RESOLUTION TO ISSUE CIGARETTE PERMITS
WHEREAS, the following firms and persons have made appli-
cation and paid the mulct tax required by law for the sale of
cigarettes and cigarette papers; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that
the applications be granted and the City Clerk be and he/she
is hereby directed to issue a permit to the following named
persons and firms to sell cigarette papers and cigarettes:

RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE nHRnnNF STRFFT TMPRnVFMFNTC-LIaSNTNnTnN
STREET TO IOWA AVENUE
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY
CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT
OF BIDS.
WHEREAS, notice of public hearing on the plans, specifications, form of contract,
and estimate of cost for the construction of the above-named project was published as
required by law, and the hearing thereon held.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That the plans, specifications, form of contract, and estimate of cost for
the construction of the above-named project are hereby approved.
2. That the amount of bid security to accompany each bid for the construction
of the above-named project shall be in the amount of 10% of bid payable to
Treasurer, City of Iowa City, Iowa.
3. That the City Clerk is hereby authorized and directed to publish notice for
the receipt of bids for the construction of the above-named project in a newspaper
published at least once weekly and having a general circulation in the city not less
than four (4) nor more than twenty (20) days before the date established for the
receipt of bids.
4. That bids for the construction of the above-named project are to be received
by the City of Iowa City, Iowa, at the Office of the City Clerk, at the Civic Center,
until 10:00 A.M. on the 31st day ofMarch , 19_n. Thereafter, the
1 bids Jbe opened by the City Engineer or his designee, and thereupon referred to
the Council of the City of Iowa City, Iowa, for action upon said bids at its next
i meeting to be held at the Council Chambers, Civic Center, Iowa City, Iowa, at 7:30 p.m.
on the 12th day of April , 19 83.

RESOLUTION AUTHORIZING EXECUTION OF AGREEMENTS FOR
VAULT REHABILITATION.
WHEREAS, the City of Iowa City, Iowa, has negotiated agreements with the
following property owners:
1) Bill Mihalopoulus
2) Douglas A. Duss
3) Edris P. Rinella
4) James Mondanaro
5) 124 Building Company, A General Partnership
6) Richard C. Miller, as attorney-in-fact for Gladys Meyer Douttiel
Copies of said agreements are attached to this Resolution and by this
reference made a part thereof, and,
WHEREAS, the City Council deems it in the public interest to enter into
said agreements in conjunction with the proposed Dubuque Street improvements
from Washington Street to Iowa Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL:
1. That the Mayor and City Clerk are hereby authorized and directed to
execute the agreements with the above mentioned property owners.
2. That the City Clerk shall furnish copies of said agreements to any
citizen requesting the same.

AGREEMENT
This Agreement is entered into between Bill Mihalopoulos
hereafter "Owners" and the City of Iowa City, Iowa, a
municipal corporation, hereafter "City."
WHEREAS, it is in the public interest to make certain improvements
along Dubuque Street between Washington and Iowa Avenue in Iowa City,
Iowa, and to replace certain vault tops located in the right of way along
Dubuque Street; and
WHEREAS, property owners have an obligation under Iowa law to
maintain adjoining and abutting public ways including sidewalks and
vaults; and
WHEREAS, in the event the City chooses to replace the vault tops,
Owners and City wish to set forth a cost-sharing arrangement for replace-
ment of vault tops.
NOW THEREFORE BE IT AGREED AS FOLLOWS:
1. In the event City decides to replace Owners' vault tops, Owners
shall pay one-half (1/2) of the replacement cost for vault tops adjacent
and/or adjoining Owners' business and/or property, said amount not to
exceed $ 1060.00 In the event the City contract award is below the
Engineering Estimate, Owners' share shall be reduced on a pro -rata basis.
2. In consideration for Owners' payment of one-half replacement
costs, the City agrees to replace vault tops located at 127 Iowa
Avenue (street address), and more particularly described as
follows:
Beginning at the Northeast corner of Lot 1, Block 80,
Original Town of Iowa City, Iowa, according to the
recorded plat thereof, thence West 67 feet, thence South
40 feet, thence East 67 feet, thence North 40 feet to the
place of beginning
City further agrees to install or repair streetlights, sidewalks, curbs
and gutters, trees, bikeracks and trash receptacles as the City deems
necessary, at no additional cost to the property or business owners.
3. This Agreement shall be binding on the parties' successors in
interest and shall be recorded in the Johnson County Recorder's Office.
City shall pay recording costs.
In the event all Owners do not agree to contribute the one-half share
for vault top replacement along Dubuque Street between Washington and Iowa
Avenue as deemed necessary in the City's determination, this Agreement
shall be null and void and of no force and effect.

life estate in the same reserved to Joseph Rinella, Sr.
City further agrees to install or repair streetlights, sidewalks, curbs
and gutters, trees, bikeracks and trash receptacles as the City deems
necessary, at no additional cost to the property or business owners.
3. This Agreement shall be binding on the parties' successors in
interest and shall be recorded in the Johnson County Recorder's Office.

wish to point out that Mrs. Rinella is signing this and delivering it to you
on the expressed condition that it has been represented to her that in
replacing the vault tops and the sidewalk, the elevation and width of the
sidewalk will not be changed and that the parking in front of the premises
will not be eliminated. I've talked with you about this and you have affirmed

and the South Twenty (20) feet of the North Forty (40) feet of
Lot Eight (8) all in Block Eighty (80), Original Town of Iowa
City, Iowa
City further agrees to install or repair streetlights, sidewalks, curbs
and gutters, trees, bikeracks and trash receptacles as the City deems
necessary, at no additional cost to the property or business owners.
3. This Agreement shall be binding on the parties' successors in
interest and shall be recorded in the Johnson County Recorder's Office.
City shall pay recording costs.
In the event all Owners do not agree to contribute the one-half share

AGREEMENT
This Agreement is entered into between Gladys- Meyers P.outtiel
hereafter "Owners" and the City of Iowa City, Iowa, a
municipal corporation, hereafter "City."
WHEREAS, it is in the public interest to make certain improvements
along Dubuque Street between Washington and Iowa Avenue in Iowa City,
Iowa, and to replace certain vault tops located in the right of way along
Dubuque Street; and

WHEREAS, property owners have an obligation under Iowa law to
maintain adjoining and abutting public ways including sidewalks and
vaults; and
WHEREAS, in the event the City chooses to replace the vault tops,
i I Owners and City wish to set forth a cost-sharing arrangement for replace-
ment of vault tops.
I NOW THEREFORE BE IT AGREED AS FOLLOWS:
I 1. In the event City decides to replace Owners' vault tops, Owners
( shall pay one-half (1/2) of the replacement cost for vault tops adjacent
I and/or adjoining Owners' business and/or property, said amount not to
exceed $ 1470.00 . In the event the City contract award is below the
Engineering Estimate, Owners' share shall be reduced on a pro -rata basis.
2. In consideration for Owners' payment of one-half replacement
costs, the City agrees to replace vault tops located at 23 South

The south 20 feet of the north half of Lot 8, in Block 80 in
Iowa City, Iowa, according to the recorded plat thereof; also a
iright of way upon the north 4 feet of the east 23 feet of the
I south half of said Lot 8, together with the right to use the
area above the passageway as now in use, and the further right to
erect and construct a building above the passageway as now in
II use to the extent of the grantor's rights

! City further agrees to install or repair streetlights, sidewalks, curbs
and gutters, trees, bikeracks and trash receptacles as the City deems !
necessary, at no additional cost to the property or business owners.
3. This Agreement shall be binding on the parties' successors in
interest and shall be recorded in the Johnson County Recorder's Office.
City shall pay recording costs.
In the event all Owners do not agree to contribute the one-half share
for vault top replacement along Dubuque Street between Washington and Iowa
Avenue as deemed necessary in the City's determination, this Agreement
shall be null and void and of no force and effect.

IT IS AGREED by and between the State of Iowa, Iowa
Department of Transportation (hereafter D.O.T.), Highway
Division and the City of Iowa City in Johnson County, Iowa
(hereafter City) as follows:
1. The D.O.T. and the City entered into Preconstruction
Project Agreement No. 81-3-032 for the reconstruction
of Iowa Primary Highway No. 1 including its
intersection with U.S. Primary Highway No.'s 6 and
218, all of which lie within the City. The
Agreement was signed by the City and D.O.T. on
June 2 and 30, 1981, respectively.
2. As a result of design changes adopted subsequent to
the execution of Agreement 81-3-032 storm sewer
revisions have been made which affect section no.'s
16 and 17 on pages 4 and 5 of said Agreement. Section
no. 16 of said Agreement (100% City reimbursement)
will be revised to read as follows:
The following tabulation reflects those
storm sewer related items which carry only
city water and do not qualify for cost
sharing. The total cost of these items is
$41,991.20 and will be borne entirely by the
City.

The City will reimburse the D.O.T. for 100% of
the additional cost to the project for extending
the 72" storm sewer (line no. 34) easterly to
the Iowa River as per section no. 18, page 6, of
j Agreement 81-3-032. Actual cost is $98,154.32,
The D.O.T. agrees to reimburse the City for 100%
of the cost to construct a sanitary sewer line
on the south side of Highway 1 from Sta. 1168+00
to Sta. 1175+00. Actual cost is $14,530.00.
Upon completion of project construction and proper
billing by the D,O.T T. the City will reimburse the
D.O.T. for $332,283.50 which represents the total
sewer construction costs attributable to the City
in section no. 2 of this Agreement ($41,991.20 +
$206,667.98 + $98,154.32 - $14,530.00).
3. All provisions set forth in Agreement No. 81-3-032 which
are not revised or in any way affected by this Addendum
shall remain in full force and effect.

permanently closed at its junction with Iowa 1
and a cul-de-sac will be constructed. The
westerly extension of Ashley Drive will form a
reconstructed intersection with Sunset Street.
c) Miller Avenue will be reconstructed from its
junction with Iowa 1 extending northerly
approximately 83 ft.
d) Hudson Avenue will be reconstructed from its
junction with Iowa 1 extending northerly approxi-
mately 86 ft.
e) Orchard Street will be reconstructed from its
junction with Iowa 1 extending northeasterly
approximately 70 ft, l

5. The following construction will be let by the D.O.T.
in conjunction with the Iowa 1, related construction
described herein:
a) Benton Street will be reconstructed from its
junction with Orchard Street (one block west
of combined Primary Highway No.'s 1, 6, 218)
extending easterly to the Iowa River bridge.
The proposed facility will provide for a
Portland Cement Concrete curbed roadway.
b) Riverside Drive (at its junction with Benton
Street) will be reconstructed from a point
located approximately 400 ft. + north of Benton
Street extending southerly to a tie-in with
reconstruction at the intersection of Primary
Highway No.'s 11 6 and 218. The proposed facility
will provide for a Portland Cement Concrete curbed
roadway with median tapers located north and
south of Benton Street.
Total cost for the construction described in sections

6. The D.O.T. will develop and construct the Projects, as
described, in accordance with said project plans and
bear all costs incident thereto except those costs for
�1 which the City is made specifically liable for hereunder.
7. Project construction as described in sections 2-5
herein must be staged to insure safe traffic flow
and proper access between various parts of the City
during the construction period. The following staging
is proposed for construction of this project: l
a) In the 1981 construction season, Iowa 1 will
be reconstructed from its junction with proposed
Freeway 518 south of the City extending northerly
and easterly into the City to the west edge of
the Primary Highway No.'s 1, 6 and 218 intersection.
b) All other items listed in sections 2-5 herein
shall be constructed in the 1982 construction season
and will be completed and open to traffic
prior to September 15, 1982. !`

E: The City further agrees, upon completion of the project,
that no changes in the physical features thereof will be
undertaken or permitted without the prior written con-
sent of the D.O.T.
9. The City agrees that the D.O.T. may temporarily close
to traffic across the project all streets or all
which intersect the project after notice to the City. I'
10. The D.O.T. will install adequate traffic control devices
at the streets and alleys temporarily closed during
the project.
11. The D.O.T. will stage this project to provide for
through traffic during the construction period.
Should traffic volumes become too high at the south
junction of Iowa 1, U.S. 6 and U.S. 218, the D.O.T.
will use Gilbert and Benton Streets as a U.S. 6 detour
during construction of the south junction of Iowa 1,
U.S. 6 and U.S. 218. The D.O.T. will be responsible
for the detour signing and maintenance, all at no
cost to the City, j

12, Responsibilities for construction, maintenance, signing,
sidewalks and utilities shall be in accord with Section
820.06, Chapter 1, Article P, of the Iowa Adminis-
trative Code. The D.O.T. will at no cost to the City
construct all replacement sidewalk affected by this
project. The City will be responsible for relocating any
City owned utilities which are affected by this project,
all at no cost to the D.O.T. All other utility relo-
cations (privately owned) have been provided for by
utility agreements and waivers of statutory notice which
have been executed through the D.O.T.
13, A separate contract will be let at a later date for
construction of traffic signals within this project
area. A traffic signal agreement will be submitted
to the City prior to the letting. The D.O.T. will
be responsible for traffic signal construction at no
cost to the City. UpcLn completion of construction,
the City shall thereafter be responsible for all
future energy and maintenance costs associated with
said signals, all at no cost to the D.O.T.
'14. Any costs incurred by the City in performing its
obligations hereunder shall be borne exclusively by
the City, without reimbursement by the D.O.T.
15.. If a hearing is necessary for the permanent closure
of Ashley Drive at its intersection with Iowa Primary
.Highway No. 1, the City will conduct same in accordance
with Section 306.11 of the Code of Iowa, all at no
expense or obligation to the D.O.T. The D.O.T. will
participate in the hearing.
16. The following tabulation reflects those storm sewer
related items which carry only city water and do not
qualify for cost sharing. The total cost of these
items is estimated at approximately $22,623 and will
be borne entirely by the City.

Upon completion of project construction and proper
billing by the D.O.T., the City will reimburse the D.O.T.

estimated storm sewer construction costs attributable
to the City in section No.'s 17 and 18 of this Agreement

18. The D.O.T. will rip rap the south U.S. 6 ditch
located east of U.S. 218 with P.C. Concrete
commencing at the proposed outlet of line No. 34
(72" storm sewer) extending easterly to the Iowa
River. Should the City desire to extend the 72"
storm sewer (line No. 34) in this area, they shall
assume 100 percent of the actual cost associated
therewith,
19, The City in accordance with Section 306.4(3), Code
of Iowa and Section 820.06(1.2c), Chapter 1, Article 1
P, of the Iowa Administrative Code, shall discontinue
and prohibit any use of project right of way for
business purposes. The City shall prevent.any future
encroachment or obstruction within the limits of project
right of way.
20, The City agrees to permit the removal of any trees
within the limits of the established street that
will interfere with the construction of the project.
21. Parking shall be prohibited on the minor street
approaches for a distance of 35 ft. in advance of the
stop signs and on the exit sides of the minor streets
for a distance of 35 ft. beyond the far crosswalks.
Parking shall be prohibited on the project.
22. Subject to the approval of, and without expense to
the D.O.T., the City agrees to perform (or cause to
be performed by sending proper notification), all relo-
cations, alterations, adjustments or removals of utility
facilities, including but not limited to power, telephone
and telegraph lines, natural gas pipelines, water mains
and hydrants, curb boxes, sanitary sewers, and related
poles, installations and appurtenances, as well as any
other facilities or obstructions which are located
within the limits of an established street or alley
and which will interfere with construction of the Project,
all in accordance with the Utility Accommodation Policy
of the D.O.T. i
23. It is agreed that no new or future utility occupancy
of Project right of way, nor any future relocations
of or alterations to existing utilities within such
limits, shall be permitted or undertaken by the City
without the prior written consent of the D.O.T. All
work shall be performed in accordance with the Utility
Accommodation Policy and other applicable requirements
of the D.O.T.
24. All storm sewers constructed by the D.O.T. as a
part of. said Project shall become the property of the
City, which shall be responsible for their maintenance
and operations. The City shall not make any connections
it to said storm sewers without the prior notification of
the D.O.T. The City shall take all appropriate measures 3G

25. The City shall be responsible for providing without
cost to the D.O.T. all right of way which involves;
(a) dedicated streets or alleys, and (b) other
City -owned lands, except park lands, subject to
the condition that the D.O.T. shall reimburse the
City for the value of improvements situated on
such other City -owned lands, if any. The City has
apprised itself of the value of these lands and,
as a portion of their participation in the project,
voluntarily agree to make such lands available without
further compensation. The D.O.T. shall be responsible
for acquisition of all other right of way.
26. Right of way acquisition for this project is covered
by Agreement 78-1-190 which was signed by the City and
D.O.T. on December 20, 1978, and January 9, 1979,
respectively.
27. The CITY, its successors in interest and assigns, as
part of the consideration hereof, does hereby covenant
and agree that; (1) no person on the ground of race,
color, sex, or national origin shall be excluded from
participation in, denied the benefits of, or be other-
wise subject to discrimination in the use of said
facilities, (2) that in the construction of any improve-
ments on, over or under such land and the furnishing of
services thereon, no person on the ground of race, color,
sex, or national origin shall be excluded from partici-
pation in, denied the benefits of or otherwise be
subjected to discrimination, (3) that the City shall
use the premises in compliance with all other require-
ments imposed by or pursuant to Title 49, Code of i
Federal regulation, Department of Transportation,
Subtitle A, Office of the Secretary, Part 21 Nondiscrimi-
nation in Federally Assisted Programs of the Department of
Transportation - Effectuation of Title VI of the Civil
Rights Act of 1964, and as said Regulations may be amended
and Title 23 U.S. Code Section 324, Prohibition of
Discrimination on the basis of sex.
28. If any section, provision or part of this Agreement
shall be found to be invalid or unconstitutional, such
judgment shall not affect the validity of the Agreement
as a whole or any section, provision or part thereof not
found to be invalid or unconstitutional.

each of which so executed shall be deemed to be an
original and both shall constitute but one and the
same instrument.

A RESOLUTION SETTING LEGAL HOLIDAYS FOR PARKING METERS, PARKING
LOTS AND MULTI-LEVEL PARKING FACILITIES.
WHEREAS, Chapter 23, Article VIII, Division 3, Code of Iowa City,
establishes provisions for parking meter zones and parking lots; and
WHEREAS, Resolutions No. 77-168 and 79-441 designate certain legal
holidays with regard to the use of parking meters,
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY
THAT:
Effective March 1, 1983, Resolutions 77-168 and 79-441 be repealed and the
legal holidays for parking meters, parking lots and multi-level
facilities be as follows:
a. New Year's Day (the first day of January)
b. Memorial Day (the last Monday of May)
C. Independence Day (the fourth day of July)
d. Labor Day (the first Monday of September)
e. Thanksgiving Day (the fourth Thursday of November)

RE: Special Assessment Projects - Sidewalk on Kimball Road and
Paving of St. Anne's Drive
Yesterday you asked about the estimated cost for these projects. The
Kimball Road project consists of approximately 2,700 square feet of
sidewalk an the east side of Kimball Road north to Whiting Avenue.
The estimated cost of the project is $27,492.91 of which $12,601.91
will be assessed and $14,891 would be paid for by the City. The City's
share is primarily curbing and some concrete street work. There
currently is no curbing in this area.
The St. Anne's Drive project consists of seven-inch paving for 724
feet from the east end of the existing paving on Foster Road to Prairie
du Chien Road. The total estimated cost is $103,802.74 of which
$100,365.24 will be assessed and $3,437.50 will be assumed by the City.

4" concrete sidewalk be constructed within Iowa City, Iowa, as

WHEREAS, it is proposed that said project be constructed
as a single improvement under the authority granted by
Division IV of Chapter 384 of the City Code of Iowa:

Costs of said improvements will be assessed to the proper-
ties within the boundaries of the district. No property shall
be assessed more than it is benefited by the improvements nor
more than 258 of its value on the date of its assessment.
Said assessment may include a ten percent Default and
Deficiency Fund, as authorized by Section 384.44, City Code of
Iowa.
A plat and schedule and estimate of costs are now on file
in the office of the Clerk as required by law.
Any difference between the amount which is derived from
cash payments made by property owners during the thirty day
collection period and the sale of Improvement Bonds issued
against assessments on benefited properties and the total cost
of the improvements, shall be paid for from the proceeds
derived from the issuance and sale of bonds as authorized by
Section 384.25, City Code of Iowa, and/or from such other
funds of said Municipality as may be legally used for such
purpose.
BE IT FURTHER RESOLVED, that this Council meet at 730

the purpose of hearing property owners subject to assessment
and interested parties for or against the improvement, its

time of the hearing on this resolution of necessity, he shall j
be deemed to have waived all objections pertaining to the
regularity of the proceedings and the legality of using spe-
cial assessment procedure.
BE IT FURTHER RESOLVED, that the Clerk is hereby
instructed to cause notice to be published and mailed as
required by law of the pendency of this resolution and of the
time and place of hearing objections thereto, and to the said
preliminary plans and specifications, estimate of costs and to

The City Council of Iowa City, Iowa, met in regular
session, in the Council Chambers, Civic Center, 410 E.
Washington Street, Iowa City, Iowa, at 7:30 o'clock P.M., on
the above date. There were present Mayor Mary C Neuhauser

PRELIMINARY RESOLUTION FOR THE CONSTRUCTION OF
STREET IMPROVEMENTS IN THE CITY OF IOWA CITY,
IOWA
WHEREAS, this Council, after a study of the requirements,
is of the opinion that it is necessary and desirable that
7" concrete pavement be constructed within Iowa City, Iowa, as
hereinafter described; and
WHEREAS, it is proposed that said project be constructed
as a single improvement under the authority granted by
Division IV of Chapter 384 of the City Code of Iowa:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF IOWA CITY, IOWA:
Subdivision A. That Iowa City, Iowa, construct 7"
concrete pavement, as hereinafter described.
Subdivision B. The beginning and terminal points of said
improvements shall be as follows:
i 7" concrete pavement on St. Anne's Drive from the East end
of the existing pavement on Foster Road, East 724' to

Prairie du Chien Road.

Subdivision C. That City Engineer of Iowa City, having

been employed as ngineer to prepare plats, schedules,
estimates, plans and specifications and otherwise to act in
said capacity with respect to said project is hereby ordered

the plat and schedule of special assessments against benefited

"Schedule of Assessment.", under the column therein headed
"Property Valuation": j

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF IOWA CITY, IOWA: _
That said schedule of values, hereinabove referred to, be
and the same is adopted as the valuations of the lots, with
the proposed public improvements completed, within the boun-
daries of said improvements and the Clerk is hereby directed
to forthwith deliver the same to City Engineer, the Engineer,
for said project, said Engineer to insert said values in the
schedule of assessments which is to be prepared and filed with
this Council.

That said plat and schedule, estimate of cost and plans
and specifications be and the same are hereby adopted as the
proposed plat, schedule, estimate of cost and plans and speci-
fications for said improvements and are hereby ordered placed
on file with the Clerk for public inspection.
BE IT FURTHER RESOLVED, that the boundaries of the
District for the making of said improvements, as shown in the
Engineer's plat, be and the same are hereby fixed as the boun-
daries for said St. Anne's Drive Special Paving Project -1983.

WHEREAS, preliminary plans and specifications and plat and
schedule and estimate of cost are now on file in the office of
the Clerk showing the boundaries of the district., containing
the properties and lots to be assessed, locations of the
improvements, each lot proposed to be assessed, together with
a valuation of each lot as fixed by the Council, an estimate
of the cost of the entire proposed improvements, stating the
cost of each type of construction and kind of materials to be
used, and an estimate of the amount proposed to be assessed
against each lot, for the construction of the St. Anne's Drive
Special Paving Project -1983, as hereinafter described, in
Iowa City, Iowa:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF IOWA CITY, IOWA:
That it is deemed desirable, advisable and necessary to
construct as a single improvement the St. Anne's Drive Special
Paving Project -1983, in Iowa City, Iowa.
Said district containing the properties to be assessed is
set out and described in the following "Notice to Property
I Owners", set out in this Resolution of Necessity.
Said improvements within said District are located and
described in the following "Notice to Property Owners", set
out in this Resolution of Necessity.
The method of construction shall be by contract.

Costs of said improvements will be assessed to the proper-
ties within the boundaries of the district. No property shall
be assessed more than it is benefited by the improvements nor
more than 258 of its value on the date of its assessment.
Said assessment may include a ten percent Default and
Deficiency Fund, as authorized by Section 384.44, City Code of
Iowa.
A plat and schedule and estimate of costs are now on file
in the office of the Clerk as required by law.
i Any difference between the amount which is derived from
cash payments made by property owners during the thirty day
collection period and the sale of Improvement Bonds issued
against assessments on benefited properties and the total cost — - --
of the improvements, shall be paid for from the proceeds
derived from the issuance and sale of bonds as authorized by
Section 384.25, City Code of Iowa, and/or from such other
funds of said Municipality as may be legally used for such
purpose.
BE IT FURTHER RESOLVED, that this Council meet at
o'clock _.M., on the �h day of Marrh . 1983, in
the Council Chambers, Civic Center, 410 E. Washington Street, {
for the purpose of hearing property owners subject to
assessment and interested parties for or against the
improvement, its cost, the assessment, or the boundaries of
the district. Unless a property owner files objections with
the Clerk at the time of the hearing on this resolution of
necessity, he shall be deemed to have waived all objections j
pertaining to the regularity of the proceedings and the lega-
lity of using special assessment procedure.
BE IT FURTHER RESOLVED, that the Clerk is hereby
instructed to cause notice to be published and mailed as i
required by law of the pendency of this resolution and of the I
time and place of hearing objections thereto, and to the said
j preliminary plans and specifications, estimate of costs and to
j the making of said improvements; said Notice to be in substan-
tially the following form:

which time the owners of property subject to assessment for
the proposed improvements, or any other person having an
interest in the matter may appear and be heard for or against
the making of the improvement, the boundaries of the district,
the cost, the assessment against any lot, tract or parcel of
land, or the final adoption of a Resolution of Necessity. A
property owner will be deemed to have waived all objections
unless at the time of Hearing he has filed objections with the
Clerk.
