One of the oldest documented traditions of Iowa City is the planting of
trees to enhance its streets. The historic trees in the Summit Street -
Sheridan Avenue area are today a witness to the interest, even the fervor,
that accompanied the tree planting movement of the 1840's and '50's. An
ordinance passed by the City Council in 1858 encouraged the planting of
"good hardwood trees" for shade. Meanwhile, at the undeveloped edges of
the city, great stands of noble oaks have graced our landscape, an endowment
of priceless worth.
The City Council has in recent times given its support to perpetuating
this tradition. The planting and tree care programs directed by city
foresters up to this past year have continually pursued the challenges of
replacement and conservation as the city has expanded. That the Council
acted with great wisdom and foresight in enacting a tree ordinance for
commercial parking areas is constantly appreciated for the resulting
attractive appearance of business properties. The designation of Iowa City
as Tree City USA in 1981 celebrated the widening concern and successful
tree planting efforts of groups and individuals. What the City has done
so far to protect and augment.its arboreal inheritance is revealed in
the enhancement of the landscape as well as the enhancement of public and
private property values.
We commend the Council and strongly urge it to increase support for the
forestry program. It is our belief that a tree planting and conservation
program that will truly meet the needs of our expanding community is a
high quality investment in our future. We strongly recommend that the
Council give new and careful scrutiny to this challenge.
It is our conviction that Iowa City, with its legacy of trees from the past,
along with recent and prospective tree planting, requires the direction and
supervision that a full-time professional, experienced in the management of
all aspects of trees and related plant material on a city-wide level, can
provide. Only an investment of this caliber can adequately protect our
extraordinarily valuable public asset: our trees.

RE: Local Cable Television Access
The Educational Cablevision Consortium is made up of five local educational
institutions: Kirkwood Community College, Grant Wood Area Education Agency,
Iowa City Community School District, the Iowa City Catholic Schools, and
Willowwind School.
As a consortium, we have established four basic purposes for local programming
on channel 27: 1) to inform Iowa Citians about programs and activities in
our schools; 2) to communicate among educational institutions for such purposes
as inservice; 3) to present live and pre-recorded educational programs to schools
and homes; 4) to share visual programs produced by students.
Institutional members of the consortium have made considerable commitments to
use of the channel. The Iowa City Community School District has provided space,
staff and equipment for basic operation of the channel. All institutions have
committed considerable staff time to administration of the channel through the
consortium and to production of programming for the channel. Planning and policy
setting have required large amounts of time during the first year. In short, a
sizable commitment has been made to careful, thoughtful development of the
educational channel. This commitment is evidence of the importance of local
access to the educational institutions serving our city.
We write this letter to express our appreciation for City support of local cable
television access. At this early stage of development, we foresee the need for
continued support to further the use of local access channels. As you develop
long-range plans for use of franchise fees, we urge you to consider continued
support of local cable access. We are hopeful that some of the franchise fees
might be available to continue our efforts to provide the citizens of Iowa City
with local educational programming.

As directed by Section 23-16 of the Municipal Code of Iowa City, this
is to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa. City, the
City Traffic Engineer will direct that signs be installed so as to
prohibit parking from "8:00 AM to 4:00 PM On School Days" on the west
side of Grissel Place from its intersection with Whiting Avenue north
to the school property. This action will take place on or shortly
after February 9, 1982.
COMMENT:
This action is being taken at the request of the Shimek PTO Safety
Committee. This action will facilitate movement of vehicular
traffic on Grissel Place not only during inclement weather but during
other times of the school year. Further it will enhance the safety
of school children who either ride bicycles or walk to Shimek School.
Attached to this memorandum is a copy of the letter from the
Chairperson of the Shimek Safety Committee.

Re: Traffic Safety
I am the safety chairman at Shimek Elementary this school year (1981-82),
and a matter concerning traffic safety has come to my attention. Grissel Place
is the entry street to the school parking lot. It is a hill, and the ice and
large amounts of snow have made safe travel difficult this year. Added to this,

however, is the additional hazard of parked cars along this entry way, belonging
to residents. Two vehicles cannot pass one another on this street, visibility
is reduced and cars have difficulty getting up the hill when it is icy because
they must negotiate around a parked car. Children meanwhile are crossing at the
base of the hill in this unsafe situation.
This situation was officially discussed at the January 13 PTO meeting at
Shimek, having been brought up by a parent. According to Mr. Holmes, our i
principal, this same situation has been the cause of concern and consternation
I
of many school bus drivers, the bus dispatcher and other parents for a long j
time.
Keeping in mind that the winter promises to make the situation worse, we would
like to make a formal request that parking on Grissel Place be disallowed during
school hours during school days.

parking on the east and south sides of Jessup Circle from its intersection
with MacBride Drive north and east to the beginning of the cul-de-sac at
the east end of Jessup Circle. This action will be taken on or shortly
after February 10, 1982.
COMMENT:
This action is being taken after a resident of Jessup Circle requested a
postcard survey be conducted to determine the consensus of the affected
residents. This action reflects the consensus opinion of the .affected

Physical Characteristics: The topography is level.
ANALYSIS
The applicant wishes to rezone two residential lots from RIB to C2 which would
result in an expansion of the commercial uses fronting on Highway 1. At the
present time, the two lots in question as well as the lots abutting to the north
and south are being used for residential purposes. The two lots in question
have C2 zoning located to the east, south and west of them, and RIB zoning to the
north. Because of the land uses to the south and north, it must be determined
whether the requested rezoning would create an incompatibility of land use.
Zoning is a tool which is intended to protect private property from devaluation
due to incompatible land uses. Prior to approving a rezoning, it should first
be demonstrated that the rezoning will not decrease the value of the adjoining
properties or that if there is an adverse impact, it can in some fashion be
mitigated. In this case, the requested rezoning could potentially adversely
impact the residential uses to the north and south.

In regard to the property to the south, it can be argued that because it already
has C2 zoning, is surrounded on three sides by commercial uses, and is adjacent
to what will soon be a four lane, limited access highway, the impact of further
commercial development to the north will be minimal. Rather, the value of this
property as a residential use was greatly diminished at the time it was rezoned
to C2.
The question remaining is the impact of the proposed rezoning on the property to
the north, which is zoned R1B. Although this property is already in close
proximity to the existing C2 zone, it is evident that the proposed change in
zoning would increase the impact of commercial zoning on the residential use.
If this impact could be mitigated through the use of screening, then an argument
could be made in favor of the rezoning. However, Iowa City currently has no
means of requiring screening in a C2 zone. Therefore, there is no way to insure
that adverse impacts will be mitigated without amending the Performance
Standards in Section 8.10.18 of the Zoning Ordinance to include C2 zones.
STAFF RECOMMENDATION
For the above reasons, staff recommends that the rezoning request for the
property located at 1014 and 1016 Hudson Street be denied. If the zoning
ordinance were amended to provide for screening between the C2 and R1B zone,
or if the applicant can demonstrate that the rezoning will not create adverse
impacts on the adjoining properties, the staff would recommend approval.

Dear Doug:
As you suggested in our telephone conversation of
January 25th, I am writing to explain some of the details
in connection with an application which I filed to vacate
an alley at the Ralston Creek Village site. The abstract
to this property was sent to Des Moines for examination by
Terry Monson of the Ahlers law firm. The Ahlers law firm
is acting as bond counsel to the City and to Ralston Creek
Apartments Ltd. in connection with this project.
Mr. Monson has noted that the abstract shows an alley
platted in Lyman Cook's Subdivision of Outlot 25 and Berry -
hill and Pierce Addition. The prospective purchaser of the
industrial development bonds intends to have the bonds
secured by a first mortgage on the real estate. The lack
of evidence showing that this alley has been vacated
causes concern to the attorney doing the title opinion for
the bond purchaser.
We are trying to close on the bonds as quickly as
possible. The proceeds from the bonds are needed to con-
struct the apartment complex and without those bond pro-
ceeds construction will be delayed. August 1st has been
projected as a closing date and delay in sale of the bonds
may push completion past that date. Obviously, we are
- concerned about having the apartment units available for
occupancy by the time the fall semester at the University
of Iowa commences.

public hearing on vacation of the alley and disposition
could be held on the same date and that the three readings
of the ordinance on vacation could be waived and the
matter concluded in one proceeding. We are, of course,
requesting that the vacated alley be disposed of by con-
veyance to Ralston Creek Apartments Ltd.
By way of background, in 1966 the City vacated the
north 230 feet of the alley in Lyman Cook's Subdivision.
The alley which we seek to have vacated lies south of that
vacated portion and north of Ralston Creek.

Re: FY83 Compensation for Administrative and Confidential
Employees
It appears that the across-the-board increases in 'the City's
collective bargaining settlements for FY83 will range from slightly
less than 7 percent to approximately 7.8 percent. In addition,
employees in all three bargaining units who have not reached the top
of their salary range are eligible for step increases. These
increases range from 3.5 percent in AFSCME to an average of 9.9
percent in the Police Department
In the last six fiscal years, the across-the-board salary adjustments
have averaged 8.45 percent yearly for all employees. This ranges
from a low of 6.72 percent for management employees to 10.17 percent
for the Police unit. In the six-year period the total adjustments
have ranged from a low of 40.3 percent for management to a high of
61.0 percent for Police.
The attached compensation policy for administrative and confidential
employees, adopted by the City Council last year, provides for an
annual salary survey which becomes the basis for establishing total
compensation levels,• including wages and fringe benefits. This
process is utilized to enable the City to maintain a competitive
labor market position.
The yearly survey of 23 Midwestern cities recently was completed. At
the minimum entrance step, Iowa City is 2.64 .percent above the
average for all positions and at the maximum 12.1 percent. Of
course, few employees are at the minimum or maximum steps.
Therefore, the midpoint position probably is more indicative of the
City's competitive position. At the midpoint the City is 8.15
percent above the average. While this position is not even close to
the position of certain Police and Fire salaries, which are close to
"top" in the State, it does represent a satisfactory competitive
Position which should allow the City to attract and retain qualified
staff. Except for the position of assistant city engineer, which
lags significantly below survey average salaries, the FY83 salary
adjustments for confidential and administrative salaries will not
need an above average increase due to labor market pressure or
competitive position. A special salary step will be established for
the position of assistant city engineer. The other adjustments
should be predicated only upon FY83 bargaining unit increases and the
total City salary increase history, previously discussed in this
memorandum.

Administrative Emolovees
The following adjustments for administrative employees are
recommended:
1. Across-the-board increase - 7 percent.
2. Merit increase - Maximum of 3.5 percent for those eligible.
3. Exceptional service increase - Maximum yearly payment of
$1,000. The amount of $10,000 should be reserved for this
purpose. In the FY82 budget $11,300 was allocated.
Funding is available in the proposed FY83 budget for these
adjustments.
Confidential Employees
The compensation policy provides that compensation for confidential
employees will be established to ".....maintain the comparability of
confidential positions with those of similar positions within the
bargaining unit." Therefore, for FY83, it is recommended that the
across-the-board wage adjustment for confidential employees be
established at 7.8 percent.
In addition, the salary ranges of confidential employees have
previously been established at levels above comparable AFSCME
positions to compensate the confidential employees for their
exclusion from the bargaining unit. In FY82, these steps have ranged
from 1, percent at Step A to 4 percent at Step F above the equivalent
AFSCME steps.
In FY83, it is recommended that the percentage variance be equalized
at 2 percent for each step, except for Step F which would be 3
percent in FY83 and 2 percent in FY84. The confidential employees
then will be included in the job classification study being conducted
for all AFSCME employees. The job evaluation study will be the
mechanism which establishes a valid basis for any additional salary
difference which should exist between AFSCME steps and the
confidential employees. The cost savings from the equalization of
steps (approximately $3,500) will be used to fund any
reclassifications which the study determines to be necessary.

COMPENSATION POLICY
ADMINISTRATIVE AND CONFIDENTIAL EMPLOYEES I
I
I. Introduction
The goal of this compensation policy is to outline the parameters
within which compensation decisions will be made which will assure
that the City of Iowa City receives the highest returns from its
i investment in its human resources - its employees, and to provide for
equity in all compensation decisions.
The City's ability to manage its public services with the greatest
efficiency and effectiveness is heavily dependent upon the
capability and performance of its administrative employees and
r confidential support staff.
The principles of this compensation policy establish the basis for
f the recruitment, retention and motivation of the caliber of
employees necessary to attain the high standards of performance
demanded by Iowa City. The establishment of this policy recognizes
that adequate levels of employee compensation may significantly ?
increase the effectiveness of government service.
This policy is adopted by the City Council in accordance. with Section
2.08(e) of the Charter which provides IJ that, "the Council shall fix i the amount of compensation of persons it appoints and shall provide
for the method of compensation of other City employees."
II. Policy Statement and Program Guidelines

t Through adoption of this policy, the following compensation
objectives are established:
A. Annual review of Compensation Program.

I. Following adoption of this compensation policy, and on an
annual basis, the City Manager will present for the City
Council's review, recommendations with regard to salary,
benefits and performance based compensation increases for
administrative and confidential employees. The City
Council will determine levels of benefits and the City
Manager will establish individual compensations for each
administrative and confidential employee. The duty of the
City Manager is in accordance with Section 4.04A(4) of the
Charter which provides that the City Manager shall,
"Supervise the administration of the City personnel
system, including the determination of the compensation of
all City employees appointed by the City Manager subject
to State law and this Charter."

B. Establishment of Base Compensation and Benefit Levels -
Administrative Employees
1. Total compensation levels, which include wages and fringe
benefits, will be established to maintain a competitive
labor market position.

comparable Iowa and Midwestern cities and within the
local labor market will be conducted by the Human
Relations Department to assess prevailing salary and
benefit levels and changes within the labor market.
b. Recommendations concerning necessary adjustments to

participants, with consideration for the special
requirements necessary for successful employment with
the City of Iowa City, and will address internal
equity or compression problems.

employee within the salary range.

Re: Proposed Cable TV Related Budget
The Broadband Telecommunications Commission (BTC) recognizes the intention that the
City be reimbursed from the cable franchise fee for its "up front" expenses of $48,641
in establishing the Iowa City cable TV system. The Commission supports the tying of
that payback plan to the remaining 12 years of the franchise. Trying to accordian those
payments over fewer years will, we believe, seriously cripple the community benefits
from cable TV. '
A principal benefit of cable to Iowa City is the creation of community access channels -
government, public, schools and library. To modestly work towards meeting some of the
programming needs of these channels we strongly urge the establishment of an Access
Support Fund from Hawkeye's three percent franchise fees. The fledgling access
channels must be supported now, in their infancy, when such support will do the most
good. There are already signs of success and interest. Some 350 individuals, 65
organizations and 11 schools have already participated. Without advertising over 100
people are now waiting to get into workshops. Many programs produced have been Civic
oriented: the Council meetings, programs on the Senior Center, Congregate Meals, i
housing inspection and the library. An Access Fund could also train access users to 1
make better use of the matching grant offered by Hawkeye's $5,000 per year for two years d
starting December, 1981. We need more advanced production workshops and better
coordination of the large cadre of trained volunteers to make more quality programs.
We need more essential equipment items such as City Council lights, playback decks, y
portapacks and tape. Ours is a modest proposal to begin to add, in small increments,the `
items and coordination necessary to make better use of what we already have. i
We fully recognize the legitimacy of reimbursing the City monies expended for previous

cable related efforts. However, given the current and projected demands on total
franchise fee revenue, the administration's proposed six year payback plan of the
$48,641 will leave little or no budget for community access. The administration
proposed payment to the City of $8100 from the 1982 franchise fee. We would propose
increasing that to $8,641, making the debt an even $40,000. Under our proposal future
payments would then be tied to the length of the franchise, at 9% interest. Under such
a plan payments would be $5,463 per year. The interest will total $25,556 for the
City's general fund. Meanwhile, funds would be available immediately for an Access
Support Fund. If this plan is adopted, there would be a possible $2,637 to start such a
fund in 1983 (the difference between the $8,100 proposed and our proposal of $5,463).
j Because there are many shifting priorities and demands of an ongoing nature, we propose
the Access Support Fund be entered as a line item to be allocated at the discretion of
I the BTC.

Associates does hereby withdraw as the Contract Purchaser and
Redeveloper under the contract for sale of land for private
redevelopment entered into with the City on March 16, 1981
covering Urban Renewal Parcel 64-1. This action is being taken
for the following reasons: 3
1. We have been unable to arrange for the financing of both the
hotel and the department store. The financing for the
department store has been substantially completed and could
be arranged by February 16th, the date specified in the i
contract. But despite our best efforts, it will be
impossible for us to complete the financing of the high
quality hotel we are committed to build by that date.
2. Your letter of January 18, 1982 makes it clear that the
City's position is that both parts of the project have to go
forward together and that no additional time beyond
February 16, 1982 would be given to us in which to perform on
the hotel.
3. Our strong desire to see this final stage of the urban
renewal project completed as soon as possible by someone.
We take this action in spite of our firm and steady conviction
that given more time we could bring this development as planned
to a successful conclusion. At the time that we transmitted the
signed contract to you on April 24, 1981 (a copy of the transmit-
tal letter is enclosed herewith), we asked that the performance

time that we would lose because of the filing of the notice of
tort claim by College Plaza Development Company. As we explained
at that time it would not be feasible for us to spend any large
sums of money for the planning of the development of the site
until the withdrawal of the tort claim was completed. This did
not occur until November, 1981. It is also a fact that at no
time during the period from March 16, 1981 to this date have we
been able to negotiate a financial package that was suitable for
the construction of the total project as planned. It is our
judgment that such financing will not be available within the
next 120 days and we can only speculate as to whether the
situation will change after that. Naturally, after having bid
the project three times and taking into account our commitment to
the community based on our past performance, we think it would be
appropriate to give us whatever time it takes to place this final
jewel on the crown of urban renewal achievement in Iowa City.
Since you do not share this view, we are stepping aside so that
the City may immediately pursue whatever alternatives are
available to you.
