Dear Council Members,
As you may be aware, under the present union contract,
Iowa City Transit drivers of full-time shifts do not receive
lunch breaks on Saturday if a scheduled full-time shift
driver calls in sick. The potential dangers of this practice
are readily apparent: without a meal break, fatigued and
overstressed drivers are much more susceptible to accidents
and job related illnesses. In addition, drivers who are
sick on Saturday often feel guilty about depriving their
fellow drivers of meal breaks and force themselves to work
anyway, despite being of diminished capabilities. I can
think of no other occupation where a person responsible
for a $100,000 -plus piece of equipment and millions of
dollars worth of passenger liability is deprived of a break
and a chance to get away from their job, even if only for
thirty minutes.
Having driven now for four years, three of them full
time, I have seen a vast increase in ridership and congested
streets (especially since the closing of the Iowa Avenue
bridge), and a steady decrease in the quality and reliability
of dost of the transit buses --with the resultant rise in
levels of stress and strain on the drivers of Iowa City Transit.
This practice of denying meal breaks to drivers must not
be allowed to continue.
Please consider the means you as council members have
to correct this problem and help make the streets of Iowa
City safer for everyone. Thank you.

Dear Council Members:
I too am an Iowa City bus driver concerned about the
meal -relief situation.
Granted, this is a negotiable issue, but we've brought
this issue to the bargaining table negotiation after
i negotiation, and still there remains the final problem,
of meal reliefs on Saturdays. The on-call driver is
designated the meal -relief driver on Saturdays. But if
another driver calls in sick, the on-call driver must
fill the open space. Therefore, meal reliefs are not
guaranteed on Saturdays; they are contingent upon 100%
attendance.
Not only does this cause an unnecessary morale problem
in the department, it causes additional safety and•
health problems as well. Imagine what it is like not
knowing from Saturday to Saturday whether or not you
will receive a meal relief. Imagine what it is like to
drive a bus for over eight hours without a thirty -minute
break. The few minutes that we have every hour to stretch
and to go to the toilet are not enough to keep the body
and mind productive and alert for an entire shift. And
it is degrading to have to eat something out of a sack
during a lay -over in front of several to several dozen
people. Many drivers succumb to eating junk food from
vending machines in Schaeffer Hall, or a cookie from
Cookies & More in the mall, simply because they need
some nourishment to get them through the day until they
can eat a meal after work.
This is not healthy. What's more, this is not right.
It seems incongruous with Anne Carroll's health incentive
program that these sorts of stresses should be imposed
upon a class of employees. It seems morally corrupt that

The argument of cost cannot be justified. It's under-
stood that Transit is different from other departments,
for when Transit employees take a break, other transit
employees must replace them. It's not as it is in other
departments where, for instance, a bell hole will wait
for the return of Water employees:. Transit must roll on.
But why should Transit employees be penalized for an
inherent quality of the business? When the City took
over the private bus company in 1971 the City assumed
responsibility for operations. It's unfortunate, but
there are inconvenient and sometimes costly scheduling
problems in this business.
In addition to the regular on-call drivers, additional
drivers should be scheduled for work on Saturdays to
provide meal reliefs for all eight -hour -shift drivers.
I bring this to your attention not to circumvent the
negotiating process that is coming up, but rather to
encourage it. I believe the Administration has been
hard -lined on this issue for too many years. Wetve
had to work hard over the past six years to attain
guaranteed meal reliefs during the week and during the
summer. Guaranteed Saturday meal reliefs is the final
hang up. I trust in your ability to see the reasonable-
ness of our request. I hope that you would use your

Enclosed please find copies of several letters to the City Council which
have recently been received and which are on the agenda for formal
acknowledgement by Council at its September 25, 1984, regular meeting.
I wish to call these letters to your attention as they could potentially
impact upcoming contract negotiations.
This and other bargainable issues have been confined to contract
negotiations in the past and I believe it remains in the best interest
of both AFSCME and the City to continue this practice. In addition,
Chapter 20.17(9) of the Code of Iowa states:
"A public employee or any employee organization shall not negotiate
or attempt to negotiate directly with a member of the governing board
of a public employer if the public employer has appointed or author-
ized a bargaining representative for the purpose of bargaining with
the public employees or their representative, unless the member of
the governing board is the designated bargaining representative of
the public employer."
This provision stresses the importance of bargaining through the duly
authorized representatives.
It is important to the City that we clearly understand the position of
the Union on all issues during negotiations. Only then can we respond
in a manner consistent with the needs and priorities of the entire
bargaining unit membership as epxressed through your bargaining repre-
sentatives. Separate communications serve only to confuse the issues
and make negotiations more difficult for all parties involved. We wish
to avoid all such problems if possible.

Your letter to Tom Summy of May 29th indicated that "after
modification to the existing ramps are completed the staff
will re-evaluate the need for any new signage". The Chamber
of Commerce Parking Committee feels that the appropriate time
to address the question of signage has come.
The committee's concerns regarding signage are as follows:
1) The need exists to provide signage out of the Central
Business District to direct travelers to the parking
facilities. Since the City will have spent $100,000
to remodel one ramp and $1,500,000 to expand the other,
we should make it as easy as possible for transients
to find those facilities.
2) The need exists to provide signage within the parking
facilities. Ramp rates, park and shop, pedestrian
access and hours of operation are all items that should
be addressed with signage.
We strongly encourage the City to have the parking consultants
cover the signage issue in their final report. Thank you for
your consideration in this matter.

I am keenly interested in this subject as it applies to Mercy ..
Hospital. I feel that to screen the parking lot would be a disaster.
A six"foot hedge screen would provide a hiding place Tor criminals.
Much has been said about trying to prevent crime nationally. This
would be one place where the City could make a start in crime proven -
tion, .
Mercy Hospital employees and visitors come and go at all hours
of the night at all times of the year. I am in favor of the planting
of hedges. in most cases but not atthis site where it might conceal
criminals. Safety for those assiciated with Mercy Uspital comes first.
Therefore, I feel that an exemption to this law should be made in this
particular case.

To the Mayor and City Council of Iowa City:
We're sure that this is not the first time that the problem
of parking has come to your attention. However, it is still
very much a problem and we are writing to urge you in the
strongest possible terms to alleviate the problem.
No, we're not complaining about the sports fans, or about
the price of the city ramps.
Our complaint is about non-residents taking advantage of the
free parking in front of our house in order to avoid paying
the ramp fees that they should be paying. In fact, today,
like many others, it wasn't just parking on our block: it
was all of the parking spaces in the surrounding four
blocks.
During the few weeks this fall term has lasted so far, we
often have had to park far from our house after finding our
block filled by cars with out -of -county license plates or,
in any case, not from anywhere in our neighborhood.
Given the obvious magnitude of this problem (no spaces in
four blocks!), it seems fair to say that the problem is a
burden on a significant number of your constituents. We're
sure that any survey would confirm this guess.
In addition, the fact that out-of-towners park for free
rather than using the ramps deprives the city of revenue, as
well as creating a constant inconvenience for those who live
in the area.
We have two suggestions:
1) Loosen the alternate -side parking rules.
2) Institute some sort of parking permit scheme
like other cities have (e.g., Cincinnati); require non-
resident cars --those without permits --to park in ramps, or,
at the very least, at meters (though the short-term nature
of the meters would suggest that they should be saved for
residents).
Once again, we urge you to take some action on this problem
as soon as possible.

At its regular meeting of September 25, 1984, the City Council
received and placed on file your letter concerning parking in
Iowa City. You are correct that this is not the first time that
parking problems have been called to the Council's attention,
especially problems in the Central Business District and the
near -downtown area. Often in recent weeks, both ramps have been
filled to capacity and parking space at meters is scarce. At the
present time, the Transportation Planner for Johnson County Council
of Governments is working with a consultant to prepare recommenda-
tions for the City Council to alleviate parking problems in the
downtown area.
This, of course, will not offer any immediate relief for your
problem. The parking scheme which you suggest - to have nonresident
cars park in ramps - would not be practical in Iowa City with the
limited space in the ramps and with the many out -of -county and
out-of-state cars belonging to students.
As you may know, it is the responsibility of the property owner to
provide parking for tenants. You may wish to contact your landlord
with your problem.

I understand from an article in a recent issue of The Press
Citizen that the City Council is still considering an ordinance
concerning the proliferation of newspaper dispensing machines.
I would like to take this opportunity to urge the members of
the Council to stop this proliferation.
As you know, the Iowa City/Johnson County Arts Council rents a
suite on the lower level of the Jefferson Building at 129 E.
Washington. We have access to one window on the right of the
entrance door to the building for displaying our posters and
publicizing our events. Currently several newspaper dispensers
block half of our window, effectively limiting the little
space available to us for publicity. At this time, the Arts
Council is doing everything possible within our limited budget
to increase our visibility within the community. Not only
are the machines unsightly, but they are severely limiting
our ability to publicize our activities. We would like to
see the machines removed and we urge the City Council to pass
an ordinance limiting not only the number but the placement of
these machines.
I appreciate your conveying this communication to the members of
the Council. If I can speak effectively for such an ordinance,
please let me know.

At its regular meeting of September 25, 1984, the City Council received
and placed on file your letter concerning commuter service between Iowa
City and Cedar Rapids and, more specifically, the proposal of Charter
Coaches. The City of Iowa City has not denied Charter Coaches the oppor-
tunity to begin commuter service. Their use of the downtown transit inter-
change has been denied and we have suggested that they contact the bus
terminal to make arrangements for this service. The decision to deny
the use of the downtown transit interchange was based on the fact that
the Iowa City Transit plans to expand the bus service. With Iowa City,
Cambus, and Coralville buses converging on the downtown interchange,
there is no room for the addition of another bus line. Taxicab companies
have in the past requested space at this same location and were denied
for the same reason.

an arrangement for convenient travel to Iowa City.

Per the transfer of ownership between Heritage Cablevision and the
City of Iowa City, Heritage Cablevision requests a rate review to
allow a $.40 increase on our basic monthly service rate from $8.90
to $9.30.
On a separate sheet, you will find a Franchise Fee Increase analysis.
As you can see, the application is relatively simple (rate increase
vs. outgoing cash). It should be noted that franchise fees also
apply to all other revenue obtained from operating the franchise
including installation revenue. These other revenues are included
in this analysis.
Also, Federal Copyright Fees have been considered because they are
assessed against our basic service revenues. As a result, any
Increase in basic rates means an increase in copyright fees.
Because this increase will be channeled back into the various access
programs which benefit all the communities we serve, our analysis
represents the entire service area.
As you are concerned, Heritage also is concerned with the preservation
of local community programming, so this increase does not come
without its own merit. Heritage Cablevision, during this time of
change, remains committed to local programming and supportive in
every way.

Dear Council Members:
I am writing to you because of my concern about the traffic
situation at the intersection of Mormon Trek Road and Melrose Avenue
in the hope that some action can be taken to reduce the hazardous
conditions there. Through a recent conversation with John Lundell
in the Iowa City Planning Department I've learned that the Transporta-
tion Department has done a study of this intersection and that certain
recommendations have been proposed.
In addition to the recommendations to widen the intersection to
two lanes in each direction, which should be of the highest priority,
I would also recommend that a warning sign, preferably with a flashing
light, be installed at the top of the hill on Mormon Trek Road for
northbound traffic approaching the signal. That hill becomes perilously
icy and,due to thedirection in which it declines, freezes up easily
and does not receive sunlight to melt it until well after other portions
of the surrounding roads have become safely passable. The warning sign,
or light, would not be very expensive and can be in place before winter.
The city is to be commended for undertaking the much-needed study
of this intersection which I am told is the ninth most dangerous inter-
section in the city and at which 80 accidents (I'm not surprised) have
occurred in the past three years. Since the study was done in July
when West high was not in session (I understand the city had to meet
a deadline for a report to the University) perhaps a follow-up study
can be done now that school is in session. West Nigh School students
may even be interested in helping.

At its regular meeting of September 25, the City Council received and
placed on file your letter of September 10 regarding the traffic
situation at the intersection of Melrose and Mormon Trek. Traffic
Engineering crews will soon be erecting a warning sign on'Mormon Trek
Boulevard south of the intersection. This sign will warn of a traffic
signal ahead.
I have spoken with the Superintendent of Streets and he reports that his
crews do consider this north facing hill a number one priority in their
frost patrol. This means that the City sanding crews do consider this
to be one of the first locations for the application of sand and salt
when called upon in frost conditions. Hopefully this attention will
reduce the amounts of weather-related accidents at this intersection.

At its regular meeting of September 25, 1984, the City Council received
and placed on file the petition regarding the alley south of Rochester
Avenue and north of Hotz Avenue. The Public Works Department has included
this alley in Iowa City's Capital Improvements Program for paving improve-
ment by special assessment after July 1985. The City Council will review
the Capital Improvements Program this fall prior to adoption of the FY86
budget early in 1985.
Alley paving is financed by special assessment because it is the function
of alleys to provide additional access to the abutting properties. There-
fore, even though other persons may use the alleys, the benefits derived
from paving an alley are realized mainly by the property owners.
This reply is being sent to you as the first signer of the petition.

who believe a downtown site, near campus, for a new liquor
store,is not appropriate.
As you know, a representative of the State Board of
Liquor Control held a hearing last week concerning the
location of a new liquor store in Iowa City. This rep-
resentative summarized the hearing as follows: "I ... know
that some of the opponents of the downtown liquor store
are here, in the majority, and by taking this back to
the Board I don't know that I am taking something back
which represents the majority of Iowa City citizens."
She advised those attending the hearing to address our
"local governing body".
The Board decided as long ago as 1978 to place a new
liquor store in downtown Iowa City. They believe they
have a mandate to do so, on the basis of a letter dated
February 6, 1978, from Robert Vevera, then Mayor of
Iowa City:
"The City Council of Iowa City supports the Commission's
proposal to locate a liquor store in downtown Iowa
City.... The Beer and Liquor Control Department is to
be complimented for sound future Manning."
In contrast to what occurred in 1978, we believe that
now the City Council should change its public stance in
regard to this issue.
In 1983 alone, there were over 1000 arrests in Iowa City
for public intoxication, liquor law violations and drunk
driving. The Johnson County Sheriff's Department records
that X2,172 days were spent in jail by people prosecuted
for drunk driving; that is an average of five persons
per day in jail for drunk driving. Our police spent
$3300 in the same year, just to transport individuals
arrested for violations due to intoxication.
The volume of wine and spirits sold in Iowa City is the second
largest in the State of Iowa. There is no question that these
statistics relate to our population of University students.
And there is no question that a downtown liquor store,near
campus, will both increase sales of liquor to college

students and augment the already dramatically increasing
nuisance of public intoxication in Iowa City.
There is widespread opposition to a downtown liquor st ore.
The staff of the Iowa City Press -Citizen wrote an editorial
opposing a downtown location, which appeared on Monday,
September 24, 1984. A spokesman from the Iowa City ecu-
menical council of churches also issued a statement op-
posing the new site. As one Iowa Citlan said at last
week's hearing, "The last thing we need in downtown
Iowa City is more liquor."
We ask the City Council to write a new letter to the
State Board of Liquor Control, opposing the downtown site.

Our Opinion
It's the wrong place
but the right time
Anyone who has ever tried to buy a bottle of wine before a
a holiday or a football game — and stood in a line that
backed up all the way down the aisle — can testify that Iowa
City needs another liquor store.
But the occasional crowds and the irritation of standing in
long lines is only part of the problem. The present location is
also inconvenient for too many people. People living in far
northeast and westside neighborhoods, for example, have to
drive an inordinately long way for a bottle of liquor.
One liquor store in Iowa City and one in Coralville can-
not possibly serve a community of nearly 70,000. The existing
volume of business should be spread among more stores at
more locations so supply meets demand.
The Iowa Beer and Liquor Control Department is currrent-
ly considering 11 cities, including Iowa City, as possible sites
for six new mini liquor stores.
Iowa City needs another store. But all five sites under con-
sideration are in the downtown area. And downtown is not
the right place for a new liquor store.
With the exception of the Old Capitol site, none of the pro-
posed locations has adequate parking facilities. A store with
little or no parking usually means traffic problems — cars
"standing" by the curb or circling the block while friends
make a purchase.
In addition to traffic problems, a liquor store close to the
university presents another serious problem.
Those who support a downtown location argue that under-
age college students who want to drink are going to do it
anyway, and that their older friends can already walk to
downtown convenience stores and buy them beer.
That's true. But campus arrests for drunken driving, pub -
He intoxication, liquor law violations or disorderly conduct
have been Increasing. In 1982, 21 people were arrested on
campus for alcohol-related crimes. By 1983, the number had
more than doubled — hitting 49.
A mini liquor store within walking distance of the dorms
will certainly make it easier for underage students to get
hard liquor.
Given the disadvantages of a downtown location, the Iowa
Beer and Liquor Control Department should consider locat-
ing the mini store elsewhere in Iowa City — in a heavily
traveled part of town where the store Is more accessible to
more people, like in Towncrest or on Riverside Drive.
The state's principle interest in building the new mini li-
quor stores centers on the revenue they will generate. And
'the Iowa City store promises to be financially successful.
Last fiscal year, Iowa City's liquor store had the second-
highest sales in the state.
An alternate location would serve both the city and the

TO THE FOLLOWING COMMISSION:
RESOURCES CONSERVATION COMMISSION
Four vacancies - Three-year terms
January 1, 1985 - January 1, 1988
The duties of members of the Resources Conserva-
tion Commission include serving as an advisory
body to the City Council of Iowa City. They
shall research, review, and recommend policies,
rules, regulations, ordinances, and budgets re-
lating to matters of energy and resource conser-
vation and provide recommendations and reports
to the City Council on the activities of the Com-
mission. The Commission shall exercise broad
responsibility for development of resource con-
servation policies and shall pay special atten-
tion to long-range planning and programming. The
Commission shall, for the public welfare, make
recommendations on energy matters. These recom-
mendations may relate to local governmental and
quasi -public agencies, private residences and
investment properties, and office, commercial
and industrial properties.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City. The persons appointed to this Commission
shall be, by training, education, experience, or
demonstrated interest, knowledgeable in matters
pertaining to energy use and conservation.
These appointments will be made at the September
25, 1984, meeting of the City Council at 7:30 P.M.
in the Council Chambers. The actual terms will
begin January 1, 1985. Persons interested in
being considered for these positions should contact
the City Clerk, Civic Center, 410 East Washington.
