RESOLUTION NO. 83-1
RESOLUTION OF COMMENDATION
WHEREAS, Abbie Stolfus retired from the service of the City of Iowa City
effective January 1, 1983, and
WHEREAS, the said Abbie Stolfus has given the City of Iowa City nearly 19 years
of dedicated service from January 28, 1964, to January 1, 1983, and
WHEREAS, during this nearly 19 years Abbie Stolfus has set an example of service
and dedication to her position and has been a friend as well as an advisor to
those seeking the services of the City Clerk's office, and
WHEREAS, the City Council of Iowa City wishes to commend the said Abbie Stolfus
for such dedicated and outstanding service as City Clerk of the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA:
1. That the City Council of Iowa City, Iowa, hereby commends Abbie Stolfus for
service as City Clerk of Iowa City, Iowa,
2. That the City Council extends the gratitude of the City to the said Abbie
Stolfus for her service.
3. That the City Council grants Abbie Stolfus the title of City Clerk emeritus
upoq her retirement.
4. That the Mayor and Acting City Clerk are hereby authorized and directed to
certify a copy of this resolution to Abbie Stolfus.

RESOLUTION AUTHORIZING CONVEYANCE OF VACATED MAIDEN LANE RIGHT-OF-WAY
LOCATED BETWEEN PRENTISS STREET AND DES MOINES STREET.
WHEREAS, the City of Iowa City did vacate the Maiden Lane right-of-way located
between Prentiss Street and Des Moines Street which is legally described as:
Beginning at the Southeast Corner of Lot 4, Block 21 County Seat Addition to
Iowa City, Iowa; Thence NO0°12'59"E, (Assumed bearing) 320.00 feet to the
Northeast Corner of Lot 1, Block 21 County Seat Addition to Iowa City, Iowa;
Thence S89°45'26"E, 50.00 feet on the South right-of-way line of Prentiss
Street; Thence S00°12'59"W, 300.88 feet on the West line of Block 5, Lyon's
First Addition to Iowa City, Iowa; Thence S35°33'49"W, 23.43 feet on the
Westerly right-of-way line of Gilbert Street; Thence N89°45'26"W, 36.44 feet
on the North right-of-way line of Des Moines Street to the point of
beginning. Said tract of land containing 15,869 square feet and subject to
easements and restrictions of record; and
WHEREAS, said property was appraised at a value of $26,500 on February 17, 1982;
and
WHEREAS, said property was vacated at the request of Frank Boyd and John
Rummelhart with the intent of conveyance to same; and
WHEREAS, a purchase offer has been made by Frank Boyd and John Rummelhart in the
amount of $10,000; and
WHEREAS, a public hearing on the proposed conveyance was held on the 4th day of
January, 1983, at the City Council Chambers, Civic Center, 410 E. Washington
Street, Iowa City, Iowa, with publication of notice as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY:
1. That the City agrees to convey the vacated Maiden Lane right-of-way,
described above for the amount of $10,000.
2. That the Mayor is authorized to sign and the City Clerk to attest a quit claim
deed conveying said right-of-way to Frank Boyd and John Rummel hart.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL LARGE SCALE
RESIDENTIAL DEVELOPMENT PLAN OF IOWA -ILLINOIS MANOR.
WHEREAS, the owner, Iowa -Illinois Manor, a partnership, has filed with the
City Clerk of Iowa City, Iowa, an application for approval of the
preliminary and final Large Scale Residential Development (LSRD) plan
located on the following described real estate in Iowa City, Johnson
County, Iowa, to -wit:
Commencing at the southwest corner of Out Lot 26 of the Original Town
of Iowa City, Iowa; thence N 0°00' along the west line of the said

after due deliberation said Commission has recommended that the
requirement to show existing contours be waived and the LSRD plan be
accepted and approved; and
WHEREAS, the preliminary and final Large Scale Residential Development
(LSRD) plan is found to conform with all of the requirements of the City
ordinances of the City of Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
1. That the preliminary and final Large Scale Residential Development
(LSRD) plan pertaining to the above-described real estate be and is
hereby approved.
2. That the Mayor and the Clerk are hereby directed to certify a copy of
the resolution of the preliminary and final Large Scale Residential
Development (LSRD) plan to the office of the Johnson County Recorder
at the County Courthouse in Iowa City, Johnson County, Iowa.

Iowa -Illinois Manor has requested, and it has been
approved by the Planning and Zoning Commission, for a
change in zoning from C2 to RA for property located on
the corner of Van Buren Street and Burlington Street,

Iowa -Illinois Manor does hereby request that the
City Council of the City of Iowa City approve the change

Physical characteristics:
ANALYSIS
The site is in the floodplain and will
require elevation prior to construction.
Development is proposed for the corner lot in the southeast quadrant of the
intersection of Burlington and Van Buren Streets. The plan submitted calls for
the demolition of the existing structure, which has been a vacant commercial
property for a number of months. The new structure would be a three-story
apartment building with 54 units.
The property in question is in the floodplain of the Ralston Creek watershed.
The floodway, or channel of the stream, is to the west of Van Buren Street and
does not encroach on the development site. Any new construction within the
floodplain must have the lowest floor, including the basement, elevated to or
above the 100 -year flood level. The flood level at this site is 661.25 feet. The
first floor elevation of 666.3 feet shown on the plan is 5 feet higher than the
flood level; the five feet allows for a crawl space beneath the main structure.
Approximately 6 feet of fill will be used to attain the required elevations.
At the Planning and Zoning Commission's meeting of November 4, 1982, a
recommendation was made to the City Council to rezone this property from C2 to
R3A in response to an application from the property owner. A public hearing
before the City Council is set for December 21, 1982. The plans which have
been submitted are based on the Commission's approval of the rezoning request.
Council approval of the LSRD will depend upon final approval of the rezoning,
however, the Commission may proceed with this application in the context of its
previous decision.
DEFICIENCIES AND DISCREPANCIES
The staff has met with the applicant and the following discrepancies and
deficiencies were discussed.
I. Additional information required on the Plan:
A. The title of the Plan should be LSRD-Preliminary and Final.
B. The distance between B and J Auto Refinishing and the applicant's
property line should be shown.
C. Verification of the location of the sanitary sewer is necessary.
D. A graphic scale and date should be noted.
E. A typical for the tree islands with curb height.
2. Legal description:
A. Outlot 28 should be noted as Outlot 26 and the pin notation on the
map should be placed farther north on the west property line.
B. The description of the property acquired to the south of Outlot 26
should be reconciled with what is shown on the Plan.

3. Water:
A. A 6" water line connecting the 6" line north of Burlington and a 6"
line to the south of the applicant's property should be shown along
the alignment of the sidewalk on the east side of Van Buren Street.
B. Two fire hydrants are required on the east side of Van Buren Street.
C. A 10 foot easement over the water line should be shown.
4. Sewer:
A. A 10 foot sanitary sewer easement should be shown.
B. The chairlift and entranceway on the south side of the building
should be moved so as not to be constructed over the sanitary sewer.
jC. The distance, size and slope of the sewer should be shown.

S. A public access easement should be shown over the sidewalk on the east
side of Van Buren Street.
6. Parking:
A. The size of the aisles between the parking spaces should be at least 18
feet.
B. The drive between the sidewalk area on the east side of Van Buren
Street and the parking lot requires the provision of tree islands
separating the parking from the drive. The developer has the option
of eliminating this drive by providing expanded green space between
the sidewalk and the parking spaces.
C. Four inch asphaltic concrete is necessary in those areas of the lot
having a crushed stone base.
7. The configuration of the parking lot trees should be revised in accordance
with modifications made in the parking lot plan. Additional building
coverage trees may be necessary dependent upon the redesign of the tree
plan; 38 building coverage trees are required to cover the square footage
of the building proposed.
8. The curbcut indicated on Burlington Street should be removed.
9. Legal papers consisting of the required easements and a resolution for
approval should be submitted.
The applicant has stated that every effort will be made to make the necessary
modifications or revisions to the Plan. A revised Plan will be presented at the
Informal Commission meeting December 13.

STAFF RECOMMENDATION
The staff recommends that the LSRD Plan for Iowa -Illinois Manor be deferred.
Upon resolution of the deficiencies and discrepancies described above, the staff
recommends that the LSRD plan be approved.

AND RECEIPT OF BIDS TO PURCHASE LAND FOR PRIVATE REDEVELOPMENT
PARCELS A1, A2, A3, B, AND C, LOCATED IN THE
LOWER RALSTON CREEK AREA OF IOWA CITY.
WHEREAS, the City of Iowa City, acting as the Grantee/Local Public Agency
pursuant to the provisions of Title 24 CFR, Part 570 and provisions of Chapter
403, State Code of Iowa, has used Community Development Block Grant funds for
land acquisition and clearance to facilitate improvements to the Lower Ralston
Creek Area of Iowa City, and
WHEREAS, the City of Iowa City wishes to offer remaining parcels of land for
private redevelopment.
NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA that the
City Manager and/or his designee is hereby authorized and directed to solicit
offers to purchase Redevelopment Parcels Al, A2, A3, B and C, located in the
Lower Ralston Creek area of Iowa City, as shown on the map attached hereto,
until 12:00 noon, February 4, 1983.
BE IT FURTHER RESOLVED that the Acting City Clerk is hereby authorized and
directed to publish notice of such solicitation of offers to purchase
Redevelopment Parcels Al, A2, A3, B and C for said private redevelopment.

The attached Prospectus provides information for potential
purchasers and developers of five parcels of land located in the
Lower Ralston Creek Area. If the City Council approves the I.
Resolution on the January 4, 1983, agenda, the City Clerk will
advertise for and receive bids to purchase these parcels fora 30 day i
period. -

We wish to call your attention to particular stipulations of the
Prospectus:
1. Minismuw bids, as specified for each parcel, are required. Each
bid/proposal must be accompanied by a bid security deposit of
$500 per parcel. i
2. The parcels must be developed within three years of the i
designation of developers.
i
3. The parcels must be developed in a manner that is consistent j
with the Comprehensive Plan and Zoning Ordinance. However, no
designated land uses are stipulated.
4. Other requirements as to the form and content of an offer to
purchase (bid) are detailed in the documents referred to on page
10 of the Prospectus.
Staff will be present at the January 3, 1983, informal City Council
meeting to answer any questions that you may have.

LOWER RALSTON CREEK PROPERTY DISPOSITION PROSPECTUS
1982
CITY OF IOWA CITY
SECTION I: INTRODUCTION
The City of Iowa City is seeking responsible developers to purchase
five parcels of land located in the Lower Ralston Creek area of Iowa
City. The five sites offered for sale are located between Wright
Street and Kirkwood Avenue; Dubuque and Gilbert Streets; south of
the Iowa City central business district. (See location map on page
12.)
The City has recently finished a series of creek improvements as
part of the Lower Ralston Creek Neighborhood Improvement Project
funded by the U.S. Department of Housing and Urban Development.
The primary purpose of the Lower Ralston Creek Neighborhood
Improvement Project was to reduce flooding in the area, as well as
generally upgrade the neighborhood. The goals and objectives of
the project were:
I. To reduce flooding and the flood hazard of Ralston Creek.
2. To eliminate blight, health and safety hazards from existing
buildings through rehabilitation and demolition.
3. To assemble properties of appropriate sizes for private
redevelopment of land uses specified in the Comprehensive
Plan.
The land uses in the Lower Ralston Creek area have been
characterized by interspersed commercial and residential development
of various types. Many of the original single-family residences have
been removed and replaced with multiple -dwelling units and
commercial and service buildings. This area also now contains many
community and government service facilities. The Comprehensive
Plan indicated that the zoning in this area should be reevaluated
because conflicts between the zoning classification and actual land
uses were identified. The Neighborhood Improvement Project is
attempting to encourage the location of identified compatible land
uses in the Lower Ralston Creek area.
The City desires to see the Lower Ralston Creek area maintained and
upgraded through rehabilitation and reinvestment. The Lower
Ralston Creek area was designated for redevelopment, which enabled
Iowa City to allocate federal Community Development Block Grant
(CDBG) monies for housing rehabilitation, housing code
enforcement, and various neighborhood improvements. These
programs work together to improve the quality of life for Iowa City
neighborhoods. Some of the existing housing in the Lower Ralston
Creek area has already undergone rehabilitation.

SECTION II: SUMMARY FACTS
I. All proposals must be received by the City Clerk, Iowa City
Civic Center, 410 E. Washington Street, Iowa City, Iowa, 52240
by 12:00 noon, February 4, 1983, at which time the proposals
shall be opened. Late proposals will not be considered. The
City Council reserves the right to extend the aforesaid date for
receipt of proposals with appropriate notice if deemed
necessary.
2. Proposals must be accompanied by a cashier's check or certified
check payable to the City of Iowa City in the amount of Five
hundred dollars ($500.00) per
3. The City plans to select a preferred developer or developers on
or before April 12, 1983. Between the submission deadline and
the above selection date, the City may request a meeting or the
inclusion of additional materials. Following the receipt of the
development proposals, the City reserves the right to negotiate
with developers concerning the terms and conditions of their
proposals, so long as any agreed changes do not materially
affect the conditions stated herein.

4. The City's evaluation of proposals will be based on the criteria
cited on p. 11.

5. Following designation, the selected developer or developers will
have sixty (60) days within which to execute a real estate
contract, unless this period is extended, in writing, by the
City. Failure to execute an agreement or contract within this
I time may cause forfeiture of the bid deposit and loss of parcel

6. Construction occuring on these parcels is subject to the
conditions and terms contained in the Flood Hazard Overlay
Zones Ordinance (38.11.02) of the Iowa City Code of

SECTION III: BACKGROUND INFORMATION ON THE FIVE PARCELS
OF LAND LOCATED IN THE LOWER RALSTON CREEK AREA
The City of Iowa City began planning for the redevelopment of the
Lower Ralston Creek area during the late 1970's as a result of the
Iowa City Comprehensive Plan and the Ralston Creek Stormwater
Management Plan. The Lower Ralston Creek area was extremely
susceptible to severe flooding problems. As a result of the flooding
problems and neighborhood deterioration, CDBG funding from the
U.S. Department of Housing and Urban Development was used to
improve bridges (automobile and railway) and widen the creek
channel to handle additional flows of water. Neighborhood studies in
the area showed that the Lower Ralston Creek neighborhood had
changed from a single family residential area with neighborhood
businesses into a multi -unit residential area with commercial and - - -
service activities not found in the downtown area. The
Comprehensive Plan recommends that the area be used for Land j
Consumptive Uses. These land uses would include neighborhood
commercial establishments, as well as other commercial activities more
appropriately located outside the downtown area. I

Zoning: This parcel is zoned MI (light industrial). Land uses
permitted in the MI zone include: commercial
i(wholesale or retail), service industries, and light
manufacturing operations.
j Size: This parcel is approximately 3,900# (60 feet by 65
feet) square feet in size.
Surrounding
! Land Use: North - 2 -way secondary arterial (Benton Street)
and commercial
South - Single family residential.
East - 15 foot alley right of way and vacant

West - Commercial office building
Services: Traffic: This parcel is served from the north by a
two-way east/west secondary arterial. The
parcel is located approximately one-half block
west of a major north/south arterial (Gilbert
Street).
Utilities: Parcel Al is serviced by water, storm
sewer, sanitary sewer, telephone, electricity
and natural gas.
Topography: Parcel Al is presently depicted as being located in
j the 100 -year flood plain of Ralston Creek. The
completion of two stormwater detention dams and
improvements to the lower portion of Ralston Creek
will either remove or greatly reduce the susceptibility
of the parcel to flooding. The official Iowa City
floodway maps are presently being revised to reflect
these changes. Although the parcel has also been
filled to raise its elevation, certain floodproofing
standards specified in the Iowa City Flood Hazard
Overlay Zone Ordinance may have to be followed.

Location: The map on page 12 shows the location of Parcel A2.
Zoning: This parcel is zoned MI (light industrial). Land uses
permitted in the MI zone include: commercial
(wholesale or retail), service industries, and light
manufacturing operations.
Size: This parcel is approximately 12,025 square feet in
size. The parcel is long (north/south) and narrow
(east/west) with the northern width being
approximately 65 feet and the southern end tapering
to a paint. The length of the parcel at its longest
point is 234.7 feet. The parcel will be subject to a 20
foot wide access easement along its east and south
sides, parallel to Ralston Creek.
Surrounding
Land Use: North - 2 -way secondary arterial (Benton Street)
and vacant.
South - Ralston Creek.
East - Ralston Creek.
West - 15 foot alley right of way, vacant, multi-
family and commercial.
Services: Traffic: This parcel is served from the north by a
2 -way east -west secondary arterial. The parcel
is located approximately one-half block from a
major north -south arterial.

Topography: Parcel A2 is located directly adjacent to Ralston
Creek, and it is presently shown as being located
within the 100 -year flood plain. This parcel has also

PARCEL A3:
Location: The map on page 12 shows the location of Parcel A3.

Size: This parcel is approximately 17,920 square feet in
size. The parcel is roughly shaped like a right
triangle with the two 90 degree sides 130 feet and 180
feet In width and the hypotenuse about 200 feet in
length.

East - 15 foot alley right of way, Ralston Creek.

Dubuque Street which is a secondary arterial.
This is a one-way street, heading north.
Utilities - Parcel A3 is served by water, storm sewer,
sanitary sewer, telephone, electricity and
natural gas. A 2 foot by 3 foot brick oval sewer
crosses the southern portion of this parcel.
The area above the sewer will be subject to a 15
foot utility easement which cannot be built upon

(roughly 159 feet by 53 feet). The frontage on the
south (Benton Street) is 53 feet. This parcel will be
subject to a 20 foot wide access easement along Its
east side, parallel to Ralston Creek.

North - Commercial (parking and storage)
South - Secondary arterial roadway (Benton
Street)

This parcel is approximately 26,745 square feet in
size (303 feet by 90 feet). It will be subject to a 20
foot wide access easement along its east side, parallel
to Ralston Creek.

South - Railroad right of way; Lafayette St.
East - Ralston Creek
West - 20 foot alley right of way, commercial and
multifamily
Traffic - Lafayette Street, which runs along the
southern edge of the parcel, is unpaved. The
terminus of Lafayette Street is also on the
southern end of the parcel so access can be
gained from this point or the alley to the west.
Utilities - Parcel C is serviced by telephone,
electricity, storm sewer, and natural gas.
Water would have to be accessed from a point
approximately 200 feet distant. An unused but
open 2 foot by 3 foot brick oval sanitary sewer
runs along the western edge of the parcel.
Access to this sewer could be obtained but is
not encouraged. The next closest sanitary
sewer hookup is approximately 200 feet distant.
Parcel C is located directly adjacent to Ralston
Creek, and it is presently shown as being located
within the 100 -year floodplain. This parcel has been
substantially filled to raise its elevation. Certain
floodproofing standards specified in the Iowa City
Flood Hazard Overlay Zone Ordinance may have to be

SECTION IV. LAND DISPOSITION PROGRAM
The City is soliciting private offers to purchase and develop five
parcels of land in the Lower Ralston Creek area. The specific
development requirements are listed below. The City desires to
afford developers a maximum possible flexibility, consistent with the
City's determination to protect the existing elements of the Lower
Ralston Creek area. The City will not consider or accept any
proposals which do not meet the requirements set forth herein.
I. Price:
The minimum sale price of each marketed parcel is as follows:
Parcel Al: $13,525
Parcel A2: $19,525
Parcel A3: $46,525
Parcel B: $13,525
Parcel C: $27,525
2. Land Use:
All development proposals must be consistent with the City's
Comprehensive Plan and Zoning Ordinance. Any commercial
uses proposed for the development of these parcels should be
those that are more appropriately located outside of the central
business district. Proposals may include site assemblage and
redevelopment with adjoining properties. A proposed, project
which serves to increase the City's tax base will be viewed more
favorably than one which provides for minimal or no increase in
the tax base.
3. Timetable for Development:
All proposals must include a timetable for the proposed
development of the parcels or parcel. No proposal will be
accepted by the City if the development timetable exceeds three
(3) years from the date of selection and designation of
developers.

SECTION V. PROCEDURES
This Prospectus constitutes the official solicitation of offers to
purchase and develop one, all, or some combination of, five selected
parcels of land located in the Lower Ralston Creek Area of Iowa
City, following its announced availability through legal notices and
other advertising. The developer intending to submit a proposal
must do so by 12:00 noon, February 4, 1983. Prior to this date,
developers are encouraged to inform the City, in writing, of their
intention to submit a proposal. In order to be considered, the
written proposal must contain the information as set forth in Section
VI, Content of Proposal.
It shall be expressly understood that proposals received after the
time and date set forth above will not be considered. After the
formal cut-off date for receipt of proposals, no attempt will be made
to withhold the names of those submitting proposals.
REQUEST FOR INTERPRETATION PRIOR TO SUBMISSION
OF PROPOSALS
During the period when proposals are being accepted, no official oral
interpretation or clarification of the City's requirements will be given
to any potential offerors. Requests for official interpretation or
clarification must be submitted in writing, and all replies to such
requests will be issued as addenda to this Prospectus and sent to all
concerned parties.
DEVELOPER DESIGNATION PROCESS
Upon receipt of the written proposals, City staff will review and
evaluate all proposals. The City Council will, after recommendation
from the staff, designate a preferred developer or developers.
Designation of the preferred developer or developers will be made by
the City Council on or before April 12, 1983. City Council reserves
the right to extend the date of said designation, if deemed
necessary.
CONTACT WITH DEVELOPERS AFTER SUBMISSION OF PROPOSALS
No written or other materials may be submitted to or accepted by the
City after 12:00 Noon, February 4, 1983, unless specifically
requested by the City in writing. During the course of review and
evaluation the City may wish to meet with one or more developers for
further clarification. The City, therefore, reserves the right to
initiate such meetings. Meetings, moreover, may be conducted on an
individual or collective basis, involving anywhere from one to all
prospective developers. They may be called, however, only at the
initiative of the City. Following receipt of the development
proposals, the City reserves the right to negotiate with developers
concerning the terms and conditions of their proposals, so long as
any agreed changes do not materially affect the conditions stated
herein.

AGREEMENT OR CONTRACT WITH PREFERRED DEVELOPER
After the City designates the preferred developer or developers, the
developer(s) so designated will be expected to enter into a real
estate contract within sixty (60) days, unless this period is
extended by the City. At the conclusion of that period, if the real
estate contract has not been executed, the City reserves the right,
at its sole option, to rescind the designation of the developer or to
extend the time period allowed for negotiation and execution of such
an agreement or contract. Should the City exercise its option to
rescind a developer's designation the City may initiate negotiations
with one or all of the other developers who submitted a proposal on
the parcel(s), or the City may begin a new selection process. All
materials submitted to the City shall become the exclusive property
of the City and shall be utilized as the City deems proper.
PROJECT EXECUTION
Upon the execution of a real estate contract, the developer or
developers shall proceed, in accordance with the terms and
conditions which were mutually agreed upon. Full payment of the
purchase price is due upon conveyance of the title to the developer.

SECTION VI: THE PROPOSAL
In order to be considered by the City, proposals shall contain two
(2) copies of each item of information requested below, to be
completed as specified, and to be received by the City Clerk, City of
Iowa City, no later than 12:00 Noon, February 4, 1983, at which time
the proposals shall be opened. After that time, no new proposals
shall be accepted and no modifications to those already submitted will
be allowed unless specifically requested by the City.

OFFERS TO PURCHASE
All offers to purchase must be submitted in substantially the same
format as the form furnished by the City and must be complete in all i - - ----_
respects. Any additions, deletions, or modifications of the Offer to
Purchase must be justified and explained in full detail in a narrative
statement attached to the Offer.
Prospective purchasers/redevelopers may obtain a complete bid
packet from the Office of the City Clerk, City of Iowa City, upon
payment of $5.00 (non-refundable) per packet.
Materials and forms to be included in the proposal are:
1. Offer to Purchase Land for Private Redevelopment, accompanied
by bid deposit of Five hundred dollars ($500.00) per parcel.
2. A written narrative that explains the use or uses proposed for
each parcel.
3. Timetable for development (not to exceed three years),
4. Redeveloper's Statement of Qualifications and Financial
Responsibility.
