The installation shall consist of construction of one span of 13.800 three phase line
and will be located as shown on the detailed plat attached hereto.
AGREEMENTS: The utility company, corporation,applicant, permit holder or licensee, (hereinafter referred to as the permit holder)
agrees that the following stipulations shall govern under this permit.
1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations,
regulations anddirectives of the Iowa State Commerce Commission, Utilities Division, the Iowa State Department of Health, all rules
and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way
caused by highway construction or maintenance operations.
4. The Iowa Department of Transportation shall give the permit holder at least 48 hours written notice of any proposed construction
or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's
property occasioned by any construction or maintenance operations on said highway.
6. The permit holder shall take all reasonable precaution during the construction and maintenance of said installations to protect and
safeguard the lives and property of the traveling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall he made in writing to the Engineer whose name is shown below.
8. The permit holdcragrecs to it all times givc the Iowa Department of Transportation timely notice of intention to perform routine
maintenance within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to
the safety of the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department of Transportation
Manual on Uniform Traffic Control Devices for Streets and Ilighways.
Flagging operations are the respon%ihility of the permit holder. The original placement of signs and removal on completion of the
work shall he accomplished hV the permit holder.
10. Opervtions in the construction and maintenance of %aid utility i1mallation shall he carried on in such a manner as to cause
minimum of interference to m distraction of uaffic on said highway.

12. The permit holder shall idemnify and save harmless the State of Iowa, and the Iowa Department of Transportation from anyand
all causes of action, suits at law or in equity, or losses, damages, claims• or demands, and from any and all liability and expense of
whatsoever nature for, on account of, or due to the acts or ommissions of said Permit holder's officers, members, agents, representa-
lives, contractors, employees orassigns arising out of or in connection with its (or their) use or occupancy of the public highway under
this permit.
13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement• may be
considered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is
assured, or revocation of the permit. The cost of any work caused to he performed by the State in removal of non -complying
construction will be assessed against the permit holder.
14. A copy of the approved permit shall be available on lhejob site at all times for examination by Department of Transportation
officials.
15. This permit shall terminate 20 years from date Of approval for gas and water mains outside the corporate limits of a municipalit
in accordance with the Code of Iowa. Chapter 320. Renewal may be requested. y

COMMUNICATION BETWEEN THE CITY COUNCIL AND BOARDS AND COMMISSIONS
MARCH 1, 1983
1. Boards and Commissions should use an identical format for minutes. The
following is recommended:
a. Members present.
b. Members absent.
C. Staff present.
d. Recommendations to the City Council.
e. Requests to the City Manager for information and staff assistance.
f. List of matters pending Commission/Council disposition.
g. Summary of discussion and formal action(s) taken.
2. Items recommended to the City Council by Boards and Commissions should be
listed as separate Council agenda items to distinguish them from the formal
receipt and filing of minutes. Staff will insure that each recommendation
includes a statement indicating if and when formal Council action or
informal consideration should be given to any specific recommendation.
3. Recommendations from Boards and Commission should be accompanied by the
appropriate staff report(s). Information pertaining to any alternatives
that were considered and the rationale for the recommendation should be
included where appropriate.
4. At such time as the City Council takes any formal action or gives informal
consideration to any such recommendation, staff will insure that the
appropriate Board or Commission is notified of the results of that action
or consideration, or of any decision by Council to either defer or give no
further consideration to that recommendation. Such notification will
include an appropriate item on the agenda for the next meeting of that
Board or Commission.
5. When items come to the City Council for which there is a designated Board

Dear Mayor & Members of the City Council: j
I recently met with members of the Housing Commission in order to discuss how
the lines of communication and the transfer of information between CCN and the
Housing Commission could be improved. We agreed that there were two basic
elements contributing to the problem. The first was the fact that both �..-
commissions meet on the first Wednesday of the month within two hours of each
other. This does not permit the distribution of information from CCN to the
Housing Commission prior to its meeting, and then leaves a full month before CCN
receives the Housing Commission's input. The Housing Commission kindly agreed I
to try to move its meeting to the second or third Wednesday of the month to
alleviate this problem.
The second element that has created some misunderstandings is that CCN has not
always been aware of the Housing Commission's priorities for funding. In our
meeting, we agreed that the Housing Commission would provide CCN with a list of
its priorities on an ongoing basis, and that both commissions would exchange
minutes of meetings. We all feel that this will help to resolve our
communication problems.
In our discussion, we also recognized that the two commissions will, at times, i
have different priorities according to their respective charges from the City I
Council. For this reason, the Housing Commission may sometimes disagree with a
recommendation made by CCN to the City Council regarding the CDBG funding of a
specific project, as happened recently with the River City Housing Collective's
request for funding. In the future, CCN will indicate the Housing Commission's
endorsement or opposition to a recommendation for funding of a housing-related
CDBG project, for your information.
In light of the foregoing discussion, CCN considers that a meeting between the
City Council, CCN and members of the Housing Commission may no longer be
necessary. Both commissions feel that they will now be able to work together
better in dealing with some of the housing needs in Iowa City.

( I represent Shaler Enterprises, a general partnership and the
Hunters Run Development Company. These companies own property lying
immediately west of the new Freeway north of Rohret Road. They also
own Hunters Run Subdivision Part One,... which lies west of the new
' freeway and south of Rohret Road. 5
A preliminary plat, planned area development and large scale
residential plan was filed and approved by the City of Iowa City for i
this whole area and provided for the development of the area in stages.
1 Final platting of Part One of Hunters Run Subdivision has been
11 completed and lots will be sold in part one as soon as the City of
Iowa City has completed the extension of the water line down Rohret
Road.
The proposed new comprehensive plan shows this entire area as j
Ag -RR -1, even though a preliminary plan was approved for the area
at a much higher density. We would request that the new comprehensive
plan be changed to comform to the preliminary plan which has already
been approved. J
The new comprehensive plan also shows that property lying more
than 300 feet south of Rohret Road would be deannexed. Part of the
area proposed for deannexation would include most of Lots 4 and 7
in Part One of Ilunters Run Subdivision. Storm water management
basins for that part of the subdivision would then be located outside
of the City Limits as would the houses which would be constructed
on Lots 4 and 7. It is requested the proposed comprehensive plan
would be altered so that all of the area covered in Lots 4 and 7
of Hunters Run Subdivision Part One would remain in the City limits.

Concerning a variance to Section 8.10.24•B of the
Zoning Ordinance at 528 East College Street:
After many well-publicized and well -attended
public hearings, the Planning and Zoning Committee
and the City Council decided that the College Hill area
had reached the population density that indicated it
should be down -coned„ This was done by a unanimous
vote. Conditions have not changed since then.
We feel that the wishes of the residents should
carry at least as much weight as the wishes of the
investors, and ask that the variance be denied,

In a staff report prepared regarding this item, a total of ten
deficiencies and, discrepancies were listed, two of which were on the
preliminary plan and eight on the final plan. Revised plans have
been submitted by the applicant correcting all noted deficiencies and
discrepancies. Specifically, the preliminary plan has been revised
and now shows the acreage of the tract, and 15 foot easements over
both the proposed sewer line and the proposed water line. The final
plan has been revised as follows:' complete curve note information
has been provided; the required easements have been shown; a
signature block has been provided for Hawkeye CableVision; the
legal description is certified by a land surveyor; and the acreage of
the tract has been provided. Further, the water line has been
revised to meet the specifications of the City's Water Division and
common driveway agreements have been submitted for review by the
Legal Department. Finally, construction plans have been approved
by the Engineering Division.
Because this application now meets all requirements of the Iowa City
Code of Ordinances, staff recommends that the amended preliminary
and final PAD and LSRD plan be approved.

ANALYSIS
The applicant is requesting approval of the amended preliminary and final PAD
and LSRD plan of Lots 91 and 92, Ty'n Cae Subdivision Part 2. Lots 91 and 92
are part of an amended Planned Area Development plan and subdivision plat for
Lot 90, which was approved in 1979 and included 6.9 acres divided into a total
of six lots and 68 units. A total of 32 units were approved for Lots 91 and 92.
These two lots have now been sold, and the new owner is proposing to amend
the approved plan. The site layout will remain substantially the same as the
plan approved in 1979; however, larger units are now being proposed. The
units originally approved measured 16' x 32' and the proposed new units would
measure 18' x 401. As a result of this change, it was necessary to redesign the
parking area. Instead of locating 18 parking spaces (which are provided in
addition to garages) along the south end of the tract, the amended plan shows
two separate parking areas of eight spaces each. As proposed, one parking
area would be located on the east side of the development, and one would be
located on the west side. Staff sees this change as an improvement because it
moves the parking spaces off of the drive entering the development and locates
them closer to the individual units which they will be serving.
Another change from the originally approved plan is that the walkway along the
north boundary of the tract is not shown. The applicant has indicated that it
would like to locate a planting screen in this location to separate the
development from the electric substation immediately to the north. Staff
recognizes the benefits of the proposed screening and would not oppose a
relocation of the proposed walkway. One acceptable alternative would be to
place a walkway through the central court of the development. While this
location is not as conveniently located for pedestrian traffic originating from the
development proposed at the end of Cambria Drive, it does permit a mid -block
cross-over to Mormon Trek Boulevard.
A concern has been raised by the Fire Chief regarding the access provided to
this development. He has stated that it would be very difficult for a firetruck
to get in and out of the two deadend drives which extend to the north boundary
of the tract on either side of the 32 dwelling units. The applicant has proposed
a separate solution for each of the drives. First, for the easterly drive, a
hammerhead turn -around would be provided at the north end of the drive.
Second, a driveway would be extended to Mormon Trek Boulevard from the
north end of the westerly drive, thereby eliminating the dead -ending of this
drive. This driveway will also provide an additional means of access for the
development.

Because the access from Cambria Court to Lot 91 is provided by a drive
extending across Lot 92, a common driveway agreement should be established to
provide for the future maintenance of this drive. This agreement represents
the only legal papers which would be required for approval of this plan.
STAFF RECOMMENDATION
Staff recommends that the amended preliminary and final PAD and LSRD plan be
deferred. upon resolution of the deficiencies and discrepancies listed below,
staff would recommend approval.

The topography is moderately sloping.
The applicant is requesting approval of the final plat and LSRD, PAD Plan of
Walden Ridge, Parts 1, 2, 3 and 4. The PAD, LSRD plan is in substantial
compliance with the approved preliminary plan with the exception that it has
been broken down into four parts. This is being done to allow the project to be
more easily staged and does not represent a deviation from the plan which would
require the revision of the preliminary plan. As part of the Planned Area
Development approval process, the applicant is requesting that several zoning
requirements be varied.
First, by definition, a lot is required to front "...upon a public street or
upon an officially approved place." In this case, each of the 100 dwelling
units will be located on a small lot (750 square feet for a two-bedroom unit,
1,100 square feet for a three-bedroom unit) which will be contained within the
boundary of a lot containing the area held in common for all the dwelling units.
There are four lots containing common area which represent parts 1, 2, 3 and 4 of
the development. Two of the lots containing common area do not front on a public
street, and none of the 100 dwelling unit lots front directly on any type of
right-of-way, although a parking area is located in front of each. Maintenance
of the common area lots will be carried out by homeowner associations (including
the drives and parking areas).
Also, a portion of the tract is zoned R3, and a portion is zoned CH. Approval of
the PAD will permit the applicant to average the density permitted in each zone
over the total tract area. As designed, the density in the land zoned CH will
actually be greater than is normally permissible in a CH zone. However, the
number of units on the tract will not exceed what would be permitted
individually in the area zoned R3 and in the area zoned CH.
Another requirement of the PAD provisions is that "in the event the open space
land is to be retained under private ownership, the developer must submit a
proposed legally binding instrument setting forth the procedures to be followed
in maintaining said areas and the means for financing maintenance costs."
Because the common area lots include both open space for recreational purposes,
the parking lot and drive areas, it is important that the two types of open area
be differentiated in the required legal documents. This will ensure that the
green space will not be encroached upon by further paving.

The final plat of Walden Ridge contains only Lot 1 of the approved four lot
preliminary plat. This lot has been further subdivided into the four additional
common area lots (Parts 1, 2, 3 and 4) plus 100 dwelling unit lots. While this
does not result in a change in the character of the development, it does
represent a further division of Lot 1 as approved in the preliminary plat. The
applicant has lettered the four common area lots A through D to show that they
are not buildable and numbered the dwelling unit lots consecutively through the
four parts, 1 through 100.
STAFF RECOMMENDATION
Staff recommends that the final plat and PAD, LSRD Plan of Walden Ridge be
deferred. Upon resolution of the deficiencies and discrepancies listed below,
staff recommends approval.
DEFICIENCIES AND DISCREPANCIES
1. Legal papers have not yet been submitted.
2. A note should be provided on the plans that each unit will have separate
utility services.
3. The application is titled "Walden Ridge, Parts 1, 2, 3, and 4, final plat i
and PAD, LSRD plan." For clarity, this title should be revised to
recognize the existence of the approved preliminary plat and the use of Lot
2 in Walden Square Subdivision which has been finally approved i.e.
"Subdivision of Lot 1, Walden Ridge Subdivision and Lot 2 Walden Square
Subdivision." Further, the dwelling unit lots should be renumbered so that
Lots 1 and 2 are not duplicate numbers.

Please waive the requirement for three readings on these
amended preliminary plats, final plats, final PAD's and
LSRD's and act on this submittal at your March 1, 1983
meeting..
In order to meet our marketing plan, we would like to have
the first four dwelling units completed.by May 15, 1983
to use as model units. If we break ground March 2,.we
will have only 75 calendar days (including spring rain
days) to complete these homes. This is an extemely tight
schedule.
There has been no controversy raised about this project
from the public, all of the city staff's comments and
concerns have been satisfied, and the Planning and
Zonning Commission voted unanimously to recommend
approval (subject to utility signatures and final legal
papers, which will be completed before March 1).
