During the Council's review of site specific zoning on
November 28, 1983, the above referenced property was the sub-
ject of a zoning change as part of the "Proposed New Zoning
Ordinance". This property was zoned RIA for the past 20 years.
The Council voted to rezone this parcel ID/RS.
This ID/RS zoning requires a five acre tract of land for
each dwelling unit. The RIA zoning requires 10,000

ing that the land cannot be used for the next decade or so.
This is far from the truth!
The land owners have surveyed and reviewed the use of this
property continually for the past 12 years. Contour maps have
been flown, preliminary layouts have been prepared, package
sewer plants are being evaluated and plans for multiple housing
along the high cliffs overlooking the Iowa River (the former
quarry site) are prepared. The entire 77 acres is ready for a
request for a Planned Area Development under the present City
ordinances.
During the past three years there was no demand for hous-
ing in Iowa City (or in the nation). Now that the demand has
returned to Iowa City this area is ready for development using
private sewer facilities.
The owners request that the 77 acre tract located along.
the Iowa River, Interstate 80 and bordering the Elks Country
Club be zoned RS5 which is the equivalent of the existing RIA

Ladies and Gentlemen:
on November 7, 1983, I filed a letter inquiring about the proposed
rezoning of property owned by my client, Hone Town Dairies. Since that
time and as recently as Novenber 28, 1983, I mentioned to the Council
that we were not in a position to voice all of our objections to the pro-
posed rezoning until an answer to the letter was received.
I am sure that the City Attorney has been extremely busy and has not
as yet had an opportunity to respond to the letter. However, you propose
to give the first reading of the new ordinance on December 6, 1983, and
I am therefore setting forth our objections with the understanding that
we may have additional objections after my letter of November 7, 1983,
has been answered.
The revised draft of the proposed new zoning ordinance was printed
September 22, 1983, and approved by Planning and Zoning. In that ordinance,
the property was placed in a highway ccomercial zone (CH -1) and one of the
permitted uses was "dairy products, processing and packaging". It is our
judgment that this designation was proper for the use that has existed for

Pursuant to a letter written by Andrew M. Isserman filed November 1,
1983, the Council amended the proposed ordinance and determined to leave
my client's property in a highway commercial zone but only as a special

evening meeting and at a subsequent meeting Friday morning with Andrea
Hauer and Dick Peterson.
As Chairman of the Hotel Steering Committee of the meeting Thursday
night, Perret requested that only specific suggestions be given relative
to the hotel design. That is why we offered sketched solutions to the
unique design problem confronting the citizens of Iowa City. These
solutions we feel should be given very careful consideration by you and
the developer. At that meeting, there appeared to be significant
support for these suggestions. We believe that these solutions would
considerably mitigate.our losses and possibly losses of others that
would be affected if the present plan submitted to you is implemented.
While all of our concerns could be eliminated by locating the hotel east
of Dubuque Walk, as required in the original urban renewal plan, it was
made very clear to us at the meeting Thursday evening that the City is
not interested at that suggestion. The City, by allowing excavation
and additionally permitted foundations to be constructed without a
foundation permit or approved building design, has apparently negated
the City's interest in relocating the hotel.

The concept drawing that we presented Thursday night, provided for a 40
foot wide unimpeded opening connecting Lucas Square south to Burlington.
This drawing has been given to the developer for their use and consideration.
Early Friday morning we attempted to obtain detailed plans of the hotel
from the City so our suggestions could be explained in more explicit
detail. We were told that such plans were not available at this time
and further in a discussion between Mr. Lind and Mr. Berlin, Berlin was
unsure that our meeting with the developer or any representative of the
City might take place. However, at 11:30 A.M. we did have a meeting
with Andrea Hauer, Director of Planning and Mr. Peterson, an attorney
representing the developer. At that time Ms. Hauer indicated that the
City had only one set of plans and she was not sure where they were
located at the time, or if they could be made available. The plans were
finally made available to us at 4:00 P.M. on Friday. At the meeting at
11:30 A.M. we discussed the suggestions made and other issues regarding
the design of the hotel, relative to schedule and cost.
We also want you to understand that these sketches have been done by us
gratuitously and with no intent of financial gain. Additionally, we are
enclosing more detailed suggestions in an attempt to lessen the major
concern that numerous people have regarding needed circulation through
the building site. It appears that these changes can be incorporated
without any loss of rooms and no apparent major cost implications. They
are worthwhile considerations in the design of the hotel.
We have continued to support the concept of the hotel in downtown Iowa
City and feel it is an essential part of the final downtown fabric. It
is because of this that we have spent numerous hours and effort to see
that such development can take place respecting the commitment that
countless people have made towards urban renewal in our downtown. We
ask your consideration for this position.

Enclosed please find petitions from 381 people who work or shop in downtown Iowa
City.

While we solicited these signatures in the past few days, almost 100% of the people
asked to sign were very eager to do so. Everyone is anxious to see the hotel project 1
completed but we feel strongly that it should not function as a barrier between the
parking ramp and the downtown area of Iowa City. Further, we feel that the exterior
materials should be harmonious with existing structures.
There is a concern that the use of brick for the hotel project will make downtown
Iowa City look like a brickyard. Due to the large amount of glass in the building,
I'm certain a selection of brick could be made that would blend in well with existing
structures and not overwhelm the downtown.
Whereas the developer has the option in future years of selling this project, we,
the people who rely on an attractive and well functioning downtown, must live with
this project for years to come.

Re: West Side Park Subdivision - Vacation of a
Portion of "Public Highway Easement" Along
Mormon Trek Boulevard
Dear Councilpersons:
I am writing this letter on behalf of West Side Co. West
Side Co. is the owner and developer of West Side Park
Subdivision.
This letter is a request for the City to initiate easement
vacation proceedings for the area shown as "Public Highway
Easement" on the final plat of West Side Park. The portions of
Mormon Trek Boulevard and West Side Drive which are located
within the easement area would be excluded from the vacation.
In addition, any storm, utility, or sanitary easements would be
excluded from the vacation. Reduced copies of the plat which
show the easement area to be vacated are enclosed with this
letter for your reference. A more specific legal description
will be provided to the City Staff.
The "Public Highway Easement" clouds the title to portions
of lots along Mormon Trek. The vacation would resolve these
problems.
Prior to the subdividing of West Side Park this matter was
discussed with the City Planning staff and it was determined
that the City did not need more than an 80 foot right-of-way
for Mormon Trek Boulevard and a 60 foot right-of-way for West
Side Drive and that the excess right-of-way could probably be
vacated.
We would appreciate it if the City would initiate these
vacation proceedings.

RE: Tree Regulations
Dear Mayor Neuhauser and the City Council Members:
The Environmental Concerns Committee of the Greater Iowa City Area
Chamber of Commerce has recently completed a complete, thorough
review of the City of Iowa City's "Tree Regulations" (Division 2,
Section 1-64 of the City of Iowa City proposed 1983 Comprehensive
Zoning Ordinance). The Greater Iowa City Area Chamber of Commerce
Board of Directors approved the suggested "Tree Regulations", and
herein.forward the proposed new regulation to the City Council.
The impact of the "Tree Regulations", as well as the entire Zoning
Ordinance, has major implications upon the community's environment.
We suggest several changes in the present "Tree Regulation", which
will result in a better understanding by all those affected by
these regulations. Enclosed you will find a copy of our proposal.
In addition, our committee would be available to discuss the pro-
posed changes being recommended to the Council or the Planning
and Zoning Commission.

DIVISION 2. TREE REGULATIONS
Sec. 1-64 General.
(a) Purpose. The purpose of these regulations stall be to assure that
trees are preserved and planted with the development or redevelopment of
buildings, drives, and parking areas within the City in accordance with the
best ecological concepts, environmental objectives and site planning prin-
ciples so the well-being of the residents of the City is protected and
enchanted.
(b) General Applicability. No building permit or certificate of occupancy
shall be issued for the construction, reconstruction or structural alteration
of a building and/or construction or reconstruction of a parking lot without
conformity with the provisions of the tree regulations. However, property in
the CD -10 and AG Zones shall be exempt from the requirements of these provisions.
The distances required herein for the location of a tree shall mean the distance
to the center of the tree and where fractional numbers of trees result, the
number of trees required shall be rounded to the closest whole number.
(c) List of Trees. The varieties and sizes at initial installation of trees
permitted by this ordinance for the use indicated, are specified in the "List
of Trees for Iowa City" as updated and amended from time to time and available
as a supplement to and made a part of the tree regulations. The "List of Trees
for Iowa City" may be obtained from the office of the City Forester or the Build-
ing Department. Evergreen trees, used for screening purposes in accordance with `
the provisions of Sec. 1-67 (j) Screening, page 164 may be used to satisfy the
requirements of the tree regulations provided they are of a variety suitable for
screening purposes, as listed in the above supplement, and are allowed to grow
to their mature height. References to "Large and medium" or "small" trees in
subsequent paragraphs refere to the mature height as scheduled in "The List
of Trees for Iowa City".
(d) Site Plan. When provisions of the tree .regulations are applicable, a site
("plot" plan shall be submitted with the request for a building permit and shall,
in addition to the information normally required, include:
(1) the size and location of required tree islands; and
(2) the mature height (small and large), location and type y
(evergreen or deciduous) of existing and proposed tree
planti ngs.
Sec. 1-65 Requi rements.
f
(a) Trees adjacent to and within street rights-of-way. The following provisions
shall regulate the plantingof trees adjacent to and within street rights-of-way.
(1) Applicability.
a. Whenever there is a conversion or a new use established, the
requirements of this subsection shdll be applicable to the
entire lot.
b. Whenever a principal building(s) is constructed, reconstructed
or structurally altered by one or more

additions, the total of which increases the floor area by more
than 10 percent, the requirements of this subsection shall be
applicable to the entire lot.
C. If any provision of this Chapter would preclude the planting
of one or more trees adjacent to the right-of-way, the trees
unable to be planted adjacent to the right -or -way shall be
planted within the right-of-way according to the provisions
of paragraph (3). However, trees excluded by the provisions
of paragraph (3) may be omitted.
d. If trees presently exist with the right-of-way, trees need
not be planted adjacent to the right-of-way provided that the
required number of trees exists. Additional trees required
shall be planted adjcent to the right-of-way except as provided
in subparagraph c above.
(2) Required tree planting adjacent to street right-of-way. Trees shall
be planted adjacent to street right-of-way and meet the following
conditions:
a. The species to be planted shall be listed in the "List of
Recommended Trees for Iowa City" as street trees or permitted
by the city forester.
b. Large and medium size trees shall be planted at a minimum ratio
of one tree for every 40 feet of lot frontage or for small size
trees, every 30 feet of lot frontage. In the case of a corner
lot, only one tree for every 60 feet of lot frontwv, shall be
required.
C. Trees shall be planted adjacent to street right-of-way within
eight (8) feet of the right-of-way line but not closer than four
(4) feet to a public sidewalk or the anticpated location of a
future sidewalk where one does not now exist.
d. Small size trees may be located within eight (8) feet from a
building; however, large and medium size trees shall not be
located closer than 16 feet from a building.
e. Large and medium size trees shall be spaced no closer than
40 feet apart, or for small size trees, no closer than 16
feet apart,except along streets where screening is appropriate
or required. In the latter case, trees shall be planted in
accordance with the provisions of Sec. 1-67, page 164, and be
of a variety suitable for screening purposes as designated
in the "List of Recommended Trees for Iowa City".
f. Trees shall be located within planting areas and separated
from parking areas pursuant to the requirements of paragraph
(b) (2•)

g. Trees and/or hedges and shrubs shall not be located within•a
triangular area adjacent to the intersection of street rights -
of way, two (2) of its sides 30 feet in length each and measured
along the right-of-way lines from the point of intersection.

h. Trees shall be placed to avoid interference with the construction,
maintenance and operation of public and private utilities and
services above or below ground as determined by the utility companies
and the City Engineer.
(3) Placement of trees within public rights-of-way. Trees planted within public
rights-of-way shall meet the following conditions:
a. A tree planting permit shall be obtained from the City Forester.
b. The species to be planted shall be listed in the "List of Recommended
Trees for Iowa City" as street trees or permitted by the City Forester.
Established trees shall have a single trunk and branches shall be pruned
a, minimum of 7 feet above the public right-of-way.
c. Trees shall not be located within four (4) feet of a public sidewalk

exist. Trees shall not be located within four (4) feet of the curb.
d. At street intersections, trees shall not be located within 70 feet of
the intersection of curb lines along arterial streets within 50 feet along

along residental streets, or within thirty (30) feet of the intersection
of curb lines of driveways of commercial, industrial, or institutional
properties.
! e. At the intersection of a street and an aisle or a drive and at the
i intersection of a street and an alley, trees shall not be located
j within 10 feet of the drive, aisle or the right-of-way line of the
alley.
f. Large and medium size trees shall be placed no closer than 40 feet
apart or located closer than 16 feet to a building. Small size trees
shall be located no closer than 16 feet apart but may be located to within
eight (8) feet of a building.

(3) Required tree planting for parking areas. Trees and planting areas shall
be provided within and abutting the perimeter of the parking area (s) and
meet the following conditions:

feet of a planting area. Large and medium size trees not allowed
in smaller planting areas shall be planted within required planting

g. Trees allowed in small planting areas shall be located a minimum of
four and a half (41) feet from the edge of a planting area and trees
allowed only in a large planting area shall be located a minimum of

h. Trees shall not be located withinfour(4) feet of a public sidewalk

(c) Planting. For guidelines on planting refer to "Planting Methods" attached
to "List of Trees for Iowa City"
(d) Installation. All tree plantings required by this section shall be installed
prior to occupancy or commencement of a use. If the plantings cannot be in-
stalled prior to occupancy or commencement of a use, the Building Official
may grant a delay to the seasonal calendar dates of June 1 or November 1,
whichever occurs first.
(e) Maintenance. It shall be the responsibility of the owner of a lot to
maintain and replace, if necessary, trees required by these provisions
after their planting. Trees whose branches overhang sidewalks should
be kept pruned, providing a minimum of seven (7) feet clearance above
public right-of-way. It shall be the responsibility of the city to remove
dead trees and stumps from within public right-of-way areas.

Administrator in a national educational testing and service organization.
Regular involvement with such basic issues in education as standardized
testing, bias, equity in educational opportunity, career development.
Elected officer of a national professional association committed to the
educational, personal, social, and political development of women, and to
educational equity in general.
Editor of a national professional education journal that focues in its
quarterly issues on women's concerns, rights, education, equity in general.
Specifically, this past year, I have conceptualized, organized, and produced
onurnal issues campus, and the oneeds ted oof the two mincreasing portant mnumber an hof disabled ts areas: sstudents exual ronsment
college campuses.
Currently, I am working on journal issues that will be devoted to educational
and career concerns of Hispanic women and American Indian Women, and to
Issues related to the participation of women in sports at the collegiate level.
My PhD dissertation focused on the general effects of anti-Semitism before and
during World War II.
I am a member of Big Brothers/Big Sisters.
I am a founding officer of the Johnson County Humane Society.
Finally ... I grew up in a public housing project in the New York metro
area, and so I have first-hand experience with the problems and needs of
low-income families, especially as they relate to housing and to public
assistance programs.
