modify procedures (first consideration) to amend the Historic Preservation a certificate of no material effect for designating historic districts. Comment: The Planning and Zoning Commission, at a meeting held July 19, 1984, recomnended by a 6-0 vote approval of proposed amendments to the Historic Preservation Ordinance which were submitted by the Historic Preservation Comnis- sion. The proposed amendments authorize the issuance of a Certificate of No Material Effect for projects in historic districts which have no affect on any historic architectural features of the building or on the district, and amend the process for designating historic districts by requiring that the Planning and Zoning Commission receive any comments of the Office of Historic Preservation of the Iowa State Historic Department prior to the Commission's action. No comments were received at the public hearing held August 28; 1984. Action: �_ii/�,]/ Q ,/�9 U / d c. Consider an ordinance amending the Zoning Ordinance regard- ing the provisional use language for dwellings in the CB -2 zone. (first consideration) Comment: The Planning and Zoning Commission recommended by a 4-2 vote approval of a proposed amendment to the provi- sional use language of the CB -2 zone which would permit dwelling units above or below the ground floor only when the ground floor was occupied exclusively by another principal use permitted in the zone. Consider an ordinance amending Section 36-88 of the Zoning Ordinance to bring the procedures therein into compliance with recent State legislation amending Chapter 414 of the Code of Iowa. (first consideration) Comment: The Planning and Zoning Commission recommended by a 6-0 vote approval of a proposed amendment to Section 36-88 of the Zoning Ordinance. This amendment alters the time requirements for notices of public hearing and changes the area from which a formal protest can be initiated to require an extraordinary majority vote of City Council on Zoning Ordinance amendments. The proposed ordinance will bring the Iowa City Code into compliance with recent State legislation amending Chapter 414 of the Iowa Code. A diagram illustrat- ing the effect of the proposed amendment regarding formal protest to rezoning actions is included in the Council packet. Action: ITEM N0. 5 - nsi er an or finance to rezone property at 624 South Gilbert Street from CI -1 to CC -2. Z-8410. (passed and adopted) Comment: The Planning and Zoning Commission recommended by a 6-0 vote approval of the rezoning of 624 South Gilbert Street from CI -1 to CC -2. This recommendation is consistent with the staff's recommendation contained in a report dated June 7, 1984. PUBLIC HEARING ON PLANS, SPECIFICATIONS, COST ESTIMATE FOR THE CONSTRUCTION OF DIAMONDS FENCE PROJECT. FORM OF CONTRACT AND THE MERCER PARK BALL Comment: This project involves enclosing each of the four Mercer Park ball diamonds with a 72 inch high metal fabric fence. The Engineer's estimate for this project is $29,000. Comment: This hearing is being continued from the July 31, 1984, meeting where it was deferred because of lack of informa- tion on the a art signage proposed under this agreement. This issue has been resolved with the information on,the signage contained in the Hotel Steering Committee minutes f August 15, 1984, and are listed on the Consent Calendar, Item No. 3b.(5). One sign would be located above the entrance of the Dubuque Street Parking Ramp and the second would be plced in the ata athe interse tion ofroud betwen the Burlington andewalk Dubuquedthe streetsar 7 ramp Action: Z44164�1 _ clic �tP��u-cam( . .=a, i' Agenda Regular Council Meeting September 11, 1984 Page 8 ITEM NO. 9 - PUBLIC HEARING TO CONSIDER AMENDING CHAPTER 17 BY REVISING THE REQUIREMENT FOR MAINTENANCE OF PUBLIC AREAS TO INCLUDE STRIPING AND MARKING OF INDIVIDUAL PARKING SPACES. Comment: This ordinance was prepared at the Council's request. The proposed amendment adds to Chapter 17 a requirement for the maintaining of striping/marking of parking spaces within parking areas as required by the Zoning Ordinance. The Housing Commis- sion, at their meeting of August 14, 1984, did not recommend in favor of the proposed ordinance. The issue of whether or not the Zoning Ordinance requires the "maintaining of strip- ing/marking of parking spaces" was referred to the Zoning Code Interpretation Panel. This interpretation is included in the Council's packet. Amendment of the Housing Code without deleting the striping/marking requirement in the Zoning Code would be redundant and cause jurisdictional issues between the Housing Board of Appeals and the Board of Adjustment. Staff does not recommend amending the Housing Code. Action: U ITEM NO. 10 - PUBLIC HEARING ON AN APPLICATION FOR 14 SECTION 8 EXISTING HOUSING CERTIFICATES. Comment: Paragraph 403A.28 requires the Housing Authority to hold a public hearing before undertaking any low cost housing project. The Iowa City Housing Authority has submitted an application for 14 Section 8 Existing Housing Certificates to be utilized in conjunction with the Rental Rehabilitation Program. The 11 foot high pole sign would be located between the sidewalk and Dubuque Street Parking Ramp. The facia sign would be placed over the entrance to the Dubuque Street Parking Ramp. Comment: This resolution allows for the combining of negotia- tions with the AFSCME bargaining unit on behalf of both the City and the Library Board of Trustees for the FY86 contract. (second consideration) Comment: As the majority of the members of the Senior Center Commission are older, it has become apparent that between extended vacation and illness, it is very difficult to achieve a quorum. When quorum is achieved (4) the number seems small to make important decisions for the whole Commission. Furthermore, often three of the four present were not at the last meeting so only one member has a sense of continuity in the decision-making process. It is believed that two additional members on the Commission will increase our chances of having a higher percent- age of members present and knowledgeable. The second change is to correct an apparent oversight which authorizes minutes to be sent to the Director of Parks and Recreation and makes no mention of the Johnson County Board of Supervisors. As the County provides 20 percent of the opera- tional budget for the Senior Center and the Director of Parks and Recreation like all directors receives our minutes in their copy of the Council packet, we have deleted the Director and added the County. The Rules Committee approved the proposed changes an July 17, 1984. 'g; Action: ; / ,/At/ ITEM �O AtQ`�lsG� ITEM NO. 24 = CONSIDER AN ORDINANCE AMENDING SECTIONS 5-6(a) AND 5-6(d) OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, REGARD- ING THE SIZE OF DANCE FLOORS. (second consideration)' Comment: The present ordinance requires dance floors to have a minimum square footage of 200 feet.
