ORDINANCE APPROVING THE FINAL PLANNED AREA
DEVELOPMENT (PAD) PLAN OF TY'N CAE SUBDIVISION PART
3, IOWA CITY, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF IOWA
CITY, IOWA:
SECTION I. The final PAD plan of Ty'n Cae
Subdivision, Part 3, submitted by Dynevor Inc., is
hereby approved, and legally described as follows:
Commencing at the Northwest corner of the
Northeast quarter of the Northwest quarter of
Section 20, Township 79 North, Range 6 West of
the 5th Principal Meridian; thence North
00014110" East, 143.98 feet along the west
line of the east half of the southwest quarter
of Section 17, Township 79 North, Range 6 West
of the 5th Principal Meridian; thence South
88058149" East, 45.40 feet, to a point which
is the intersection of the south line of Ty'n
Cae, Parts 1 and 2 in the northeasterly right-
of-way line of Mormon Trek Boulevard as
relocated, and the point of beginning; thence
South 88°58'49" East, 1283.33 feet along said
south line of Ty'n Cae, Parts 1 and 2 to the
southeast corner thereof, a recorded bearing
and distance in accordance with the plat of
subdivision recorded in Plat Book 17, Page 24
of the records of the Johnson County

said Parcel 13, recorded in Deed Book 584,
page 337 of the records of the Johnson County
Recorder's Office. Said tract of land
contains 30.65 acres more or less and is
subject to easements and restrictions of
record.
SECTION II. Variances from the RIB zoning
requirements approved as part of the PAD plan are
as follows:
1. The five foot side yard required in an RIB
zone is revised to permit construction of zero
lot line units in accordance with certain
design standards noted on the PAD plan for
Lots 1-40, 42-95 and 97-104.
2. The overall site density is averaged over the
entire tract and the type of units altered to
permit the development of four 12-plax multi-
family residential buildings on Lot 41 and a
total of 38 townhouse units on Lots 96a -E.
SECTION III. This ordinance shall be in full force
and effect when published by law.
SECTION IV. REPEALER. All ordinances and parts of
ordinances in conflict with the provision of this
ordinance are hereby repealed.
SECTION V. SEVERABILITY. If any section,
provision or part of the Ordinance shall be

adjudged to be invalid or unconstitutional, such
ajudication shall not affect the validity of the
Ordinance as a whole or any section, provision or
part thereof not adjudged invalid or
unconstitutional.
SECTION VI. EFFECTIVE DATE. This Ordinance shall
be in effect after its final passage, approval and
publication as required by law.

AN ORDINANCE AMENDING CHAPTER 8. 10, THE ZONING ORDINANCE OF THE
MUNICIPAL CODE OF THE CITY OF IOWA CITY, IOWA, BY DELETING
SECTION 8.10.50, AIRPORT OVERLAY ZONES, AND SUBSTITUTING IN
LIEU THEREOF A NEW SECTION 8.10.50.

SECTIMENTS. Section .10.50 is hereby amended by deleting
said section and serting the fol owing:
8.10.50 Airport over ay zones.
8.10.50.1 Findings.
(a) The creation or esta 'shment of an airport hazard is a public j
nuisance causing potent 1 injury to those served by the airport;
(b) It is necessary in t e in rest of the public health, safety, and
general welfare that creati of airport hazards be prevented and
that this be accompl shed, to he extent legally possible, by proper
exercise of the poli a power;
(c) The prevention of he creation or tablishment of airport hazards,
and the eliminatio removal, alters ion, mitigation or marking and
lighting of exis ng airport hazards re public purposes for which
the City may rai a and expend public nds, as an incident to the
operation of th airport, to acquire nd or property interests
therein;
(d) Because of th propensity of sanitary land ills for attracting
birds, which i turn are hazardous to aircraft '� flight, landfills
are not consid red compatible with airport operations; and :i
(e) It is highly esirable that there be no structures or natural objects
or traverse w ys within the clear zones.
8.10.50.2 Definit'ons.
The following d finitions only apply in the interpretation and
enforcement of the airport overlay zones.
(a) Airport. The Iowa City Municipal Airport.
(b) Airport elevation. The highest point of the airport's usable
landing area measured in feet above mean sea level, which elevation
is established to be 661 feet.

(c) Airport hazard. Any structure, tree or use of land which would
exceed the Federal obstruction standards as contained in FAR Part
77 - Subpart C of Federal Regulations as revised March 4, 1972, and
which obstruct the airspace required for the flight of aircraft and
landing or takeoff at the airport or is otherwise hazardous to such
landing or taking off of aircraft.
(d) Air ort La out Plan. A drawing in the Airport Masterp Plan depicting
exl ting and future property lines and facilities 'ficluding but not
d to runways, taxiways, aprons, buildings a clear zones.
(e) Air ort imar surface. A surface longitu nally centered on a
runway whi extends 200 feet beyond the end of a runway. The width
of the prima surface of a runway shall b that width prescribed in
Part 77 of t e Federal Aviation Regul ions (FAR) for the most
precise approac existing or planned for either end of that runway.
The elevation of ny point on the prim y surface is the same as the
elevation of the ne rest point on the r nway centerline.

airport facilities, a f'nancial plan and proposed time schedule for

(i) Minimum descent alt'tude. The lowest a titude, expressed in feet

instrument approach procedure and no instrument designation
indicated on a FAA approved airport layout plan or by any planning
document submitted to the FAA by competent authority.
8.10.50.3 Airport zones and airspace height limitations.
In order to carry out the provisions of this Section, there are hereby
created and established certain zones which are depicted on the Airport

(b) Conical OverlayAOC) Zone.
(1) Defined. The land lying under a surfacg extending outward and
upward from the periphery of the horizontal surface at a slope
of 20 to 1 for a horizontal distance of 4,000 feet.
(2) Hei�ht limitation. No structure shall penetrate the conical
surface in the OC Zone, as depicted on the Airport Height Zoning
Map.,
(3) Use limitation. Sanitary landfills shall not be permitted in
the OC Zone.

(c) Approach Overlay (OA) Zone.
(1) Defined. The land lying under a surface longitudinally
centered on the extended runway centerline and extending
outward and upward from each end of the primary surface. (NOTE:
An approach surface is applied to each end of each runway based
upon the type of approach available or planned for that runway
end.)

1. 500 feet wide for runways 12, 17, 30 and 35.
2. 1000 feet wide for runways 6 and 24.
b. he outer edge of the approach surface is:

3. 4,000 feet for runway 24.
C. The approach surface zone extends for a horizontal
distance of:`
1. 5,000 feet at a slope of 20 to 1 for runways 12 and
17.
2. 10,000 feet at a slope of 34 to 1 for runways 24, 30
and 35.
3. 2200 feet at a slope of 20 to 1; thence level at an
elevation of 791 feet MSL from 2200 feet to 3740 feet;
thence from 3740 feet to 10,000 feet at a slope of 34
to 1 for runway 6.
(2) Height limitation. No structure shall penetrate the approach
surface in the OA Zone, as depicted on the Airport Height Zoning
Map.

(d) Clear Overlay (OCL) Zone.
(1) Defined. The land lying under portions 'of the OA Zone and
described as follows:

a. Runway 6 - 1000 feet wide at the inner edge of the OA Zone
and 1425 feet wide a distance of 2700 feet from the inner
edge.
b. Runways 12 and 17 - 500 feet wide at the inner edge of the
OA Zone and 700 feet wide a distance of 1000 feet from the
inner edge.

c. Runway 24 - 1000 feet wide at the inner edge of the OA Zone
and 1510 feet wide a distance of 1700 feet from the inner
edge.
d. Runways 30 and 35 - 500 feet wide at the inner edge of the
OA Zone and 1010 feet wide a distance of 1700 feet from the
inner edge.
(2) se limitations. No use shall be permitted in which there is

Unl orm Building Code (1979 Edition) with an occupancy rating
of 0 square feet of floor area per person or less. In

tra sitional surface in the OT Zone as debicted on the Airport

the OT Zone.

8.10.50.4 Use restrictions.
In addition to the above restrictions on land, the following special
requirements shall apply.
(a) Any person who proposes any development of greater height than an
imaginary surface extending outward and upward at the slope of 100 to
1 for a horizontal distance of 20,000 feet from the nearest point of

st runway shall notify the Federal Aviation Administration

Proposed Construction or Alteration shall be sent to the
r Traffic Division, of the FAA Regional Office in Kansas
souri, and one copy to the Iowa City Airport Commission.

descent altitude for an instrument approach to any runway, nor shall
any structure be erected that causes the minimum obstruction
clearance altitude or minimum enroute altitude to be increased.
(c) Lighting.
(1) All lighting o \ illumination used in conjunction with street,
parking, signs or use of'land and structures shall be arranged
and operated in `such a manner that it is not misleading or
dangerous to aircraft operating from the airport or in the
vicinity thereof.
(2) The owner of anystructure over 200 feet above ground level
shall install on, the structure lighting in accordance with
Federal Aviatioq Administration (FAA), Advisory Circular 70-
7460 and amendments.
(3) Any permit or variance granted may be so conditioned as to
require the owner of the structure or growth in question to

(d) No operation from any use shall produce electronic interference
with naviga on signals or radio communication between the airport
and aircraf .
8.10.50.5. Spe�al exceptions.
(a) The heig and use limitations contained in the Airport Overlay Zones
may be modified by special exception granted by the Board of
Adjustment (the "Board"). However, no such special exception shall
be gragted unless the Board finds, based upon written reports from
the Federal Aviation Administration, and the Aeronautics Division of
the Iovia Department of Transportation, that -
(1) In an application to permit any structure, tree, or use of land
to exceed the height limitations of the Airport Overlay Zones,
that such structure, tree, or use of land, would not obstruct
either the airspace required for the flight of aircraft, or
landing and take -off of aircraft at the Airport, and is

otherwise not hazardous to such landing or take -off of
aircraft.
(2) In an application to permit a use of .land otherwise prohibited
herein, that such use would not be incompatible with airport
operations.
(b) An a plicant for a special exception hereunder shall, as part of the
applic tion submitted to the Board, file the required written
reports of the federal Aviation Adminstration, and the Aeronautics
Division f the Iowa Department; of Transportation. No application
for a special exception hereunder shall be set for hearing by the
Board until ch reports have been filed.
SECTION 3. REPEALER. All ordina4cces and parts of ordinances in conflict
with the provision of Y
ce are hereby repealed.

recommendations for use of'land on and adjacent to the airport. The
Airport Layout Plan is a component part of the Master Plan.

8.10.50.3 Airport zones and airspace height limitations.
In order to carry out the provisions of this Section, there are hereby
created and established certain zones which are depicted on the Airport
Height Zoning Map. A structure located in more than one (1) zone of the
followini zones is considered to be only in the zo a with the more
restrictive height limitation. The various zones are ereby established
and defined,as follows:
(a) Horizontal Overlay (OH) Zone.
(1) Defined.,` The land laying under a Horizontal plane 150 feet
above the, established airport elevation, the perimeter of which
is constructed by:
a. SwinginJ,arcs of 5,000 foot" radii from the center of each
end of the primary surface of runways 12 and 17 and
connecting the adjacent,ares by lines tangent to those
arcs, and \
b. Swinging arcs of 10,000 foot radii from the center of each
end of the prima>•y surface of runways 6, 24, 30 and 35 and
connecting the adjacent arcs by lines tangent to those
arcs.
(NOTE: The radius of the arc specified for each end of a runway
will have the same arithmetical value. That value will be the
highest determined for either end of the runway. When a 5,000
foot arc is encompassed by tangents connecting two adjacent
10,000 foot arcs, the 5,000 foot arc shall be disregarded on the
construction of the perimeter of\the horizontal surface.)
(2) Height limitation. No structure \gall exceed 150 feet above the
established airport elevation in the OH Zone, as depicted on the
Airport Height Zoning Map.
(3) Use limitation. Sanitary landfills hall not be permitted in

imaginary surface extending outward and upward at the slope of 100 to
1 for a horizontal distance of 20,000 feet from the nearest point of
the nearest runway shall notify the Federal Aviation Administration
(FAA). One executed form set (four copies) of FAA Form 7460-1,
Notice of Proposed Construction or Alteration shall be sent to the
Cheif, Air Traffic Division, of the FAA Regional Office in Kansas
City, Missouri, and one copy to the Iowa City Airport Commission.

(c) Airport hazard. Any structure, tree or use of land which would
exceed the Federal obstruction standards as contained in FAR Part
77 - Subpart C of Federal Regulations as revised March 4, 1972, and
which obstruct the airspace required for the flight of aircraft and
landing or takeoff at the airport or is otherwise hazardous to such
landing or taking off of aircraft.
(d) Airport Layout Plan. A drawing in the Airport Master Plan depicting
existing and future property lines and facilities including but not
limited to runways, taxiways, aprons, buildings and clear zones.
(e) Airport primary surface. A surface longitudinally centered on a .
runway which extends 200 feet beyond the end of a runway. The width
of tke primary surface of a runway shall be that width prescribed in
Part of the Federal Aviation Regulations (FAR) for the most
precise pp roach existing or planned for either end of that runway.
The eleva ion of any point on the primaryy surface is the same as the
elevation o the nearest point on the ruyilway centerline.

BE IT ORDAINED BY THE CITY OF IOWA CITY, IOWA:
SECTION i. PURPOSE. The purpose of this ordinancis to implement the
Iowa' ity Municipal Airport Master Plan by estab shing Airport Overlay
Zones nsistent with said plan and establishi g a clear overlay zone
within w 'ch uses which would be incompatib a with the airport are
prohibited.

8.10.50.2 Definitions.
The following definitions only apply in

(c) Airport hazard. Any structure, tree or use of land which would
exceed the Federal obstruction standards as contained in FAR Part
77 - Subpart C of Federal Regulations as revised March 4, 1972, and
which obstruct the airspace required for the flight of aircraft and
landing or takeoff at the airport or is otherwise hazardous to such
landing or taking off of aircraft.
(d) Airport Layout Plan. A drawing in the Air ort Master Plan depicting
existing and future property lines and facilities including but not
limited to runways, taxiways, aprons, buildin s and clear zones.
(e) Air ol^t primarysurface. A surface lo n i dinall centered on a

runway hi ch extends 200 feet beyond the e d of a runway. The width
of the p imary surface of a runway shall be that width prescribed in
Part 77 f the Federal Aviation Regulations (FAR) for the most
precise ap oath existing or planned for/either end of that runway.
The elevatio of any point on the prim iy surface is the same as the
elevation of a nearest point on the r nway centerline.

(f) Airspace height. For the purpose of etermining the height limits in
all zones set for h herein and sh wn on the Airport Height Zoning
Map, the datum sha 1 be mean sea level elevation unless otherwise
specified.
i (g) Instrument runway. A nway ith an existing instrument approach
procedure or for which n instrument approach procedure has been
approved or planned.
(h) Airport Master Plan. A co rehensive plan for development of the
j, airport over a 20 year tim riod. The Master Plan includes among
other things, aviation ac ivit forecasts, determinations of needed
airport facilities, a fi ncial Ian and proposed time schedule for
developing facilities includ in the Master Plan, and
recommendations for use of and o and adt ent to the a9rport. The
Airport Layout Plan is component rt of the Master Plan.
j (i) Minimum descent alti ude. The lowes altitude, expressed in feet
above mean sea le v 1, to which des ent is authorized on final
approach or durin circle -to -land ma euvering in execution of a
` standard instrume approach procedure a d where no electronic glide
slope is provided
(j) Minimum enroute altitude. The altitude 1 effect between radio
fixes which a sures acceptable navigation 1 signal coverage and
meets obstruc ion clearance requirements between those fixes.
(k) Minimum obs ruction clearance altitude. The

(m) Visual runway. A runway intended solely for the operation of
aircraft using visual approach precedures with no straight -in
instrument approach procedure and no instrument designation
indicated on a FAA approved airport layout plan or by any planning
document submitted to the FAA by competent authority.
8.10.50.3 Airport zones and airspace height limitations
In order to carry out the provisions of this Section, there are hereby
create and established certain zones which are depicted on the Airport
Heightning Map. A structure located in more than one (1) zone of the
following zones is considered to be only ig� the zone with the more
restrictiv height limitation. The various zones are hereby established
and defined s follows: /
(a) Horizonta Overlay (OH) Zone.

foot arc is ''compassed by tangents connecting two adjacent
10,000 foot ay�cs, the 5,00 foot arc shall be disregarded on the
construction of the perimet r of the horizontal surface.)
(2) Height limi :tion. No struct�re shall exceed 150 feet above the
establishe airport elevation the OH Zone, as depicted on the
Airport H ight Zoning Map.
(3) Use limitation. Landfills shall not be permitted in the OH
Zone.
(b) Conical Ove lay (OC) Zone.

upwa d from the periphery of the horizontai\surface at a slope
of 2 to 1 for a horizontal distance of 4,000 feet.
(2) Height limitation. No structure shall penetrate the conical
surface in the OC Zone, as depicted on the Airport Height Zoning

the height Jions herein or (b) any use of land prohibited herein.
No such speception shall be granted, however, unless the Federal
Aviation Adration and the Aeronautics Division of the Iowa
Department oportation shall have indicated, in request pursuant to
subsection (aof, that such structure, tree or use of land would not
obstruct thece required for the flight of aircraft and landing or
takeoff at the airport or is otherwise hazardous to such landing or taking

such use would not be incompatible with airport operations.

SECTION 3. REPEALER. All ordinances and parts of ordinances in conflict
with the provision of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY. If any section,,/por vision or part of the

8.10.50.4 Use re trictions.

requirements shal apply to each use:
(a) All proponents of structures defined under FAR 77, Subpart B shall
file notice as required with the FAA.

(b) No structure shall be erected that raises the published minimum
descent altitude for an instrument approach to any runway, nor shall
any structure be erected that causes the minimum obstruction
clearance altitude or minimum enroute altitude to be increased.
(c) Lighting.
(1) All lighting or illumination used in conjunction with street,
parking, signs or use of land and structures shall be arranged
and operated in such a manner that it is not misleading or
dangerous to aircraft operating from the airport or in the
vicinity thereof. / /

ORDINANCE NO. 83-3131
ORDINANCE AMENDING THE ZONING ORDINANCE BY
CHANGING THE USE REGULATIONS OF CERTAIN
PROPERTY LOCATED AT 223 S. RIVERSIDE COURT
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF IOWA CITY, IOWA:
SECTION I. That the property described
below is hereby reclassified from its
present classification of RIB to R3A, and
the boundaries of the R3A zone as indicated
upon the zoning map of the City of Iowa
City, Iowa, shall be enlarged to include
the property located
Commencing at a point 25 feet south
of the north line of Lot 2 in
subdivision of part of Lot 3 of
Section 16, Township 79 North, Range 6
West of the 5th Principal Meridian
according to the plat thereof recorded
in Deed Record 36, page 234 of the
Records of Johnson County, Iowa and
205 feet west of the west line of
Riverside Drive in Iowa City, Iowa;
thence west 70 feet; thence south to
the north line of the right-of-way of
the Chicago, Rock Island and Pacific
Railway Company; thence northeasterly
along the north line of said right-of-
way to a point directly south of the
place of beginning; thence north to
the place of beginning also sometimes
described as follows:
Commencing 25 feet south and 205
west of the northeast corner of Lot 2,
Sperry's Subdivision, Section 16,
Township 79 North, Range 6 West,
Johnson County, Iowa; thence west 70
feet; thence south to the Chicago,
Rock Island and Pacific Railroad
right-of-way; thence northeasterly
along said right-of-way 70 feet more
or less, to a point directly south of
the place of beginning; thence north
to the place of beginning.
SECTION II. The Building Inspector is
hereby authorized and directed to change
the zoning map of the City of Iowa City,
Iowa, to conform to this amendment upon the
final passage, approval and publication of
this ordinance as provided by law.
SECTI�I. The City Clerk is hereby
authorized -and directed to certify a copy
of this ordinance to the County Recorder of
Johnson County, Iowa, upon final passage
and publication as provided by law.
SECTION IV. REPEALER. All ordinances and
parts of ordinances in conflict with the

Ordinance shall be in effect after its

required by law.

AN ORDINANCE AMENDING CHAPTER 5 OF THE CITY
CODE TO REGULATE THE CARRY -OUT OF OPEN BEER
OR ALCOHOLIC BEVERAGE CONTAINERS FROM
LICENSED PREMISES.
SECTION I. PURPOSE. The purpose of
this amendment is to prohibit the carry -out
of open containers of beer or alcoholic
beverage from licensed premises.
SECTION II. AMENDMENT. Chapter 5 of
the Code of Ordinances of the City of Iowa
City, Iowa, is hereby amended by adding the
following new Section 5-11:
Sec. 5-11. Open Containers.
It shall be unlawful for any person or
for any licensee or permittee under
this chapter or his/her agents or
employees to permit any person to
carry from a licensed premises any
open container of beer or alcoholic
beverage, including but not limited to
bottles, cans, glasses, mugs, and
cups, except when such carry -out is
related to and necessary for
custodial, maintenance, or other bona
fide employment purposes.
SECTION III. REPEALER. All
ordinances and parts of ordinances in
conflict with the provision of this
ordinance are hereby repealed.
SECTION IV. SEVERABILITY. If any
section, provision or part of the Ordinance
shall be adjudged to be invalid or
unconstitutional, such ajudication shall
not affect the validity of the Ordinance as
a whole or any section, provision or part
thereof not adjudged invalid or
unconstitutional.

AN ORDINANCE PROVIDING FOR COMPENSATION FOR
THE MAYOR AND COUNCILMEMBERS OF THE COUNCIL
OF IOWA CITY, IOWA, AND REPEALING ORDINANCE
NO. 75-2765.
BE IT ENACTED BY THE CITY COUNCIL OF
THE CITY OF IOWA CITY, IOWA:
SECTION I. PURPOSE. The purpose of this
Ordinance is to raise the rate of compensa-
tion paid to the Mayor and Councilmembers of
the Council of the City of Iowa City, Iowa.
SECTION II. RATES OF COMPENSATION.
The following rates of compensation
shall be paid to members of the City Council
of the City of Iowa City, Iowa, effective
January 1, 1984:
1. The Mayor shall be compensated at
the rate of $6011.20 annually.
2. The other Councilmembers shall be
compensated at the rate of $5012.80
annually.
SECTION III. REVIEW DATE. Review of the
Mayor an ounce me ers' compensation
shall take place as part of the budget
review process for the fiscal year during
which each election will occur. I
SECTION IV. REPEALER. Ordinance No. 75-
2765 and all of er rdinances or parts of
Ordinances in conflict with the provision of
this Ordinance are hereby repealed.
SECTION V. EFFECTIVE DATE. This Ordinance ;
