AGREEMENTS: The utility company,corporation,applicant, permit holder or licensee, (hereinafter referred to as the permit holder)
agrees that the following stipulations shall govern under this permit.
1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations,
regulations and directives of the Iowa State Commerce Commission, Utilities Division, the Iowa State Department of Health, all rules
and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holder shall be fully responsible for any future adjustmems of its facilities within the established highway right of way
caused by highway construction or maintenance operations.
4. The Iowa Department of Transportation shallgive thepermit holderat least 48 hours written notice of anyproposed construction
or maintenance work, on eitherexisting or newlyaequired right-of-way, that is likely to conflict with the installation belonging to the
;+ Hermit holder in order that the permit holder may arrange to protect its facilities.
'+ 5. The State of Iowa and the Iowa Department of Transportationassume no responsibility for damages to the permit hoider's
property occasioned by any construction or maintenance operations on said highway.
6. The permit holder shall take all reasonable preca ution during t he construction and maintenance of said installations to protect and
safeguard the lives and property of the traveling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall be made in writing to the Engineer whose name is shown below.
B. The permit holder agrees toat all times give the Iowa Department of Transportation timely notice of intention to perform routine
• maintenance within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious rcprd to
the safety or the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department or Transportation
Manual on Uniform Traffic Control Devices for Streets and Highways.
Flagging operations are the responsibilitycif the permit holder. The original placement otsigns and removal on completion orthe
work shall be accomplished by the permit holder.
10. Operations in the construction and maintenance of said utility installation shall be carried on in such a manner as to cause
minimum of interference to or distraction of traffic on said highway. /

11. The permit holder shall be resp. ible for any damage that may result to said h,tshway because oft he construction operation', or.
maintenance of said utility, and shall reimburse the State of Iowa or the Iowa Department of Transportation any expenditure that fhe
State of Iowa or the Iowa Department of Transportation may have to make on said highway because of said Permit Holder's s utility
having been constructed, operated, and maintained thereon.
12. The permit holder shall idcmnify and save harmless the State of Iowa. and the Iowa Department of Transportation from any and
all causes of action, suits of law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of
whatsoever nature for, on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, reprcsenta-
t lives,contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public highway under
t this permit.
13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be
considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is
assured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of noncomplying
construction will be assessed against the permit holder.
14. A copy of the approved permit shall be available on thejob site at all times for examination by Department of Transportation
officials.
15. This permit shall terminate 20 years from data ofapproval for gas and water mains outside the corporate limits of a municipality
in accordance with the Code of Iowa. Chapter 320. Renewal may be requested.

Re: Proposed Amendment to the City Plaza Ordinance
Included in the City Council agenda is a motion to set a public hearing on
October 23 to consider changing the boundaries of City Plaza.
The first change is the deletion of a portion of the former City Plaza which
is now included as part of Urban Renewal Parcel 64-1b, the hotel. Because
this property is now privately owned, it should be deleted from the ordi-
nance. This amendment will change the southern -most boundary to the south
property line of the Governor Lucas Square.
The second proposed change to the ordinance is the inclusion of Urban Renewal
Parcel 65-2a which is Blackhawk Minipark minus the small corner area which
the Council has indicated it wishes_ to have marketed for development pur-
poses. The addition of the remaining portion of Blackhawk Minipark to the
City Plaza will mean that the City may offer vending and other special event
permits for that area utilizing the same criteria it does for the City Plaza.
However, the Council may choose to exempt this area from vending if it
desires. More importantly, defining this area as a portion of City Plaza
means that it will now be a public right-of-way, with access to and from
adjacent properties onto the City Plaza allowed without the necessity to
execute an easement. In other words, if the Paul -Helen Building owners or
Dain -Bosworth building owners wished to have a pedestrian access from their
building into the Blackhawk Minipark (which would then be City Plaza), they
could do so without having to execute any kind of legal agreement with the
City. This right would also extend to whomever owns Urban Renewal Parcel
65-2b, the parcel to be marketed.

Dear Mayor McDonald and Members of the Council:
The purpose of this letter is to submit my resignation as
ember 31, 1984. It has indeed been a
City Attorney effective Dec
privilege to have served the Council, the City Manager, and the
staff for the past three years.
This decision has not been arrived at lightly. The
retirement of my former law partner in January of this year has
greatly increased my private practice load since I am
representing many of his clients. In addition, I entered into a
new law partnership with Mr. Larry Lynch in January and both of
these factors have greatly increased my private practice
responsibilities these past months. These responsibilities have
made it increasingly more difficult for me to find sufficient
time to represent both the City and my private clients.
I wish to assure the Council that in the event my successor
is not chosen by December 31st, I shall continue to serve until
the new Ci.ty Attorney is appointed.
Once again, I wish to thank the Council and the City
Administration for the many courtesies that: have been extended to
me over the past three years and I will certainly be pleased to
work with my successor to ease his or her transition into this
posi.ti.on.

Dear Mr. McDonald:
I regret to inform you that I will be unable to complete my term
as a member of the Iowa City Housing Commission. Because there
has been some difficulty in achieving a quorum for both routine
and Appeals Board meetings, the chairman of the Housing Commission
has set a permanent time for all subsequent meetings --Tuesday at 8:30 am.
It will be difficult, if not impossible for me to adapt my clinic/conference/
teaching schedule to this meeting time, and I would be able to attend
meetings only on a sporadic basis. At the time of my appointment
it was my understanding that meetings would be scheduled to avoid conflict
with routine work schedules, and it was my hope that the meetings could
be held in the late afternoon or evenings as they are for the majority
of city volunteer commissions.
I'have enjoyed my work on the Housing Commission and appreciate the
opportunity to be peripherally involved in city government. It
is my hope that I will be able to serve on another city commission
in the future.

Avenue and Bradford. The Traffic Engineer conducted a traffic count
at this intersection this fall and has recommended that signalization
be installed. This project has been recommended for inclusion in the
"high priority" list of Capital Improvement Projects for fiscal year
1986. The City Council will make a final decision before the budget
is approved early in 1985.

Dear Mayor and Councilmen:
This is to advise you of the department's intention to revise the route
number of several highways under Department of Transportation jurisdiction
in your area.
We currently anticipate completion and opening of the relocation of U.S. 218
around the west side of Iowa City late this fall. As a part of this project,
U.S. 218 will be removed from its present location and placed on the new
freeway location from south of the Iowa City airport to the junction of
I-380 and I-80. U.S. 218 will then be routed north on I-380 to its
junction with U.S. 30 in Cedar Rapids and will follow U.S. 30 from this
interchange into Benton County as it currently does. At the present time
we anticipate implementing the change north of I-80 during the next several
weeks and implementing the change south of I-80 at the time the U.S. 218
relocation opens to traffic.
The present route of U.S. 218 will become an unmarked primary highway.
This means it will remain under the jurisdiction of the Department of
Transportation but there will be no route markings along the roadway.
The level of maintenance service (i.e. snow and ice control, etc.) will not
change. Also note that the designation of U.S. 6 in Iowa City and Coralville
will be unaffected by this change.
In an effort to fully advise the public concerning this change we will be
conducting a public information meeting at 7:00 P.M. October 2, 1984 in
the community room of the North Liberty Volunteer Fire Department station
at 25 West Cherry Street in North Liberty. You are cordially invited to
attend this meeting and to comment on this proposal.

First, for myself and on behalf of B.I.C. I want to thank the City Council for your
recent decision regarding bicycle lanes in Iowa City.
In discussing bikeways with fellow bicyclists in B.I.C. the Iowa City Comprehensive
Bikeways Plan was mentioned. We came to the conclusion that the plan is badly out-
dated. Indeed, the representative from B.I.C. who had worked with Project Green and
others involved in the project informed me that he had attempted to discourage bike
lanes from being installed in the beginning. As a result of that discussion, I spoke
with Jeff Davidson (Assistant Transportation Planner) about the possibility of up-
dating the Bikeways Plan. He informed me that it is a project which The Johnson
County Council of Governments (JCCOG) would probably enthusiastically support.
Thus, I am formally asking that the Plan be updated. I offer my assistance and would
encourage the input of other interested individuals and B.I.C. members in making the
Bikeways Plan one that could be used to help minimize motorist/bicyclist conflicts
in the Johnson County area.

and placed on file your letter concerning the screening of the parking
lot at Mercy Hospit4l. The City Council has adopted an ordinance
which will allow Mercy Hospital to apply for a special exception for
screening. This ordinance provides for more flexibility in the screen-
ing requirements for parking areas which are not adjacent to single
family homes. This exception, of course, will be available to anyone
who can demonstrate that it would be in the public interest, either for
safety or aesthetic reasons, to use a different type of screening.

Because the annual meeting of our church's ruling body tonight is to
adopt a budget for 1985, I cannot attend the hearing concerning down-
town location of another Iowa City Liquor Store.
Please let me convey to you by letter what I would like to say
at the hearing:
1. I believe that the reason the Liquor Commission is proposing
another outlet here is to increase sales so as to get more liquor tax.
Up to a point, the more available liquor becomes, the more is sold.
2. Will Iowa City be better off if more liquor is consumed,
particularly by our university students? Will higher liquor consump-
tion mean necessity for less police protection, less room at the jail,
fewer driving accidents?
3. I would like to remind the Liquor Commission that the laud-
able purpose of controlling the liquor traffic has been, through the
years, the reason for the state's being "in the liquor business."
That purpose I affirm as good and wise under the circumstances. But
now it appears that their purpose is changing to "sell all the liquor
you can so as to rake in all the tax you can."
If it is a part of proceedings tonight that statements are read,
please include the above. If ynu are counting "pros" and "cons,"
please include my "con." If this statement goes no further than
yourself, that is okay. Thank you for your kind consideration.

Dear Sir:
I am writing to seriously urge you to NOT put a liquor store in downtown
Iowa City. With the rise of alcohol abuse in this country among our youth,
please, can't we avoid making it even more accessable? Why should we make
it easier for 30,000 potential drinkers in the student population to get
a quick bottle within minutes from their dorms?
Two years ago, my 28 year old brother and his 6 year old son were hit by a
20 year old 3rd offense drunk driver. No one can know the pain we have suf-
fered from what that young man has done to our family. My brother can no
longer walk without crutches, and our beautiful nephew who was once a bright
student and talented artist has suffered permanent brain damage. He now
has to attend state supported special education classes for the learning dis-
abled. Why do we continue to make it so easy to drink and drive? Is it so
the state can make more money to take care of the invalids we create?
Oh, please consider carefully this decission. Are we really providing a
service to these students? Surely there are better places for this liquor
store than in downtown Iowa City.

ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the extension of the NO PARKING HERE TO
CORNER zone on the west side of Morningside Drive north of Court Street.
This extension will move the current zone north 20 feet. This action will
take place on or shortly after October 3, 1984.
COMMENT:
This action will extend an existing NO PARKING HERE TO CORNER zone. The
extension is being made to facilitate the turning movements of school
buses turning to City High School. When the action is complete the total
length of the zone will be 50 feet.

As directed by Section 23-16 of the Municipal Code of Iowa City, this is to
advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the extension of the NO PARKING ANYTIME south
from its current southerly terminus (approximately 300 feet south of
Burlington Street) southerly another 150 feet. This action will take place
on or shortly after 21 September 1984.
COMMENT:
Currently the NO PARKING ANYTIME prohibition extends from Burlington south
along the portion of South Van Buren that is 18 feet wide. The proposed
additional NO PARKING ANYTIME would extend the prohibition south to a curve
area of transition from 18 foot wide to 25 foot wide paving. The proposed
prohibition will remove an additional five parking stalls from the street.
The removal will occur in an area of driveways which feed high density
residential rental units on the west side of Van Buren Street and commercial
enterprise on the east side. The proposed extension of NO PARKING ANYTIME
will improve the traffic flow through this area of transition.

The duties of the members of the Human Rights
Commission are to provide for the general
welfare of the citizens of Iowa City by study-
ing the relationships of people of various
races, colors, creeds, religions, nationali-
ties, sexes, and ancestries living within the
community. To provide procedures for the
operation of said Commission to eliminate pre-
judice, intolerance, bigotry and discrimination
in the City of Iowa City, Iowa, by declaring
discriminatory practices in the areas of public
accommodations, employment and the leasing,
sale, financing or showing of real property
to be against public policy and to provide
procedures for the investigation of complaints
and conciliation and to provide for enforcement.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of
Iowa City.
These appointments will be made at the October 9,

Duties: In appropriate cases and subject to
appropriate conditions and safeguards, make
special exceptions to the terms of the ordi-
nances in harmony with general purpose and
intent and in accordance with general or spec-

The duties of members of the Senior Center
Commission are to:
1. Serve in an advisory role to the City
Council with regard to needs of the senior
center.
2. Make recommendations with regard to poli-
cies and programs at the senior center.

seeking adequate financial resources for
the operation of the senior center.
4. Encourage full participation by senior
citizens in the programs of the senior center.

Re: Regulations of Activities along the Iowa River
As a result of the City Attorney's legal opinion (August 16, 1984) which con-
cluded that the existing City ordinance for authorizing water shows/exhibitions
on the Iowa River is irreconcilable with state law, the City Manager requested
that the Riverfront Commission outline, as a recommendation to the City Council,
exactly what the Commission would like to regulate along the Iowa River. This
topic was discussed at the Commission's regular meeting on September 5 and the
following recommendations to the City Council were unanimously passed:
1. That regulations concerning the Iowa River presently contained in Chapter 24
of the Iowa City City Code, with the exception of Section 24-84, be submitted
by the Iowa City City Council to the Iowa Conservation Commission for
adoption as special rules for the Iowa River.
2. That local State Legislators be apprised of the problems in having the Iowa
Conservation Commission responsible for regulating activities on the Iowa
River within the municipal boundaries and be requested to initiate changes in
State statutes to allow Iowa, City and Coralville to regulate recreational
activities on the Iowa River within their corporate limits.
The Riverfront Commission believes that special conditions exist along the Iowa
River within the Iowa City and Coralville boundaries which justify imposing
separate rules and allowing local control along this stretch. These conditions
include:
The high concentration of persons who use the River in a passive way (e.g.,
rafting, canoeing, fishing). This is attributable both to the several City
parks adjacent to the River and to the route of the River through the
University of Iowa campus.
2. The presence within this area of two dams, which present safety hazards on
the River and require strict regulations of activities in their vicinity.
The already increased tendency for riverbank erosion due to frequent fluctua-
tions in outflow from the Coralville Reservoir Dam.
Because of these conditions, the Riverfront Commission agreed that the regula-
tions presently listed in Chapter 24 of the City Code should be continued. The
only section the Commission felt should be deleted is Sec. 24-84, which would
allow water shows/exhibitions by special authorization. The Commissioners felt
that these uses conflicted with the more prevalent and appropriate passive river
activities,contributed to riverbank erosion and, therefore, should not be allowed
at all, especially in view of the close proximity of the Coralville reservoir
where such exhibitions can take place.
