RESOLUTION NO. 83-63
RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND
CITY CLERK TO ATTEST CONTRACT FOR THE CONSTRUCTION OF
DUBUQUE STREET IMPROVEMENTS - WASHINGTON STRET TO IOWA AVENUE
WHEREAS Strph Cnnstruction Comoanv. Inc.
has submitted the best bid of 149,933.60 for the construction of th
above-named project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the contract for the construction of the above-named project is
hereby awarded to Streb Construction Com an Inc.
subject to the con ition that away ee secure a equate performance bond,
insurance certificates, and contract compliance program statements.
2. That the Mayor is hereby authorized to sign and the City Clerk to
attest the contract for the construction of the above-named project, subject
to the condition that awardee secure adequate performance bond, insurance
certificates, and contract compliance program statements.

That whereas the Owner has heretofore caused to be prepared certain plans,
specifications and proposal blanks, dated the 14 th day of February
1983 , for DUBUQUE STREET IMPROVEMENTS - WASHINGTON STREET TO IOWA AVENUE
under the terms and conditions therein fully stated
and set forth, and
Whereas, said plans, specifications and proposal accurately, and fully
describe the terms and conditions upon which the Contractor is willing to
perform the work specified:
NOW, THEREFORE, IT IS AGREED:
1. That the Owner hereby accepts the attached proposal of the Contractor
for the work and for the sums listed therein.
2. That this Contract consists of the following component parts which
are made a part of this agreement and Contract as fully and absolutely
as if they were set out in detail in this Contract:

b. "Standard Specifications for Highway and Bridge Construction",
Series of 1977, Iowa Department of Transportation, Highway
Division, plus current special provisions and supplemental

the Contract in accordance with its terms and conditions,
and upon determination by Owner and Surety of the lowest
responsible bidder, arrange for a contract between such
bidder and Owner, and make available as work progresses

arranged under this paragraph) sufficient funds to pay the
cost of completion less the balance of the Contract Price;
but not exceeding, including other costs and damages for

The following sets forth the minimum requirements of a satisfactory Affirmative

RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT FOR
THE WIDENING OF HIGHWAY #1 FROM DUBUQUE ROAD TO
INTERSTATE 80
WHEREAS, the City of Iowa City, Iowa, has negotiated an agreement
with the Iowa Department of Transportation, a copy of said agreement
being attached to this Resolution and by this reference made a part hereof,
and,
WHEREAS, the City Council deems it in the public interest to enter into
said agreement with the Iowa Department of Transportation for the
widenina of Hiahwav 41 from Duhuaue Road to Interstate 80
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL:
1. That the Mayor and City Clerk are hereby authorized and directed to
execute the agreement with the Iowa Department of Transportation
2. That the City Clerk shall furnish copies of said agreement to
any citizen requesting same.

IT IS AGREED by and between the State of Iowa, Iowa Department of
Transportation (hereafter D.O.T.), Highway Division and the City of Iowa City
in Johnson County, Iowa (hereafter City) as follows:

westerly intersection of Dubuqud Road and extends
northeasterly to a tie in with the south approach

3. The City further agrees, upon completion of the project,
that no changes in the physical features thereof will be
undertaken or permitted without the prior written consent
of the D.O.T.
4. The City agrees that the D.O.T. may temporarily close to
traffic across the project all streets or alleys which
.intersect the project for short durations during the
construction period. The D.O.T. will work in close
cooperation with the City and the contractor to provide
local access across Lice project during consLrucLiun.

7. Since this project is financed with federal funds, the

and utilities shall be in accord with 820.I.A.C. (06,P)
Ch. 1 (Iowa Administrative Code).
9. Any costs incurred by the City in performing its
obligations hereunder shall be borne exclusively by the
City without reimbursement by the D.O.T.
10. Parking shall be prohibited on the project.
11. Subject to the approval of and without expense to the
D.O.T., the City agrees to perform (or cause to be
performed), all relocations, alterations, adjustments or
removals of utility facilities, including but not limited
to power, telephone and telegraph lines, cable television
lines, natural gas pipelines, water mains and hydrants,
curb boxes, sanitary sewers, and related poles,
installations and appurtenances, whether prival:ely or
publicly owned, and all other facilities or obstructions
which are located within the limits of an established
street or alley and which will interfere with
construction of the project, all in accordance with the
Utility Accommodation Policy of the D.O.T.
12. It is agreed that no new or future utility occupancy of
project right of way, nor any future relocations of or
alterations to existing utilities within such limits,

WHEREAS, THE City of Iowa City is interested in acquiring lands or
developing outdoor recreational facilities on the following described project
for the enjoyment of the citizenry of Iowa City, Iowa and the State of Iowa:
Project Title; Restroom Facility for Napoleon Park
Total Estimated Cost: $20,000
Brief Description of Project:
The City of Iowa City proposes to build a restroom building in Napoleon Park
(27 acres) to serve adult softball diamonds, girls softball diamonds, a soccer
field, and garden plot users. Construction will be performed by Park Division
employees.
AND, Land and Water Conservation Fund financial assistance is required
for the acquisition or development of said outdoor recreational facilities,
NOW THEREFORE, be it resolved by the City of Iowa City that the project
described above be authorized,
AND, be it further resolved that said City of Iowa City make application
to the State Conservation Commission to seek Land and Water Conservation Fund
financial assistance from the National Park Service in the amount of 50% of
the actual cost of the project in behalf of said City of Iowa City.
AND, be it further resolved by the City of Iowa City that it certifies to
the following:
1. That it will accept the terms and conditions set forth in the NPS
Grants -in -Aid Manual and which will be a part of the Project
Agreement for any grant awarded under the attached proposal.
2. That it is in complete accord with the attached proposal and that
it will carry out the acquisition and/or development in the manner
described in the proposal and any plans and specifications attached

race, color, or natural origin in the use of any property or facility
acquired or developed pursuant to this proposal, and shall comply
with the terms and intent of the Title VI of the Civil Rights Act of
1964, P. L. 88-352 (1964) and of the regulations promulgated pursuant
to such Act by the Secretary of the Interior and contained in 43 CFR
17.
6. That it will maintain adequate financial records on the proposed
project to substantiate claims for cost-sharing.

Napoleon Park is located in the extreme south-central section of Iowa City.
The Iowa City airport and the Iowa River are to the west. Highway 6 and a
commercial district are to the north. Sand Road and farmland border the

! Napoleon Park presently has no permanent restroom facilities. Portable
E restrooms must be transported to the park. A permanent structure would
definitely enhance the appeal of the park to its users. Adult softball,
girls softball, and garden plots are the primary functions in Napoleon
Park. These people, especially the girls, deserve adequate restroom
1 facilities.

3 The centrally located restroom facility, equipped with water fountains, i
would be readily available for use by the park population. Since four
of the six softball diamonds are for'girls softball, this building would,
add an important dimension to Napoleon Park. There are also 76 public
garden plots in the north end of the park.

Careful measures will be taken to prevent disruption of the environment
during construction. Service lines that need to be dug will not enter
the playing surface of any of the softball fields.

The topography of the area is mainly flat open area (formerly farmland)
consisting of Kentucky Bluegrass. Floodplain forest vegetation, pre-
dominately box elder and elm trees, border this level ground on the north,
south, and west extremes. There are five types of soil: the Downs,
Sparta, Spillville, Waukee, and Wiota Series. The Wiota Series (found
at the project site) consists of well and moderately well drained soils
formed in silty clay loam alluvium. The 28 inch surface layer is black,
very dark grayish brown, and dark brown silty clay loam. •The subsoil
is brown silty clay loom 20 inches thick. The Iowa River borders the
western boundary; Sand Road is to the east,

The project site is near the central portion of the park, between the
north and south parking lots. It is 150 feet west of the utility poles
on Sand Road to accommodate the proposed city sewer line project plans'.

as in restroom buildings in our other parks with sports facilities, and
we have received a high degree of acceptance from the public for them.

A park of this type which is sports -oriented and also used heavily by other
people as well is not complete without permanent restroom facilities. The
participants and spectators of the sporting events of softball and soccer
deserve such a facility. A restroom building would greatly add to the purpose
in general of the park, that being to serve the people of the community who
use it.
7. RESERVATIONS OR EA S TS:
East -hest electric line in park approximately 20 ft. wide, which covers the
entire length of the park. The legal description is as follows: Commencing
at the•Northeast Corner of the Southwest Quarter of Section 22, Township 79
North, Range 6 Ilest of the 5th Principal Meridian; thence S. 67°51'55" W.,
330.06 feet along the North line of said Southwest Quarter to a point on the
Westerly Right -of -Way line of Sand Road (also known as the Iowa City to
Burlington Road); thence S. 30'05'42" E., 611.13 feet on said Westerly Right -
The facilities at Napoleon Park include two adult men's slowpitch softball
diamonds, four girls softball diamonds, and one large soccer field. The.
softball diamonds are equipped with backstops, bleachers, and benches. A
public garden plot area consisting of 72 plots has also been made available
to the community at the north end of the park.

The non -recreational uses would be the gardening practices performed in the
park by the people leasing their individual garden plots.

A 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA GERONTOLOGY
PROJECT ADULT DAY PROGRAM FOR THE LEASE OF SPACE AT THE IOWA CITY
SENIOR CENTER.
WHEREAS, the City of Iowa City is operating a Senior Center for the benefit of
elderly residents of Johnson County; and
WHEREAS, the Iowa Gerontology Project Adult Day Program of Johnson County, Iowa,
1 is a University sponsored community service whose goals include: the
maintenance and development of its clients' independence, and the reduction of
j its clients' inactivity; and
WHEREAS, it is in the mutual interest of the City of Iowa City and the Iowa
Gerontology Project Adult Day Program to meet such goals at the Senior Center;

WHEREAS, the City of Iowa City and the Iowa Gerontology Project Adult Day
Program have negotiated a 28E agreement for the lease of space at the Iowa City

ADULT DAY PROGRAM AGREEMENT
i This Agreement, made and entered into this 13th day of April 1983, by

and between the City of Iowa City, Iowa, a municipal corporation, hereinafter
i
referred to as the City, and the Iowa Gerontology Project Adult Day Program of
I
Johnson County, Iowa, hereinafter referred to as ADP, whereas, ADP is a
University sponsored community service whose goals are: to maintain and develop
the clients' independence; to improve the clients mental and physical
functioning; to reduce the clients' inactivity; and to reduce the clients'
isolation; and whereas, it is in the mutual interest of the City and ADP to
attempt to meet such goals at the Senior Center; and whereas, Chapter 28E of the
Code of Iowa, provides that any power exercisable by a public agency of the
State may be exercised jointly with any other public agency of this State having
such power;
Now, therefore, be it agreed by and between the City and ADP as follows:
I. Scope of Services
A. The City agrees to provide space, furnishings, janitorial services,
utilities, and use of specific equipment and services as set forth
below.

II. General Terms
A. The City agrees to provide suitable classroom space on the 2nd floor
of the Senior Center to ADP for the provision of a day program for the
elderly. This space will be available Monday through Friday from 8 AM
to 12 noon. The space will be available for use by the program on
April 13, 1983 and continue until June 30, 1984, at which time
the Senior Center Commission will re-evaluate the success of the
program using this space.
B. The City agrees to provide heating and cooling for these spaces at a
level deemed appropriate for older persons.
C. The City agrees to provide regular janitorial service on a schedule
deemed appropriate by the Senior Center staff.
D. The City agrees to make available the services of the Senior Center
secretary or the phone answering device to accept calls to the program
on a limited basis.
E. The City agrees to treat in a confidential manner all participant
information that is jointly gathered.
F. ADP agrees to provide services and activities which are consistent
with the purpose and goals of the Senior Center, such services to
include, but not be limited to, health education, group counseling,
social group activities, exercise and movement therapy.

G. ADP agrees to submit a yearly self-evaluation of services and
activities.
H. ADP agrees to cooperate in data collection. A monthly report will be
filed with the Senior Center staff to include:
1. Monthly total of service units/activities provided.
2. Monthly total of elderly receiving service or participation in
scheduled activities (duplicated and unduplicated count).
3. Indentification of request for services or activities not
currently provided.
I. ADP agrees to submit a 30 day written notice when program changes are
planned.
J. ADP agrees that it shall be responsible for the supervision of ADP
clients while they are participants in the Adult Day Program at the
Senior Center.
K. ADP agrees to furnish all furniture and equipment needed for staff and
participants' use of this space.
L. ADP agrees to pay for the installation and monthly cost of a phone if
it requests one.

III. Responsibility
A. ADP assumes responsibility and agrees to pay for any and all claims
for personal injury or property damage incurred by reason of the
negligence of ADP, the University, or its employees arising from the
activities conducted under this agreement to the full extent
permitted by Chapter 25A, Code of Iowa, 1981, which is the exclusive
remedy for the processing of tort claims against the State of Iowa.
B. ADP assumes financial responsibility for the maintenance of the
present program including staff, supplies, transportation, phone and
food. ,

C. ADP assumes financial responsibility for the continuance of this
program.

B. No space may be reassigned to any other agency or organization.
C. The parties understand that the City of Iowa City does not directly
provide service and that this agreement is solely for the purpose of
assigning space in the Senior Center facility for the University of
Iowa to operate the ADP program.
VI. Termination
This agreement shall become effective 1983 and shall
terminate June 30, 1984. However, this agreement may otherwise be
terminated upon 30 days written notice by either party.
VII. This agreement shall be filed with the City Clerk of Iowa City, Iowa.
VIII. The undersigned do hereby state that this agreement is executed in
triplicate as though each were an original, that there are no oral
agreements that have not been reduced in writing in the instrument,
and that this agreement constitutes the entire contract.

Re: Status of new Customer Service Area in Treasury
We have established a new customer service area in the Treasury Division. The
purpose of that project was to improve the level of customer service by limiting
the counter service to only the straight -forward cash transactions.
Those customers who need assistance or additional information on their accounts
are directed to a clerk who can provide more personalized service in a more
conducive setting. The customer who needs to check only on the balance of
his/her utility account or total outstanding parking tickets, is directed to the
desk of the clerk located right behind the counter. The customer who needs
additional information (i.e. an analysis of his/her account balance, has a
complaint, has had his/her water shut off or his/her car towed) is directed to a
clerk in the customer service area.
The customer service area is in the back of the room along the north windows. In
order to provide enough physical space for customer service it was necessary to
make some changes in the layout of the Treasury office area. Sufficient room
for a waiting area and for chairs for customers at the clerks' desks in the
customer service area was provided. Temporary partitions that were formerly
used in the'Police records room, are being used to screen the work area from the
waiting area and the customer service area.
I also request your approval to remodel the counter so that a shorter counter
area is provided and the rest of the front of the room is screened from the
hallway traffic. This will provide a more functional arrangement in conjuction
with the new customer service area. Estimated cost for design and construction
would be approximately $1,300.
An integral part yet to be added to the customer service area concept is the
filling of the new cashier position. I recommend that we fill the new cashier
position as soon as possible so that we will not have to hire a temporary
replacement for a maternity leave in Treasury scheduled to start late in April.
I have attached a job description for that new position. The cost of filling
that position for May and June will be $1,850.

DEFINITION:
Under general supervision, performs routine clerical tasks as assigned; and performs
other related work as required.
EXAMPLES OF DUTIES:
Receipts city monies on the data terminal and issues customer receipts. Is
responsible for the level of customer service established by rules and procedures for
that activity.
Uses computer terminal for data entry of all city receipts; codes these receipts from

WHEREAS, the City of Iowa City, Iowa, employs certain personnel subject solely
to the action of the City Council referred to as unclassified personnel; and
WHEREAS, a vacancy exists in the position of City Clerk; and
WHEREAS, it is necessary to establish compensation for the said unclassified
position.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA:
1. That Marian Karr hereby is appointed to the position of City Clerk.
2. That said position shall receive as compensation that amount which is set
forth below in lieu of all other fees and compensation except as otherwise
provided by law.
3. That where said officer shall receive or collect any fees or other
compensation from others for services as such officer, the same shall be
paid to the City Treasury.
4. That the following compensation is hereby established effective April 12,
1983:
City Clerk - $20,696.00 in annual salary with additional compensation and
benefits subject to the conditions of an Employment Agreement which is
attached hereto.
5. That the Mayor is hereby authorized and directed to execute the attached
employment agreement on behalf of the City of Iowa City.

EMPLOYMENT AGREEMENT
THIS AGREEMENT, made and entered into this 12th day of April 1983 by and
between the City of Iowa City, State of Iowa, a municipal corporation,
hereinafter called the "City," as party of the first part, and Marian
Karr, hereinafter called "Employee," as party of the second part, both
whom understand as follows:
WITNESSETH:
WHEREAS, the City desires to employ Marian Karr as City Clerk of the City
of Iowa City, as provided by Ordinance and Charter provisions of said
City; and
WHEREAS, it is the desire of the City Council to provide certain benefits,
establish certain conditions of employment, and to set working conditions
for said Employee; and
WHEREAS, Employee desires to accept employment as City Clerk of said City;
NOW, THEREFORE, in consideration of the mutual covenants herein
contained, the parties hereto agree as follows:
Section 1. Duties.
City hereby agrees to employ said Marian Karr as City Clerk of said City
to perform the functions and duties of such office and to perform such
other legally permissible and proper duties and functions as the City
Council shall from time to time assign and Marian Karr agrees to serve as
City Clerk.
Section 2. Termination of Agreement.
A. Nothing in this agreement shall prevent, limit or otherwise
interfere with the right of the City Council to terminate the
services of Employee at any time.
B. Nothing in this agreement shall prevent, limit or otherwise
interfere with the right of the Employee to resign at any time from
her position with the City.
Section 3. Salary.
A. City agrees to pay Employee for her services rendered pursuant hereto
an annual base salary of $20,696.00 payable in installments at the
same time as other employees of the City are paid.
B. In addition, City agrees to further review Employee's salary and
benefits no later than July 2, 1983, at which time Employee's salary
will be increased seven percent.
C. Employee will be eligible to receive annual across the board salary
increases and merit increases effective the first pay period in July
of each fiscal year in an amount equal to that appropriated by the
City Council for Administrative employees. Employee will also be

eligible to receive bonuses for superior performances as awarded by
the City Council.
Section 4. Employee Benefits.
A. Employee will receive the same employee benefits as Administrative
employees, including but not limited to:
1. Employee and dependent group medical coverage.
2. Long-term disability coverage (effective July 1, 1983).
3. Life insurance coverage.
4. Inclusion in the normal City retirement system.
5. Sick leave accrual, and payout upon resignation or retirement.
6. Vacation accrual, and payout upon resignation, retirement or
termination.
7. Paid holidays and personal day. j
8. Longevity pay. II
9. Eligiblity for participation in deferred compensation.
10. Pregnancy leave, funeral leave, voting time and jury duty
compensation.
B. Employee will be furnished with a temporary parking permit, from time
to time, when required to drive to work to attend after hours

C. All provisions of the City Charter and Code, and regulations and I
i rules of City related to vacation and sick leave, retirement and
pension system contributions, holidays, and other fringe benefits
and working conditions as they now exist or hereafter may be amended,
also shall apply to Employee as they would to other employees of
City, except as herein provided.
Section 5. Hours of Work.
In recognition of the fact that the job responsibilities of the Employee
may require that the Employee work more than the normal work week,
compensatory time off from work may be taken during normal office hours,
as appropriate.
Section 6. Dues, Subscriptions, Professional Development.
A. City agrees to budget and pay the professional dues and subscriptions
of Employee necessary for her continuation and full participation in
national, regional, state, and local associations and organizations
necessary and desirable for her continued professional
participation, growth, and advancement, and for the good of the City.

B. City hereby agrees to budget and to pay travel and subsistence
expenses of Employee for professional and official travel, meetings,
and occasions adequate to continue the professional development of
Employee.
C. City also agrees to budget and to pay for the travel and subsistence
expenses of Employee for short courses, institutes, and seminars
that are necessary for her professional development, and for the good
of the City.
Section 7. Other Terms and Conditions of Employment.

A. The City Council shall fix any such other terms and conditions of
employment, as it may determine from time to time, relating to the
performance of Employee, provided such terms and conditions are not
inconsistent with or in conflict with the provisions of this
agreement, City Charter, or any other law.
Section 8. General Provisions.

A. The text herein shall constitute the entire agreement between the
parties.

B. This agreement shall become effective commencing April 12, 1983.
C. If any provision, or any portion thereof, contained in this agreement
is held to be invalid or unenforceable, the remainder of this
agreement, or portion thereof, shall be deemed severable, shall not I

RESOLUTION ADOPTING REVISED ANNUAL BUDGET, FY1983, ENDING
JUNE 30, 1983, FOR PUBLIC HOUSING PROJECT IA22-3.
WHEREAS, the City of Iowa City has in effect an annual contributions
contract No. KC9132, for Project IA 22-3, and
WHEREAS, the Department of Housing and Urban Delopment requires the
adoption of the annual budget and any revision by formal resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, in its capacity of the City of Iowa City Housing Authority
that:
1. The proposed expenditures are necessary in the efficient and
economical operation of the Housing Authority for the purpose
of service to low income families.
2. The financial plan is reasonable in that;
a. It indicates a source of funding adequate to cover all
proposed expenditures.
b. It does not provide for use of Federal funding in excess of
that payable under the provisions of these regulations.
3. All proposed rental charges and expenditures will be consistent
with provisions of law and the annual contributions contract.
"Pursuant to the rent schedule approved by HUD, the Iowa City Housing
Authority certifies that it is in compliance with the provisions of
Section 860.407 of Part 860, Subpart D of the Interim Rule published
September 26, 1975, in that the aggregate annual gross rent of
families residing in the dwelling units for the fiscal year beginning
July 1, 1982, will not be less than an amount equal to one-fifth of
the sum of the "Family Income", as defined in 24 CFR 860.403 (F), of
all such families, as evidenced by the following estimate for the
fiscal year:
1. Aggregate Annual "Family Income $283,145.00
2. Total Annual Income Gross Rent $ 70,824.00
3. Annual Rent -Income Ratio 25%"
In addition, pursuant to Section 860.4 of the final rule, effective
December 1982, the Iowa City Housing Authority is in compliance with
Section 207(A) of the Annual Contributions Contract, which states in
part that the Housing Authority is reexamining the incomes of
families living in the project at least once a year.

A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR
TO FURNISH A LETTER TO THE BOARD OF DIRECTORS OF
THE IOWA CITY COdARINITY SCHOOL DISTRICT REGARDING
CENTRAL JR. HIGH SCHOOL SITE
i
WHEREAS, the City of Iowa City and the Iowa City Community
School District are engaged in negotiations concerning the
respective interests of each in the site of the property on
which Central Jr. High School is located, and
WHEREAS, the Iowa City Community School District may wish to
vacate the buildings located on said site at sometime during
the year 1983, and
WHEREAS, the Iowa City Community School District is concerned
that any vacation of the premises would be deemed an abandon-
ment of the use of said property for school purposes, and
WHEREAS, the City Council of the City of Iowa City, Iowa, has
been requested to provide certain assurances to the Iowa City
Community School District that a vacation of the site not be
construed or deemed by the City to be an abandonment should
the matter eventually result in litigation, and
WHEREAS, the City Council agrees to furnish such assurances to
the School District in the form of a letter from the Mayor.
NOW, THEREFORE, BE RESOLVED BY THE CITY COUNCIL OF IOWA CITY,
IOWA, that the Mayor is authorized and directed to furnish, by
letter, the requested assurances to the School District subject
to the right of the Council to review the matter should the
Board request that the time period be extended beyond December
31, 1983.
