RE: Awards for the 1982-1983 Academic School Year
Following is a script for you for the awards ceremony Tuesday
evening, April 26, 1983, at the city council meeting. Please
feel free to change it anyway you like:
Annually, the Mayor's Youth Employment Program, awards individual
enrollees and worksite supervisors for outstanding performance
throughout the academic school year. Selection committee members
Zan Jehle, Ted Halm, and Director Peg McElroy base their decision
on the results of evaluations conducted throughout the year as
well as participation in regular workshops and additional projects
that students undertake by their own initiative. Students and
worksite supervisors are also given the opportunity to nominate
individuals for consideration.
The following young people will receive plaques in the "Outstandin
Enrollee" Category. (Here Mary decide how you want to do this
--Will the student please stand when your name is called and
come forward to receive your plaque --please remain in the front
until all four recipients have received their awards--
1. Ron Be , Iowa City, Northwest Junior student, Veteran's
Administration Hospital Centralized Scheduling, Lynn Blank
and Jaki Allensworth'Worksite Supervisors.
2. Annette Bra t, Oxford, Kennedy High School Student,

AGREEMENTS: The utility company, corporation, Applicant, permit holder or licensee, (hereinafter refer red to as the permit holder)
Agrees that the following stipulations shall govern under this permit.
1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state• and federal laws, franchise rules• and regulations.
regulationsand directives of the Iowa State Commerce Commission, Utilities Division. the Iowa State Department of Health.all rules
and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holdei shall be fully responsible for any future adjustments of its facilities within the established highway right of wav
caused by highway construction or maintenance operations.
4. The Iowa Department of Transportation shall give the permit holder at least 48 hours written notice of any proposed construction
or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's
property occasioned by any construction or maintenance operations on said highway..
6. The permit holder shall take all reasonable precaution during the construction and maintenance of said installations to protect and
safeguard the lives and property of the traveling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall be made in writing to the Engineer whose name is shown below.
8. The permit holder agrees to at all times give the Iowa Department of Transportation timely notice of intention to perform routine
maintenance within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to
the safety of the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department of Transportation
Manual on Uniform Traffic Control Devices for Streets and Highways.
Flagging operations are the responsibility of the permit holder. The original placement of signs and removal on completion of the
work shall be accomplished by the permit holder.
10. Operations in the construction and maintenance of said utility installation shall be carried on in such a manner as to cause
minimum of interference to or distraction of traffic an said highway. 6//

taintenance of said utility and shall reimburse the State of Iowa or the Iowa Department of Transportation anyexpenditure that the

12. The permit holdershall idemnifyand save harmless the Stateof lowa.and the Iowa Department of Transportation fromanyand
!I causes of action, suits at law or in equity or losses• damages, claims• or demands, and from an), and all liability and expense of
natsoevcr nature for, on account of, or duc to the acts or ommissions of said Permit holder's officers, members, agents• represcnta-
•ves, contractors, employees or assigns arising out of or in connection with its (or their) use or occupancy of the public highway under
-lis permit.
1. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement• may be
onsidered cause for shut -down of utility construction operations or withholding of relocation reimbursement until compliance is
ssured, or revocation of the permit. The cost of any work caused to be performed by the State in removal of non -complying
onstruction will be assessed against the permit holder. '
!A. A copy of the approved permit shall be available on thejob site at all times for examination by Department of Transportation
Ifficials.
i5. This permit shall terminate 20 years from date of approval for gas and water mains outside the corporate limits of a municipalit%

Re: Bids for Pipeyard Property
On Wednesday afternoon, bids were opened for the City Pipeyard property -on South
Gilbert Street. All three bids received were for multi -unit residential
development with bid prices all above the $164,000 minimum bid price. The bids
are described below:
(A) James and Loretta Clark from AUR Construction bid $189,000 for a 21 -unit
multi -residential building at a proposed development cost of $700,000,
which includes 9 one bedroom units, 6 two bedroom units and 6 three bedroom
units. The appearance of the development is very similar to Ralston Creek
Village Apartments. Special features include a central laundry facility
and security system wiring. Both conventional financing and Industrial
Revenue Bonds are being considered for project financing. The developer
expects to have the apartments completed by August 1, 1983.
(B) Hawkeye Associates bid $165,000 for a 28 -unit multi -family residential
building which includes 26 one bedroom units and 2 efficiency units. The
developer states the project is designed primarily for elderly tenants.
While the developer anticipates that 20% of the units will be eligible for
Section 8 housing assistance, the financial assumptions of the developer
are predicated upon 10% of the units being Section 8 assisted. The total
development cost is estimated at $915,000 with completion expected within 6
months from the closing on the property.
Special features include a central laundry facility, a security system, an
elevator, a community room, all entrances and apartments accessible for the
handicapped, and a small area reserved for garden plots. The investors
will contribute approximately 25% of the project cost and the balance will
be financed with industrial revenue bonds.
The offer by the developer is "contingent upon a 2,000 pound per square
foot allowable soil bearing capacity at the footing elevations...."
(C) John Roffman Construction Company bid $200,000 for the property and
proposes to construct a 32 -unit complex. All units will provide 2
bedrooms. The building is designed for "...the older, mature, professional
resident,... working downtown, or the elderly."
Special features include extensive parking under the building, an interior
courtyard and walkway so that all apartments face the interior open area,
central laundry facilities and a recreation room. Conventional financing
will be utilized. The anticipated development cost is $1.4 million with
completion expected by September.

The Staff Review Committee composed of members from Housing & Inspection
Services, Planning & Program Development, Public Works, and Legal have
evaluated the pipeyard bids submitted by AUR Construction Company,
Hawkeye Associates, and John Roffman Construction Company. The criteria
used in reviewing the bid proposals included compatibility with
surroundings, developers' past experience and financial capability,
design and appearance, and compliance with City requirements (included in
the offering) and code requirements (e.g. zoning, flood plain, etc.).
Staff recommends AUR Construction Company (James and Loretta Clark) be
designated the preferred developer. In evaluating AUR's proposal
according to the criteria, staff could find no problems. Evaluation of
the other two proposals, however, generated the following list of major
concerns.
A. Hawkeye Associates' Bid.
I. The intention of the developer is to restrict occupancy of the
project to the elderly tenants. The proposal included the use
of IRB financing which requires, by IRS rules, a minimum number
of units provided to persons eligible for Section 8 housing;
i.e., the project cannot discriminate on the basis of age.
2. The proposal was in compliance with the parking requirements
only if it remained as elderly housing. Staff requested whether
or not the developer would amend the land contract to provide
for a restrictive covenant restricting occupancy to elderly
tenants. The developer would not agree to this restriction.
3. The proposal included a contingency based on soil bearing
capacity. Staff requested this contingency be removed. The
developer would. only agree to remove this contingency after
soil testing was completed.
B. John Roffman Construction Company's Bid.
1. The proposal included underground parking as an integral part
of the plan. The developer requested that the City grant a
special exception to provide underground parking within the
flood plain.
2. The parking layout is poorly designed such that it may encourage
the backing out of vehicles onto Gilbert Street and
inaccessibility to some parking spaces.

3. The written material submitted by the developer did not
demonstrate experience in working with projects of this scale.
Several of these projects have requested IRB financing, therefore, staff
will be sending the proposals as well as our recommendation to the Design
Review Committee for their comment. The Design Review Committee meeting
has been scheduled for April 13.

of the revocation from the City Clerk's office. Please set
this matter down for hearing before the City Council at your
earliest convenience.
I am requesting this hearing because I do not believe
that any facts exist "which would have been a ground for
refusal to issue [my] permit" as required by §35-35(a)(2),
Iowa City Code. Nor do I believe that it would be detrimen-
tal to the safety, health, and welfare of Iowa City residents
for me to continue to hold a driving permit. Thank you for

Our office represents Advanced Drainage Systems, Inc., which
firm has operated a plant for the manufacture of drainage tubing and jI
related items at 1301 Sheridan in Iowa City since 1969. We have been
1 requested to object, in the strongest possible terms, to the proposed
zoning classification of RM 12 for this property.
The property in question has been used for industrial purposes
since at least 1899. This information has been obtained both through
I my own research and that of Irving B. Weber, who wrote an article on
this property for theIowa City Press -Citizen several years ago. A
wide variety of industrial uses have occurred in connection with the
property. At the time of the leasing of the property by ADS in 1969
the property was being used for warehousing and for seed cleaning
and processing. The latter activity had led to an infestation of
the property by rodents and the property was in a dilapidated condition
at the time of occupancy by ADS. Improvements were immediately i
undertaken, such as new electrical wiring, although many of these
improvements were not immediately apparent externally. In the Spring
of 1970 an effort was undertaken by certain residents in the immediate
j vicinity of the property to have the zoning classification changed
i from M-1 to R-2, which was vigorously resisted by ADS and the then -
Lessor of the property. A commitment was made at that time by ADS
that, if the zoning classification was left unchanged at M-1, ADS
would repair and rehabilitate this property so that the property
i would be both structurally sound and physically attractive. The City j

Council at that time voted 3 - 2 against the proposed rezoning, and
ADS immediately undertook the rehabilitation of the property.
External improvements included remodeling of the front of the
building, coating and painting of all exterior walls, construction of
a screening fence, the addition of significant plantings along
Sheridan Avenue and the hard surfacing of more than one block of
Oakland Avenue, as extended past the ADS property. Several years
ago, ADS also exercised an option to purchase the property under the
lease by which it had originally occupied the premises. We submit
that ADS has fully and punctually performed all of the obligations
which it undertook in 1970 in connection with the rezoning matter and
has created an attractive light industrial facility which is a credit
to the company and to this community.
As you know, the creation of a nonconforming use imposes
substantial penalties upon the property owner, including the inability
to substantially expand or remodel the facility and the inability to
restore the property following a substantial casualty loss. These
factors obviously have a significant impact upon both the market
value of this property and the future of ADS in Iowa City. A
casualty loss would cause more than the usual number of problems for
ADS because of the economics of the drainage material business and
the cost of shipping as a portion of the total cost of the product.
If the zoning would necessitate that a new site for a plant be
obtained following a casualty loss with the time required in making
such a selection, this could cause substantial financial hardship to
ADS.
I am also concerned about the signals which such a rezoning
would give to other businesses interested in locating in Iowa City.
This has certainly been a high quality small industry which has been
of considerable benefit to this community. The City Council has
indicated substantial interest in economic development and I believe
that the zoning of this property to a residential classification might
well be taken as an indication that the city was not committed to
economic development.
It appears to me that the combination of all of the factors
above set forth strongly indicates that the property should remain in
a zoning classification very similar to that in which it is presently
located.

I respectfully request that you waive the rule requiring
three considerations before the final passage of an ordinance
in respect to the above -referenced rezoning application, and,
at the next regular Council meeting, finally consider and adopt
the ordinance rezoning Van Buren Village Ltd. Is property from
M1 to R3A. I realize that this is a matter completely within
your discretion. However, I think there are several good
reasons for expediting this rezoning:
First, the rezoning application has been pending
since November 8, 1982, the date it was filed with
the City Clerk. Under normal circumstances, the
ordinance would have already been given final con-
sideration by the Council. In this case, we agreed
to deferral at the request of the City staff and
Planning and Zoning Commission, pending the update
of the comprehensive plan. That delay cost us ap-
proximately 2-3 months time. We hope to recover a
very small portion of that time by speeding up the
process at the very end.

Second, the rezoning has been favored by everyone
involved, including City staff, Planning and Zoning
Commission, and Council itself. It is consistent
with the comprehensive plan update. At no point
has anyone objected to our rezoning application.
Finally, the property is going to be developed pur-
suant to an approved LSRD plan. At the present
time it is an unimproved eyesore and serves no use-
ful purpose. We will be constructing apartments to
provide badly needed housing. Our development will
also beautify the area and increase the community's

Thank you for your letter of April 13, 1983, to the City Council

regarding the preservation of ravines in the Manville Heights area.
Most of the ravines in that area are privately owned and the City has
limited authority to regulate the use of private property. The
exception, of course, is that all zoning and other land use
regulations do apply, as in the case of the 12 -unit condominium to
which you refer. Only a downzoning of that property could have
prevented construction of those units.
Filling a privately owned ravine, if not done properly, might
adversely impact natural drainage. This is prohibited in most
instances and in the event an adjacent property suffers damage, the
property owner filling a ravine may be liable for that damage. The
aggrieved party would, naturally, have to initiate legal action in
order to recover such damages.
A developer in the Manville Heights area has indicated a desire to
access the parking area of a new apartment building by way of an
alley which is currently a ravine. Although the right-of-way for
that alley exists, it is City -owned and has never been opened for use
as an alley. Only the City Council has the authority to open that
right-of-way for alley use. The Council has not addressed this
question thus far. However, every Councilmember has received a copy
of your letter to consider at such time as a decision in this regard
may be necessary. At the current time, most publicly owned right-of-
way in areas of rough terrain such as the Manville Heights area
remains in its natural state.

I am writing in regards to the application to rezone certain
property at 521 Kirkwood Avenue. I attended the meeting
April 4, 1983.
Someone stated at that meeting a traffic engineer said
Kirkwood Avenue would be able to i;andle this extra traffic.
I wonder if he ever tried backing out of a driveway to get
on Kirkwood, also if he ever tried getting on to Kirkwood
from Webster, Z).ian_glDodge, Keokuk and Summitt Streets.
He should try sometime and see hour long it takes him to get
on Kirkwood. Yesterday noon when I wanted to go back to
work, I had to wait ten minutes to get on Kirkwood.
Webster Street is already packed solid with cars on the
east side of the street, as t:lis is the only side you
can park on. If an apartment complex were built on this
site, they would be coming to park on Webster as this is
the closest street to the site. Seems to me property
owners living here should have priority to park. We are
the ones who pay taxes. They rent these apartments to
two and three people who all have cars but they don't
provide parking spaces for that many.
Apartments were stopped from being built over in Manville
Heights as to traffic and so forth. Seems to me traffic
is a lot heavier .on Kirkwood than over there. Also it
was stopped at College Hill Park. Is this social economic
discrimmation for our neighborhood, if these apartments
are allowed to be built.
Sure the purchaser would like a return for his investment,
maybe sometime we would like a return on our property we own.
If this apartment complex went in, we would not be able to
sell our property because of this and the heavy traffic on
Kirkwood. the purchaser probably was looking for a tax
shelter; put up an apartment complex; probably hold it
for five years and then sell so lie could take a tax loss.
khat would mean another owner; would we have something like
Lakeside.
I hope you give this real good consideration before you
decide what should be done.

p It is our understanding that John Nolan has requested that the City
Council open the platted alley which abuts the property at 204 McLean
i Street in Iowa City and establish its grade. At the present time, the
platted alley is an undeveloped ravine. At the hearing before the Board
y of Adjustment on March 2, 1983, regarding the building permit for the
property at issue, Mr. Jim Shive, an engineer, presented testilrony regard-
ing the difficulties with regard to filling and opening this alley. In his
opinion, it would be necessary to obtain construction easenents from the
abutting property Owners or to construct retaining walls within the alley

It has come to my attention that your stand in the above
matter is that there are no alternatives for cars and bicycles.
As a concerned citizen of Iowa City, as well as a frequent bus
rider, I hope that you will reevaluate your position. It seems
hard to believe that cars must necessarily use that small area
in front of the mall. Drivers will not be unduly hampered in
having this small area closed to their use. Instead, I believe

The one significant risk of injury
from a transmission line is the
danger of electrical contact. Elec-
trical contact between a grounded
object and an energized conductor
can occur although the two do not
actually touch. In the case of
high-voltage lines, electricity will
are across an airgap. For example,

varies with the strength of the
voltage. Unlike the wiring at
home, the conductors of overhead
transmission lines are not en-
closed in solid insulation.

facility, or vehicle that could come
near the energized conductors.

The 14 -foot limitation is a general
standard applicable in the worst
possible situations. In many in-
stances, it can be exceeded without.
any problems. Instead of enum-
oatingnll situations, we sug-
gest again that you contact the
nearest BPA office If you have it
need to exceed the 14 -foot.

Induced Voltages
Under certain conditions, a per-
ceptible electrostatic voltage can
he induced on such objects as n
Felice, metal building, or irrigntion
system. This can happen when the
object is near a high volinge
transmission line and is insulated
from the ground.

The magnitude of an induced ..dt-
age depends on the voltage of the
transmission line, distance from
the conductor, size or length of the
object, and its orientation to the
line. Shocks caused by an induced
voltage do not usually present a
hazard; in which case, we refer to
them as nuisance shocks. Ilow•-
ever, mitigation methods to re-
move the possibility of hazards are
identified in sections of the booklet
that fellow.
Safe practices for various situa-
tions— including those involving
irrigation systems, wire fences,
and metal buildings — are dis-
cussed below.
Irrigation Systems
All types of irrigation systems
have been operated safely near
BPA powerlines for years.
Nonetheless, caution should be
used in storing, handling, and in-
stalling irrigation pipe and in ap-
eratingspray irrigation systems
near powerlines.
Irrigation pipe should be
moved in it horizontal position
under and near all poNverlines
to keep it away from the con.
duclorsoverhead.
Again, we stress that the one criti-
cal hazard from overhead lines is
the danger of bringing an object —
in this case a length of irrigation
pipe — into close proximity to a
conductor. One purpose of this
booklet is to repeatedly make this
warning. BPA has suggested to
manufacturers that they affix to
each section of pipe it warning not
to lilt the pipe into electric lines.
This is, perhaps, the most practi-
cal way to provide such it warning.
As a precatit ionarry measure,
equipment used to install irrigo-
lion systems should be kept away
from transmission lines Mile
equipment exceeds 1.1 feet in

working near a line, it is wise to
supplement normal precautions
by assigning one person to act as a
"safety watcher." 1 -ie simply stands
by,, watches, and warns the other
workers against unsure moves.
Great caution sherd be used
when moving a high-pressure ir-
rigation system, such asa Vermeer
mobile system, under a transmisr
sion line. The small wheel bases of
some of these systems tend to
make them unstable. If one should
tip while under a line, its boom
could be lifted into a conductor.
You may notice some static voltage
when unloading irrigation pipe
near transmission line. The
voltage is induced and in this case
is it nuisance rather than a hazard.
It can be reduced greatly or elimi-
nated entirely by unloading the
pipe at least 50 feet away from the
line. This also tends to reduce the
risk that the pipe will get too close
to the conductors. Even if pipe
stacked on a rubber -tired vehicle
is unloaded under a transmission
line, the possibility ofnuisance
shocks can be eliminated by
grounding. The grounding is done
by clipping one end of a wire to it
metal rod driven into the ground
and the other end to a pipe on the
bottom of the stack.

All types (if systems, including
center pivot systems, can be oper-
ated safely near or on the right -
of --way: However, irrigators should
avoid situations where a solid
stream of water can come in can -
fact with a conductor even if the
possibility is remote. Should this
occur, it person in contact with the
irrigation system, orstanding
very near it (say .i reel or so), may
encounter a severe shock. When
asked, BPA will provide assistance
as to the installation at- operation
of an irrigation system to avoid
hazardous situations.
Ifa sprinkler malfunctions and a
solid stream of water reaches a
conductor, turn off the water at its
source — by switching off the
pump — before attempting to cor-
rect the problem.
All nozzle risers in the vicinity ofa
transmission line should be
equipped with spoilers or auto.
matic shutoffs. This will prevent a
solid stream frontstrikinga con-
ductor if it nozzle breaks or falls
off.

Equipment with small diameter or
Fine mist spray nozzles is not ordi-
narily a problem. A broken spray
will not conduct a significant
amount of current. The use of Fer.
tilizer is a factor that needs to be
considered in determining the
conductivity -ora stream of water.
High volume irrigation systems
which use large nozzles and high
pressure to sprinkle big areas are
a special problem. Nozzle diame-
ters vary from % inches to I I`Iha
inches and water pressures range
from 80 to 100 psi. Thus, a solid
stream discharged from a nozzle
may reach heights of 30 to 35 feet
and go as far as 200 feet. When
such a system is in operation, a
safe distance must be kept be-
tween it and a transmission line.
If requested, BPA specialists will
gladly help you determine what a
safe distance is for your equip-
ment. Contact the nearest 13PA of-
fice if you want help.
Any problems, including nuisance
shocks, with irrigation systems
parallel to a transmission line and
within the right-of-way can be
avoided during maintenance and
assembly by grounding each sec-
tion of pipe more than 200 feet
longatench end. Groundingnt
these points is usually ac-
complished by driving a ground-
ingrod at least 2 feet into the earth
and attaching a wire equipped
with clamps between the pipe and
the rod. If you want any informa-
tion on grounding or assistance
from BPA, plense contact us. In ex-
treme situations, failure to ground
a pivot irrigation system opera-
ting within the right-of-way and
parallel to a line can cause n seri-
ous hazard. Again, contact IWA
with respect to your particular'
situation.
Underground Pipes
Underground pipes and transmis-
sion lines are compatible, but in-
stallation and maintenance must
be done properly. Generally, un-
derground metal pipes should not
pass under a line or be installed at
less than a 60 degree angle to the
transmission line centerline and
generally should not be installed
closer than 53 feet to a BPA struc-
ture or the buried grounding sys-
tem located around the structure.
In some situations, an under-
ground pipe can be located without
observing these practices. Contact
BPA if you have n question about
your particular situation.
Proper orientation of the line and
irrigation system is required to
prevent an accident in an extreme
case where a fault on the trans-
mission line mightcause electric-
ity to are from the conductor to the
tower and go to ground. This could
produce a voltage on the entire
underground piping system. The
fault would Inst less than half
second, but it could be dangerous.
Wire Fences
Barbed wire and woven wire
fences insulated from ground on
wood posts can assume an elec-
trostatic voltage when located
near transmission lines. Nor-
mally, the voltage will not be
noticeable. BPXs present practice
is to ground a wire fence on wood
posts near all 500,000 -volt lines,
and near other lines upon proper
investigation if the fence:
• Crosses the right-of-way
• Parallels the line within 125 feet
of the outside conductor and is
longer than 150 feet.
• Parallels the line 125 to 250 feet
from the conductor and is longer
than 2,000 feet.
These fences are grounded at each
end and every 200 feet with a
metal post driven at least 2 feet
into the ground. The wire strands
of the fence are attached to the
metal post. The grounding posts
are installed at least 50 feet from
the nearest transmission tower
and its grounding system. If you
have any questions about the need
for grounding, call the nearest
BPA office. These grounding prac-

Electric Fences
In certain situations BPA provides
electric Filters to ground 60 -Hz
voltages induced by a powerline.
These filters will allow the charg-
ing voltage on the fence to be effec-
tive. BPA provides these filters if
the electric fence:
• Crosses the right-of-way
• Parallels the line within 60 feet
of the outside conductor and is
longer than 1,000 feet.
• Parallels the line 125 feet of the
outside conductor and is longer
than 2,500 feet.
Electric fences not equipped with
chargers approved by the Under-
writerLaboratories —even if
transmission lines are not present
— may carry voltages and cur-
rents that are hazardous to anyune
touching the fence. In these cases
where a BPA line is located near
an existing charger that is
hazardous, BPA will provide a

Buildings
Metal buildings are buildings
whose frame, roof, or walls consist
of substantial amounts of metal. A
voltage induced on a metal build-
ing is usually drained away
through the buildings plumbing,
electrical service, metal sheeting,
or metal frame. Nonetheless,
BPA's present practice is to ground
such a building near a 500,000 -
volt line if:
• The metal building is within 100
feet of the outside conductor of
line.
• The building has more than
2,000 square feet of metal sur-
face and is within 150 feet of a
transmission line.
• The metal building is used to
store flammable materials and is
within 250 feel of it line.
One grounding rod is adequate for
n building with less than 2,000
square feet of metal surface. Two
grounding rods are used if build.

square feet. Even if the metal sur.
face is less than 2,000 square feet
an extra grounding rod can be
used in case one is damaged or
develops a high-resistance con-
tact.
Aluminum windows, downspouts,
gutters, or other metal parts on
buildings constructed of wood or
other insulating materials may
also require grounding.

Vehicles
A vehicle under an extra -high-
voltage line will not normally
carry an induced voltage because
the electric charge drains away
through the tires since most tires
are semi -conducting. An even bet-
ter path to ground can be achieved
by attaching a chain to the vehi-
cles that reaches the ground. But
even then one can still get a nui-
sanceshock if the vehicle is parked
on a nonconductive surface such as
dry rock.
Theoretically, it is possible that an
electric spark from an induced
voltage could ignite gasoline
vapor that is created during re-
fuel ing of a vehicle. We have never
had a report of a refueling accident
near our lines. Such an accident
could occur, but the vehicle would
have to be completely insulated
from ground. and the fuel and air
would have to mix together in pro-
portions that would have to be al-
most exactly right for an explo-
sion. The chance that all these
conditions would occur simultane-
ously is remote.
Because such an accident is
theoretically possible BPA rec-
ommends that vehicles be at least
70 feet 6rom an extra -high-voltage
line when they are refueled. If a
vehicle cannot be moved, connect
the metal fuel can to the vehicle
with n jumper wire before re.

Lightning
Lightning will usually strike the
highest nearby object. In rural
areas, this may be a powerline
tower or conductor. Transmission
facilities are designed to with-
stand lightning strikes by chan-
neling them to ground. When
lightning strikes a tower, the
damage is usually much less than
if a barn or tree had been hit.
Play it safe. Stay away from tow.
ers and other tall objects during
electrical storms. Lightning is
dangerous if one is standing near
where it enters the ground.

Smoke and hot gasses from a large
fire can create a conductive path.
When a fire is burning under a
transmission line, an electric cur-
rent could arc from the conductor
to the ground, endangering people
and objects near the flashover.

Metal Objects
As a precautionary practice, do not
raise any metal object more than
14 feet in the air underneath a
transmission line.
When you mount an antenha on a
large vehicle, do not let it extend
more than 14 feet above the
ground.
Before you sail a boat in a lake or
river, check the allowable clear-
ance under any transmission line.
We recommend that all masts or
guy wires above the deck be con-
nected electrically to an underwa-
ter metallic part such as the keel
or centerboard. This precaution
against lightning or accidental
contact with a powerline may save
your life.
Swimming pool skimmers should
not be raised vertically under any
powerline. BPA strongly discour-
ages the building of swimming
pools within BPA rights-of-way
because of the possibility of
an accident.

Extreme caution should be used
when felling n tree near a trans-
mission line. If the tree should fall
into the line, it can become a con-
ductive path to the ground and en-
danger anyone standing near the
base of the tree.
Pacemakers
If a person with a pacemaker is in
an electrical environment and the
pacemaker begins to produce a re-
gularly spaced pulse that is not re-
lated to a normal heartbeat,
the person should leave the envi-
ronment and consult a physician.
Experience shows that the mng-
nelic field created by transmission
lines have not affected the per-
formance of cardiac demand
pacemakers. This experience is
supported by a September 1976
statement from the Food and Drug
Administrntion's Bureau of
Radiological licalth:
"Any possible problems with
pacemaker malfunction from elec-
tromagnetic inter/en-nee have been

A recent incident involving the cutting of several
hardwood Mapel trees in the Burlington/Summit Street area
prompts this letter.
It seems to me as though the proper role for City
Forestry should be to plant and nurture trees rather than cut
them. I was specifically informed by the City Forester, that
he had marked 41 trees for cutting because people wereNlin
danger of trees falling on them!Y
A rough calculation based on 150 year history of our
City at an average population of 20,000, yields odds of 3 million
- 1 against being fallen on by a tree in any given year. I
frankly am willing to take that risk in exchange for the
aesthetic benefits.
I respectfully request that for the good of our City and
your own personal edification, you be known as leaders who
prompted tree planting for the future generations, as we have
been favored in the past.
on a slightly different approach, one of your colleagues
advises me that the arguments advanced in favor of the recent
prohibition against tree planting in the sidewalk parking
involve the following:
1. The root disruption of sidewalks;
2. The conflict with utility easements;
3. Other less specific reasons, such as branches
falling in the street and on cars and so forth.

While I recognize there is a value judgment involving
the cost/benefit ratio, anyone who appreciates the shade and
beauty of the tree -lined Streets, will conclude that the
benefits clearly outweigh the attendant expenses which may
occur every 50 or 100 years in the repair of the disruption
that may be caused by any particular renegade tree.
The aesthetic and other value and beauty is continuous
and far outweighs whatever cost may be caused thereby; and
on that basis, I suggest that you reverse the policy against
planting trees in sidewalk parkings and promote the plantings
of gracious and stately hardwoods as your legacy to the future.
I also suggest that before any trees are slaughtered by
the City forester, adequate notice be given by signing on
each particular tree so that neighbors, and other persons
directly concerned therein, can have their fair notice and
opportunity for timely response. When the only meaningful notice
is a fresh stump, the protest however aggrieved, is far more
hollow than the remaining stump.

workshops for the P.V.O.M. were both cancelled). A poll of
other community programmers would certainly reveal similar

HaLwkeyels programming staff has, in all fairness, tried
to be accommodating. My shoot was salvaged by staff member
Sandy Terzis, whose ingenious creativity and diligent effort
over many hours provided a system rigged from a hodgepodge
Of equipment designed for other purposes (including some
borrowed from the public litrary) and countless adapters,
connectors, and cables. The staff has also provided extra
editing time, as it will take nearly three times as long to
edit the footage.
However, I was still forced to communicate with my camera
crew using hand delivered notes and can clow use only direct
cuts between cameras. It is an absurdity that this project
received a community programming grant to i,improve the
quality of production,, when the absence of vital equipment
makes it next to impossible to produce anything at all.

Equipment
Dear Ms. Fearing:
Thank you for your letter concerning your difficulties in
accomplishing your goals using Hawkeye CableVision's equipment. We
::ant to hear from anyone regarding their cable related problems,
because this is one of the ways we can best keep up with such
problems and best serve the public.
You are correct in your understanding that Hawkeye CableVision has a
franchise agreement with the City of Iowa City and that in this
agreement there are certain provisions for equipment that Hawkeye is
to make available for video access production purposes. The contract
specifies that the equipment is to be maintained by Hawkeye without
specifying such things as the time frame within which the equipment
must be repaired (i.e. is one day or two weeks a reasonable 'amount of
time to have the equipment repaired?) or when the equipment should be
replaced and can no longer be adequately repaired (i.e. can the
equipment first bought by Hawkeye CableVision be offered throughout
the entire franchise or must new equipment be purchased at some point
when the original equipment is malfunctioning regularly, etc?). As
you can see, there are many questions left unanswered.
The BTC has been monitoring the situation for several months and has
been noting the problems that have arisen. Rather than becoming
involved on a day-to-day basis with access operations and equipment
problems, the role of the BTC is best fulfilled by recommending to
the City Manager a policy to deal with these problems. This
recommendation suggests that Hawkeye's franchise proposal offers a
minimum standard of equipment to be available to all access users,and
that this equipment should be available 100% of the time. The BTC
further recommended the City Manager make use of his powers under
Section 14-75(d)(3) of Ordinance 78-2917 to remedy any situation in
which Hawkeye is not complying with this recommendation. A remedy
may be made by the lease or purchase of the equipment in question or
any other method deemed appropriate by the City Manager. Please find
attached a copy of the BTC's recommendation on this matter.

This policy recommendation and the equipment problems it intends to
resolve apply only to the equipment Hawkeye Cablevision offered in
its proposal to the City.
We are aware that the local Community Programming Center staff have
been doing their best in trying to maintain and repair equipment and
to assist community producers wherever possible when problems such
as the one you decribe occur. Unfortunately such equipment problems
have increased and have been complicated in the last three years by
the unexpected high demand on the existing equipment, as well as by
the apparent lack of an adequate equipment replacement schedule.
It is intended that the BTC's policy recommendation will eliminate
the equipment problems in the portable and studio video equipment
area. Further, it is hoped that Hawkeye CableVision will realize the
seriousness of this problem, recognize the interests and needs
expressed by the high demand for community programming in Iowa City,
and 1) comply with this policy and 2) replace equipment when it is
worn out. In addition, it is hoped Hawkeye will expand their
equipment offerings to the public (as they have in fact done to some
extent) in the same spirit they have written about and spoken to
regarding their support of community programming. It was this
characteristic, to a large degree, that set Hawkeye Cablevision
apart from its competitor for the local franchise and one of the
major reasons it was granted the franchise in Iowa City.

An issue relevant to this subdivision is sewer capacity. Although the 21 inch
sewer line installed to serve this development has ample capacity, that line
empties into the northeast trunk sewer. This sewer subsequently drains into
the Jefferson Street branch of the "horseshoe" sewer which currently has
surcharge problems. The 1983 Comprehensive Plan Land Use Update states that
development on the east side should be discouraged at this time and postponed
until sewer problems are solved. The Planning and Zoning Commission has, in
previous discussions, indicated that they will not be willing to approve new
plats which have not received any commitment prior to adoption of the updated
comprehensive plan. The preliminary plat in question was previously denied
pending construction of the new 21 inch sewer. However, the issue of platting
the property was directly addressed as part of an agreement between the City
and the applicant signed in June, 1982 (attached to Staff Report Z-8305
regarding the requested rezoning of this property).
The primary vehicular access for the proposed development is via First Avenue
extended. As platted, the right-of-way for this road extends onto Regina High
School and Iowa City park land (Hickory Hill) property. This should be
forwarded to the Parks and Recreation Commission for their comments. An
agreement to dedicate this right-of-way must be obtained from the High School
prior to approval of the preliminary plat. North of the planned intersection of
Stuart Court and First Avenue extended, the road will cross the north branch
of Ralston Creek. The City has agreed to participate in the construction of a
bridge across the creek by providing the necessary culverts. This work is
scheduled for 1984.
A secondary access is provided from Rochester Avenue via an existing private
drive - Bluffwood Lane. The Engineering Division has indicated that the City
could accept this road as a public right-of-way if it were brought up to design
standards acceptable to the City. Given the topography of the area, this may
difficult to do. However,
with
it is desirable since the road connects directly
with a proposed public street it
and will serve as an access point for
this development. If the road is not improved, its intersection with public
street right-of-way should be redesigned to create a clear separation and to
discourage use of the private drive. If it is not accepted as a public right-of-
way, a public access easement will be required with the final legal papers.

Storm water detention will not be required for this development because of its
close proximity to the north branch storm water storage basin. The applicant
will, however, be required to provide 100 year storm drainageways to the basin.
As proposed, the preliminary plat includes part of a tract of land located north
of Ralston Creek. If this area is included in this plat, all of the tract of land
should be shown.
STAFF RECOMMENDATION
Staff recommends that the preliminary plat of First and Rochester, Part 1, be
deferred. Upon resolution of the issues raised above, and the deficiencies and
discrepancies listed below, staff recommends that the plat be approved.
DEFICIENCIES AND DISCREPANCIES
1. There appears to be a discrepancy in the drainageway and storm water
storage easement area shown on the plat.
2. The proposed First Avenue right-of-way must remain within the property
described, or dedication agreements must be provided.
3. No fire hydrants are shown on First Avenue north of the Stuart Court i
intersection.
4. The Pollution Control Department policy requires that all sanitary sewers
be placed in the street right-of-way for ease of maintenance.
5. The proposed water mains shown are not sized. The Iowa City Water
Department requires a 12 inch main for First Avenue and 6 inch mains on
the other streets.
6. The Water Department requests that a 6 inch water main be extended to the
end of the subdivision along Bluffwood Lane. If Bluffwood Lane is
improved and accepted by the City, the water main should be extended to
Rochester Avenue and tied into an existing main.
7. A storm sewer should be extended to the ravine between First Avenue and
Stuart Court to collect storm water runoff. This sewer should be
connected into the proposed storm sewer system which dumps into the
North Branch Dam detention basin.

8. The City has proposed to construct a water storage tank on the parcel of
land labeled exception #4 on the preliminary plat. A 15 inch overflow storm
sewer will have to be constructed to connect this water tank to the storm
sewer mentioned in item 7 above. The City requests a 30 foot sewer
easement in the ravine between First Avenue and Stuart Court for the
future installation of this overflow line.
9. The legal description does not close within the proper limits. This must be
corrected prior to submission of the final plat.

On April 7, 1983, the Planning and Zoning Commission took action on
two applications pertinent to the above subdivision. First, they
recommended approval of the proposed rezoning of approximately 40
acres from RIA to R3 and RIB. Second, they voted down a motion
recommending approval of the preliminary plat subject to resolution
of the downstream sewer capacity problems and permission from Regina
High School to use their property for public right-of-way purposes.
Subsequently, at the April 12, 1983 City Council meeting, a
discussion occurred between the City Council and Jane Jakobsen of the
Planning and Zoning Commission regarding whether the Commission had
been made aware of the City's obligations for future consideration of
this subdivision as outlined in an agreement between the City and
Plum Grove Acres, Inc., owners of the 40 acre tract in question. The
Council was informed that the Commission was unclear of the actual
obligations established by this agreement. The purpose of this memo
is to clarify for the City Council the information provided to the
Planning and Zoning Commission regarding the agreement.
First, a copy of the agreement itself was attached to the staff
report regarding the requested rezoning which was sent to the
Commission for their March 17, 1983 meeting. A question was raised
by the Commission at that time as to whether the agreement
specifically stated that the City was required to approve a
subdivision of this property. The Commission was informed by staff
that although the language of the agreement did not specifically
state that approval was required, it was staff's understanding that
that was the intent. It was also pointed out that the agreement
language in no way committed the City to approving a rezoning
request. Further, at the April 7, 1983 Planning and Zoning
Commission meeting, staff again pointed out to the Commission that it
was their understanding that the agreement in question was
interpreted by Council as committing the City to approve the
requested rezoning. Staff also reiterated the fact that the
agreement contained no language regarding approval of a rezoning and
expressed concern to the Commission that their action to approve the
rezoning and deny the subdivision may result in the subsequent
approval of both applications due to the Council's previous
commitment to approve the subdivision.

I do want to thank the members of the Iowa City Council for appointing
me as one of the members on the new Commission on Historic Preservation. I
must admit to being quite pleased with the way thinking and planning by both
elected and appointed members of the city government and most employees of the
city has changed in direction over the past 10-12 years to enable portions of
the city heritage to be preserved and used in a useful manner. I did feel
quite privileged to have been able to be a part of the process of writing the
ordinance which is now enacted and I had hoped to be able to help with its
early implementation.
Last Tuesday I was notified that I had been awarded a Senior Fulbright
Lecture Assignment for Pakistan. My family and I will leave Iowa City early
this Summer and return the middle of August next year (1984). This is an
outstanding opportunity to lecture and travel in Pakistan, Nepal, and India
together with some stops to and from that part of the world.
I tender my resignation to the Historic Preservation Commission at this
time so you can appoint another to work on it. I do hope that upon my return
in a year I may once again be given the opportunity to work with this group.
I will be in town until late May and will work with the Commission until that
time or until you have appointed a successor to me. I would like to attend the
Commission meeting on April 27 as this is their first and I feel I can have
some input as to the first things they should be concerned with. I did spend
considerable time with Mr. Jansen during the writing process and hope to impart
some of the unwritten details that might help in operation. I feel badly
about resigning after having so recently been appointed and after having badgered
the Council for so many years about getting this done. I had no idea in my
wildest dreams that I would ever get a Fulbright and obviously cannot turn such
an opportunity down.
I do imagine that Sister Venarda will be delighted when she finds I am
leaving town. Stick to your guns on the Central property and please keep the
city together until I return.

April 26, 1983 - October 26, 1984
Iowa City appointed members of boards and conmis-
sions must be qualified voters of the City of
Iowa City.
It is the duty of the Board of Electrical Exami-
ners and Appeals to periodically review the
Electrical Code and make recommendations thereto to
the City Council, to prepare and conduct written
and oral examinations, to suspend or revoke any of
the licenses or certificates for due cause, to act
as board of appeals to hear grievances arising from
a decision of the -electrical inspector and to pro-
vide for reasonable interpretations consistent with
the provisions of the Electrical Code.
This appointment will be made at the April 26, 1983
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for this position should contact the City
Clerk, Civic Center, 410 East Washington. Appli-
cation forms are available from the Clerk's office
upon request.

PART 1 -- HEARING PROCEEDINGS
April 26 , 1983
The City Council of Iowa City, Iowa, met in regular
session, in the Council Chambers, Civic Center, 410 E.
Washington Street, Iowa City, Iowa, at 7:30 o'clock P.M., on
the above date. There were present Mayor Mary C. Neuhauser
in the chair, and the following named Council Members:
Balmer, Dickson, Erdahl, Lynch, McDonald,
Perret
Absent: None
The Mayor then called for objections to the adoption of
the proposed Resolution of Necessity for the construction of
the 'St. Anne's Drive Special Paving Project -1983 in the
corporation, pursuant to notice of the time and place of
hearing duly published and mailed, and.pursuant to prior
action of said Council; and announced to those present at said
Council meeting that both written and oral objections would be
received and considered .by the Council at this time. Written
and oral objections were then received or heard'.
Council member Perret moved that the time
for the receiving of object ons be closed. Seconded by
Council member Dickson On vote, the motion was
adopted.
After reviewing'all the'objections received, the Council
found and determined that no remonstrance, pursuant to the
provisions of Section 384.51 of the City Code of Iowa, was
filed with the Council, pertaining to the proposed improvement
as set out in said Resolution of Necessity as originally
proposed. .
