BY-LAWS
IOWA CITY HISTORIC PRESERVATION COMMISSION
ARTICLE I.
MEETINGS
Section 1 . Regular Meeting. Regular meetings of this Commission shall be held
on the second Wednesday of each month.
Section 2. Special Meetings
the Chairperson and shall be called by the Chairperson's request for members of
the Commission.
Section 3. Place of Meetings. Regular meetings shall be in the Iowa City Public
Library, Civlc Center or other appropriate meeting place in Iowa City, Iowa.
Should these places be unavailable, another meeting place shall be selected.
Section 4. Notice of eti
Meng. Notice and agenda for all regular meetings shall
be distributed to all members of the Commission and the press. Special meetings
may be called upon notice to all members and the media at least 24 hours before
a special meeting is held. All provisions of the State Open Meetings Law shall
be followed.
Section 5. Quorum. A majority of the members of the Commission shall
constitute a quorum at any meeting and a majority of votes cast at any meeting
'j at which a quorum is present shall be decisive of any motion or election.
Section 6. Proxies. There shall be no vote by proxy.
Section 7. Public Discussion. Time shall be made available during all regular
meetings for open public discussion.
ARTICLE II.
MEMBERSHIP
Section 1. Membership. The Historic Preservation Commission shall consist of
seven members; term of membership shall be three years except for the
shortened initial terms that provide for staggered membership. One member
shall be a member of the Planning and Zoning Commission to be appointed by
said Commission. Annually the Chairperson and Vice -Chairperson will be
elected by the Commission members. All members shall be qualified electors of
the City of Iowa City, Iowa, and shall serve as members without compensation

Section 2. Nomination. The City Council shall appoint members to the Historic
Preservation Commission as vacancies occur.
Section 3. Terms. Upon the expiration of terms of present members, new
members shall be appointed for three year terms. Term of office for the
Planning and Zoning member shall be for three years beginning March 29th.

Section 4. Absences. Three consecutive unexplained absences of a Commission
member may result in a recommendation to the Mayor from the Commission to
discharge such member and appoint a new Commission member.
Section S. Orientation for New Members. Prior to the first regular meeting
following their appointment, new members shall be provided with copies of the
pertinent portions of the City Code, Historic Preservation Commission By-laws,
and other documents that would be useful to Commission members in carrying
out their duties.
ARTICLE III.
OFFICERS
Section I. Number. The officers of this Commission shall be a Chairperson and
Vice -Chairperson, each of whom shall be elected by members of the Commission.
Section 2. Election and Term of Office. The officers of this Commission shall
be elected annually at the discretion of the Chair.
Section 3. Vacancies. A vacancy in either office shall be filled by the members
for the unexpired portion of the term.
Section 4. Chairperson. The Chairperson shall, when present, preside at all
meetings of the members, appoint committees, call special meetings and in
general perform all duties of the Chairperson and such other duties as may be
prescribed by members from time to time.
Section 5. Vice -Chairperson. In the absence of the Chairperson or in the
event of death, inability or refusal to act, the Vice -Chairperson shall perform
the duties of the Chairperson and when so acting shall have all the powers of
and be subject to all the restrictions upon the Chairperson.
ARTICLE IV.
CONDUCT OF COMMISSION AFFAIRS
Section I. Agenda. The Chairperson or a designated representative together
with appropriate members of the City staff, shall prepare an agenda for all
regular Commission meetings. Agenda are to be sent to Commission members,
the City Council and the media at least three days prior to the regular
meetings.
Section 2. Secretary. A secretary, not to be a Commission member, shall be
provided for all regular and special meetings.
Section 3. Minutes. Minutes of all regular and special meetings are to be
prepared and distributed to Commission members and approved by the
Commission prior to being sent to City Council, in the manner prescribed by the
Council. Specific recommendations for the Council are to be set off from the
main body of the minutes and appropriately identified.
Section 4. Policies and Programs. Periodically the Commission shall review the
policies and programs of the City, relating to historic preservation and make
such recommendations to the City Council as are deemed appropriate.

information, requests for recommendations, and other matters are referred to

I am writing in regard to the proposed 35 unit apartment complex
which Dr. Rigler wishes to build on 521 Kirkwood Av. I live almost
directly accross the street at 612 Kirkwood Av, and strongly oppose
this project. I am concerned about traffic, noise, and lack of green
space in this area. This is a predominately family -residential neigh-
borhood with many beautiful homes 'located on Kirkwood Av.
I believe that construction of such a complex would downgrade the
neighborhood and lead to construction of more complexes as clearly
evident on Johnson and Dodge Streeets.
The apparent lack of planning and helter-skelter construction of
over -priced apartment units to rent to the student population demonstrates
on the part of the City Council irresponsible behavior and lack of concern
for the quality of life of residents Bho must reside next to these eyesores
and deal with the reality of their presence and the problems they create.

The proposed development of 521 Kirkwood Avenue concerns my husband
and me greatly. We are opposed to the building of any volume of apartments
there despite the fact that our home is seven blocks away, for the following
reasons
1. The volume and character of traffic on Kirkwood will effect
the value of our property at 1129 Kirkwood.
2. It will increase the potential for an accident to the growing
number of young children now living in this area. We have a
six year old whose friends live on the north side of the street.
I frequently call the Police Department now to monitor the
excessive speed of cars as well as the questionable use of
Kirkwood by large trucks.
3. The lovely character of Kirkwood's homes and shaded areas
attracted us to purchase here - not farther out. Development
of apartments at 521 Kirkwood concerns us that there is a
lack of committment by the City to maintain the integrit

will, against the commercialism and encroaching high density development that

I am writing in regards to the application to rezone
certain property at 521. Kirkwood Avenue.
Traffic is already bad enough on this street. Try sometime
to get out on Kirkwood ..venue from a driveway or a side
street, see how long it takes you to get out on this
street. Also Webster Street is already congested with
vehicles that you can hardly use your driveway. If
apartments are allowed to be constructed, property owners
won't be able to use Webster Street for parking. Seems
to me property owners should have priority to park. We
are the ones who pay taxes. They rent theseflpartments
to two and three people who all have cars but they don't
;provide parking spaces for that many. Where would they
park on Webster Street as th s;ythe closest to 521.
Apartments were stopped from being built over in Manville
Heights as to traffic and so forth. Seems to me traffic
is a lot heavier on Kirkwood than over there. Also it
was stopped at College Hill Park. This is social economic
discrimmation for our neighborhoa3,, if these apartments
are allowed to be constructed. Soon Io,ra 1-ity is going
to be overrun with apartments.
Sure the purchaserwould like a return for his investment,
maybe sometime I would lik- a return on my property I own.
If this apartment complex is allowed to be built, I would
not be able to sell my property because of this and the
heavy traffic. The purchaser probably was looking for
a tax shelter; put up an apartment complex; probably hold
it for five years and then sell so he could take a tax loss.
That would mean another owner; would we have something like
Lakeside.
I think this property should be zoned for duplex housing
or residential.

decide what should be done.

I urge you to vote against this re—zoning proposal, and instead, entertain

I understand the Council feels that Dr. Rigler should receive a "return"
on his money for investing in the pnoperty. Please consider the "return"
that members of this neighborhood should receive for investing in threir
homes and property. I bought my home on S. Lucas four years ago with the
anticipation that I was buying into a respectable Iowa City neighborhood—
one of the few that is quiet with trees and adequate green space.
Gradually, I've seen these good qualities erode as South Dodge St, became
i filled with apartment complexes. In addition, the Page St. Railroad property
is scheduled for development this summer, and the Iowa—Illinois power line
threatens to begin construction any moment. Our once quiet neighborhood is
beginning to suffer an increase in noise, pollution and traffic and a decrease
in aesthetics. Where is our return for investing in Iowa City property?
And this issue is larger than a single neighborhood. Modern, unimaginatively
designed, uniform apartment complexes are depersonalizing and turning
Iowa City into a very ugly community. Friends and neighbors -have talked
about moving out of Iowa City and acquaintances have been hesitant to
move into Iowa City because of this apartment complex issue. No one
wants to live next to one.
Again, I recommend you do whatever you can to halt hhe development of
apartment complexes in older, established Iowa City neighborh000ds, and
in particular at 521 Kirkwood Avenue. (Yesterday they began cutting down
a grove of beautiful hardwood trees there.)

I am writing about the 521 Kirkwood property, the recent discussions about
what is to be iIcne with it, and the action to be taken by the Council
this week.
I have been watching this whole issue develop, in the papers and in con-
versations with several of the people in this neighborhood. After watching
j all the houses going down an,. the apartments going up on S. Johnson St.,
I I fin,. myself very, very concerned about what's going to happen to this
area of the city.in which I own property and have chosen to live.
I do.1not want to see any sort of development on the Kirkwood property
which charges the nature of this neighborhood --anything, that is, larger
i than duplexes. And I certainly do not want to see commercial develrpment
on that property. Have you ever taken a walk around that area, on both
sides of Kirkwood? I would strongly recommend it. The houses are small,
for the most part, carefully kept -up, with space between the dwellings and
yar,s and gardens. Though I hate to see the Johnson St. houses pulled
down, those old and large and beautiful ones, this neighborhood around
Kirkwood Avenue is even more strongly a residential one with a strong
character which would be ruined by the building of apartment complexes.
Dr. Bigler has stated in newspaper accounts that the people protesting
his proposals simply do not understand the financing involved. This is
as much polemical rhetoric as a statement with any kind of carefullycon-
sidered truth. All of the homeowners that live in this neighborhood and
are requesting some sort of agreeable solution know full well the diffi-
culties of financing any piece of property these days. No one is un-
sympathetic to the problem of making ends meet, or even of realizing a
profit on a piece of investment. But we are all concerned with a climate
in this city of tear -'em -,own -ani -build -'em -fast. Surely the City Council
can bear to be a bit more fore -sighted about what its decisions mean for
the long-term development of the city's neighborhoods.
I urge you, therefore, to do whatever is necessary to keep 521 Kirkwood
Aveme in line with the existing character of the areas which surround it,
an, at the same time satisfy Dr. Rigler. The city, though it faces tough
bu,get decisions, must be able to discern between foolish expenditures, or
ones that can wait, and expenditures which will actually mean long-term
investments in the future quality of life in this cityt.

I am taking this means of expressing my concern in regard to the rezoning request
being made for the 521 Kirkwood Avenue property.
I feel that the proposed use of this property for apartment construction would
be very detrimental to the surrounding property owners and should not be allowed
to take place. I would urge you to vote that this property be developed for
use as a park or that it be zoned as RS -8 which would be consistent with the
property around it.
Many folks feel that allowing the construction of a large apartment complex
would change the neighborhood entirely and that it would cause many problems
with traffic in that area. It would also be a hazard to the children and
older folks living in the neighborhood.
I urge your thoughtful consideration on this situation.

I am writing to voice my concern regarding the proposed rezoning
of 521 Kirkwood from M-1 to RNC -20.
My husband and I purchased our home at 907 South Dodge five years
ago, and have witnessed over these past years a gradual change in the
character of our neighborhood. We are very distressed in what seems to
be happening. We are both employees at The University of Iowa, my husband
is with the Physics Department and I am with the Political Science Department,
and so are quite committed to this community. Our home affords us
economical shelter within a reasonable distance to campus. We purchased our
home from the original owner, as did many of our neighbors, and take pride
in caring for and improving our property. We feel, however, that the
increase in the number of apartment buildings in our area has greatly
decreased its value. We now face (or rather are in the middle of) the
possibility of a 58 -unit complex on Kirkwood, a 38 -unit complex on
Page and Dodge streets (just south of RR tracks), and the proposed new
power line to run along the railroad tracks. The combination of these
prospects has made us seriously consider a move, which since we are
employees of the University would put a very severe economic burden on
us if possible at all. We are not alone in these concerns. There are
many people in our neighborhood in very similar circumstances, who would
like to raise their children in a peaceful area, but feel they are being
pushed out (in order to sell the their property before the value really
declines).
We would like to see the Kirkwood property zoned RS -8 if possible
to be consistent with bordering areas. We are also very much opposed to
changing the Page/Dodge property from RS -8 to RM -12.
We would also support very strongly any possibility that the property
at 521 Kirkwood be used as a Park. We would, as many people would in our
area, support and assist in any way possible this possibility.

Mayor and Members of the City Council:
As owner of the business at 630 Iowa Avenue and leasee of the sign
l advertising the business, I request permission of the City Council to
use the public right-of-way of Iowa Avenue for the continued use of a
three -faced free-standing sign. This sign has been in place for a
number of years and has been used by the various businesses who have
i been on this site.
In 1980, when I opened the On Iowa restaurant, I was informed by the
City that the sign was illegal and that I should request permission
of the Council to have the sign in the right-of-way. I wrote two
letters to the Council and received no response. This year I am
changing the business from the On Iowa restaurant to Speak Easy.
Again, I was cited for the sign and was informed that the City
Council was the proper body to authorize the use of the sign as it
stands. I would appreciate your granting my request at this time i
for the continued use of the three -faced free-standing sign in the
right-of-way of Iowa Avenue.

Members:.
I am enclosing an areal view of this area where I and several
families,live as well as the adjacent trailer camp.
You will note that the view is along the river and in the pro-
tected area and you will notice that a motorcycle racing track
has been built and operating for some length of time (off and
j on for twoyears I believe). I wish your kind and prompt at-
tention to the disturbances created by that race track. We had
written a year ago and had been told by the city manager that
these motorcycles do not make any more noise than a truck and
we found this analogy to be extremely poor. These motorcycles
race on this track at night and on weekends and drone their
two cycle engines hours at a time. If the wind is blowing from
the east we are deluged by the blowing dust. Otherwise,
i there is a constant roaring of the engines disturbing the seven
families here as well as those in the trailer area.
We are not motorcycling hating people, we simply cannot believe
that you understood the ramifications when the permits for this
tract were given. The noise ordinance, I would think, would
clearly prohibit this. But beyond that certainly there has to
be plenty of areas away from housin and living areas where this
thing can be undertaken. Certainly it has destroyed the ecology,
upset thequietness of the evenings and,weekends and significantly
altered our life style. We have talked with Mr. Showalter
throughout this period of time and have had little satisfaction
and we are dreading the coming of a wonderful Iowa spring and
summer on the basis that we will become contaminated by the
racing on this track. We hope that you will exercise your
authority, contact the zoning people and have this permission
withdrawn, convert it into picnic area or whatever but most
certainly remove this unnecessary noise deluge from our.lifes.
We have a consensus of opinion about this thing. If you wish
the signatures of the people involved we would be glad to get
those but we trust you at this time that your common sense
will witness this mistake and that corrective action will be
taken.

Attached to this memorandum is a copy of the park use permit for the
motorcycle track at Mesquakie Park. In 1982 the City staff checked
sound levels at the boundary of the park adjacent to residences, generated
by motorcycles on the track, and found them well within acceptable levels.
The permit allows the City to cancel for cause with 90 days notice.
Since 1974 Mesquakie Park has not been used for anythina except snow
storage in the winter, until this permit was issued. There are no plans
to develop the park into picnic areas.

Sunday afternoon was a terribly disappointing
exception for me:
It was an exception, because I don't often get angry.
And when I do, I am disappointed with myself.
But Sunday afternoon, as I said, was one of those
exceptionally disappointing times.
I had provided (I thought) myself with sufficient time
to drive to the downtown area to attend a 2:30 p.m.
showing of the Academy Award winning movie, "Gandhi."
But on arriving at the north edge of the downtown area,
I was frustrated and then angered to discover that all
key streets appeared to be blocked to automobile traffic.
Traveling down a partially closed street, I found myself
in traffic being channelled across the Iowa River to
the west side of town. After turning around to get
back to a street I assumed would lead me to my
destination, it was more frustration as I ran into more
blocked streets and more detours.
Finally, I found myself on a one-way street with two
alternatives -- be funnelled back across the Iowa River
(not again #@&*!!!) or go the wrong way on the street
to get to at least the general direction of my destination.
Some time later, I arrived at the old Capitol Center
parking ramp. out of courtesy to you, I'll not enter
into a discourse about that structure other than to
emphasize that it did nothing to sooth my demeanor.

Anyway, by the time I arrived at the theater, the
feature (you guessed it) had already begun. So before
returning home to plan when I would try again to see
the movie, I decided to walk to the downtown area to
determine what immensely popular (Lute Olson returned?)
or very important (toxic chemical spill?) event was
the cause of key downtown streets being blocked to
automobile traffic.
As I approached a temporary structure and a few people
standing around at (actually it was on) a downtown
intersection, I observed several bicycle riders
apparently racing behind a car speeding precariously
close to the few spectators.
I was not thrilled.
Apparently the bicycle event was sanctioned by the
City Council and/or city manager, with approval for
blocking the downtown streets.
I urge, I plead, I protest, I ask, I demand, I beg....
please do not approve it again. (Hell, you see, hath
no fury like a middle aged man deprived of reasonable
access to his movies.)
There are places where thousands of local and area
residents play golf, softball, racquetball, tennis,
or whatever in our city. None of those places is,
to my knowledge, located on our city's downtown area
streets.
If people want to race bicycles on weekends, let them
use the driveways and parking areas at West High or
City High, or the driveways at City Park, even lesser
used side streets , or just about anywhere but the
main streets of our downtown area.
I think it is appropriate (now comes the lecture....)
for our local government officials to work actively
toward making it as attractive and as convenient as
possible for people to come to Iowa City's downtown
area. Isn't that what urban renewal has been all
about? To that end, the situation Sunday was
inconvenient and totally inappropriate.

Re: Proposed Iowa City, Iowa, Downtown Hotel
Dear Mayor Neuhauser, Ms. Dickson and Gentlemen:
The undersigned has been retained by certain area businesses
and their owners and management to present certain comments on behalf
of these businesses and individuals relative to the Iowa City Downtown
Hotel Project. The parties, who include Robert McGurk and the High-
lander Inn, Eugene Mueller, the Owner -Lessor of the Howard Johnson Motor
Lodge, Robert Thompson and Robert Winter of the Ironmen Inn, and Neil
Trott of the Abbey and Cantebury Inns are all engaged in businesses which
potentially compete with the downtown hotel facility. They also have a
great deal of knowledge with respect to the ownership, operation and
management of hotels and motels, and several of them either now own or
operate, or have owned or operated in the past, hotels, motels or
restaurants outside the immediate Iowa City area. It is their feeling
that substantial modification needs to be made with respect to the
proposed downtown hotel in Iowa City, and that further data be Drovided
by the developers, before this project will have any significant degree
of market acceptance. It is further their feeling that an unsuccessful
project in downtown Iowa City will adversely affect the efforts currently
being made to attract tourist and convention business to this area, and
that it is essential that any project undertaken in downtown Iowa City
have a substantial probability of successful operation.
We understand that the purpose of the hearing this evening, May
24, 1983, is in connection with the issuance of Industrial Development
Revenue Bonds to partially finance this project. This presentation does
not solely deal with the issuance of Industrial Development Revenue
Bonds, but rather deals with the project in its entirety. We further
understand that a hearing was held several weeks ago with respect to
whether the proposal for the Urban Development Action Grant (UDAG)

should be filed, and that none of the individuals or businesses named
above appeared at that hearing. This was because of a feeling on the
part of the parties involved that they had been unable to thoroughly
review the data from which a presentation could be made. This data
now has been obtained, and we would therefore propose to make our
comments with respect to this entire matter at this time.
We are not in any respect opposing the issuance of Industrial
Development Revenue Bonds for this project provided the city's Industrial
Development Bond policy is followed. It is our understanding that this
policy has beenfollowed in connection with all issues of Industrial
Development Revenue Bonds which have occurred since the adoption of the
Policy. We would request that this policy likewise be followed in this
instance. It does not appear to us, based upon the information that we
have reviewed, that the policy has been followed, in the following
specific respects:
1. No completed Industrial Development Revenue Bond Application
form has apparently been completed by the developer, although the
Memorandum. of Agreement states, on page 4, that "the issuance of the
bonds is subject to further review by the city council of the Issuer
and is conditioned upon, among other things, full compliance of all
provisions of the Industrial Revenue Bond Pol'ic and Procedures for the
City of Iowa City,' Iowa. It woul appear.to us that, as with all othe
Industrial Development Revenue Applications which have been processed
since the policy was adopted, the application form should be completed
and submitted before action is taken by the council with respect to the
bond issue.
2. In all instances, to our knowledge, under the Industrial
Revenue Bond Polic and Procedures for the City of Zowa City Iowa
the policy a financial analysis and review has been made by an
independent party. In all cases to our knowledge except for Mercy Hospital
this was prepared by an individual specifically designated by the city
to perform this service and to whom a fee was paid out of the application
fee paid by the applicant. In the case of Mercy Hospital, this analysis
was performed by Peat, Marwick, Mitchell & Company, an international
public accounting firm with specialists in the area of health care
facilities. We find no such documentation submitted by the applicant
in this instance.
3. It would appear that certain financial statements of "Mid -
City Hotel Associates -Iowa City", which is apparently a limited partner-
ship, and of its partners have not been submitted. The city's policy
provides that a statement of personal history and a personal financial
statement is to be submitted by each partner, or each stockholder having
208 or greater ownership. Although a statement of Dr. Johnson was

submitted, there are other indications in the "Application to the MI
Urban Development Action Grant Program" (the "application") which
indicates that members of Dr. Johnson's family will have an interest
in the project, and also that Mr. Beck will have a 25% interest in the
project. No such financial statements are submitted for these
individuals.
I We further recognize that the partnership which proposes to
develop this facility is a new entity which does not, of itself, have
t a long track record. Inasmuch as Mr. Beck and Dr. Johnson have
developed other similar projects we would suggest that financial
' statements upon these projects be obtained to ascertain their viability.
Further, we would request that the various financial statements
submitted by the individual participants in the partnership be verified
in a manner which is sufficient to reasonably verify their accuracy.
We have also reviewed a letter from Vernon Beck & Associates, Inc.
3 to Mr. Berlin providing certain information with respect to the
project and which appears to contain certain contradictory statements t
with respect to the ownership of the project, as commented upon in the
above paragraph. Under project financing, it is indicated that "a i
letter from a local banker (Iowa City) with a letter of credit backing
the IRB's" is attached. We have been unable to secure a copy of this
letter, and Mr. Mueller has been advised that the letter is lost.
Inasmuch as "a local banker (Iowa City)" could apply only to
representatives of five financial institutions, we would request that a
duplicate of the letter referred to be obtained and a copy be made
available for review. We are further concerned that the letter
identifies a proposed builder which is not locally based. We recall
that a considerable amount of comment occurred last summer because the
Mercy Hospital expansion project was utilizing an out of town electrical
contractor, although the general, mechanical and numerous other
contractors accounting for a far larger portion of the project were
locally based. At that time it was indicated that certain procedures
would be followed in an attempt to secure local participation because
' of its impact upon the economy of Iowa City. There is no indication
that such local participation has been attempted and we would request
that this matter also be reviewed. In support of our position in
this regard, it should be noted that Professor Jerald R. Barnard of the
Department of Economics in the College of Business Administration of
The University of Iowa prepared a report which was submitted in con-
junction with the application of College Plaza Development Company
relative to this project approximately three years ago, which report
substantiated the favorable impact upon the local economy brought about
through the use of locally based contractors.

Of great concern of our clients, as mentioned above, is the
matter of whether the facility as presently conceived and located can
be successful in the marketplace, and further, whether all costs in
connection with this project are being adequately considered. To take
these matters in reverse order, it would appear that the proposed
selling price of the property is some $67,000.00 below the appraised
value thereof. The purchase price of the property is only approximately
$50,000.00 greater than the January 1, 1983 assessed valuation of a
nearby parcel containing only 6,000 square feet. It is further noted
that it will be necessary to renovate the Black Hawk mini -park at
an estimated cost of approximately $75,000.00 to $100,000.00 to
compensate for the plaza improvements being taken, and that approxi-
mately 12,000 square feet of plaza improvements previously constructed
will be destroyed. Based upon the estimated cost of renovation of the
Black Hawk mini -park, it would appear that the improvements destroyed
would have a value of at least $125,000.00. As will be subsequently
set forth later in this letter, it appears to our client that a down-
town hotel facility could be constructed with a far greater possibility
for success in the marketplace which would not involve these particular
costs.
In the opinion of our clients, the construction costs of
approximately $78,000.00 per room, necessitating a rental rate of
$70.00 per night on the average, appear to be unrealistic in light
of market conditions in the area. Contrary to the Application (page 21),
it has not been the experience of our clients that occupancy rates
outside the downtown are generally above 708. Because of their opinion
that this occupancy percentage will not be attained, a higher room
rate will be required, thereby further decreasing occupancy. It is
their opinion that the room rates of $46.00 to $83.00 per night over a
ten year period, based upon the level of occupancy realistically attain-
able, will not be sufficient to insure the viability of this project.
Although Mr. Zuchelli in his report utilized published rates of the
various motels in the area in an attempt to indicate that the proposed
rates for the facility were not appreciably higher than present rates,
published rates do tend to be substantially higher than rates actually
charged by area motels except during peak periods. A schedule of the
room rates of many of these facilities, prepared as of May 4, 1983, is
attached. On this basis, it would appear that the proposal for a
Sheraton -franchised facility having a construction cost of approximately
$58,000.00 per room would be a far more realistic proposal.
The proposed professional fees of $1,600,000.00 for a total
project of less than $13,000,000.00 would appear to be excessive. Inasmuch
as these are all funds which would be paid from "private equity", it
would appear to be particularly important that the actual cash of that
amount go into the project. In our experience also, the contingency

of $242,000.00, or less than 2% of the project, is too low, as is the
working capital to be provided of $183,000.00. In the first year, a
negative cash flow of $106,000.00 is anticipated, reducing net working
capital to $77,000.00. Because of general economic uncertainties such
as those which have been experienced over the past two years, it is
submitted that this is an entirely inadequate cushion for a facility
of this magnitude.
4. On page 20 of the application it is stated that "the amount
of equity which the developer has agreed to commit to the project has
been determined on the basis of the value of the project for both tax
and cash flow benefits." This would appear to underscore the need for
verification by the city of the actual tax benefits which this can
provide for the various owners. Presumably if these benefits are not
present, based upon the above statements, this would have a negative
impact upon the viability of the project.
On page 21 of the Application numerous market conditions are
cited, and it is indicated that "various market surveys have been
undertaken by the developer and by consultants involved in project
planning." No statistics from these surveys has been set forth, however,
and the report does not contain documented market information. None
of the parties named above recall being contacted with respect to any
market survey or request for information. we would request that this
documentation be made available for our further review. Our experience
has been that there are only two firms in the United States which have
been specifically involved over a long period of time with the preparation
of marketing studies for hotels and motels, those being the public
accounting firms of Laventhol & Horwath & Harris, Kerr, Forster & Company.
The reports by these firms contain considerable market data and would
statistically set forth the demand for a given facility, or the lack
thereof. It would appear to us to be appropriate for one of such firms,
or one of comparable standing which may have entered this field more
recently, to provide a market study on this project.
Based upon the experience of the persons named above, it is
their considered opinion that the demand for this facility, as set forth
on pages 160 to 162 of the Application, is not accurate. For example,
the Abbey, which is located in reasonably close proximity to University
and Veterans hospitals, estimates that only three to five percent of its
occupancy is related to hospital visitors. It is their experience that
hospital visitors generally tend to utilize lower cost facilities located
very close to the hospital being visited. Although sales persons
calling upon the local hospitals might represent a somewhat larger base
of customers, it has again been the experience of our clients that sales
persons are extremely cost conscious and do not generally tend to stay
in luxurious facilities. We feel that it is noteworthy that, of the

three hospitals located in Iowa City, a letter in support of the
Application was obtained only from Mercy Hospital which primarily
serves patients within a one hour drive of Iowa City. Nothing
supporting the need for this facility from University or Veterans
hospitals, which serve a much larger geographical area, appeared in
the Application.
Although conferences and conventions do represent a significant
potential for this market, it is not known how many of the attendees
will choose the pay higher rates, Many of the conferences and institutes
sponsored by the University of Iowa are not geared to high income persons,
and we therefore feel that it might be assumed that these persons will
not represent a significant number of patrons of this facility. Ac-
cording to our calculation, based upon the items set forth in the
report, some 8,377 total occupancy days would have to be attributed to
conferences, conventions and meetings. We feel that this is excessive.
Our clients have been in a position to observe the difficulties which
have been encountered by facilities comparable to the proposed hotel in
Des Moines, Cedar Rapids and Davenport, and do not feel that a level
of occupancy for this facility can be generated which will make it
sufficiently different from those to enjoy success at these rates.
p Quite understandably, our clients would take exception to those
f items in the Application (pages 156 to 159) dealing with comparable
1 facilities. The facilities represented by our clients have all been
well maintained and periodically upgraded and were, in one instance,
# rescued from a foreclosure proceeding. One of these facilities is
j undergoing a very substantial renovation at the present time. Also,
during the current property tax valuation process the assessed
valuations of the facilities named above increased by as much as 83%,
with two facilities having 888 increases prior to reduction as a part
of the appeal process. Although it is true that the restaurant
facilities referred to in this section of the report do not provide a
variety of menu choices such as is available in many large cities, it
should also be noted that, within the past 10 years, four facilities
offering such menus in this immediate area have closed due to lack
of financial success. This included two facilities in downtown Iowa
City, Bit Orleans and Louis Pasteur's. While the Iowa City downtown
hotel is presented in the Application as a high quality, top-of-the-
line facility,, it does not appear that the room sizes as indicated
on the "project schematics" appearing at pages 92 and 93 of the
Application reflect current room sizes for such facilities in the
national market. Specifically, a width of 12 feet 8 inches per room is
provided, with the current standard providing for room widths of
approximately 15 feet. In this connection it might be noted that the
Ironmen Inn, originally a "Hilton" franchised facility, was built to
Hilton standards and provides 15 foot wide rooms.

It would further appear to our clients that the estimate of
costs for furniture, fixtures and equipment of $12,000.00 per room,
appearing at page 145(a) of the Application is excessive in light of
market conditions. The Sheraton -franchised proposal, of slightly over
$4,000.00 per room, appears to our clients to have a substantially
greater possibility of financial viability.
Our clients are perhaps most disturbed by the statements set
forth upon page 158 of the Application, indicating that there are no -
other plans for expansion of the supply of rooms of meeting space
in the area and that, "in view of its commitment to the success of the
downtown site for hotel activity, the city may be expected to discourage
any new facilities which would compete with this location." While we
have not had an opportunity to fully research the matter, it would
! appear that this action on the part of the city, if it in fact represents
policy of the City of Iowa City, may well violate the provisions of
the Sherman and Clayton Anti -Trust Acts. Further, the statement that
there are no plans for expansion of meeting space in the area is in-
accurate. On Friday, May 6, 1983 Dean Hines of the University of Iowa
College of Law indicated that a continuing education facility
accomodating 350 to 400 attendees was being incorporated in the new
law school building and which would be the future location of such
events as the Spring Tax Institute, an annual program for lawyers which
has been held for more than 25 years in Iowa City each spring and which,
in recent years, has attracted approximately 400 registrants. As only
one example, the College of Law does carry on a significant continuing
education program, and from Dean Hines' comments I believe that it
might be anticipated that such events would be held at the College of
Law once this facility is completed.
As was indicated at the beginning of this letter, it is not our
intention to discourage competition which is competing fairly with the
facilities represented above. In order to bring this about, we would
suggest that the following ac ion be taken:
1. Inasmuch as it is the position of our clients that the proposal
referred to above has little likelihood of market success, we would
suggest that the project as presently constituted be cancelled as soon
as this would be possible without incurring legal liability on the part
of the city. In the meantime, we would suggest that all items submitted
on behalf of the present developer be carefully scrutinized and that
full compliance with the city's Industrial Revenue Bond Policy be secured.
2. After the completion of Step 1, we would suggest that the
entire area located north of parking ramp 2, and'comprising approximately
.6 square block, be rebid solely for a hotel facility substantially along
the lines of the proposal of The Dey Building Corporation originally

approved by the City of Iowa City back in 1977. Because of the lack
of high rise construction and the facts that the project no longer
would "bridge" Dubuque Street, would not adversely affect the
architecture of the College Block Building and would not involve the
destruction of a substantial amount of existing plaza construction,
we feel that this proposal is vastly preferable to the one which is
proposed to be implemented at this time. We feel that such a facility
would be the only one which has realistic possibility of achieving
market success in the community and would represent a positive addition
to the fine motels and restaurants currently located in the Iowa City-
Coralville area with prices which might be afforded by a sufficient
number of patrons to insure its s ^^^^^

The Mayor announced that the purpose of the meeting was to
hold a public hearing on the proposal to issue not to exceed
$10,000,000 aggregate principal amount of the City's Commercial
Development Revenue Bonds (Mid City Hotel Associates -
Iowa City Project), as required by Section 419.9, Code of Iowa,
and Section 103(k) of the Internal Revenue Code of 1954, as
amended, for the purpose of financing all or a portion of the
cost of acquiring, constructing, improving and equipping a nine
story hotel consisting of guest rooms, convention and meeting
rooms, a swimming pool, coffee shop, and food and beverage
facilities located within the area of and consistent with the
City's Project No. Iowa R-14 Urban Renewal Plan. It is
proposed that the proceeds from the sale of said Bonds be
loaned by the City to Mid City Hotel Associates - Iowa City,
with loan payments sufficient to pay principal of, interest and
premium, if any, on such Bonds as the same shall fall due.
The Mayor then asked if there was any person or persons
present to express views for or against the proposal to issue
said Bonds, notice of said hearing having been published as
required by law. Written objections or other comments were

The duties of members of the Resources Conservation
Commission will include serving as an advisory body
to the City Council of Iowa City. They shall re-
search, review, and recommend policies, rules, reg-
ulations, ordinances, and budgets relating to mat-
ters of energy and resource conservation and pro-
vide recommendations and reports to the City Coun-
cil on the activities of the Commission. The Com-
mission shall exercise broad responsibility for
development of resource conservation policies and
shall pay special attention to long-range planning
and programming. The Commission shall, for the
public welfare, make recommendations on energy
matters. These recommendations may relate to local
governmental and quasi -public agencies, private
residences and investment properties, and office,
commercial and industrial properties.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City. The persons appointed to this Commission
shall be, by training, education, experience, or
demonstrated interest, knowledgeable in matters
pertaining to energy use and conservation.
This appointment will be made at the May 24, 1983
meeting of the City Council at 7:30 P.M. in the
Council Chambers. Persons interested in being con-

Duties of the Housing Commission members include
investigating, studying, reviewing and analyzing
the housing needs and the meeting of such needs
within the City of Iowa City and investigating
and determining if slum areas exist or other areas
where there are unsafe, unsanitary or overcrowded
housing conditions, and studying and investigating
and making recommendations relating to the clear-
ing, replanning and construction of slum areas and
providing dwelling places for elderly persons and

Re: Appeal of Robert A. Rath
At the hearing on the appeal by Robert A. Rath regarding the
revocation of his taxicab driving permit, Mr. Rath questioned the
validity of City's "Exhibit 4" which was a document from the Division
of Criminal Investigation purporting to be a transcript of the
criminal record of Robert Andrew Rath. In particular, Mr. Rath
questioned the accuracy of the entry which showed an OMVI conviction
in 1968 in Butler County.
This issue has now been clarified upon receipt of additional
documentary evidence by this office subsequent to the hearing. In
the interests of justice, I hereby request permission to present this
evidence to you prior to your deliberation on the appeal.

Consideration set for 7:30 p.m., May 24, 1983
Dear Mayor Neuhauser and City Council Members:
Mr. Rath hereby resists the application to re -open the
evidentiary record in his case made by Assistant City Attorney
David Brown on May 18, 1983. At the conclusion of the lengthy
hearing held on May 10, 1983, the Council expressly stated
that the case was submitted and that no further evidence
would be received. Both parties had ample advance notice of
that hearing and should have been fully prepared to present
their cases at that time. Further, an evidentiary record would
be difficult to close if parties were permitted to re -open it
whenever they found arguably relevant evidence by delving
further and further into an applicant's remote past. Such a
system would have little benefit for the parties or the Council.
However, should the Council elect to re -open the record
to permit Mr. Brown to submit his new evidence, Mr. Rath requests
that he be given an opportunity to testify in rebuttal. Thank
you for your consideration in this matter.
