The applicant's request covers roughly an entire city block bound by Gilbert and
Prentiss Streets and the old Linn Street right-of-way, just north of the Chicago,
Rock Island and Pacific Railroad tracks. Part of the block is vacant, a small corner
parcel is in multi -family use, and the remainder is in commercial uses. At least half
of the block is included in the flood hazard overlay zone of Ralston Creek and is
subject to flood hazard regulations. The uses of the surrounding blocks are very
similar to that of the property in question.
Uses in the C2 zone generally include land consumptive commercial uses and
commercial establishments which approach a light industrial type of use such as
repair shops, bottling plants, and print shops. Multi -family uses are permitted but
are discouraged by the requirement of 2,000 square feet per unit. In the CBS
zone, the emphasis is on service and retail establishments such as in the CB,zone
and auto oriented commercial uses. Multi -family dwelling units are permitted with a
density of 750 square feet of lot per unit.

This area is shown on the comprehensive plan update as general commercial and is

adjacent to an area intended for mixed residential/commercial uses. The CBS zoning
requested is consistent with the general commercial designation. The proposed
1
zoning map shows the property in question as CB -2, a zone very similar to CBS.
The applicant has expressed a desire to develop a portion of the property for multi-
family residential use. The CBS zoning is sought for the increase in the number of
units permitted and the flexibility of development at either a commercial or
residential use. With C2 zoning, a maximum of 47 units would be permitted; under
` CBS a maximum of 127 are possible (these calculations are for the entire 2.2 acres).
Access to any use of this property could be provided off of Prentiss Street; access
to Gilbert Street should be discouraged.
STAFF RECOMMENDATION
The staff recommends that the request to rezone property in the southwest quadrant
of the intersection of Prentiss and Gilbert Streets be approved since the request is
consistent with the Comprehensive Plan Update and will permit uses compatible with
the surrounding area.

The property on which R313 zoning is requested is currently being used for an
office. use. The applicant wishes to change this use to multi -family residential
housing. Under the current C2 zoning six units would be permitted; with R313
zoning, 16 unitsarepossible. However, since 24 parking spaces would be
required, it is unlikely that the full 16 units could be built on this particular
lot.
Although the current zoning Is C2, the uses surrounding the applicant's
property. reflect the uses of a CO or multi -family residential zone. On the west
side of Dubuque Street is publicly owned property (Henry Sabin School), to the
north are offices,, and to the east and south are residential dwellings. The only
use in the area restricted to C2 zoning is the veterinary clinic immediately north
of the applicant's property.
The Comprehensive Plan Update shows this area as mixed commercial/multi-
family residential. The proposed Zoning Ordinance designates the lots from
Harrison Street south including the applicant's property as CO -1. The property
adjacent to the applicant's and immediately south is shown as RM80.

Street and a frontage road between Highway 1
and Bryn Mawr Heights, Part Thirteen, and
will consider any written bids submitted for
this property, either prior to the hearings
or at the hearings. Plats of the property
are on file at the City Clerk's Office in
the Civic Center. This notice is given
pursuant to Chapter 362.3 of the Code of
Iowa, 1983.

Notice is hereby given that a public
hearing will be held by the City Council of
Iowa City, Iowa, at 7:30 PM on the 13th day
of September, 1983, in the Council Chambers
in the Civic Center, Iowa City, Iowa. At
which hearing the Council will consider
arguments for and against the proposed
Ordinance presented under the initiative
procedures in the Iowa City charter which
is entitled: Ordinance Establishing a Fair
Rent Board as an Administrative Agency of
the City of Iowa City, and Delegating to
the Board the Duty and Power to Establish
the Maximum Rental Value For Certain
Residential Dwelling Units in the City.

examination in the Office of the City
