Dear Honorable Mayor and Councilpersons:
I hereby certify that the construction of the improvements listed below
have been completed in substantial accordance with the plans and specifi-
cations of the Engineering Division of the City of Iowa City. The
required maintenance bond is on file in the City Clerk's office.
Shamrock/Arbor Creek Channel Improvements Project as constructed
by Gee Grading & Excavating, Inc. of Cedar Rapids, Iowa.
I hereby recommend that the above mentioned improvements be accepted by
the City of Iowa City.

Re: Tax Abatement Ordinance
With adoption of a tax abatement ordinance as enabled by the Iowa Code, the
City Council will make available to all industrial real estate, as defined by
State law, a program under which a portion of the property taxes due on any
added value to a qualified property may be abated according to a schedule.
The schedule set forth in the Iowa Code is a five year time frame, with 75%
of the added value exempt from taxation in the first year, 60% in the second
year, 45% in the third year, 30% in the fourth year, and 15% in the fifth
year. In the sixth year, the full value of the property is taxed. The
Council may adopt an alternative schedule when adopting the ordinance setting
up the program. The Council has no discretion in the types of industrial
development the abatement program will apply to. Qualified real estate is
defined by the State statute and interpreted by the administrative rules of
the State Department of Revenue.
Once the ordinance is adopted, any new construction or expansion to indus-
trial real estate, any acquisition or improvement of machinery used in
manufacturing, and any qualifying warehouse or distribution center may apply
to the City Assessor for participation in the abatement program. These
applications will not come before the City Council. The City Assessor will
determine if the applicant's property qualifies and if the application meets
the deadlines of the Iowa Code. If all requirements are met, the assessor
must grant the exemption. Attached are the definitions of qualifying real
estate set forth in the Iowa Code and the administrative rules.
Applications which the City Council will review and act on by ordinance are
those from property owners requesting prior approval of eligibility for tax
exemption. A project is not assessed for the value adde uncalendar
year following the project's completion, and abatement cannot be applied for
until construction is complete. Prior approval gives an indication to the
property owner of the eligibility of the project for the abatement program.
Prior approval does not, entitle the property owner to an exemption until
construction of the project is completed and is found to be qualified real
estateby the City Assessor. Prior approval is required of a project which
involves the reconstruction of an existing building. Reconstruction must be
1) required due to economic obsolescence, 2) necessary to implement recog-
nized industry standards for the manufacturing and processing of specific
products, and 3) required to continue to competitively manufacture or process
specific products. Prior approval may be sought on new construction projects
before construction actually takes place. Again, the approval of the Council
does not guarantee an exemption at the time construction is completed and
application is made to the assessor. However, if the completed project
complies with the requirements of the State Code, the assessor must grant the

exemption. If the exemption on a prior approval project is rejected by the
assessor, the property owner may submit an amended proposal to the City
Council for approval or rejection. The amended proposal must receive final
approval from the City Assessor. Presumably, this revision would address the
use of the property and no physical changes to the completed project.
Essentially, the Council has limited latitude within this program. In
adopting the ordinance to set up the program, the Council may establish a
percentage schedule different from the five year plan set out in the Iowa
Code. Once the ordinance is adopted, the assessor working within the
constraints of the State law approves or disapproves all applications. The
Council may, however, repeal the tax abatement ordinance at any time it is
deemed to be no longer of benefit to the City.
The staff is prepared to draft an ordinance similar to those presented to the
Council in the November 19 information packet which incorporates the schedule
set forth in the Iowa Code. A hearing is scheduled to be set on December 4
for December 18; the first reading would occur January 8 and the vote for
final passage January 29, 1985. The state law requires that the ordinance
not be finally adopted in any less than 30 days from the date of the public
hearing.

New construction of industrial real estate and the acquisition of or improve-
ment to machinery and equipment assessed as real estate pursuant to Section
427A.1, (i.e. machinery used in manufacturing establishments), unless the
machinery or equipment is part of a normal replacement or operating process
to maintain or expand the existing operational status. New construction
means new buildings and structures and includes new buildings and structures
which are constructed as additions to existing buildings and structures. New
construction does not include reconstruction of an existing building or
structure which does not constitute complete replacement of an existing
building or structure or refitting of an existing building or structure,
unless the reconstruction of an existing building or structure is required.

The effect of this exemption on a $9 million building would be
a savings of around $600,000 over the five-year period.
C. Machiy And Equipment Taxes Have Been Reduced By 70 Percent.

the equipment. A company with $1,000,000 worch of equipment will
have taxes figured on a value of $300,000.
D. Open -Port Warehousing. Product shipped into an Iowa distribution
center and destined for out-of-state delivery is exempt from
taxation. The product may be repackaged and still be exempt from
taxation.
E. Personal Property Taxes Are Being Phased Out. Within the next
few years the personal property tax will be completely eliminated.
There is now a county rollback of around 75 percent and a statewide
exemption of $175,000. All personal property (inventory and
office equipment) is assessed at the value of raw materials or
acquisition cost.

consistent with the Tax Abatement Legislation as has been
approved by the Iowa State Legislature. The local
ordinance will provide a policy which is consistent with
local needs and opportunities for future development of our
economy and the community. The Property Tax Abatement
Policy will enable our community to be competitive In
efforts to attract future development, computable with the
long term plans and objectives of our community.
The Executive Committee voted unanimously to endorse the
establishment of a Tax Abatement Policy, and local enabling
legislation, which will make our community competitive In
economic development efforts. The Executive Committee takes
this action on behalf of the Board of Directors, and upon
recommendation of the Economic Development Committee.

Dear Mayor McDonald:
At the regular meeting held on November 14, 1984, the
board of directors of First Capitol Development, Inc.,
unanimously voted to support the adoption of a property tax
abatement ordinance to support industrial expansion in Iowa
City consistent with existing legislative guidelines.
The existing state guidelines Include new construction
for Industrial facilities, warehouses and distribution
centers. Approval of such an ordinance would bring Iowa
City to a position comparable with more than seventy Iowa
communities with existing ordinances and enable us to
share in stated state Initiatives to attract warehousing and
distribution centers to the state.
It should be emphasized that the proposed tax abatement
ordinance would not serve as a burden to the existing tax

I object to further large-scale development on or near
Melrose Lake for the following reasons:
1. Drainage. The water which leaves Melrose Lake goes
under the railroad tracks to the east and then passes through
my neighbor's yard and my property before reaching Brookland
Park. (My neighbor, M.L. Huit, and I each own a little more than
an acre of wooded land.) In recent years, the development of
numerous apartment complexes in the Melrose Lake area --with the
accompanying increase in roofs and paved areas --has resulted in
a substantial increase in water flow which in turn has caused
erosion in our backyards.
According to the legal advice I have received and my own
brief examination of Iowa case law, it appears that I would be
among the property owners who would be in a position to sue all
the Melrose Lake area developers who have contributed to the
problem as a group. I am certain that the City of Iowa City
would not wish to be responsible --legally or otherwise --for
further aggravating this situation. (For the applicable law,
see Braverman v. Eicher, 238 N.W.2nd 331.)
I also believe that it would be in the city's best interests
to avoid additional drainage problems in Brookland Park which
cannot absorb all the water it receives from Melrose Lake. City
crews are already unable to mow portions of the park after storms
because water is standing several inches deep in some places.
Persons walking through the park on their way across the railroad
tracks to Melrose Lake apartments make muddy paths.

2. Safety of school children. As the parent of two young
children, I --and others in the neighborhood --have expressed
concerns about the dangerous traffic situation on Greenwood
in front of Roosevelt elementary school. Cars going down the
Greenwood hill travel on a narrow, snaking road and have limited
visibility as they approach the crosswalk. On icy days or when
cars are speeding, the situation becomes especially dangerous.
(According to local historian Irving Weber who lives a block from
the school, an underpass was planned but never built.)
Additional buildings in the Melrose Lake area would
contribute significantly to this problem --especially at peak

traffic times in the morning when children are walking to
school. The city traffic engineer says that new apartment
units on the lake would mean several hundred more car trips
a day in an already congested area with narrow, winding,
hilly streets. Because of the location of the lake and the
railroad, almost all of the additional traffic would empty
onto Greenwood approximately fifty yards above the crosswalk.
3. The environment. Like most people who live in Iowa
City, I am concerned about the quality of my surroundings and
the preservation of natural beauty and wildlife to the extent
it is possible. I do not think development should mean the
wanton destruction of the more pleasant aspects of our city.
I am told there are apartment vacancies in the area now and
we are seeing signs of decreasing enrollments at the University
of Iowa. Unnecessary development not only ruins open areas
we enjoy, but also ultimately lowers property values in the
surrounding neighborhood.
The Melrose Lake area deserves particular attention because
it is an "environmentally sensitive" area and because, according
to a recent city report as I understand it, our neighborhood
has been found to be 11.26 acres deficient in park and open
spaces by national standards.
The former owner of my house, who moved outside the city
largely because he was upset by over -development in the area,
listed over 150 species of birds which he had seen in the
vicinity. In the summer of this year, I attempted to use a
humane trap to catch two woodchucks who were invading our
gardens. I caught six raccoons, six opossums, and other animals
which I delivered to the animal shelter. This little pocket
of nature --from Brookland Park through my backyard to the lake --
is one that people enjoy very much. This might be characterized
as an emotional concern, but it is one which is deeply felt.
As a modest petition effort on a Sunday afternoon several
weeks ago demonstrated, public opposition to further large-scale
developments could not be more apparent. People in the area
have begun to meet to discuss the issue. I join my neighbors
in opposing unnecessary development that would further damage
adjoining private property, make unsafe traffic conditions more
unsafe, and remove one more scenic bit of land from our
immediate environment.

I am writing to express my concern in regard to the justification
given by the Board of Adjustment for the decision to reduce the
front yard requirements for the lot on the corner of Sturgis Drive
and South Riverside Drive. I am especially concerned about the
position taken by the Board as stated in Mr Scott Harkens letter
to Mayor John McDonald dated October 30, 1984 in which the following
sentence appears.
"If the applicant meets all of the required standards, the City
Attorney has advised us that the board must grant the special
exception."
I am told that the use of "must'$ in the above statement derives from
the fact that special exceptions are regarded as a "right".
I should like to point out that the citizens of the City of Iowa City
and other cities in the State of Iowa also have a right to organize
and enforce zoning ordinances.
In any case in which two rights conflict then there has to be
some balance achieved.
It is my great concern that on this matter the granting of rights
has been tilted markedly toward the applicant for special exception
by the position of the City Attorney.
I further ask the question in this situation: Who does champion the
rights of the citizens of Iowa City in the somewhat adversarial conduct
of a hearing before the Board of Adjustment? There is no evidence
that advice from the City Attorney suggests a weighing of rights.
As you are aware I felt that the Board of Adjustment had ample
grounds for not granting the Exception. It is my opinion that the
Board was unduly influenced by the "must" as indicated in the letter
of Mr. Barker in which "must" is underlined for emphasis.

I have been asked to respond to your letter of November 23, concerning the actions
of the Board of Adjustment, particularly in relation to special exceptions and the
"weighing of rights" in the Board's decision making.
As you may be aware, Section 31-91(g)(2)b of the Zoning Ordinance sets forth
certain criteria or standards which the Board is to use in granting any special
exception. Generally, those seven criteria address the effect the granting of the
special exception will have on surrounding properties and the public interest.
Specifically, the first standard enumerated requires that the specific proposed
exception not be a detriment to the public health, safety or welfare. In evalu-
ating the requested exception within this criterion, the Board weighs the interest
of the larger community against the request of the applicant.
If, based upon the evidence presented at the hearing, the Board finds that the
exception meets the standards listed, that is, that the exception will not have an
adverse effect on surrounding properties and will not otherwise violate the public
interest, then the exception must be granted. Numerous court decisions have so
held. One may, of course, disagree with the findings of the Board and, therefore,
its final decision. There is a 30 -day appeal period after the decision of the
Board is filed in which anyone aggrieved by the decision, or any taxpayer, can
bring the issue before the District Court.
In your remarks to the City Council, you expressed concern that the Board acted in
a manner which excluded the full participation of those attending the hearing. I
feel certain that was not the Board's intent, but your concerns will be brought to
the Board's attention.
Thank you for your letter. We all share your concerns that actions of the City
government be fair and equitable in both intent and practice.

ADVISORY COMMITTEE
This Comcmittee.is being established to aid the City
Council in the review of the position of City Attor-
ney and the selection of a new City Attorney.
Persons interested in serving on this Review and
Advisory Committee are requested to submit applica-
tions to the City Clerk, 410 East Washington, Iowa
City, Iowa, no later than November 28, 1984. Appli-
cation forms are available from the Clerk's office
upon request. Preference will be given to persons
who have one of the following qualifications:
1. Member of the Bar Association (2).
2. Faculty member from the College of Law or an
attorney otherwise associated with the Univer-
sity of Iowa•(2).
3. Former City Attorney (1).
4. Citizens preferably with prior service with the
City either as City Council members or board/
commission members (2).
The Mayor will serve as an ex -officio member of the
Committee.
These appointments will be made at the December 4,
1984, meeting of the City Council at 7:30 P.M. in
the Council Chambers.
The Committee initially will:
1. Review the responsibilities of the City Attor-
ney to determine if changes are appropriate; and
2. Consider the merits of a full-time vs a part-
time City Attorney.
Prior to advertising the position, the Committee
will make recommendations to the City Council on the
foregoing issues. After the City Council makes
decisions on these issues and the position is ad-
vertised, the Committee will screen applications
for this position and conduct prel4minary inter-
views prior to recommending applications for
further consideration by the City Council. The
Director of Human Relations will provide staff
assistance for the Committee.
