line for the transmission of electricitY
The installation shall consist of construction of one span `of 13,200 3 phase line across
and will be located as shown on the detailed plat attached hereto.
AGREEMENTS: The utility company,corporation,applicant, permit holder or licensee, (hereinafter referred to as the permit holder)
agrees that the following stipulations shall govern under this permit.
I. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules. and regulations.
regulations and directives of the Iowa State Commerce Commission, Utilities Division, the Iowa State Department of Health. all rules
and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way
caused by highway construction or maintenance operations.
4, The Iowa Dcpai Intent of Transportation shall give the permit holderal least 48 hours written notice of any proposed construction
or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's
property occasioned by any construction or maintenance operations on said highway.
6. The permit holder shall takcall reasonable precaution during the construction and maintenance of said installations to protect and
safeguard (he lives and property of the Ira "ling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall be made in writing to the Engineer whose name is shown below.
R. The permit holderagrces loaf all times give the Iowa Department of Transportation timely notice of intention to perform routine
maintenance within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to
Qac safety of the public. Traffic protection shall be in accordance with Part \11 of the current Iowa Department of l ransportation
Manual on Uniform Traffic Control Devices for Streets and Highways.
Flagging operations are the responsibility of the per mit holder.1 he original placement of sign+and removal on completion of the

1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the
current Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state. and federal laws• franchise rules, and regulations,
regulationsand directives of the Iowa State Commerce Commission, Utilities Division. the Iowa State Department of Health,a11 rules
and regulations of the Iowa Department of Transportation, and any other laws or regulations applicable.
3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way
caused by highway construction or maintenance operations.
4, The Iowa Department of'rransportation shall givc the permit holder at least 48 hours written notice of any proposed construction
or maintenance work, on either existing or ncw9y acquired right-of-way, that is likely to conflict with the installation belonging to the
permit holder in order that the permit holder may arrange to protect its facilities.
5. The Stoic of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's
property occasioned by any construction or maintenance operations on said highway.
6. The permit holder shall take all reasonable firccautionduring the construction and maintenance of said installations to protect and
safeguard the lives and property of the traveling public and adjacent property owners.
7. The permit holder agrees to give the Iowa Department of Transportation forty-eight hours' notice of its intention to start
construction on the highway right-of-way. Said notice shall he made in writing to the Engineer whose name is shown below.
g. The permit holder agrees in at all times give the Iowa Department of Transportation timely notice ofintent ion toperform routine
maintenance within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The permit holder, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to
the safety of the public. Traffic protection shall be in accordance with Part 1r1 of the current Iowa Department of Transportation
Manual on Uniform Traffic Control Devices for Streets and Highways.
Flagging operations are the responsibility of the permit holder. The original placement of signs and removal on completion of the
work shall he accomplished by the permit holder.
10. Operations in the construction and maintenance of said utility imtallation shall be carried on in such a manner as to cause
minimum of interference to nr distraction of traffic on said higheay.

According to Chapter 331.906 of the Code of Iowa, during
June the County Auditor convenes a convention for the purpose of
selecting new members for the County Compensation Board. The
Compensation Board traditionally meets during the month of
October in each year, and in a series of public meetings, recom-
mends what the salaries of county elected officials should be.
All town councils in Johnson County shall send a representa-
tive from their town council to the convention.
The purpose of the convention, which will be held at 7:30
p.m., June 30, 1983, at the Johnson County Courthouse in Iowa
City, will be to appoint two members to the Compensation Board.
One member will serve through June of 1985 and will be chosen by
the representatives of the town council at the convention from
among the town council members. The second member will serve
through June of 1987 and will be chosen by the representatives of
the town councils at the convention from among the members of the
general public.
For the next meeting of your town council, please place an
item on the agenda for the council to appoint a representative to
attend the convention. The Board should appoint a person who
will definitely be able to attend. If there is a lack of atten-
dance and there is no quorum, the meeting will need to be res-
cheduled, and those who did attend will have wasted their valu-
able time.
Please inform the person elected by the town council as a
representative to the convention, and provide the Auditor's
Office with a copy of that notification.

A question has come up as to whether or not the mayor may be
appointed to attend the convention on June 30 at 7:30 p.m. in
the Johnson County Courthouse which will select two members to
the County Compensation Board.
The answer is yes, the mayor may be the person appointed by
the town council as its representative to the convention. A
mayor may also be chosen as a member of the Compensation Board
when the representatives from the town councils decide at the
convention.
The relevant portion of the Code of Iowa states that one
member of the Compensation Board "shall be a mayor or member of
the city council of an incorporated city located within the coun-
ty selected by a convention of the representatives of all in-
coporated cities located within the county. Each city shall be
represented at the convention by the mayor or a member of the
city council selected by the mayor and members of the city coun-
cil." 1331.905 (l.a), Code of Iowa (1983), p. 19151

received by the City Council as a part of its regular agenda for June
21, 1983. At that time the Council concluded that it would not be
desirable for a Council member to serve on the governing board of any
Human Service Agency which is funded by the City. This policy will
be formalized by the City Council in the near future.

We feel compelled to write regarding the developing situation with the
Iowa City airport. We had hoped that the Council would have taken the
appropriate action regarding the construction of the apartments at the
end of the north -south runway and stopped that construction to stay in
compliance with the projected master plan for the Iowa City airport.

Our firm is one that does benefit by the utilization of the airport.
HLM would not have been able to develop to its present size and capabilities
without the use of a good general aviation airport in Iowa City. We
work in some 22 states and find the only effective method to properly
service those clients as well as clients in Iowa is by the use of our airplane.
We are very appreciative of the facilities that we have in Iowa City and
the services that we are able to acquire at the airport. We have continually
upgraded the type of airplane equipment to meet our demands and have
allowed the airport to influence our airplane equipment. If we were
required to go to Cedar Rapids to use such aircraft, we would find it
most inconvenient and difficult. further, commercial traffic in and
out of Cedar Rapids does not provide us with the flexibility needed to
maintain service to our clients. Our airplane is utilized almost on a
daily basis and is an instrumental and integral part of our organization.
We feel that the construction of the apartments now being undertaken
provides an increased safety hazard around the airport. Should an
airplane lose power while taking off to the north, because of the align-
ment and proximity of this construction, it would be very difficult to
keep from hitting the building. We have been very fortunate in Iowa
City in having a minimal number of accidents because we feel it is a
well run airport and the obstacles have been kept to a minimum.
We have lived through one major complaint on the noise of aircraft.
Those of us who are pilots make a very conscious effort to keep noise to
a minimum and to take diversionary turns to minimize noise over housing
areas. If we were to make such a diversionary move flying to the north,
we would be right back into the area that we try to miss when we take
off on the north-west runway. Even though I know it has been stated

that people realize they are going to have a noisy environment, the
first group of people might know that, but certainly the second and
third will not, and there will be an ongoing aggravation of a noise
problem at the airport for the residents in this apartment building.
It seems to us that the City has been expressing, which we are very
pleased about, a desire to bring additional industry into this community,
a position that we have urged for a long period of time. It must be
realized that to get a plant of a major company in this area means easy
and quick access to that plant by the management of the corporation.
This access is accomplished almost entirely by general aviation, particularly
in outlying areas such as Iowa City. We believe that the Iowa City
airport is a tremendous asset and value in its location in providing
that type of facility for such corporate aircraft. If we are going to
limit the ability of the airport to receive general aviation, that is
another negative on our list for firms to locate here in the Iowa City
area.
There is another economic problem that construction of this unit presents
and.that is the governmental support to properly improve and maintain the
runway facilities at the airport. I believe it has been well demonstrated
and has been properly expressed by FAA officials that Iowa City stands
to, lose more than $2,000,000 in'the improvement of its airport facilities.
I sincerely hope that you as a Council can take the necessary steps to
rescind this construction to allow for the appropriate improvement of
the airport so that we can have a true and valuable asset for general
aviation to and from this community.

The City Council, at its regular meeting of June 21, 1983, received and

and staff share your belief that the airport is a tremendous asset and

all existing zoning requirements unless we paid the property owner for deny-
ing him the use of his property. The amount of compensation was estimated
to be as much as $500,000. This amount was more than the City could afford
and therefore reluctantly the development was approved. The Council has
now taken steps to see that the zoning ordinances will specifically prohibit
residential use in that area. We are at this time still negotiating with
F.A.A. with the hope of obtaining the grant.

For the information of your Honorable Body, I am inclosing a copy
of a letter I have sent to the Johnson County Boars of Supervisors for
their regular meeting of June 16. You may want to nsk each member of the
Senior Center Commission whether or not they feel that the Johnson County
Congreg-:te 'teal Frogrim should be in accordance with Yederal law. insofar
as age eligibility is concerned.
I am also inclosing copies of the City's "Complimentary Senior Center
Card" Numbers 1 and 2. This Card was written by a City staff member.
Bette Yeisel. A copy is given to each person 55 years of age and older
who registers to use a service or attend an organized activity at the Center.
Between Sept. 1, 1981 and about the middle of November, 1982, 2,070 numbers
had been given and presumably the same number of Cards given out. (That
number were for Bard No. 1.)) Cards like No. 2 have been given out since
about the middle of November, 1982. Even thoush four words were erased,
the meaning is the same as the serving of a congregate meal is a service.
It is now very apparent that the time has come when something will
need to be done about that Complimentary Senior Center Card, especially
the second paragraph of Section 3. if Johnson County is to have a Congre-
gate Meal program that is in accordance with Federal law, insofar as age
eligibility is concerned. by suggestion is that it be referred to a
Committee composed of The Honorable Mayor, Mary Neuhauser. Attorney Clemens
Erdahl and Attorney Lawrence Lynch for consultation with City Attorney
Robert Jansen.
If this letter is to be referred to the City Manager for reply, please
lot it be after it has been discussed by your Honorable Body.
Please send a copy of this letter, and enclosures, to City Attorney
Robert Jansenq also to Bette Meisel and the Senior Center Commission and
the Council of Elders if either of them doesn't already have copies.

Mr. Don Sehr, Chairman, and Memberd of the Johnson Co. Board of Supervisors
I would like to comment on the statement made by Chairman Don Sehr
at the May 24 informal session of your Board regarding the Johnson
County congregate meal program. I quote from the Minutes of that
meeting, a copy of which I have before me
"Sehr asserted that in his opinion the extensive disagreements
between members of the Nutrition Advisory Council and the Senior Center
Commission were endangering the success of congregate meals.
He expressed dismay that Congregate Neale and the Senior Center
Commission could not work together."
I did a little checking in an attempt to find out what the disagree—
ments were all :about. I find there is a bad situation regarding age
eligibility, but is something that you Supervisors can very easily oorect,
The following is the situation as I see it'

of Supervisors, the City permits the Supervisors to use a certain
amount of space in the Senior Center at certain hours of the day, seven
days a week for the purpose of serving congregate meals, with the
provision that the program will comply with all applickbe Federal, State
and local laws rules and regulations, and that the Supervisors will
regularly report to the City the numb er of meals served each month.
Beyond that the Supervisors are on their own.
No. 2. When the Senior Center opened on Sept. 1, 1981, a City
staff member, Bette Meisel, gave each person 55 years of arra and older
who applied for a service or to attend an organized activity a
Complimentary Senior Center Card and assigned him/her a number and
them an instruction sheet telling them how the number was to be
used. You will note from the inclosed copy that this instruct sheet
' read! "If you use a service such as congregate meals, or attend an
organized activity such as a class your number will need to be recorded."
At this time it would have been well if the Directeur of Nutriti-on,
Michael Foster hnd said to Ms. Meisel, "That nge 55 figure doesn't look
right to me because the 55ers Etre not eligible for congregate meals on
s donation basis. (A 55er is a person between the ages of 55 and 60 who
is not the spouse of a person in their 60's nor a Disadvatged or disabled
person who is not yet 60 years of age but who lives in a home for the
elderly where congregate meals are served . This would also have been

a good time to remit Ms. Misel that as long as the Supervisors stayed
within the law, the City had no right to tell them how to operate.

direction, congregate meals, on a donation basis, were available to
every person age 55 and over. All they need to do is to go to the
sign in table in the dining room, record their numbers, and that's it.
On July 29, 1982 our capable County Attorneys filed their legal
opinion regarding congregate meal eligibility, in which they stated
that in their opinion the Johnson County Congregate Meal program is
not being oyerated in compliance with Federal law. This opinion is so
well written that it has never been challenged by any attorney. The
last paragraph in this opinion reads, "As before on this overall
subject, we will be available to respond to questions and assist as
necessary in reviewing or 3wxi:3ng advising on the policies and
practices which we have recommended you initiate." This help is avail-
able not only to the Supervisors but to the members of the Nutrition Advisary
Board as well.
With the advice OIijj42IYIBtxnz9xzf and help of Attorney
J. Pntrick White, a number of much needed correction were quite
promptly made, But congregate meals remained available, on a donation
basis, to all persons 55 years of age and older who went to the sign..in
table and recorded their numbers.
No. 3. At the beginning of this letter, I told you it would be
very easy for you to get the Johnson County congregate m eal program
operating in compliance with Federal law. The following is how,
(a)`, Supervisors to instruct Nutrition Director to inform the
participants that, beginning with a certain date, Senior Center numbers
would no longer be used in the dining room since some who have Seater
Cards are not eligible for congregate meals.
(b)'+ Tell the participants that in order to keep count of the
number of meals served they will be asked to sign their names, the same
as they did when meals were served in the churches.

appreciated if, when they record their number with the host at either

of June 2. One sentence cancels two others and you have nothing.
And so I say, please, Supervisors, get the Johnson County congregate
meal program operating in compliance with Federal law, in so far as
age eligibility is concerned, and get it the easy and sure way indtoad
of trying to get it in some hard, ineure way. And please dont let Mr.
Coen throw any more monkey -wrenches into the maohinery, as he apparently j
did when he wrote the Karch 11 letter to Rev. Robert Woleh, Chairman of I
the Nutrition Advisory Board and signed it William J. Coen, Senior
Center Commission Chairperson. (Mr. Coen is a member of both of the
Advisory Committees.

Thank you for your letter of June 14, 1983, regarding congregate
meals.
The Senior Center Commission, at its meeting on May 19, 1983, voted
6-0 (with one member absent) to revise Item N4 on the Congregate
Meals cards information sheet to read that it is not obligatory but
would be appreciated for participants to sign their Senior Center
number. The Commission also voted to include a sign at the sign -in
table with a similar statement so that people would understand that
giving their Senior Center number was only a request.
I believe that this action by the Senior Center Commission will help
to clarify for all persons that possession of a Senior Center card
does not automatically make one eligible for congregate meals.
However, as I have stated in the past, it will not eliminate the
basic problem revolving around the fact that it is not permitted to
require identification from those participating in the program.
Therefore, it is impossible to insure that all participants are, in
fact, 60 years of age or older or are qualified spouses.
I am confident that the action by the Commission referred to above
will go a long way to alleviate misunderstandings about the Senior
Center complimentary card and its relationship to eligibility for
participation in the Congregate Meals Program.

Enclosed please find a letter from Assistant Attorney General Scott H.
Nichols in which he reviews the Iowa City Human Rights Ordinance, Chapter
18 of the Code of Ordinances of the City of Iowa City, and finds it
deficient in certain critical procedural aspects. Mr. Nichols was writing
in response to a Human Rights Commission request for the review of the
Chapter 18 amendments concerning -the areas of housing and disability
previously submitted to you. As you can see, his comments do not pertain
to the amendments the Commission proposed but go to the sufficiency of
judicial review of the entire Chapter.
Our own review of Chapter 2, Administration, and Chapter 18, Human Rights,
leads us to believe Mr. Nichols is correct in advising the City to track
Chapter 601A of the Iowa Code more closely. The City's Chapter 2 does
contain a general provision for judicial review of administrative actions
which could be construed to apply to Chapter 18 as well. However, given
the importance of the right to judicial review of administrative actions
and the ease with which a clear provision could be added to Chapter 18, it
seems unwarranted to rely on the Chapter 2 section.
We have requested an opinion on this subject from the Iowa City City
Attorney and expect that office to concur in recommending prompt revision
of Chapter 18. Should you also concur, the Human Rights Commission
further recommends that these revisions be made at the earliest possible
time and not be postponed until you consider the Commission's substantive
Chapter 18 proposed amendments.

Re: Review of Proposed Ordinance
I was happy to examine the proposed ordinance of the Iowa
City Human Rights Commission in response to your request.
In § 18-31(d)(7) (second line) the ordinance refers to "pre-
sences" of disability. It appears to me that the BFOQ should re-
late to the "absence" of disabilities in specific jobs. In fact,
the ordinance could tighten the BFOQ exception even further by
inserting "the absence of particular disabilities" in lieu of the
current phrase, "presence of disability."
In § 18-42(c), the ordinance should also exclude from com-
mission deliberations those commissioners who participate in the
review of a complainant's evidence pursuant to § 18-39(a)(3).
Assuming such a complainant overturns the "no probable cause"
decision, and conciliation fails, there is no guarantee that all
of the evidence submitted in the § 39(a)(3) procedure will also
be submitted in the § 42 hearing. In that event, a respondent
could argue that the commissioner who deliberated in both pro-
ceedings was tainted by extrarecord evidence in the S 42 deci-
sion. Furthermore, a commissoner who decides to overturn a "no
probable cause" decision could possibly be challenged for bias.
The agency will spare itself some unnecessary challenges by
separating § 39 decisionmakers from S 42 adjudicators.
I have two major suggestions for revising your proposed ordi-
nance. In Cedar Rapids Human Rights Commission v. Cedar Rapids
Community School District, 222 N.W.2d 391 (Iowa 1974), the Iowa
Supreme Court invalidated the local anti -discrimination ordinance
because it failed to provide for judicial review of local agency
actions. The proposed Iowa City ordinance appears to suffer from
a similar omission. I would propose that you add the language of
Iowa Code S 601A.17(1)(1983) to your proposed ordinance. By in-
corporating this language, the Dubuque Human Rights Commission's
enabling act survived an attack. See _Dietz v. Dubuque Human
Rights Commission, 316 N.W.2d 859, 861 (Iowa 1982).

Traffic Engineer will direct that the present NO PARKING CORNER TO HERE
sign located on the east side of Gilbert Street approximately 30 feet
north of its intersection with Bloomington Street be relocated north
approximately 70 feet north of the intersection of Gilbert Street with
Bloomington Street. This action will take place on or shortly after June
28, 1983.

As directed by Section 23-16 of the Municipal Code of Iowa City this is to
advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City the City
Traffic Engineer will direct that a NO PARKING CORNER TO HERE sign be
installed on the south side of Jefferson Street approximately 60 feet east
of the intersection with Gilbert Street. This sign will be installed on
or shortly after June 28, 1983.
COMMENT:
This sign is being reinstalled at this site. The prohibition was
originally removed in late March of 1983 in an attempt to provide more on -
street parking in the area. It has been learned in the interim that its
removal has created difficulty for pedestrians crossing Jefferson Street
and for access to a private residence driveway. The sign therefore is
being reinstalled.

On Friday, June 17, we filed an application for rezoning with $200,00
collected from residents of Wheaton Road. We ask that you support our
efforts to rezone the eastern side of Wheaton Road to be compatible with
the Western side of Wheaton Road. This would involve changing the present
R-3 zoning on the East side to R -1B. Attached is a plat of Wheaton Road
with the specified areas marked.
The following are the reasons that we ask that you give this matter your
immediate attention:
1.) All houses in the specified area are presently single family homes.
2.) Someone has immediate (July 1st) plans for buying one of the
houses in the specified area and converting it to a duplex.
3.) The proposed Comprehensive Zoning Ordinance does change the East
side of Wheaton Road to be compatible with the west side of Wheaton
Road.
4.) The conversion of this Single Family Dwelling to a Multiple Family
Dwelling will possibly creatcadditional noise, traffico and parking
problems in what is pcesently a safe and quiet neighborhood.
Due to the immediate plans for conversion of this property by the new oxner,
we are requesting that during the June 21st City Council meeting that you
set a date for a public hearing. This would prevent any permits from being
issued until this matter was settled.

It has come to our attention from the Agenda for the June 21, 1983
Council Meeting that; Item No. 2, - c.(4) is to: Consider motion
approving Class C. Liquor License for EECH, Inc. dba Gabes, 330
E. Washington Street.
K We feel it is important to share with you, these thoughts:

d� g past several months, we have worked in a friendly wa s
with Gabe's to find workable solutions to our concerns regarding
ti parking, noise, and vandalism. We have found that the Management
of Gabe's have been willing to cooperate with us.
Our major concern at this time is in regards to the noise echoing #
g; from the beer garden and the vandalism caused by persons as they
1 leave the beer garden. We would ask the City Council to encourage !
the Iowa City Police Department to monitor the noise level and
insure that it is within the limits of the Iowa City Noise Or- i
x` dinance.

We have hired an off-duty police officer on many occasions for
security purposes. On these occasions several arrests have taken
place.

BOARD OF LIBRARY TRUSTEES
Three vacancies - Six-year terms
July 1, 1983 - July 1, 1989
The Board of Library Trustees is a semi -autonomous
body of nine persons empowered by State Law to plan,
direct and control all affairs of the public library.
This includes determining long-range goals of
library service, adopting written policies to govern
operation of the library and employing a competent
staff to help plan and implement the Board's ser-
vice goal.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City.
These appointments will be made at the June 21, 1983
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-
sidered for these positionsshould contact the City
Clerk, 410 East Washington. Application forms are

agreed to terms that will allow Iowa Book & Supply
to remain in our present location. The owners opened
serious negotiations on both this and the Old Capitol
Center location immediately after acquiring the Dey
Building. After weighing the two offers, we chose
to continue our 63 year tradition of residing at the
corner of both the downtown and the campus.
My staff and I appreciate your patience and
willingness to assist us during our rather lengthy
negotiations.

Resolution to Proceed with the Issuance and Sale
of Industrial Development Revenue Bonds
(Iowa Book & Supply Company Project)
in an aggregate principal amount not to exceed $500,000
WHEREAS, the City of Iowa City, Iowa, in the County of Johnson,
State of Iowa, (the "Issuer") is an incorporated municipality authorized
and empowered by the provisions of Chapter 419 of the Code of Iowa, 1982,
as amended (the "Act") to issue revenue bonds for the purpose of
financing the cost of acquiring, by construction or purchase, land,
buildings, improvements and equipment, or any interest therein, suitable
for the use of commercial enterprises which the City Council of the
Issuer as the governing body, finds is consistent with an urban renewal
Plan, adopted by the Issuer pursuant to Chapter 403 of the Code of Iowa; and
WHEREAS, the Issuer has adopted and Urban Renewal Plan, Project No.
Iowa R-14 (the "Urban Renewal Plan") for the Urban Renewal Area
designated therein (the "Urban Renewal Area") and in furtherance of its
efforts to carry out the Urban Renewal Plan the Issuer has been requested
by Iowa Book & Supply Company (the "Company") to issue its Industrial Development
Revenue Bonds to finance certain improvements and equipment (the "Proect")
suitable for use by the Company in its commercial enterprise to be j
located within the Urban Renewal Area of the Issuer, which will employ
substantial numbers of people from and near the Issuer with the resulting
increased employment, substantial payrolls and other public benefits
flowing therefrom; and
1%1EREAS, it is proposed to finance all or a portion of the cost of
the Project through the issuance of Industrial Development Revenue Bonds
(Iowa Book & Supply Company Project) of the Issuer in an aggregate principal
amount not to exceed $500,000 (the "Bonds") and to lerrpoan said amount to the

Pay the principal of and interest and redemption premium, if any, on the
Bonds, as and when the same shall be due; and

Section 1. It is hereby determined that the undertaking of the
Project and the financing of the same is consistent with the Urban
Renewal Plan and will promote urban renewal, rehabilitation and re-
development of the Issuer, and will enhance the tax base of the Issuer
increase commerce within the Issuer and add to the welfare and prosperity
of the Issuer and its citizens.
Section 2. It is hereby determined it is necessary and advisable
that the Issuer proceed with the issuance and sale of the Bonds as
authorized and permitted by the Act to finance all or a portion of the
cost of the Project, and such actions will be taken by the Issuer as may
be required pursuant to the provisions of the Act to authorize, issue
and sell the Bonds upon receiving reasonable advance notice and upon
reaching mutually acceptable term with the Company regarding such Bonds.

Section 3. The Issuer will enter into all agreements prepared by
Bond Counsel which are necessary to be entered into by the Issuer in
connection with the issuance and sale of the Bonds. Prior to execution
of said agreements by the Issuer all other
Attorneyand the Issuers Bond Counsel shall approve all agreements the City

agreements shall be authorized and approved after due consideration by
this Council prior to their execution by the Issuer.
Section 4. The Mayor, the City Clerk and the City Attorney are

Section 5. All resolutions and
