ORDINANCE NO. 84-3207
ORDINANCE AMENDING SECTION 36-58(e),
SCREENING REQUIREMENTS, OF THE ZONING
ORDINANCE OF IOWA CITY, IOWA.
SECTION I. PURPOSE. The purpose of this
amendment is to provide some flexibility
in the enforcement of off-street parking
screening requirements in those cases
where the public interest is better served
by some modified approach to screening.
SECTION II. AMENDMENT. Section 36-58(e)
of the Zoning Ordinance "screening
requirements" is hereby amended by adding
the following paragraph:
(4) The Board of Adjustment may grant
a special exception to modify the
screening requirements when a parking
area requires screening as provided in
subparagraphs (1) and (2) above, when
neither the lot on which the parking
area is located and the lot abutting
or across the street are zoned RS.
The special exception shall be subject
to all the requirements of Section
36-91(g) and may only be granted when
the applicant can demonstrate that
modification of screening requirements
would better serve the public interest
than would strict compliance with said
requirements. Public interest may
include but is not limited to reasons
of public safety or aesthetics. In no
case shall a special exception be
granted to modify the screening
requirements for a lot abutting or
across the street from a lot in an RS
zone.
SECTION III. REPEALER. All ordinances
and pars o or finances in conflict with
the provision of this ordinance are hereby
repealed.
SECTION IV. SEVERABILITY. If any
section, provision or part of the Ordi-
nance shall be adjudged to be invalid or
unconstitutional, such adjudication shall
not affect the validity of the Ordinance
as a whole or any section, provision or
part thereof not adjudged invalid or
unconstitutional.

Moved by Zuber, seconded by Strait, that the rule requiring ordinances
to be considered and voted on for passage at two Council meetings prior
to the meeting at which it is to be finally passed be suspended, the
first and second consideration and vote be waived and the ordinance be
voted upon for final passage at this time.
Ayes: Baker, Ambrisco, Dickson, Erdahl, McDonald, Strait, Zuber.
