From: Citizens of Iowa City,
Regarding: Proposed truck route along Scott Boulevard.
The undersigned. are concerned about the proposed truck
route urged by the Chamber of Commerce in the Press Citizen on
Monday July 18, 1983 (pg. 2A). Our particular concern, and
objection, is having that truck route follow existing Scott
Boulevard from Court Street to Rochester Road. Since this route
rias first envisioned, the area between Scott and Oberlin and Scott
and Amherst has literally exploded into a residential area (single-
family, condominiums, and apartments). Small children frequently
dart out onto the streets of the area. Also the noise and the fumes
from trucks would be objectionable.
We sincerely request that serious consideration be given to
selecting a more rural and less dangerous route.

The first concerns Home Town Dairy. At the informal discussion
November- 7, 1 noted Nr. Boothroy indicated the special exception
use of dairy product production and packaging should apply at
least to the LSNRD submitted by the dairy. 1 enclose a copy of
this on their location map. It is indicated by the two arrows.
The area to the east which is shaded belongs to three residential
use lots owned by others, a lot owned by the dairy not on the
LSNRD east of those lots and the DX station. I feel that this
area need not be zoned for dairy production as there is none
going on there. I suggest CN -1 to conform to the neighborhood
commercial already there. If the dairy were not present, I
believe CN -1 would be proper for all the commercial property in
this area. At the meeting November 7 it was discussed what might
happen post dairy if that ever happens and thus my hope to zone
particularly the non-dairy property as CN -1. All the uses in the
shaded area would be conforming if CN -1..
The cross hatched area is city property and I ask that the zoning
be F to conform to other city property.
The second concern is the lots in Giblin"s Third addition which
would become non -conforming if zoned RS -5. The area now is RI -8.
I am asking for RS -8 under the new ordinance which is medium
density single family residential. This is in keeping with the
neighborhood which contains four duplexes and 21 single family
houses in current use. As you know R1 -A changes from 10,000 sq.
ft. to 8,000 sq. ft. as it becomes RS -S. RI -8 is 6.000 while RS -
8 is 5,000 for single family lots. That seems in proportion to
me. I hope you will agree that going from R1-6 to RS -8 is not
unreasonable. If instead the requirement: is raised to 8.000 sq.
ft. then my lot- at 28 Caroline Court becomes non -conforming as
does a major portion of the single family lots in the
subdivision. Non -conformity is a serious matter and could reduce
property values causing problems in the fuLure. Please consider
seriously maintaining conformity to the zoned use of our
property. The zone RS -8 would have no conflict: with the cities'
comprehensive plan.

Re; Parking in the RM145 zone.
My letter is to reiterate some questions that must be raised
regarding proposed parking regulations in RM145 zoning.
1. As presently proposed the requirement of 3/4 of a park
space per unit would certainly disallow any landlord from
allocating one full park space to any one unit or to any one
tenant residing in any one unit. since any one tenant or any
group of tenants living in one unit could not lay claim to one
full park space, then the same logic would question why to
require any parking space at all.
Alas, we all know better. Parking is a problem and therefore,
each rental unit should have the privilege of laying claim to at
least one full parking space. I can certainly state with firm
conviction that any new high rise will not consist of one bedroom
units but rather three bedroom units. That is simply because
the cost and economics of high rise construction will require
three bedroom construction to insure a financial return and
avoid investment suicide. Therefore, the requirement of only
3/4 of a park space for three or four individuals per unit, who
will probably be students, who love and cherish the automobile,
is simply not adequate.
2. Building requirements in RM145 zoning will allow two basic
types of high density construction, namely, high rise consisting
of four or more stories, and, low rise construction consisting
normally of three story construction. To require 2 1/2 park
spaces for each unit of three bedroom construction in low rise
construction versus 3/4 of a park space for each unit of three
bedroom construction in high rise construction does not appear
to follow guidelines of being reasonable. Surely, both types of
construction provide a common benefit and common purpose to
tenant and community alike. The developer who builds the low
rise building should not have to conform to any greater parking
requirement than his counterpart across the street who opts to
construct the high rise building. If the low rise developer is
required to construct extra parking spaces, such extra spaces will
be infiltrated by occupants of the high rise building. The law
of large numbers will prevail and quite conceivably the occupants
of the high rise building could totally occupy all of the parking
spaces provided for the low rise building. Please do not place
the developer of the low rise building in such a disadvantaged
position. Parking requirements should be equal for both high
rise and low rise developement providing they are both located
within the boundaries of RM145 zoning.

I am writing to you on behalf of Jim and Loretta Clark in
regard to the proposed rezoning of the above property and the
effect of revisions to city ordinances dealing with the number
of roomers in certain zoning categories.
This property was constructed in 1970 and contains six
two-bedroom dwelling units. Since construction, the structure
has been used for multi -family residential housing. Each unit
has normally been rented by four tenants. This property is
located on North Dodge Street, immediately north of the Eagle
Food Store. The proposed zoning map would place this property
in a RS 8 area. A multi -family residential unit is neither a
permitted nor provisional use under the proposed ordinance.
There is currently a proposal before the Council to alter
the number of roomers allowed in certain single family residen-
tial zones. Under what I understand to be the current draft
of that provision, in the RS 8 zone a dwelling unit could be
occupied by a family, which can be two unrelated persons, and
a roomer.
Additionally, there is some question about whether an
additional off-street parking space would be required for each
roomer. The space simply does not exist to add additional
parking. Therefore, it may be the effect of the RS 8 zoning
class and the limitations on roomers to limit maximum occupancy
to two or three persons per unit.
Obviously, this has a serious impact on the value of the
property to the Clarks, as well as on it's market value.

I am writing on behalf of Jim and Loretta Clark regarding
the proposed zoning of a substantial portion of the near north
side of Iowa City. The new zoning ordinance and zoning map
propose RM 12 zoning for the bulk of this area. The Clarks own
a number of multi -family residential units within this area,
including buildings at 522 East Bloomington, 517-519 East
Fairchild, 613 North Gilbert, 118-120 North Johnson, 333-337
East Church Street, 322-324 North Van Buren Street, and 521-523
North Linn Street.
These buildings and uses complied with all applicable
ordinances at the time of their construction. There has already
been one rezoning of the area which has caused the buildings
to become nonconforming. The changes contemplated by the new
zoning ordinance and map will continue and perhaps even increase
the degree of nonconformity.
I have two concerns and suggestions. First, it would seem
appropriate to recognize the existing uses of these structures
with a zoning more nearly in keeping with their existing use.
Either RM 44 or RNC 20 zoning would be closer than the proposed
RM 12.
Perhaps, even more important, is the language in the pro-
posed ordinance dealing with nonconformities. Specifically,
Section 1-69(B) states that the new ordinance shall not be
interpreted as any authorization for the continuance of use of
a structure in violation of zoning regulations in effect prior
to it's enactment. I believe that it is the intent of the
ordinance to allow the nonconforming uses to continue, so long

as they are not in anyway enlarged. However, I believe there is
an ambiguity in Section 1-69(B) which should be resolved prior
to the effective date of the ordinance.
I hope that you will consider both the issues of zoning
these particular properties to reflect their recent historic
uses and resolving questions about the ongoing uses of,noncon-
forming buildings.

I am not writing this letter in a legal capacity, but rather on behalf of the
Preucil School of Music as a member of its Board of Directors.
The Preucil School building at 524 North Johnson Street is owned by Doris and
Bill Preucil. It is leased at a very low rent to the Preucil School of Music,
which is a non-profit, 501(c)(3), non-discriminatory educational institution
offering musical training for all children and providing facilities for
family -centered musical festivities. As most of you are probably aware, the
school is housed in the Czecho-Slovakian Hall which is qualified on the Na-
tional maintained androf restoredoincitsioriginal condition.n9Yousareeallen eautifull
encouraged to
give it a visit if you have not already done so. I guarantee you will enjoy
it.
As you may imagine, this building was never designed to be used for music in-
struction. The existing rooms are spacious but inefficient for this use.
However, its original configuration must be and should be maintained.
The school would like to excavate beneath the first floor and construct a
basement of less than 1,500 square feet. The basement would be used for
storage and for three and a maximum of four teaching studios. There are pre -

under the zoning ordinance and, thus, this construction requires an additional
14 to 15 parking places. As you can see on the attached Exhibit "A", the
cross hatched area is the only actual ground surrounding the building. As you
can see, it cannot accommodate any parking.
The Council's exemption of downtown churches from a provision in the new Ordi-
nance requiring them to conform to the zoning standards when expanding would
seem equally applicable to the Preucil School. On behalf of the School and
the Board of Directors, I am respectfully requesting such an exemption, or a
provision in the zoning ordinance to assist in this very special dilemma. I
would urge the following in support of this request:
1. The addition of three to four teaching studios in the basement
will not increase our needs for parking. Please let me explain.
The school is virtually unused except from 3 to 6:30 P.M. or on weekends. The
Preucil School has an agreement with school officials to utilize the large
(90') Horace Mann parking lot immediately north of and adjacent to the Preucil
building during "after school hours". Since Preucil students engage in their
musical activities after school, the use of this convenient parking lot meshes
very well with the needs of Horace Mann. Further, children are very often

2. The attached Exhibit "A" indicates there is no possible land area
which may be used for parking.
3. The reasons recently printed in the Press -Citizen for exempting down
town churches would seem equally applicable to the Preucil school:

a. The zoning provisions require additional parking.
b. It is clear that additional parking space is not available.
c. The Preucil building is located on a "small lot".
d. We will have to expand by adding a basement.
4. This is the only possible expansion for this building. Additional
stories and additions may not be constructed at any time in the future.

5. This proposed construction will not alter the appearance of the
building except for the exterior entrance on the side. The building plans
have already been approved by the State Historical Preservation office.
6. The maximum possible increase in parking requirements resulting from
this construction would be very minimal because of the very few students who
can be accommodated in the new basement.
7. We are currently renting additional classroom space from the Zion
Luthern Church only two and a half blocks away. We would be able to avoid
this additional rental expense with the increase in space offered by the base-
ment. Also, most of the parking for those students who are taught at Zion
takes place at the Preucil school building in any event.
8. The construction is required for reasons other than space. It is
necessary to strengthen the existng weak understructure. This has become a
serious problem requiring engineering assistance. Incidental but vital bene-
fits would include the elimination of rodents (rats) and insects, the elimina-
tion of odors from the building and increase in storage space.
9. Although we would like to fully excavate the basement, its area would
exceed 1,500 feet requiring a sprinkling system. The School cannot afford the
sprinkler. Thus, the area has been reduced to less than 1,500 square feet.
10. I really believe in the Preucil School and its purpose. Its philos-
ophy deeply involves the entire family which tends to strengthen family units.
The students and the excellence which they have achieved has enriched Iowa
City culturally. The school has gained an international reputation. The stu-
dents are the mainstays in the orchestras of the Iowa City churches, assist in
University of Iowa productions, supply music for weddings, dinners, receptions
and parties, provide programs for service clubs and for nursing and retirement
homes and University conferences. For 9 out of the last 10 years, a Preucil
student has been the concertmaster in the All -State Orchestra. This year, it
supplied the concertmaster, assistant concertmaster, principal second violin,
first and second chair violas and approximately 11 other players. The stu-
dents win scholarships to Eastman, Julliard, Indiana, Aspen and other schools.
The Preucil School is visited regularly by teachers fran the United States and
Europe. It is the only school of its kind in the State of Iowa and is a def-
inite credit to Iowa City.
Mr. Schmeiser suggested that Doris Preucil attend your Thursday evening meet-
ing. She will be there to answer any questions you may have. Please forgive

Dear Councilors,
I am disappointed that you do not feel that you can
provide funding for improvements at Longfellow Play-
ground. Our PTA felt it was a reasonable request on
our part since CDBG funds have been used in the past,
and the playground is designated as a neighborhood
park,
However, I am more disappointed and concerned with
the attitudes and rudeness displayed at the Council
Meeting and public hearing on that evening, November
7th. A simple explanation of why you felt other fund-
ing requests had higher priority would have sufficed.
But rather, there was extreme rudeness expressed
toward the chairman of CCN, whose committee had spent
many hours preparing their recommendation. There was
hostility expressed toward the Iowa City School Board,
who had nothing to do with our funding request.

The City Council, at its informal meeting on November 14, 1983,
discussed recommendations from the Committee on Community Needs
regarding the FY84 Community Development Block Grant Program.
Included was a recommendation to fund improvements to playground
equipment at Longfellow School in the amount of $3,250.
Following discussion of these specific recommendations, it was the
informal consensus of the Council that funding for this type of
improvement should come from a source other than the CDBG program.
The Council wishes to minimize the use of CDBG funds for smaller
projects which traditionally have been funded from other sources and
to emphasize those larger scale projects for which funding might not
otherwise be available.
In the past, maintenance of playground equipment, etc, on school
grounds has been the responsibility of the School District.
Nevertheless, Council realizes that some school grounds are
functioning as neighborhood playgrounds as well, particularly in the
summertime. Therefore, this proposal will be referred to the
Director of Parks and Recreation to determine whether or not
alternative funding sources might be available.

During a meeting with Mayor Neuhauser and other city representatives, it
was suggested that I write to individual council members and others setting
forth specific concerns of the owners of Plaza Centre One regarding the
present hotel configuration. Accordingly, I have visited at some length with
Richard Hansen and John Lind for the purpose of obtaining their comments and
objections. I have summarized their view and expressed them in this letter.
All of the statistical data contained herein was furnished by Richard Hansen.
My clients have made a substantial monetary and time investment in an
office building in downtown Iowa City known as Plaza Centre One in compliance
with and in reliance on an urban renewal plan as shown in Exhibit 1 attached.
The investment was made with full knowledge that no vehicular access would be
available to the building by the public, but as a substitute for that vehicu-
lar access, there was direct and unrestricted pedestrian access from the
Dubuque Street Parking Garage and pedestrian malls along Dubuque and College
as indicated in Exhibit 1. A major pedestrian square (Lucas Square) was also
part of the amenitities provided to offset the loss of vehicular access.
This pedestrian access and parts of the pedestrian mall amenities were
eroded as shown in the prospectus developed by the City for bids on November 8,
1982 for a hotel and commerical development. The commercial development was
changed from the original urban renewal plan ostensibly to accommodate Arm-
strong's. My clients were not pleased with that configuration because of the
more restricted pedestrian walkways, but did not object because of the poten-
tial of incorporating the hotel and Armstrong's. Yet the plan still provided
a pedestrian access beneath the building as shown in Exhibit 2.

Exhibit 3 shows the present proposed hotel configuration. The open access
beneath the building has been eliminated. Access through a building with
doors of any kind does not provide the type of access needed. Visual access
through a building is not possible. Although preliminary discussions suggest
an enclosed public space will be open 24 hours a day, operational difficulties
due to vandalism and other conduct would seem to indicate that such will not
be the case in the future. Consequently, no visual or direct pedestrian
access is available to Plaza Centre One.
Further, in the present proposed configuration of the hotel, the commercial
space that remains undeveloped and unspoken for is so far removed from Lucas
Square that its viability as commercial space is questionable.
It is difficult to understand when it became obvious that Armstrong's was
not interested in Iowa City, why the Council continued to explore a design
which eliminated a public pedestrian space greater in magnitude than Blackhawk
Park, and which required thousands of dollars of removal work of amenities and
the relocation of utilities as well as an expensive solution for the hotel
developer.
Lucas Square is an amenity that attracts hundreds of people to downtown
Iowa City during the lunch hour and throughout the afternoon. It is a signifi-
cant amenity to Plaza Centre One. In the bid documents submitted by the City,
the extension of that square to the south was somewhat reduced but certainly
was accommodated as the hotel building was located 46 feet south of the north
property line. The present building configuration is now 22 1/2 feet south of
that property line, a major reduction in the spatial quality of the square.
Further, the present hotel configuration casts a shadow on the square as
demonstrated in Exhibits 4 through 7 at 2:00 o'clock P.M. at various times of
the year. Numerous studies that have been done nationally prove that pedes-
trian spaces in shadow are not effectively used by the public. Further, the
present configuration of the hotel cuts off any southerly breeze to this space
every day from spring through fall and will make this a very stifling place,
particularly in the summertime. Not only my clients but the people of Iowa
City who use this public space will be adversely affected by this configuration.
On other issues:
1. The Council is evidently changing its policy regarding parking as it
is accommodating specific parking allocations in the Dubuque Street parking
ramp for the hotel. My client has several times requested from the Council a
change in the parking policy to accommodate a minimal but important number of
stalls for office -type businesses in the downtown area. The users of the
facilities of the hotel could easily fill the ramp denying access to this
parking facility by either the shopper or the so-called "temporary reserved"
parking. The City is the sole provider of parking in the downtown area and
should address this question immediately.

2. The configuration of the hotel creates an alley of less than 10 feet
in width between the hotel and the College Block Building. This will undoubted-
ly become a major security and maintenance problem for years to come. It seems
out of context to provide such a separation between buildings in an urban
design setting that is not prevalent in the downtown area of Iowa City. A 10
foot space between an eight -story building and a two-story building (the
College Block Building) is of questionable urban design massing.
3. The use of stucco as the exterior material of what will become the
most prominent building in downtown Iowa City is of major concern. This
material is inexpensive, has a high maintenance factor, and is of questionable
longevity in this climate.
4. It is my understanding that my clients will be receiving a letter from
Mr. Berlin outlining modifications that will be made in the present east -west
pedestrian mall as well as reduction of the planter at Lucas Square to accommo-
date movement of fire trucks to the east side of Plaza Centre One. Upon
receipt of that letter, they will have it reviewed by their insurance carrier
for appropriateness. It is, of course, assumed that the City will bear the
expense of these modifications.

In view of the obvious progress of the work at this time, it is essential
and in the interest of all parties that a decision concerning this matter
should be made immediately. Plaza Centre One owners do not wish to institute
litigation but feel that their property will be substantially damaged. One of
the purposes of this letter is to place the City of Iowa City on notice that
unless the owners are granted some relief by the City Council, a claim for
damages because of reduction of value of property will be filed. Our appraisers
have indicated that extensive damage will occur to this property if construction
is accomplished according to the present hotel configuration.
Richard Hansen and John Lind have advised me that they will be happy to
meet with any one at any reasonable time upon reasonable notice for the
purpose of further explaining their position.

I represent the owners of Plaza Centre One, the first structure of the
Iowra City D:xantown Urban Renewal Project.
It is apparent that the concept of a pedestrian mall prohibits any
vehicular access to this property. The use of the property above the
first floor for offices was always contemplated and the building was
constructed with city approval after representations were made concerning
the use of the property and its availability to customers and tenants.
From the first stages of the Urban Renewal Project, Plaza Centre One
had a planned visual exposure from the south. It was repeatedly indicated
that this southern visual exposure would enable persons using the Dubuque
Street parking ramp to locate the building with ease and have easy pedestrian
access to it.
We are now advised that plans have been changed and the proposed hotel
will remove any visual exposure of the building from the south as well as
impede the pedestrian access to it by compelling customers and patrons to
enter the mall area through a narrow walkway or possibly through a hotel
lobby. These access proposals change the original plan upon which my
clients relied and invested substantial amounts of personal effort and Irony.
This change is completely unsatisfactory to ny clients and will result in
a "taking" of valuable property rights. Additionally, there appears to be
a substantial problem with adequate fire protection for the Plaza Centre One
building as well as its occupants.
The purpose of this letter is to advise you that my clients oppose the
change being made and object to it. Also, it is our judgment that such new
construction would constitute inverse condemnation for which my clients would
be entitled to damages.
Notwithstanding the legal ramifications or remedies which may be available

Dear Madam Mayor and Council Members:
My client, James Clark, is in the process of negotiating
a purchase of real estate located at the southwest corner of
the intersection of Gilbert and Prentiss Streets in Iowa City.
This is the former Boyd and Rummelhart Plumbing building.
As anyone who drives by this site is aware, this is one
of the most visible and blighted areas on Gilbert Street. The
City, private developers, and project Green have made great
strides in the past few years in enhancing the visual appeal
of the Gilbert Street corridor. This particular site would
give that effort a quantum leap forward.
Mr. Clark's desire is to build multi -family residential
housing on this site. A careful financial analysis of the
project demonstrates that the development is infeasible, if
not impossible, under current market interest rates. This
site is particularly amenable to underbuilding parking, because
of the topography of the area. Such underbuilding parking,
however, adds significantly to building costs.
This site is currently not in the Chapter 403 area which
is eligible for industrial revenue bond financing. The Chapter
403 area does not take in any of the west side of Gilbert Street
south of Court Street. On behalf of Mr. Clark I would like to
request that you give consideration to extending the eligible
Chapter 403 area south along the west side of Gilbert Street to
the Rock Island railroad tracks, so as to encompass this par-
ticular building site.
As the Council is aware, the use of bond proceeds can add
much needed housing, particularly in the area of low to moderate

income housing. This project proposes twenty-nine units of
which six would be committed to the low and moderate income
housing market for a minimum period of ten years under indus-
trial development bond regulations.
Turning to conventional financing to develop this site
would result in an extended delay in development at best and
perhaps no development at all. We certainly hope you will give
favorable discussion and consideration to expanding the area
eligible for revenue bonds to include this site.

Dear Council Members and Mr. Berlin:
I am writing on behalf of GWG Investments. GWG has the
option to purchase the library parking lot under the terms of
the contract between the partnership and the City of Iowa City.
GWG intends to exercise its option to purchase. One or more
buildings are planned for the site.
The contract (Offer to Purchase -Old Public Library and
Parking Lot) is not particularly clear as to all the procedures
required for exercising the option. Paragraph 8 of the con-
tract provides in part:

Parking Lot Lease Terms: The Buyer retains the right to pur-
chase the parking lot in entirety within twelve (12) months
from the date that title to the library is conveyed. Purchase
price will be $205,000. The right to purchase shall be at Buy-
er's option and Buyer will exercise this option by giving writ-
ten notice to Seller. Seller agrees to convey said property
within sixty (60) days after receipt of said notice.

The Buyer, when exercising the option to purchase the parking
lot property by written notice, will tender $20,500 in the form
of a cashier's check, money order or certified check as earnest
money. The balance on the purchase will be paid within sixty
(60) days from the date this offer is exercised. If the Buyer
fails to perform this agreement within the time limit herein
specified, Seller may retain the earnest money as liquidated
damages, not as a penalty or forfeiture, and declare this
agreement terminated. The Seller may, as an option, proceed to
have this agreement specifically enforced or pursue any other
remedy that is available, in law or equity, for breach of this
j agreement.
Title to the library was conveyed February 17, 1983. The
closing occurred on the morning of the 17th in the law library
at the Civic Center. Since that is the case, GWG interprets
the contract to require it to exercise its option by giving
written notice and tendering the $20,500 downpayment on the
library lot to the City on or before February 17, 1984. Then,
both the City and GWG will have sixty (60) days from that date
to close the transaction with GWG paying the balance of the
purchase price and receiving a warranty deed. Further, at its
own option, GWG can choose to exercise the option to purchase
earlier and close within sixty days.
The primary ambiguity that we are concerned about is the
question of whether or not closing and delivery of title has to
occur within the twelve month period, on or before February 17,
1984. We don't believe that the contract requires that, but
would request that you review the questions raised in this let-
ter and provide us with your opinion sometime before December
5, 1983.

ACTION:
Pursuant to Section 23-274 of the Municipal Code of Iowa City, the
City Traffic Engineer will authorize the removal of four parking
meters on the west half of the 200 block of E. Court Street. The four
meters to be removed are known as C071, C073, C075, and C077. These
four metered stalls will be removed and replaced with a NO PARKING
ANYTIME prohibition. This action will take place on or shortly after
November 22, 1983.
COMMENT:
This action is being taken to improve the sight distance for school -
aged children using Regina Elementary School. The improved sight
distance should enhance the ability of these school -aged children to
cross Court Street.

In response to the City Manager's letter of October 20,
1983, directed to Bruce Glasgow, GWG has tried to gather infor-
mation for the City of Iowa City to present to the Council mem-
bers the extent of the Carnegie Library improvements. However,
we have been unable to put a dollar value on the improvements
due to the nature of the contractors doing work in this busy
season of the year. Most of the work is on a "time and mate-
i rials" basis. The billings for the work will not be received
for payment until later, when the weather forces the contrac-
tors in -doors. At that time they will issue their statements
for work performed.
Enclosed is a list of the operations and improvements that
are now being completed or are under way by GWG and a list of
the scheduled 1984 improvements.

Hopefully, the City of Iowa City will be able to use this
information to show that GWG is performing under the contract.

COMPLETED IMPROVEMENTS AND WORK IN PROGRESS
AS OF NOVEMBER 1, 1983
The existing Kewanee heating boiler and burner was removed
from the building and a new boiler and burner installed.
The existing Trane compressor was removed from the build-
ing and a new Trane compressor was installed.
The Johnson Service control system was upgraded by the
installation of an "air dryer" and all controls were ser-
viced and/or replaced.
The existing chimneys were repaired.
A program of extensive rewiring was started. The upper
level of the library building was rewired for its intended
use.
Phone service in the upper level was extensively improved
to accommodate additional phones and computer terminal
services.
All existing floor covering, tiles and carpeting, in the
upper level was removed and the floor reconditioned. New
carpeting was installed on the entire upper level.
All ceramic tiles on the entry levels and the steps that
needed attention were repaired or replaced.
All the wall surfaces on the upper level were repaired and
repainted.
New room partitions are now being constructed in the lower
level.
All wall surfaces in the lower level are being repaired
and repainted.
All former leaks that destroyed the outside walls and the
ceilings in the lower level are being repaired and re-
painted.
New ceiling tiles are being installed.

On the outside of the building all of the shrubbery and
trees were pruned and cleaned by Leon Lyvers, Tree Sur-
geon. The original planting design by the architects was
discovered and revealed.
A new sidewalk on Linn Street is being constructed.
A new 6 -inch cast iron water main was installed from Linn
Street into the building and the existing 100 -year old
lead water line was removed and "killed" in Linn Street.

B. A new brick sidewalk from the Linn Street walk to the area

D. Window replacement bids are now being received and will be
evaluated. A contractor will be selected to do the work.
Windows will be constructed to resemble the windows as
they existed in 1902.
E. The boiler room will be sound proofed.

H. A masonry repair effort will be started on the outside of

I. Plans for an addition to the Library are now being re-

Dear Madam Mayor,
As members of the Iowa City Historic Preservation Commission, we would like
to comment on Mr. Jim Clark's request to have the southwest corner of the inter-
section of Gilbert and Prentiss Streets included in the Chapter 403 urban renewal
area.
We agree with Mr. Clark's attorney, C. Joseph Holland in a letter to you dated
November 10, when he says "this is one of themost visible and blighted areas on
Gilbert Street." lie also agree that the re -development of that corner would enhance
the area. However, we all share a serious concern about how that re -development is
to take place.Re-development per se is not necessarily an improvement.
Our particular concern is the corner's proximity to the Close Mansion at 538
South Gilbert. We are sure you agree that the renovations of the Mansion have resulted
in a structure that the entire city should be proud of. Efforts such as those made
by the owners of the Mansion should be encouraged by the city. Whenever possible,
those efforts should also be protected.
The Planning and Zoning Commission also seems to share our concern about this
particular location. When the Boyd-Rummelhart property was granted a re -zoning from
commercial to high density residential several PdZ commissioners, at the time of the
vote, expressed their hope that whoever developed the property would take into con-
sideration the Close Mansion.
Thus, we would support Mr. Clark's request to extend the urban renewal desig-
nation to the property in question. We would also support his request for Industrial
Revenue Bonds to help develop the area. However, we would support these requests
only if the City Council is willing to exert a strong influence in the design review
process afforded by the issuance of IRB's.
Mr. Clark has a unique opportunity to truly enhance this location. We feel he
should be encouraged. We would very much like to work with him to provide an attractive,
cost-effective, structure that will combine with the Close Mansion to make this much
traveled corner of Iowa City an imaginative union of the old and the new.
Your consideration in this matter would be greatly appreciated. Please let us
know how you feel about this location.

A great deal of emphasis has been placed lately on preserving the College
Park area. Is the present beauty of the park itself to be preserved or is it
the memory of the way it looked before the July h, 1953 twister when thirteen
large, beautiful trees fell never to be replaced? IS the City of Iowa City is
in favor of downgrading, depreciating property usedand valuation in this area
to preserve it, I believe it is time that fends be appropriated to improve the
College Park itself. There are very few trees in it and most df them need
trimming, care, and attention. Some are quite unsightly. The water fountain
has been removed from the park. The park is used to a large extent by persons bring—
i•ngr,: their pets to run loose. The children's sandboxes had to be removed some
time ago because of the unsanitary conditions of them.
We have been interested in the park since 1940. I found the first swings
which were placed in it. I convineddtbhe Recreation Commission to purchase them
second hand. I was told that the swings were being placed on the west side of
the park nearest our house so we could get most of the noise. We have always
enjoyed the children using them.
In this same area at the northwest cornen of the park is the very
unsightly Ralston Creek area. If the College Park area is going to be worth
preserving, some extensive changes need to be made.

the Council questioned whether it would be appropriate to delay
setting a public hearing on the designation of historic districts
until after torments have been received by the Iowa State
Historical Department.
According to procedures outlined in the ordinance, the proposed
historic districts were sent to the Iowa State Historical
Department on November 16, 1983. Comments from the State
Office have not yet been received. It would be appropriate for
the Council to defer setting the public hearing until after
receipt of comments concerning these designations.

One vacancy - Five-year term
January 1, 1984 - January 1 ,1989
Duties: In appropriate cases and subject to appro-
priate conditions and safeguards, make special ex-
ceptions to the terms of the ordinances in harmony
with general purpose and intent and in accordance
with general or specific rules therein contained
and provide that any property owner aggrieved by
the action of the Council in the adoption of such
regulations and restrictions may petition the said
Board of Adjustment directly to modify regulations
and restrictions as applied to such property owners.
It can only act pursuant to the zoning ordinance.
It has no power to act upon any ordinances other
than the zoning ordinance. It cannot grant a vari-
ance unless specific statutory authority provides
for,granting a variance. Variances granted under
Iowa Code, Chapter 414.12(3) and Iowa City Munici-
pal Code A -8.10.28H 1(d) may only be granted in the
case of "unnecessary hardship". The hardship must
be substantial, serious, real, and of compelling
force, as distinguished from reasons of convenience,
maximization of profit or caprice.
