Purpose:To sell this property for commercial and residential development. Location: 404-406 S. West - post office; R38. { 45 -day limitation period: 9/2/83 J ANALYSIS F The applicants are requesting that certain property in the southeast quadrant !' of the intersection of Court and Dubuque Streets be changed from R3B zoning which permits only residential development at a maximum density of one unit for 6 every 750 square feet of lot to CBS, which would permit commercial development' as well as the residential density permitted under R3B. This property is within one block of the central business district and is designated in the 1983 Comprehensive `Plan Update for the uses allowed under CBS zoning. ' The proposed 1983 zoning map shows this property as C132, a zone consistent with the current CBS zone. Surrounding uses include medium to high-density multi -family residential, 'commercial, and public uses. These uses are not incompatible with the proposed zoning change and probable redevelopment. Representatives of St. Patrick's have expressed their concern to the City previously regarding the traffic generated by multi -family uses on the block and the use of the alley between the apartments and the school. Although the proposed change would not add to the potential for multi -family development here, the commercial activity proposed may add to the school's concerns. In the CBS zone, off- street parking for commercial uses is not required and although there is a City - owned parking facility within a block, the alley may present a convenient alternative to patrons of any commercial establishments. However, even given this potential conflict, a long-range view of this area supports the zoning and use proposed and does not anticipate the reestablishment of a "neighborhood" of the nature that is compatible with the school. STAFF RECOMMENDATION The staff recommends approval of the rezoning request from R313 to CBS based on the compatibility of the proposed zoning with the 1983 Comprehensive Plan Update and the compatibility of the commercial and residential uses proposed with the majority of the surrounding properties. ANALYSIS The applicants are requesting approval of an amended final PAD plan for Lots 1221 123 and 124 of Court Hill -Scott Blvd. Addition, Part 7. The plan originally approved in 1979 showed a duplex on Lot 122, a fourplex on Lot 123 and a duplex on Lot 124, with each structure having an individual access point to Oberlin Street. The applicants are proposing to amend that plan to allow construction of 2 fourplex buildings which extend over all three lots. The proposed plan also combines access for all eight units to two points via a circular drive. Another concern is raised because of the proposal to build over three lots - that is the potential for future transfer of ownership of individual lots which do not conform with the zoning ordinance. Because staff has always maintained that shifting lots lines in such a way that new lots are not created does not constitute a subdivision, it would be possible to attempt to transfer ownership of a portion of the subject tract in a manner which does not conform to the zoning ordinance. An agreement should be submitted which would require the platting provisions of Chapter 32 of the Iowa City Code of Ordinances to be met prior to the sale of any land. The PAD eprovisions tion also require that evidence of ownership or of a legally binding P agreement for the purchase of all of the property be submitted. In this case, single ownership of all three lots should be substantiated. Also, because of the proposed placement of the buildings on the existing lots, it will be necessary for the side yard requirements and parking design standards requirements (no parking or driveways in the side yard) to be varied as part of the Planned Area Development approval process. Overall, staff finds little difference in the visual image created by the amended PAD vs. that originally approved. The amended plan will result in the same density on the tract and approximately the same amount of open space. Therefore, if the above concerns can be met, staff would recommend approval of the amended plan. STAFF RECOMMENDATION Staff recommends that the amended final PAD plan of Lots 122, 123 and 124 of Court Hill -Scott Boulevard Addition, Part 7, be deferred. Upon resolution of the above concerns and of the deficiencies and discrepancies listed below, staff would recommend approval. ..... _...
