(1) Set public hearing for December 4, 1984, on an Ordi- nance to correct the legal description in Ordinance No. 83-3144, vacating a portion of alley right-of-way in Block 9 of County Seat Addition. (Behind 522 S. Dubuque St.) Comment: Title examiner has raised questions as to the validity of previous actions regarding this vacation and disposition, so a corrected ordinance and disposal resolution must go through the public hearing process. Copies of the proposed ordinance and resolution will be included in your packet for December 4. (2) Set a public hearing- on December 4, 1984, on the _ disposition of the'vacated alley right-of-way in Block 9, County Seat Addition. Comment: See comment above. (3) Set a public hearing on December 4, 1984, on a Policy and Level of Service for Snow and Ice Removal. Comment: See attached memorandum from the City Manager. (4) Consider setting a public hearing for December 4, 1984, on a proposed program description and application for rental rehabilitation grant funds. Comment: The City has been advised by the U.S. Department of Housing and Urban Development (HUD) that Iowa City is eligible to apply for a formula allocation of $70,000 through HUD's Rental Rehabilitation Grant Program. Due to a short notice with HUD's fiscal year allocation of grant funds, the City must submit its application to HUD by December 17, 1984. The program description will be forwarded to the City Council in advance of the public hearing on December 4. A resolution authorizing the filing of a CDBG Statement for 1985 is included in this agenda (Item No. 12). It is recommended that $100,000 be allocated for Goodwill Industries. (2) Letter from Scott Barker, Chairman of the Board of Adjustment, regarding the special exception for property at 5 Sturgis Corner Drive. This information was requested by the Council. (3) Letter from Scott Barker regarding the work of the Board of Adjustment and City staff. f. Application for the Use of Streets and Public Grounds. (1) Application from Timothy Ganske for permission to picket in front of the Emma Goldman Clinic on November 17, 1984. ConsiderT etting a public hearing for December 4, 1984, on a Planned Development Housing Plan for Ty'n Cae, Part 4. (S-8424) Comment: The Planning and Zoning Commission, at its August 19, 1984, meeting, recommended by a 5-0 vote approval of the Planned Development Housing Plan for Ty'n Cae, Part 4. This plan amends the Planned Development Housing Plan for Ty'n Cae, Part 3. This recommendation is consistent with that of the staff. The staff report will be provided to the Council prior to the public hearing. Action: Agenda Regular Council Meeting November 20, 1984 - 7:30 P.M. Page 4 �I 30 b. Consider a resolution approving the final plat of Deer Hill Subdivision. (S-8427) Comment: The Planning and Zoning Commission recommended by a vote of 4-0 at its November 1, 1984, meeting, that the final plat of Deer Hill Subdivision, located east of Highway 218 and one-half mile north of the Butler Bridge in Johnson County, be approved. This recommendation is consistent with that of the staff included in a report dated October 4, 1984. Action:�/�i c. Consider a corrective ordinance to vacate a portion of the Grove Street right-of-way (V-8404). (first consideration) Comment: At its October 18, 1984, meeting, the Planning and Zoning Commission recommended by a vote of 6-0 approval of a corrective ordinance to vacate a portion of Grove Street west of Ferson Street. The ordinance corrects a discrepancy in the width of right-of-way on the original vacation. This corrective action is necessary to enable proper disposal of Action: 'the property. Consider an ordinance to rezone 6.3 acres south of West from I-1 to CI -1 (Z-8418). (first considerati 7 Comment: The Planning and Zoning Commission recommended by a vote of 5-0 approval of the request from Mary Hartwig Inc. to rezone 6.3 acres south of Highway 1 West and north of the Iowa City Airport form I-1 to CI -1. A public hearing was held on November 6, 1984; no comments were received. The applicant has requested a waiver of the readings and a vote for final passage at this time. Page 5 Consider a resolution approving the preliminary plat for the Ruppert Subdivision and a preliminary Large Scale Non - Residential Development (LSNRD) plan for the MHI Auto Center, located south of Highway 1 West and north of the Iowa City Airport (S -8429a). Comment: The Planning and Zoning Commission has recommended by a 6-0 vote that the preliminary plat of the Ruppert Subdivision and the preliminary LSNRD for the MHI Auto Center be approved with a waiver .of preliminary plat requirements for all except Lot 1 of the tract, and a waiver of sidewalk requirements, and subject to rezoning of the property to CI -1 and the resolution of the frontage road issue. This recommendation is consistent with that of the staff included in a report dated October 15, 1984. A letter has been sent to the Iowa Department of Transportation indicating acceptance by the City of vacated right-of-way to enable the construction of a frontage road for this develop- ment. Consideration of this resolution is dependent upon the waiver of readings and vote for final passage on the rezoning of the property, as stated above. Action: I �z/,l �ueaJ ITEM NO. 5 - PUBLIC HEARING ON AN ORDINANCE AMENDING SECTIONS 15-48 AND 15-62(A)'OF THE CITY CODE OF ORDINANCES, RELATING TO REFUSE COLLECTION. Page 6 ITEM NO. 6 - CONSIDER AN ORDINANCE AMENDING SECTIONS 15-48 AND 15-62(A) OF THE CITY CODE OF ORDINANCES, RELATING TO REFUSE COLLECTION, TO LIMIT PLACEMENT- OF REFUSE CONTAINERS IN FRONT OF BUILDINGS AND TO CLARIFY THAT ONLY COMBINATIONS OF FOUR OR FEWER DWELLING UNITS WILL RECEIVE REFUSE PICKUP SERVICE. (first considera- tion) Comment: The purpose of this Ordinance is to prohibit commer- cial solid waste containers (e.g., dumpsters) in 'front of buildings, and to clarify the City's refuse collection require- ments to provide that the City's residential refuse collection service will only be provided to aggregations containing four or fewer dwelling units. The Public Works memo dated October 22, 1984, and a copy of the proposed ordinance are attached to this agenda. Page 8 ITEM NO. 11 - RECOMMENDATIONS OF BOARDS AND COMMISSIONS. ITEM NO. 12 - Action: ITEM NO. 13 - a. Consider recommendations of the Urban Environment Ad Hoc Committee that the Urban Environment Policies be adopted as an amendment to the Iowa City Comprehensive Plan. These policies are scheduled for discussion at the informal meeting on November 19. A memorandum concerning this matter is furnished' in the information packet. /it�D/C�itii+uG u CONSIDER A RESOLUTION AUTHORIZING FILING OF A COMMUNITY DEVELOP- MENT BLOCK GRANT PROGRAM STATEMENT FOR 1985 IN THE AMOUNT OF $736,000 UNDER THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED, INCLUDING ALL UNDERSTANDINGS AND ASSURANCES• CONTAINED THEREIN AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE GRANT. Comment: The City Council held a public hearing on the proposed Program Statement on November 6, 1984, and considered citizen comments in. the final Community Development Block Grant fund allocation for 1985. A summary description and comments for requests received by CCN and a "project resource book" were included in the November 6, 184, Council agenda packet. Passage of this resolution will permit filing of the program statement with the Department of Housing and Urban Development. Minutes of the October 23 meeting of CCN, in which CCN's recommendations for allocation of CDBG funds are listed, are on the consent calendar of this agenda. CONSIDER RESOLUTION GRANTING CABLEVISION ASSOCIATES VII D/B/A HERITAGE CABLEVISION, INC., A RATE INCREASE OF FORTY CENTS PER MONTH. Comment: This resolution approves the 40 -cent per month basic rate increase requested by Heritage Cablevision subject to an increase in the franchise fee to five percent. The Broadband Telecommunications Commission (BTC) has recommended that this increase be granted. A public hearing was held on November 6, 1984. No objections to this rate increase were voiced at that time. Page 9 ITEM NO. 14 - CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF THE FIFTH AMENDMENT TO THE CONTRACT FOR TECHNICAL SERVICES FOR THE CITY -UNIVERSITY URBAN RENEWAL PROJECT I (IOWA R-14) BETWEEN THE CITY OF IOWA CITY AND ZUCHELLI, HUNTER & ASSOCIATES, INC. Comment: This resolution authorizes the continued services of Zuchelli, Hunter & Associates, Inc., for technical services for the development of Urban Renewal Parcel 64-1A, immediately east of the Iowa City Holiday Inn. This resolution incorporates the scope of services previously informally approved by the City Council. (second consideration) Comment: This ordinance will change the City Plaza Ordinance (Chapter 9.1 of the Code of Ordinances) by amending several of the boundaries of City Plaza. A portion of Urban Renewal Parcel 64-1b which is formerly the City Plaza will be deleted due to the development of the hotel and Urban Renewal Parcel 65-2a (the minipark minus the small corner parcel which will be marketed) is to be added to City Plaza.
