Because of the many questions now being considered, regarding the sale of the property, this statement is directed both to you and to the Iowa City Board of Education. On behalf of the people who depend on Mercy Hospital for health care, we urge you to consider the effect any new use of the Central property would potentially have on Mercy's ability to provide health care services. The ripples of influence also affect the local economy since many of Mercy's patients come from outside of Johnson County, bringing essential business activity here. Please consider the following: 1. The lack of parking space is severe. Unmet parking needs will exist even after the completion of Mercy's current construction project. 2. Modern outpatient services, which are less costly for patients and which help patients recover from medical treatment more rapidly, are being provided and expanded at Mercy in a responsible, future -oriented way. This will result in even more cars coming and going. 3. Future directions in health care include illness prevention programs, health education classes, fitness and wellness activity, and personalized programs caring for people in new ways --all involve more people and more cars. 4. Mercy's future viability extends beyond its regional health care mission. Williams, Gregory J. Downes, Ralph L. Neuzil and myself, purchased the old Rock Island Stockyards from the bankrupt Chicago - Rock Island and Pacific Railroad Company. The property purchased includes Lots 2 through 9, Block 4, Page's Addition to Iowa City, Iowa, as well as a triangle between a centerline of Dodge Street on the West,12 feet south of the southerly most tract of the Cp.I & P on the 11orth, the north lot lines of Lots -2 through 9, Block 4 of Page's Addition on the south and Lucas Street on the East. In addition, we purchased a small parcel located between the old Rock Island Right of way and the north line of Lucas Street. When doing site work on the property purchased, two storm sewer lines were discovered which crossed Lot 8 in Block 4 of Page's Addition. i It -will not be possible to build on this lot without interferring with the storm sewer lines. we have carefully searched the records at the Courthouse and cannot find where the City of Iowa City ever received an easement of record for these lines. The lines were apparently constructed when the new Dodge Street Bridge was built around 1969. The City entered into a formal agreement with the CRI & P for the bridge's construction. Attached to this agreement was an exhibit "A" showing the location of a 130 foot easement to be granted to the City for the bridge and road right of way. This easement was later formalized and filed for record in IIook350, Page 34 of the Records of the Johnson County Recorder. 134 II` MICROFILMIBYJO RIVI-'""MIC CEDAR RAPIDS •YES I Page Two City Council -Rock Island January 21, 1983 This easement does include a small portion of Lot 8 but the storm sewer lines were not constructed within the easement area. Had they been constructed within the easement area, construction of Lot 8 could be accomplished without interfering with the lines. The only reference to the storm sewer lines as constructed was i on plans for the bridge project and are indicated on these plans as proposed. Formalization of the easements was never completed by the City and the CRI&P. The City then has no recorded easements. The City then either has a permissive use for these lines which can be interrupted by us or they have an easement through prescription or adverse possession. An easement by prescription can be found by Court of Law if the I City claimed the easement as a matter of right or hostile possession for more than ten years and the titleholder of the property had express notice thereof. Such requirements must be met by the City in order to obtain a prescriptive easement. The transfer of the property to us i would also change the City's rights from a permissive use to hostile possession.but then the 10 years would not start to run until we had taken title. See Schwenker vs. Sagers, 230 NW 2d, 525 (1975). j There appears to be nothing in the City's records which would indicate that the City notified the CRI&P of its intent to claim an. j easement. Having the easement marked "proposed" on the plans would indicate the need for formalization and approval. Even if a Court found an easement the width and what rights the i City might have would still be in question, the Court could find an 15 inch easement for the pipe only. I We have a problem in that we do not want to build on the storm sewer lines and destroy them. The City had a problem in that it.,does not have an easement for these lines. We are proposing three alternatives: 1. That the City move the lines so that Lot 8 can be built upon without interferring with the lines. In return, we will grant the City j a formal easement for the relocated lines, if they are located outside the current 130 foot easement area. 2. We will move the lines and grant the City an easement for the relocated lines, if the City will vacate Lucas Street, between the old Rock Island Right of Way and Page Street. If the portion of Lucas Street to be vacated appraises out at more than the cost of moving the lines, we would pay the City the excess. If it appraised out at less than the cost of moving the lines, we would not expect any reimbursement. CAPITAL IMPROVEMENT PROGRAM The proposed five year Capital Improvement Program (CIP) for FY84-FY88 is submitted herewith for consideration by the City Council. Capital improvement programming is the planning, coordination, and scheduling of public improvements for a community over a period of years. The scheduling is developed according to priorities based upon need, desire and importance of such improvements to the community within the constraints of the City's ability to finance, as well as having the staff to design and administer the projects. Essentially, the CIP is a legislative and management tool to facilitate the scheduling, planning and execution of a series of public improvements over a five year period. The FY84-FY88 CIP is a compilation of projects currently in the CIP and new project requests. Although most projects were placed into the proposed five year plan, a f16r projects have been placed on a pending list. Those projects generally were viewed as having a low priority for funding at this time. One exception is the Wastewater Treatment Plant. Although it was included on the pending list, it is considered a high priority. However, because alternatives are being examined, it is impossible, at this time, to estimate the cost or timing of the project. II. FINANCING OF PROJECTS The financing of the projects included in the FY84-FY88 CIP is detailed on each project sheet. Summaries of funding by sources appear in this front section. The City strives to secure and utilize funds other than operating revenue and general obligation bonds to the maximum extent practical and utilize general obligation debts within the parameters of the City's fiscal policy. The graph at the end of this front section shows General Obligation (GO) Bond issues by year. The issues proposed for the next five years, based on this Proposed CIP, are smaller issues than past years'. This is attributable both to the scheduling of lower cost projects and the use of revenue sources other than GO Bonds wherever possible for funding of the project costs. III. FISCAL POLICY CONSIDERATIONS A concept of sound financial planning is critical for the success of any program whether it be public or private. As a result, the CIP is a determination of 1) the levels of capital projects and 2) the sources of financing those projects. While i i MICROFILMED BY i -JORM -MIC RALA13 CEDAR RAPIDS •DES MDIIIES i _ A /-57 determining the scheduling of projects for completion within the next five years, it was necessary to deal with the City's financial resource limitations; both those that have been _ established by State law and those that have been adopted as policy by the City Council as a guide to future City expenditure and indebtedness. It is the later limitation to which the City Council addressed itself in 1973 by the formal adoption of a fiscal policy that is aimed at controlling and regulating the property tax level for debt service on General Obligation Bonds used to finance capital expenditures. The 1979 revised fiscal ^ policy provides a more comprehensive method of financing the — many capital projects which the City needs. Adherence to this fiscal policy can be expected to provide the following advantages: 1. Investors interested in City of Iowa City bonds can refer to a fiscal policy and rely on it in making decisions on whether to buy obligations of the City and in determining the interest rates that they will bid. A formally approved fiscal policy has a strong bearing on the City's ability to I maintain and improve upon its credit rating. I 2. The proposed property taz levy for debt service, on which w there is no state imposed maximum limit, can be projected and regulated to either remain relatively stable or to increase at an even controlled rate. I I 3. Planning for public improvements normally takes place over a period of years. Nearly always, funds are spent for engineering and right-of-way prior to the years in which j actualconstructiontakes place. The fiscal policy can establish amounts of money which will be spent for several years in the future for the best public improvements facility planning and make it possible to concentrate time and funds on those priority projects which can be financed and constructed within the City's financial limitations. 4. A very significant advantage of a formal fiscal policy is to demonstrate the need for additional revenue sources in future years by matching expenditures and indebtedness permitted by such a fiscal policy against a much greater need for additional public improvements. BALANCED BUDGET: The budget of the City of Iowa City shall be drawn so that es- timated revenues and anticipated expenditures are equal. (State law requirement) 2: TAX CEILING: The budget of the City of Iowa City shall be drawn so that tax revenue in the general operating fund does not require a tax levy in excess of the limit established by State law. CAPITAL EXPENDITURES 1. DEFINITION: A. Capital Improvements - Capital items of a relatively permanent nature, such as buildings, and other attachments or improvements to land which are intended to remain so attached such as storm drains, sewers. and streets. Capital improvements have four characteristics: (1) They last a long time. (2) They are relatively expensive. (3) They usually don't recur annually. (4) They result in fixed assets. B. Capital Expenditures - Those expenditures for public improvements and their preliminary studies and the acquisition of property or equipment for new public improvements. Capital expenditures are expenditures for capital improvements and shall be financed under the provisions of this fiscal policy and planned in terms of the five year Capital Improvement Program. Excluded from capital expenditures are operating expenditures; those annual expenditures which are necessary to the maintenance of the city, the rendering of services, and providing for normal operations. 2. PROJECT ANALYSIS: Capital improvement projects for the five year period shall be analyzed for the following: (1) Compatibility with the Comprehensive Plan. (2) Revenue source - A clear distinction shall be made between tax supported and self -supported bonds (G.O. versus revenue bonds). In addition, proposed revenue sources shall be analyzed in terms of whether the revenue can be used for the proposed project and the probability that the revenue will be available. (3) Compatibility with the City Council's goals. 3. MAXIMUM LIMITATIONS ON GENERAL OBLIGATION BONDS: The following two maximum limitations shall apply to general obligation bonds: A. Debt Limit: Debt incurred as a general obligation of the City of Iowa City shall not exceed constitutional or statutory limits: II presently 5% of the market value of the taxable property within the corporate limits as established by the City i Assessor. (State law requirement) ! B. Borrowing Reserve: w A minimum of 20% borrowing reserve, or debt margin, shall be rf 1.+ maintained to meet emergencies, and if so used, the bonds shall be retired as soon as reasonably possible in I� accordance with the provisions of this fiscal policy. 4. CEILING ON DEBT SERVICE: Debt service charges payable from the general tax levy shall not exceed 25% of that levy in any one fiscal year. 5. FINANCING: As a general rule financing of capital improvements shall meet the following guidelines: iA. General property tax and operating revenues, to the extent - available, shall be used for capital project financing. B. When general property tax and operating revenues are not available under the maximum tax rates permitted by law or deemed advisable by the Council, financing of capital projects and replacements may be accomplished by the use of bonds as outlined in Section 6 hereof. C. BOND ISSUES: A. General obligation bonds - Bonds shall be.pf a serial type and general obligations of the City of Iowa City. They shall have a maximum maturity of 20 years. The maturity schedule shall provide for level principal amortization payments insofar as practicable. B. Revenue Bonds - Revenue bond financing shall be determined after first reviewing whether the use of revenue bonds could be more advantageous than financing with general obligation bonds. Revenue Bonds shall be issued in accordance with the following: (1) Amortization of principal and interest shall require no more, including reserves, than approved estimates will provide.from net revenues to be available. (2) In so far as possible, debt service, after the project has been completed and in operation for one full fiscal year, shall be level within practical constraints each year. (3) All revenue bonds for public purposes shall be sold at public competitive bidding in accordance with the requirements of Chapter 76, Code of Iowa as amended. The first fiscal policy was adopted by motion of the City Council at its regular meeting on June 5, 1973. OUTDOOR POOL FACILITY The project involves replacing the existing City Park pool with a new outdoor pool facility. The existing pool is 34 years old; the normal life of an outdoor pool is 25-30 years. At any time j a major breakdown, such as the collapse of the return pipe which is under the center of the pool or failure of the filter system, could make it impractical to repair and reopen the pool. This is true because the Comprehensive Plan has never been interpreted to be site specific. Rather, it is intended as a general guide for land development and, therefore, given the close proximity of the general commercial land use category to this site, C2 can be interpreted to be a compatible zoning. The request is based upon a desire to use an adjacent lot (Lot 25) in conjunction with Lot 26 to construct multi -family housing. The two lots, 25 and 26, will in effect be combined into one lot. Lot 25 is presently zoned R3A. MEMORANDUM Date: October 25, 1982 To: Filet[/ < From: Don c mems Re: Zoning Ordinance Interpretation Panel The Zoning Ordinance Interpretation Panel met on October 15, 1982, to review a request by Mr. Mike Furman concerning the location of a 12 -unit apartment building on two lots, one of which is zoned R3A and the other C2. Mr. Furman proposes to place the apartment building on the lot zoned R3A and to provide parking for the apartment building on the lot zoned C2. Each lot has an area of 9,000 square feet. Since one apartment unit is permitted for each 1,000 square feet 'of land area in the R3A zone and one unit for each 2,000 square feet is permitted in the C2 zone, the question is whether, with the two lots combined, a total of 18,000 square feet could be applied to construct 12 apartment units or whether only nine units could be built on the lot zoned R3A. The Panel 0eviewed the development plans proposed for the development and found all requirements of the two zones the same except for: (1) the density of development and (2) the signage allowances. After much discussion the Panel unanimously agreed that a development must meet the requirements of the zone in which it is located regardless of whether the zoning line divides the property. The reason for this conclusion is based on the fact that one is, in essence, rezoning the lot zoned R3A by placing 12 units on the property rather than nine as would not otherwise be possible if the property owner did not own the lot zoned C2. First, in Section A, the language "where a subdivision is required by this chapter" was placed at the beginning of the paragraph. While this language previously existed in the paragraph, placing it at the beginning acts to put one on notice immediately that this language applies only when a separate tract of land is divided into three or more lots or parcels for purpose of transfer of ownership or building development. Second, in paragraph B, the language "except pursuant to an agreement expressly conditioned on final subdivision approval" was moved to the beginning of the paragraph. By placing it at the beginning, it becomes clear that an agreement to transfer or sell land is permissible prior to final subdivision approval, as long as the agreement is conditioned on such approval'. The intent of this provision is to restrict the actual transfer of land without proper subdivision procedures.
