Dear Mary:
I have been asked to write to you concerning the proposed new zoning
ordinance by Leroy Butler, the president of sutler Plumbing.

Butler Plumbing is located west of Miller Avenue on the south side of
Hwy. 1 west.
I
He has just discovered that the new zoning would make his property non-
conforming. He operates a plumbing and heating business at that loca-
tion.
It is my understanding that this business would be conforming if the
area where his property is located were in a CI -1 zone rather than in a
CC -2 zone.
I understand that there are several properties in the area which would
become non -conforming unless the zoning is changed. I would be happy
to sit down with the council or with staff to discuss this matter if you
wish us to do so.

Subject: Prior legal actions affecting certain
Properties in Iowa City and, in particular,
a 2.99 acre tract located adjacent to the
Westinghouse Learning Property on Highway 1
Members of the City Council:
In your deliberations on the proposed new zoning ordinance
and comprehensive plan, it would be advisable to deal with the
results of prior legal actions that have ended in Court decrees
that overruled or modified City zoning laws. You should con-
sider a clause in the new ordinance that would state:
Where a property has been subject to legal
review by the Courts, and where a property
has been declared by the Courts to be sub-
ject to a decree handed down by the Courts,
then the parts of this ordinance affecting
the particular property will be subject to
the previously rendered Court decree. Any
property that has been declared by the
Courts to have a use as decreed in a Court
order shall follow the Court decree even
though the decree is in variance with this
ordinance.
The use of this statement in the new ordinance would prevent
further litigation on certain properties throughout the City
including the above referenced tract.

RE: Proposed Zoning Ordinance
Dear Mayor Mayor Neuhauser and Council Members:
It is realized that a great deal of time and effort has been expended by
the City staff and the City Planning and Zoning Commission over the past
years in their work on the proposed zoning ordinance which has been sub-
mitted to you for review and which you now have under consideration.
It is understood that the Council has established a deadline of December
20, 1983, for passage of the proposed ordinance. In view of the many
concerns that have already been expressed about the ordinance and the
various revisions which are in process or which are being considered,
the Chamber of Commerce remains concerned that the established time
schedule for passage will not allow adequate opportunity for a proper
determination of the impact of this ordinance on affected property owners.
In the event the Council does proceed to pass the ordinance as is pre-
sently contemplated, the Chamber of Commerce urges that the Council
and staff be very flexible in its consideration of needed changes as
the ordinance is applied in the future. Furthermore, the Chamber of
Commerce is willing to appoint special subcommittees of the Chamber
to work with the City in the areas of the zoning ordinance, the tree
ordinance and the sign ordinance as a means of cooperative input in
addressing the problems related to these matters. If we can be of
assistance in this manner, please let us know and we will proceed ac-
cordingly.

Our office represents Drs. Wallace, Rosenberger & Hackbarth, who have filed an
Application for the issuance of Industrial Revenue Bonds, and there was not
adequate time for your staff review of the Application to allow the Applica-
tion to be put on the agenda for the Regular Council Meeting to be held on
December 6, 1983.
It is extremely critical from a timing standpoint that the Industrial Revenue
Bonds be approved for issuance prior to December 31, 1983. I, therefore,
would like to request that the Council hold a Special Meeting on Friday,
December 9, 1983, for the purpose of approving the Memorandum of Agreement,
and that a public hearing be set for either Monday evening, December 26, or
Tuesday morning, December 27, 1983, at a Special Meeting of the Council for
the purpose of approving the issuance of the Bonds.
I have conferred with Rosemary Vitosh, and it is my understanding that the
staff will be able to complete its review and submit a report to you prior to

Commission in their work toward the development of such facilities.

RE: Sewage Treatment System
Dear Mayor Mary Neuhauser and Council Members:
After the recent trip to Europe in an effort to attract economic
development to the Iowa City area, we all learned that economic
development and growth is a long process. It is extremely im-
portant that a number of minimum items be in place, before our
"Extras" like quality education, safe and clean living environ-
ment and developed transportations will be considered. One of
these minimums is a effective and efficient sewage treatment system,
both for the present and the future.
It is understood that one of the priorities of the 1983 Council is
the beginning of a plan to empliment a new sewage system for Iowa
City. We are encouraged that the City Council recognizes this
problem, and is working to find a solution. However, we are
concerned about the speed with which this decision will be made
and the limited number of possible solutions considered.
We agree that the sewage system is a priority item and one which
should be addressed in a careful and considered manner.
The City Council is in the middle of the adoption of a comprehensive
zoning ordinance, which is taking your attention and time. The
sewage system is as important of a matter in the future of Iowa
City and we request that you give it equal attention and consideration.
Therefore, we request that you delay making any decisions on any
plan until time is available for indepth consideration. We will
be reviewing some of the proposed solutions in the near future, and
hope to develop a position on the solutions. As the economic de-
velopment is a long term process, we feel delaying a decision even
up to six months is worth the wait for the long-term benefits
our community will receive.

Dear Madam Mayor,
As members of the Iowa City Historic Preservation Commission, we would like
to comment on Mr. Jim Clark's request to have the southwest corner of the inter-
section of Gilbert and Prentiss Streets included in the Chapter 403 urban renewal
area.
We agree with Mr. Clark's attorney, C. Joseph Holland in a letter to you dated
November 10, when he says "this is one of the most visible and blighted areas on
Gilbert Street." We also agree that the re -development of that corner would enhance
the area. However, we all share a serious concern about how that re -development is
to take place.Re-development per se is not necessarily an improvement.
Our particular concern is the corner's proximity to the Close Mansion at 538
South Gilbert. We are sure you agree that the renovations of the Mansion have resulted
in a structure that the entire city should be proud of. Efforts such as those made
by the owners of the Mansion should be encouraged by the city. Whenever possible,
those efforts should also be protected.
The Planning and Zoning Commission also seems to share our concern about this
particular location. When the Boyd-Rummelhart property was granted a re -zoning from
commercial to high density residential several PdZ commissioners, at the time of the
vote, expressed their hope that whoever developed the property would take into con-
sideration the Close Mansion.
Thus, we would support Mr. Clark's request to extend the urban renewal desig-
nation to the property in question. We would also support his request for Industrial
Revenue Bonds to help develop the area. However, we would support these requests
only if the City Council is willing to exert a strong influence in the design review
process afforded by the issuance of IRB's.
Mr. Clark has a unique opportunity to truly enhance this location. We feel he
should be encouraged. We would very much like to work with him to provide an attractive,
cost-effective, structure that will combine with the Close Mansion to make this much
traveled corner of Iowa City an imaginative union of the old and the new.
Your consideration in this matter would be greatly appreciated. Please let us
know how you feel about this location.

Dear Mr. McDonald:
I am directing my letter to you because of your comments in
todays Daily Iowan, but I hope you will share my thoughts
with other members of the City Council.
I am .writing as a private citizen to register my disapproval
of allowing the new hotel to occupy any portion of Dubuque
Street and to request that the City pursue getting an injunc-
tion to stop the builder before further construction occurs.
From the very beginning, it was stated in the media that the
new hotel and department store would be constructed on the
square block next to the Lenoch and Cilek store. To my
knowledge there was never a mention of construction on
Dubuque Street itself. Now the builder has excavated the
street and will proceed with his building under implied
consent unless there is sufficient citizen protest to stop
him. This building will, if permitted, create a barrier to
the pedestrian mall that has come to be the centerpiece of
downtown Iowa City. I realize that federal funding is
involved and there is a rush to get the funding details final-
ized before Congress can change the guidelines but I also
realize that this is the time to stop construction that does
not comply with the original specifications. Please get an
injunction to stop this action before the builder proceeds
to erect a building that will destroy the openness and
beauty of our little downtown.

Dear Council Members:
Our efforts to build Iowa City's first commercial television
station have been seriously damaged by the Iowa City Municipal
Airport Commission's handling of our request that it
accommodate the communications tower we need.
As I have told you previously, the tower could result in'
some minor inconveniences to a few airplane flights during
some weather conditions. It is likely that most of those
inconveniences would occur only during the few months it
would take to install and commission an additional NDB
(a navigational aid), which we have propcsed to fund. it
is the gift of the money for that NDB that we now ask you.
to accept for improvement of the Airport.
More specifically, the Television Development Association
Of Iowa gift would be $10,000 to be used for purchasing
and installing an NDB placed so that it would serve an
instrument approach to Runway 6 that would be clear of
the tower area. We would make the gift in a series of
payments, each no more than five days prior to the dates
that payments are due for the NDB equipment and the services
necessary for its installation (excluding services that
can be provided by Airport personnel).
Other than the use of the gift as previously described,
the only contingency would be that the Airport management
make all necessary applications for the NDB and the
instrument approach no later than December 31, 1983, and
complete installation and commissioning within one year.
Besides permitting the construction of the television
station, this beacon also would result in operational
improvements to the Airport. At the least, the NDB would
improve the instrument approach to Runway 6 by making it
more direct to the runway's centerline. Properly placed,
it also could provide better instrument landing minimums

Dear Mr. Sasser:
We are applicants for permission from the Federal
Communications Commission to build Iowa City's first
commercial televison station. The station also would
serve as the base of operations and programming for a
network that could serve up to 90 percent of Iowa's
population. The President of the Greater Iowa City
Chamber of Commerce informed you in an October 11 letter
of the importance of our communications project to the
Iowa City area.
Our efforts to find a site for the multi -use 2,000 -foot
communications tower from which the station would transmit
have been underway for more than a year. Because of
aeronautical considerations, there are only two feasible
areas for the tower: one approximately 13 N.M. west of
the threshold of Iowa City Rwy 6; the other approximately
10 N.M. from the threshold of Rwy 24. Because the approach
to Rwy 24 would be more frequently used, it would seem
that the site to the west would impact the airport less.
In fact, the west site has been thoroughly examined under
Aeronautical Study No. 83 -ACE -573 -OE, which determined
it to be a hazard primarily because of its effect on
proposed Iowa City NDB Rwy 6. Informal analysis indicates
that there is little doubt that an additional NDS would
permit an insrument approach procedure to Rwy 6 that would
be an improvement over the currently -proposed NDB Rwy 6,
while not conflicting with the proposed tower. If the
additional NDB were properly placed off -airport, it appears
that the landing minimums to Rwy 6 would be better than
are available from any other instrument approach to Iowa
City. This certainly would result in a substantial
improvement in capabilities at the Airport.
The Iowa City Municipal Airport Commission on November
17 rejected our offer to pay substantially all the costs
of purchasing and installing an additional NDB. We believe
that this rejection was based primarily upon the traditional
pilot concern about tall towers, although it long has been
the position of your agency that communications towers
of that height are presumed to be non -hazardous if properly
positioned.

However, the unrelated problems of the Airport in attempting
to regain its Federal funding and sanctioning were mentioned
by the Commission as a factor in its rejection of our offer.
It would appear to us that an improvement in the Airport
such as the additonal NDB should work to the Airport's
favor in your consideration of removing its non-compliance
status.
We do not wish to place the city in a position of choosing
between a viable future for its Airport and its first
commercial television station. If the matter of accommodating
the tower as proposed will have any impact on the issue
of compliance vs non-compliance, would you please inform
us at once? We need to have a clear statement from the
FAA that the Airport's efforts to regain its funding either
will or will not be harmed by the tower's accommodation
thru installation of the additional NDB as proposed. We
believe that such funding is important to the City in which
we propose to locate our operations center. We do not
wish to place the city in a position of choosing between
a viable future for its Airport and its first commercial
television station.

ACTION:
Pursuant to Section 23-274 of the Municiple Code of Iowa
City, the City Traffic Engineer will authorize that the
time limit of the two parking meters at the west end of
the south side of the 400 block of East Iowa Avenue be
changed from ten hours to one hour. These parking meters
are designated I 301 and I 303. This change will occur
on or shortly after December 7, 1983.
COMMENT:
This action is being taken to provide short term parking
for the Unitarian Church located at 10 South Gilbert.

As directed by Section 23-16 of the Municipal Code of Iowa City, this is to
advise you of the following action:
ACTION•
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City Traffic
Engineer will direct the installation of NO PARKING ANY TIME on the east side
of Cambria Court from the intersection with Cae Drive north to the cul-de-sac.
This action will take place on or shortly after December 13, 1983.
COMMENT:
This action is taking place after the completion of a postcard survey. The
consensus of the residents which will be directly affected by this prohibition
is in favor of the prohibition.

As directed by section 23-16 of the Municipal Code of Iowa City, this is
to advise you of the following action:
ACTION•
Pursuant to the Section 23-234 of the Municipal Code of Iowa City, the
City Traffic Engineer will direct the installation of a NO PARKING CORNER
1U HERE sign on the west side of Oakland Avenue at a point approximately
35 feet south of the intersection of Oakland Avenue and Court Street.
This action will take place on or shortly after December 13, 1983.
COMMENT:
This action is being taken at the request of the Transit Manager Larry
McGonagle to facilitate the turning movement of buses at the intersection
of Oakland Avenue and Court Street.

Re: Parking Prohibition on Wright Street CITY CLERK (3)
As directed by Section 23-16 of the Municipal Code this is to advise you
of the following action.
ACTION:
Pursuant to Section 23-239 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct the installation of NO PARKING ANY TIME signs
on both sides of Wright Street between Clinton Street and Dubuque Street.
This action will take place when the property owners on the south side of
this block of Wright Street complete the construction of their parking
lots.
The owner of the property on the south side of Wright Street is construct-
ing parking lots on both the east and west side of the old Rock Island
Railroad train depot. As part of this parking lot construction he is
installing curbs on the property line. These new curbs will result in
Wright Street being 22 feet wide. With the street this wide, parking must
be prohibited on both sides so that two-way traffic can be maintained.

The City Council of Iowa City, Iowa, met in reeular session
on the 6th day of December , 1983, at 7:30 o'clock n .m.,
at the _Civic Center in the City. The meeting was called to
order and there were present D1ary Neuhauser Mayor, in the chair,
and the following named Council Members:

The City Council investigated and found that notice of intention
to issue Housing Revenue Bonds, Series 1983 (Systems Unlimited, Inc.
Project) in an aggregate principal amount not to exceed $375,000 had,
as directed by the City Council, been duly given according to law.

This being the time and place specified in the notice for the
conduct of a public hearing on the proposal to issue such Bond, the
Mayor announced that all local residents attending the hearing would
now be given an opportunity to express their views for or against the
proposal to issue the Bond. The following local residents expressed
their views as follows:

views for or against the proposal to issue the Bond, Council Member
Balmer introduced a Resolution entitled:
"Resolution authorizing the issuance and sale of Housing Revenue
Bond, (Systems Unlimited, Inc. Project) of the City of Iowa City,
Iowa, in the principal amount of $375,000, to finance the costs of
acquisition by construction or purchase of land, buildings,
equipment and improvements suitable to be used to provide housing
for the handicapped; the execution of a Lender Loan Agreement with
Iowa State Bank & Trust Company, Iowa.City, Iowa providing the
terms and sale of such bond; the execution and delivery of a Loan
Agreement with Systems Unlimited, Inc. providing for the repayment
of the loan of the proceeds of such bond, and related matters",
and moved its adoption, seconded by Council Member Perret
After due consideration of said resolution by the Council, the Mayor
put the question on the motion and upon the roll being called the
following named Council Members voted:

RESOLUTION
"Resolution authorizing the issuance and sale of Housing Revenue
Bond, (Systems Unlimited, Inc. Project) of the City of Iowa City,
Iowa, in the principal amount of $375,000, to finance the costs of
acquisition by construction or purchase of land, buildings,
equipment and improvements suitable to be used to provide housing
for the handicapped; the execution of a Lender Loan Agreement with
Iowa State Bank s Trust Company, Iowa City, Iowa providing the
terms and sale of such bond; the execution and delivery of a Loan
Agreement with Systems Unlimited, Inc. providing for the repayment
of the loan of the proceeds of such bond, and related matters",
WHEREAS, the City of Iowa City, Iowa, in the County of Johnson,
State of Iowa (the "Issuer") is an incorporated municipality authorized
and empowered by the provisions of Chapter 419 of the Code of Iowa, '
1983, as amended (the "Act") to issue revenue bonds for the purpose of
financing the cost of acquiring, by construction or purchase, land,
buildings, improvements and equipment, or any interest therein,
suitable for the use as a housing unit or complex for the elderly or
handicapped; and
WHEREAS, the Issuer has made the necessary arrangements with
Systems Unlimited, Inc. (the "Company") for the acquisition by
construction or purchase of land, buildings, equipment, and improvements
suitable to be used to provide housing for the handicapped (the
"Project") located within the corporate boundaries of the Issuer at
1918 - 1924 - 2004 Hollywood Boulevard;•and
WHEREAS, it is necessary and advisable that provisions be made for
the issuance of Housing Revenue Bond, Series 1983 (Systems Unlimited,
Inc. Project) of the Issuer in an aggregate principal amount not to
exceed $375,000 (the "Bond") as authorized and permitted by the Act to
finance the cost of the Project to that amount; and
WHEREAS, the Issuer will loan the proceeds of the Bond to the
Company pursuant to the provisions of a Loan Agreement dated as of
October 1, 1983 (the "Loan Agreement") between the Issuer and the
Company the obligation of which will be sufficient to pay the principal
of, redemption premium, if any, and interest on the Bond as and when
the same shall be due and payable; and

WHEREAS, the Bond will be sold pursuant to ana secured as provided
by a Lender Loan Agreement to be dated as of October 1, 1983 (the
"Lender Loan Agreement") by and between the Issuer and Iowa State Bank
V Trust Company, Iowa City, Iowa (the "Lender"); and
WHEREAS, the rights of the Issuer in and to the Loan Agreement are
assigned to the Lender under the Lender Loan Agreement; and
WHEREAS, notice of intention to issue the Bond has been published
and this Council has conducted a public hearing pursuant to such
published notice, all as required by the Act, and has hereby determined
that it is necessary and advisable to proceed with the financing of the
Project; and
WHEREAS, the Issuer has arranged for the sale of the Bond to the
Lender;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Issuer,
as follows:
Section 1. Authorization of the Bond. In order to finance the
cost o acquiring and constructing the Project at the location set
forth in the preamble hereof, the Bond shall be and the same is hereby
authorized, determined and ordered to be issued in the principal amount
of $375,000. The Bond shall be issued in fully registered form,
numbered R-1, and shall be dated as of the date of issuance and
delivery thereof and shall be executed, shall be in such form, shall be
payable, shall have such prepayment provisions, shall bear interest at
such rates, and shall be subject to such other terms and conditions as
are set forth therein and in the Lender Loan Agreement and Loan
Agreement. The Bond and the interest thereon do not and shall never
constitute an indebtedness of or a charge against the general credit or
taxing power of the Issuer, but are limited obligations of the Issuer
payable solely from revenues and other amounts derived from the Loan
Agreement and the Project and shall be secured by an assignment of the
Loan Agreement and the revenues derived therefrom. Forms of the Lender
Loan Agreement, the Bond and the Loan Agreement are before this meeting
and are by this reference incorporated in this Bond Resolution, and the
City Clerk is hereby directed to insert them into the minutes of the
City Council and to keep them on file.

by Section 1.03 of the Lender Loan Agreement to effect the making of
the loan of the proceeds of sale of the Bond to the Company pursuant to
Section 1.02 of the Lender Loan Agreement.
Section 3. Repayment of Loan. The, Loan Agreement requires the

the principal of, redemption premium, if any, and interest on the Bond
when and as due and the payment of such amounts by the Company to the
Lender pursuant to the Loan Agreement is hereby authorized, approved
and confirmed.
Section 4. Loan Agreement. In order to provide for the loan of
the proceeds of the Bond to acquire and equip the Project and the
payment by the Company of an amount sufficient to pay the principal of
and premium, if any, and interest on the Bond, the Mayor and City Clerk
shall execute, acknowledge and deliver in the name and on behalf of the
Issuer the Loan Agreement in substantially the form submitted to the
City Council, which is hereby approved in all respects.
Section 5. Miscellaneous. The Mayor and/or the City Clerk are
hereby authorized an directed to execute, attest, seal and deliver
any and all documents and do any and all things deemed necessary to
effect the issuance and sale of the Bond and the execution and delivery
of the Loan Agreement and the Lender Loan Agreement, and to carry out
the intent and purposes of this resolution, including the preamble
hereto.

First, I'd like to take this opportunity to thank you for your
support and leadership during the past two years. I have enjoyed the

I currently find that due to existing emoloynmt and changes in
personal priorities, I must reluctantly submit my resignation from the
Commission. The experiences and knowledge I have gained from working on
the Cartnission have been invaluable. My resignation will be effective
February 2, 1984, or until replaced, whichever is sooner. This will
allow the completion of my term as chairman, and allow either the current
or Council -elect to make the appointment.

the respective cities shall serve terms of two (2) years each."
The person you select is required to serve until June 1985. This board meets
the second Wednesday of each month from 7:30 a.m.-9 a.m. at the Iowa City Chamber
