AN ORDINANCE AMENDING THE ZONING ORDI-
NANCE, FLOOD HAZARD OVERLAY ZONES, TO
PROVIDE FOR THE ADOPTION OF PRELIMINARY
REVISED FLOOD MAPS AND A FLOOD INSURANCE
STUDY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
SECTION I. PURPOSE. The purpose of this
ordinance is to permit the use of prelimi-
nary revised flood maps and flood insur-
ance study dated May 17, 1984 for the
implementation of the Flood Hazard Overlay
Zones.
SECTION II. AMENDMENTS. Chapter 36 of
e Iowa City Municipal Code entitled
Zoning Ordinance is hereby amended as
follows:
A. Section 36-31(c) is hereby repealed
and the following is adopted in lieu
thereof:

Flood Boundary and Floodway Map and
the Flood Insurance Study dated May
17, 1984, provided by the Federal
Emergency Management Agency as the
official documents. No ordinance
related to these documents shall be
adopted or enforced based upon
modified data reflecting natural or
man-made physical changes without
prior approval of change in the
documents by the Federal Emergency
Management Agency.
B. Section 36-32(d) is hereby repealed
and the following is adopted in lieu
thereof:

elevation/flood protection a eva on.
The water surface elevation of the 100
year flood, which is shown on the
preliminary revised Flood Insurance
Rate Map (FIRM), assuming only that
encroachment on the floodplain that
existed when the preliminary revised
Flood Insurance Rate Map dated May 17,
1984 was adopted. Additional and
complete encroachment to the floodway
encroachment lines will cause the
water level to surcharge one (1) foot

or less above the flood protectior
elevation as shown in Table I of the
preliminary revised Flood Insurance
Study.
SECTION III. REPEALER: All ordinances
an par s o or finances in conflict with
the provision of this ordinance are hereby
repealed.
SECTION IV. SEVERABILITY: If any
sec ion, provision or par of the Ordi-
nance shall be adjudged to be invalid or
unconstitutional, such adjudication shall
not affect the validity of the Ordinance
as a whole or any section, provision or
part thereof not adjudged invalid or
unconstitutional.
SECTION V. EFFECTIVE DATE: This Ordi-
nance shall be in effect after its final
passage, approval and publication as
required by law.

Re: Flood Plain Maps
On May 21, 1984, the City of Iowa City received the preliminary Flood
Insurance Study which includes copies of the Flood Plain Maps as com-
pleted by the Federal Emergency Management Agency (FEMA). The City of
Iowa City has been directed to review the material and notify.FEMA within
thirty (30) days of any comments, including obvious errors, which might
justify modification of the maps. The Engineering Division, Planning
Department, and Shive-Hattery 8 Associates, Iowa City's consultant for the
project, are currently reviewing the materials.
Revisions to the previous maps include areas within the Ralston Creek,
South Branch Ralston Creek, Iowa River, Willow Creek, Clear Creek, and
Rapid Creek watersheds.
A) RALSTON CREEK
The base flood elevations are proposed to be decreased as follows:
- from the Iowa River to Benton Street...2 1/2' to 7' respectively
- from Benton Street to LaFayette Street ... 7'to 6' respectively
- from LaFayette Street to the Rock Island Railroad tracks 6'
- from the Rock Island Railroad tracks to Gilbert Street...6' to 4'
respectively
- from Gilbert Street to Burlington Street...4' to 2 1/2' respec-
tively
- from Burlington Street to Washington Street...2 1/2' to 2' respec-
tively
- from Washington Street to Johnson Street...2' to 1 1/2' respectively
- from Johnson Street to Lucas Street...l 1/2' to 3 1/2' respectively
- from Lucas Street to Evans Street ... 3 1/2' to 1 1/2' respectively
- from Evans Street to Jefferson Street ... 1 1/2' to 2' respectively
- from Jefferson Street to Rochester Avenue. .2' to 4' respectively
- from Rochester Avenue to outlet of North Branch Dam ... 4' to 3'
respectively
- from outlet of North Branch Dam to upstream boundary of backwater
from North Branch Dam and then to Scott Boulevard ... 3' to 0'
respectively
The 100 -year flood boundary lines are proposed to be closer to the
creek, most appreciably between the Iowa River and Burlington Street.
In fact, 100 -year flood boundary lines and the top of the creek bank
are one and the same between Kirkwood Avenue and the Rock Island
Railroad tracks.

B. SOUTH BRANCH RALSTON CREEK
The base flood elevations are proposed to be decreased as follows:
- from junction with Ralston Creek to College Street. ..1 1/2' to 0
respectively
- from College Street to 2nd Avenue... l' or less
- from 2nd Avenue to 1st Avenue... 1' to 1 1/2' respectively
- from 1st Avenue to Meadow Street ... 1 1/2' to 3' respectively
- from Meadow Street to Brookside Drive ... 3' to 2' respectively
- from Brookside Drive to South Branch Dam... 2' to 1' respectively
The 100 -year flood boundary lines are proposed to be closer to the
creek in some areas, but this revision is of small magnitude.
C. IOWA RIVER
Johnson County is also completing revisions to their Flood Insurance
Study. Therefore, to correct mismatches with the Johnson County
study, the base flood elevations for the Iowa River from Burlington
Street to the south corporate limits of Iowa City are proposed to be
increased from l' to 2' respectively. The proposed revisions termi-
nate at the Burlington Street Dam.
D. WILLOW CREEK
Due to the proposed modifications to the flood information for the
Iowa River as specified previously, the 100 -year flood boundary lines
for Willow Creek are proposed to be expanded near the south corporate
limits of Iowa City . Also, the previous maps incorrectly show the
south corporate limits of Iowa City where Willow Creek joins the Iowa
River; the new maps include the small area (previously excluded) which
is, for the most part, within the 100 -year flood boundary of Willow
Creek.
E. CLEAR CREEK
The 100 -year flood boundary lines for Clear Creek are proposed to be
expanded near the west corporate limits of Iowa City. This proposed
revision is very small.
F. RAPID CREEK
Flood information, including base flood elevations and 100 -year flood
boundary lines, is proposed to be shown for that part of Rapid Creek
in Iowa City.

ORDINANCE AMENDING THE ZONING ORDINANCE BY
CHANGING THE USE REGULATIONS OF CERTAIN
PROPERTY LOCATED AT 624 SOUTH GILBERT
STREET.
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
SECTION 1. That the property described
below is hereby reclassified from its
present classification of CI -1 to CC -2,
and the boundaries of the CC -2 zone as
indicated upon the zoning maps of the City
of Iowa City, Iowa, shall be modified to
include the property located at 624 South
Gilbert Street:
Lots 5 and 6 in Block 2 in Lyon's
Addition to the City of Iowa City,
Iowa, according to the recorded plat
thereof, except that part occupied by
the right-of-way of the Chicago, Rock
Island and Pacific Railway Company as
now located. Also, all that portion
of the alley south of Lots 5 and 6,
Block 2, Lyon's First Addition, Iowa
City, Iowa.
SECTION II. The Building Official is
hereby authorized and directed to change
the zoning map of the City of Iowa City,
Iowa, to conform to this amendment upon
the final passage, approval and publica-
tion of this ordinance as provided by law.
SECTION III. The City Clerk is hereby
authorized and directed to certify a copy
of this ordinance to the County Recorder
of Johnson County, Iowa, upon final
passage -and publication as provided by
law.
SECTION 1V. REPEALER. All ordinances and
parts of ordinances in conflict with the
provision of this ordinance are hereby
repealed.
SECTION V. SEVERABILITY. If any section,
provision or part of the Ordinance shall
be adjudged to be invalid or unconstitu-
tional, such adjudication shall not affect
the validity of the Ordinance as a whole
or any section, provision or part thereof
not adjudged invalid or unconstitutional.

Ordinance shall be in effect after its
final passage, approval and publication as
required by law.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 17 OF THE
CODE OF ORDINANCES OF IOWA CITY, IOWA, BY
REVISING THE REQUIREMENTS FOR MAINTENANCE
OF PUBLIC AREAS TO INCLUDE THE STRIPING
AND MARKING OF INDIVIDUAL PARKING SPACES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
SECTION I. Section 17-7(v) of the Code of
Or�naoces of the City of Iowa City, Iowa,
is hereby repealed and substituted in its
place is the new Section 17-1(v).
(v) Maintenance of public areas.
(1) Every owner or operator of a
dwelling containing two (2) or
more dwelling units or more than
one rooming unit shall be
responsible for maintaining, in
a safe and sanitary condition,
the shared public areas of the
dwelling and premises thereof,
unless there is a written
agreement between the owner and
occupant to the contrary.
(2) Every owner or operator of a
dwelling shall maintain the
striping/marking of parking
spaces within off-street parking
areas for such dwelling as
required at the time of issuance
of the building/occupancy permit
for such dwelling by the
off-street parking requirements
of the Zoning Ordinance (Chapter
36 of the Code of Ordinances of
the City of Iowa City).
SECTION III. REPEALER: All ordinances
and parts Of ord nances in conflict with
the provision of this ordinance are hereby
repealed.
SECTION IV. SEVERABILITY: If any
section, prov son or part of the Ordi-
nance shall be adjudged to be invalid or
unconstitutional, such adjudication shall
not affect the validity of the Ordinance

Re: Section 36-58 - Striping and Maintenance of Striping for Parking
Spaces
The Zoning Code Interpretation Panel met on August 31, 1984, to review a
request submitted by the City Council questioning whether the Zoning Ordi-
nance required the continued maintenance of striping for parking spaces
after their delineation in parking areas.
According to the introductory paragraph of Section 36-58, off-street parking
requirements, it states that "off-street parking and stacking spaces, aisles
and drives shall be provided and maintained (emphasis added) in compliance
with the (requirements of the subject section)." According to subparagraph
(c)(2)j of this section, "in all parking areas (which consist of more than
four parking spaces) required by this Chapter, parking spaces shall be
visibly delineated on the surface by painted or marked stripes." "'Visibil-
ity," according to Webster's New Collegiate Dictionar , has the quality of
being apparent„ conspicuous, or recogniza e.
The Panel unanimously agreed that as long as parking spaces could be identi-
fied, according to the stripes which delineate them, the conditions of the
above subparagraph have been met. At such time as the nature of the stripes
did not permit immediate identification of the parking spaces, the parking
area will be in noncompliance with the provisions of the Zoning Ordinance.
The owner of the parking area would then be responsible for bringing it into
compliance to avoid penalty according to the terms of the ordinance.

ORDINANCE TO AMEND THE PENALTIES FOR DEFEATED
PARKING VIOLATIONS FOR OVERTIME PARKING
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF IOWA CITY, IOWA:
SECTION I. That Sections 23-255(b)
and 23-255(c) are hereby repealed and
substituted in lieu thereof are the
following new Sections 23-255(b) and
23-255(c)•
(b) All fines for overtime parking in
violation of Division 3 of this
article shall be three dollars
($3.00).
(c) All fines for violation of the
one-hour restricted [one in the
Civic Center lot shall be three
dollars ($3.00).
SECTION II. REPEALER. All ordinances
and parts o ordinances in conflict with
the provision of this ordinance are hereby
repealed.
SECTION III. SEVERABILITY. If any
section, provision or part of the Ordi-
nance shall be adjudged to be invalid or
unconstitutional, such adjudication shall
not affect the validity of the Ordinance
as a whole or any section, provision or
part thereof not adjudged invalid or
unconstitutional.
SECTION IV. EFFECTIVE DATE. This
Ordinance shall be in effect on January 1,
1985, following its final passage,

law.
