Sd(2) - Consider motion setting a public hearing for 12/18/84 on an ordinance amending Chapter 14, Article IV, Division 2 of the City Code of Ordinances. Comment: On August 28, 1984, the City and Heritage Cablevision, Inc. executed an agree- ment wherein the City approved the transfer of the Broadband Telecommunications franchise from Hawkeye Cablevision Corporation to Heritage upon certain terms and conditions. The proposed ordinance amendments reflect the changes agreed upon by Heritage in the agreement. Agenda Regular Council Meeting November 6, 1984 Page 3 (3) Letter from Stephen A. and Jo Ella Bobek regarding traffic noise problem from Highway 6 Bypass. The City did investigate sound barriers, particularly as relates to Home Town Dairies. You probably have noted in other communities, including Des Moines, that the only effective sound barrier has been the construction of large walls which protect residential properties from the freeway. (4) Letter from Robert J. Bender concerning the landscaping in front of his building at 335 South Clinton. The City Manager previously informed the City Council that a committee would be studying the central business district maintenance. This certainly will be one of the things to be considered. However, it is doubted that there would be a recommendation to simply remove the landscaping. Pictures of the plantings were included with the letter and are available in the City Clerk's office. (5) Letter from John Dane, representing Old Capitol Kiwanis Club, regarding the telecommunication device for the deaf at the Police Department and Public Library. No reply is necessary. (6) Letter from Richard P. Vornbrock, representing the Iowa City Noon Lions Club regarding the telecommunication device for the deaf at the Police Department and Public Library. No reply is necessary. (7) Letter from Mr. 0. C. Spriestersbach, President of the Iowa City Community Theatre, requesting a meeting with City officials to discuss the possibility of obtaining financial support. This matter will be discussed with the Parks and Recreation Commission. (8) Letter from Paul A. McCoy presenting a proposal to place a sculpture in Hickory Hill Park. Mr. McCoy plans to be present at the November 6 meeting to furnish a picture of his planned sculpture. Comment: At their October 18, 1984, meeting, the Planning and Zoning Commission recommended, by a vote of 5-1 (Horowitz voting no), that provisions of the Zoning Ordi- nance relating to roomers should remain unchanged and that no exemption for church -affiliated residential uses should be adopted. (S-8424) Comment: The Planning and Zoning Commission, at its August 19, 1984, meeting, recommended by a 5-0 vote approval of the planned development housing plan for Ty'n Cae Part 4. This recommendation is consistent with that of the staff. The staff report will be provided to the Council prior to the public hearing. Action: c. Public hearing on an ordinance to rezone property between runways 30 and 35 from P to an overlay zone of CI -1. (Z-8413) Comment: The Planning and Zoning Commission, at a meeting held October 4, 1984, recommended by a vote of 3-2 (Scott and Jakobsen voting no) approval of the requests submitted by the Airport Commission for the rezoning of approximately ten acres between runways 30 and 35 from P to an overlay zone of CI -1. Public hearing on an ordinance to rezone 6. acres south of Highway 1 West from I-1 to CI -1. (Z-8418) Comment: The Planning and Zoning Commission, at their October 4, 1984, meeting, recommended by a vote of 5-0 approval of the request from Mary Hartwig Inc. to rezone 6.3 acres south of Highway 1 West and north of the Iowa City Airport from I-1 to CI -1. The staff's recommendation for approval of this rezoning was conditioned on an amendment to the Comprehensive Plan. The Commission did not recommend an amendment. (Z-8404) Comment: At their October 18, 1984, meeting, the Planning and Zoning Commission recommended by a vote of 6-0 approval of a corrective ordinance to vacate a portion of Grove Street west of Ferson Street. The ordinance corrects a discrepancy in the width of right-of-way on the original vacation. This corrective action is necessary to enable proper disposal of the property. This recommendation is in response to a request from the City Council to consider an extension which would coincide with typical lease arrangements and the end of term at the University. The staff recommends that the readings on this ordinance be waived and that it be voted on for final passage at this time in order to ensure completion of this action by the initial November 30 deadline. Consider a resolution approving the preliminary plat for the Ruppert Subdivision and a preliminary Large Scale Non - Residential Development (LSNRD) plan for the MHI Auto Center, located south of Highway 1 West and north of the Iowa City Airport. (5-8429a) Comment: At a meeting held on October 18, 1984, the Planning and Zoning Commission recommended by a 6-0 vote that the preliminary platof the Ruppert Subdivision and the preliminary LSNRD for the MHI Auto Center be approved with a waiver of preliminary plat requirements for all except Lot 1 of the tract, and a waiver of sidewalk requirements, and subject to rezoning of the property to CI -1 and the resolu- tion for the frontage road issue. This recommendation is consistent with the staff's recommendations contained in a report dated October 15, 1984. Staff recommends deferral of this item by Council until the property has been rezoned. (first consideration) Comment: The Planning and Zoning Commission recommended by a vote of 5-0 approval of the proposed ordinance amending the sign regulations for the CB -2 zone. This amendment is necessary as a result of an error made in the printing of the Zoning Ordinance adopted December 1983. A public hearing was held on this item on October 23, 1984; no comments were received. The staff recommends waiving the readings on this ordinance and a vote for final passage at this time. . (Z-8106) (first consid- eration) Comment: The Planning and Zoning Commission, at a meeting held September 20, 1984, recommended by a 6-0-1 vote (Courtney abstained) denial of an application to rezone property located at 209 Myrtle Avenue from RS -8 to RM -20. This recommendation is not consistent with the staff's recommendation contained in a report dated September 6, 1984. A public hearing was held on October 23, 1984; comments were received from William Meardon, attorney for the applicant, and from Mr. Li, both speaking in favor of the application. Consider an ordinance to vacate a portion of the Mormon Trek Boulevard right-of-way located on the north side of Mormon y3��0 Trek Boulevard between Plaen View Drive and the Iowa City corporate limits. (V-8403) (passed and adopted) Comment: The Planning and Zoning Commission has recommended by a 5-0 vote approval of the vacation of a portion of Mormon Trek Boulevard right-of-way. This recommendation is consis- tent with that of the staff. The right-of-way in question represents excess land acquired by the Iowa Department of Transportation for the construction of Freeway 218. Consider an ordinance adopting zoning regulations for the prevention of hazards and incompatible uses surrounding the �✓ Iowa City Municipal Airport. (passed and adopted) Comment: This ordinance was recommended by the Johnson County/Iowa City Airport Commission and was subject to public hearing on October 11, 1984. Action: 1. I %2 ITEM NO. 7 - PUBLIC HEARING TO CONSIDER A PROPOSED INCREASE OF FORTY CENTS PER MONTH IN THE BASIC SERVICES RATE FOR CABLE TELEVISION SERVICE. Comment: The Broadband Telecommunications Commission, at a special meeting on September 21, 1984, recommended approval by the City Council of an increase in the basic services rate of 40L per month as requested by Heritage Cablevision, Inc. contingent upon approval by the Federal Communications Commis- sion of an increase in the local franchise fee from 3% to 5% and the extra services package. These were negotiated in the agreement between the grantee and the City for City approval of the transfer of the franchise from Hawkeye CableVision, Inc, to Heritage Cablevision, Inc. A memorandum from the Broadband Telecommunications Specialist is attached to the agenda along with the minutes of the September 21 meeting of the BTC. Action ITEM NO, 8 - PUBLIC HEARING TO RECEIVE CITIZEN COMMENTS CONCERNING THE RECOMMENDATIONS OF THE COMMITTEE ON COMMUNITY NEEDS (CCN) ON THE USE OF $736,000 OF COMMUNITY DEVELOPMENT BLOCK GRANT (COBG) FUNDS THE CITY EXPECTS TO RECEIVE IN 1985. Comment: At the meeting of October 23, 1984, CCN discussed all requests for the 1985 CDBG funding and voted on priorities and recommendations for funding, Council received these recommenda- tions on October 26, 1984. Additional information on all projects is in the Council packet. Council will receive the final 1985 CDBG Program Statement for adoption on November 20, 1983, after the Council has had an opportunity to discuss the projects. Consider recommendation of the Human Rights Commission that the City Council adopt the amendment to Section 18-32(b)(2) of the Human Rights Ordinance. This ordinance is on the agenda for final consideration (Item No. 18). b. Consider recommendations of the Parks and Recreation Commission: (1) The Parks and Recreation Commission expresses unquali- fied support in principal of the construction of a band shell, doing so in single phase; and recommends that the staff begin the site analysis and funding analysis necessary, coordinating wherever possible with repre- sentatives of the Iowa City Community Band. (2) In view of expanded programs, services, and income, the Parks and Recreation Commission endorses approval of the Parks, Recreation, and Parks and Recreation Administration budgets as presented, with no cuts. c. Consider recommendations of the Design Review Committee: (The minutes from the October 23 meeting of the Committee, at which these recommendations were made, will be included on the agenda of November 20.) It is recommended further that approval be conditioned on 1) there being no signage on the front face of the entryway and 2) that the owner assume all maintenance responsibilities for the entryway and the area of City Plaza immediately around it. Information regarding the proposed entryway is attached. (3) That the proposal submitted by Iowa -Illinois Gas 8' Electric for the placement of transformers in two parking spaces on Iowa Avenue between Clinton Street and Dubuque Street be approved. The Iowa -Illinois representative was asked to investigate the use of smaller transformers throughout the downtown. Comment: The Iowa Code requires that cities receiving allot- ments of Road Use Tax Funds submit to the Iowa Department of Transportation for review, a five-year program of proposed street construction and reconstruction for its total system of streets. This report must be submitted to the IDOT by December 1 of each year. The report submitted to the IDOT in no way binds the Council to these projects or the timing and modifications can be made consistent with the CIP adopted by the Council. See attached memo. ITEM NO. 16 - CONSIDER A RESOLUTION AUTHORIZING THE REINSTATEMENT, 9I�THE LEASE 97 OF CERTAIN PREMISES BY UNION BUS DEPOT OF IOWA CITY, IOWA. Comment: Union Bus Depot, Inc. is lessee of the City -owned bus depot property at the corner of Gilbert and College streets. In April 1982 the lease was amended to give the lessee three options to renew (at increased rent) for two-year periods commencing on December 1 in the years 1982, 1984 and 1986. Apparently through oversight, the 1982 option was never exer- cised, so the lease is now month-to-month at the old rent. The Resolution reinstates the lease as of November 1, 1982, thereby allowing the City to collect the increased rent for the period December 1, 1982 - November 30, 1984, permitting the tenant to renew the next two-year period, and reinstating the option for the period December 1, 1986 - November 30, 1988. (first consideration) Comment: This ordinance will change the City Plaza Ordinance (Chapter 9.1 of the Code of Ordinances) by amending several of the boundaries of City Plaza. A portion of Urban Renewal Parcel 64-1b which is formerly the City Plaza will be deleted due to the development of the hotel and Urban Renewal Parcel 65-2a (the minipark minus the small corner parcel which will be marketed) is to be added to City Plaza. (passed and adopted) Comment: The Human Rights Commission, at its regular meeting on August 27, 1984, unanimously recommended approval of this amendment. The proposed amendment deletes an exemption that renters pass through the owner's living area" and clarifies the types of housing covered by the exemption. Under the existing ordinance the exemption presents a practical problem in inter- preting whether or not "renters pass through the owner's living area." Further, the term "rooming house" is replaced by "housing accommodation" which is defined in Chapter 18 and is consistent with the language of the StateCode, Section 601A.12(3). COMMENT: A current vacancy in the position of Sr. Driver Transit, the changing needs of the Public Transit Department, and previous organizational changes within the department necessitate a change in the duties assigned to the position of Sr. Driver. Many of the duties previously assigned to the Sr. Driver (a Confidential position) have now been assigned to the AM and PM Transit Operations Supervisors. Remaining duties primarily involve maintenance of the new Transit facility, equipment and grounds which would no longer classify the position as Confidential (exempt from bargaining representa- tion). The attached resolution proposes deletion of the position of Sr. Driver for the Confidential pay plan (Salary Grade 49 $18,449-$23,688) and addition of the Maintenance Worker III -Transit position to the AFSCME pay plan (Salary Grade 7 $15,496-$19,947). A savings of approximately $2,000 in salary costs is anticipated for the remainder of FY85. aQq ITEM NO. 21 '—' RESOLUTION AMENDING THE CLASSIFICATION OF POSITIONS IN THE HOUSING AND INSPECTION SERVICES DEPARTMENT. Through the attached resolution the status of the position of Sr. Building Inspector is changed from AFSCME to Administrative, reflecting supervisory responsibilities for Building Inspector positions. Approximately one year ago, upon the resignation of the previous Sr. Building Inspector, it had been felt that supervisory responsibilities for Building Inspection could be assumed by the position of Director of Housing & Inspection Services, and at that time the position had been changed from Administrative to AFSCME. Since that time it has become apparent that supervision for Building Inspection can most efficiently be performed by the Sr. Building Inspector. AFSCME and the City have jointly agreed to the changes in these positions. We are currently awaiting finalization of the changes by the Public Employ- ment Relations Board.
