Notice is hereby given that a public
hearing will be held by the City Council of
Iowa City, Iowa, at 7:30 PM on the 5th day

The 34 to 1 approach slope for runway 6 penetrates the existing,
ground elevation at points in the clear zone and at points
extending outward to 2200 feet (see attached drawing),

Once again, I am writing a letter on behalf of West
Side Company and its principals, Earl Yoder, Edward Thomas,
George Nagle and Charles Barker, to express their concern
over the proposed Airport Overlay Zones.
When I was last before this Council, my concern was
that West Side Company had no way to find out how the new
Overlay Zone would affect the recently annexed property.
This was due to the unavailability of any Airport Height
Zoning Map (referred to in proposed Section 8.10.50.3(c)(2))
showing the 34:1 slope ratio then agreed to by the F.A.A.
We are now at the time set for the public hearing since
it was originally continued, and although the numbers con-
tained in the proposed ordinance have changed, the position
of West Side Company has not. West Side Company is still
opposed to the ordinance and feels that a public hearing
for a reading of the ordinance is premature for the following
reasons:
1. There is no map showing the slope of the approach
surface zone for Runway #6 as outlined in Section
8.10.50.3(c)(1)c. Without the map, West Side Company and
others affected by the proposed ordinance cannot determine
exactly how their property will be affected. Therefore,
as I stated on July 5, there cannot be a meaningful public
hearing unless and until such a map is in existence.

2. At the meeting of the City Council on July 5, Mayor
Neuhauser stated that any agreement by the F.A.A. to change
the slope ratio from 34:1 should be obtained in writing.
To date, neither I nor any of the individuals involved in
West Side Company have seen a document from the F.A.A.
agreeing to the 20:1 slope ratio.
3. The change in the slope ratio to 20:1 still places
restrictions over the West Side Company property. While
this cannot be absolutely verified until an Airport Height
Zoning Map is made available, we believe that in some places
buildings would have to be limited to 30 feet in height
to keep them from penetrating the approach surface in the
OA Zone. Such a restriction would amount to a taking of
West Side Company property, entitling the owners to
compensation from the City.
For the above -stated reasons, West Side Company is
in no better position than it was on July 5, since it still
does not know exactly how it will be affected by the Approach
Overlay Zone extending from Runway #6. Until both the City
and the affected property owners have sufficient information
to determine any effect, and until such time as the question
of compensation has been discussed, it is the position of
West Side Company that the public hearing scheduled for
July 19, 1983, lacks the necessary notice and that any
action on the ordinance until these points have been
resolved is illegal and voidable.
