Re: Noise Ordinance - Boats
The Riverfront Commission has requested that a provision be included
in the proposed noise ordinance which would control motorboat noise.
Section 106.11 of the Code of Iowa presently provides for boat
mufflers. In addition, this provision has recently been amended so
that the State Conservation Commission may adopt additional noise
control rules. I have enclosed a copy of the amendment.
In the past, the Riverfront Commission has been frustrated because
the State Conservation Commission has preempted certain City control
of the Iowa River. It appears that this provision would preclude a
provision on motorboat no.ise in the City's noise control ordinance.
Your guidance is requested.

27 Sec. 15. Section 106.12, Code 1981, is amended by adding
28 the following new subsections:
29 NEW SUBSECTION. 7. A person shall not operate watercraft
30 in a manner which unreasonably or unnecessarily interferes
31 with other watercraft or with the free and proper navigation
32 of the waters of the state. Anchoring under bridges, in a
33 heavily -traveled channel, in a lock chamber, or near the
34 entrance of a lock constitutes such interference if
35 unreasonable under the prevailing circumstances.

California Tax Cuts Have Led
To Higher New -Home Prices

ROPOSITION 13, passed in 1978, has eased the tax burden of
California's property owners, but an unforeseen side-effect
of the tax -cutting Initiative has been higher prices for new
homes.
Pinched for money, California communities have resorted to
Iternative ways to pay for new parks, schools and streets. They

"In 1972, the cost of the average new home in California was
bout the same as the national average. Today we're about $40,000
gher than the national average," says Donald Collin; legislative

HE MEDIAN PRICE of a new home in the state is $105,000
(half cost more, half less), compared with $69,000 for the na-
tion as a whole, according to Kenneth Rosen, chairman of
the Center for Real Estate and Urban Economics at Unlver-
ty of California—Berkeley. He says the combination of Propositlon
i and land -use controls has had "very significant" effects on hous-
:g costs. "These effects are going to be widening as time goes on."
Adds Peter Kremer, president of Irvine Co., the big real estate
-veloper: "We're really In a new era in land development. The
ided costs of Infrastructure are changing Ire risks and rewards in
its business. Today developers are being asked to put in freeway
:erchanges and flood -control channels. As a result, we're seeing
it margins squeezed. It used to be that hard construction costs were
of a home's sales price. Now It's 40% or even 3576 In some

Longer processing time also has added to housing costs. Where
once took six months to gain approval for a subdivision, It now
,n take three years, Mr. Kremer says. During that time, the develo-

Estimates on just how much lengthened processing time and

:ego Building Contractors Association, says the added cost In his

N PRICING THEIR HORSES, builders usually multiply the cost
of an Improved lot by three to arrive at the selling price, Mr.
Morris says. So any added costs for land development are a
big influence on the type and price of homes that are built.
Stephen Tate, vice president of the Baldwin Co., says that for a
project his firm Is planning, San Diego is charging $5,100 a single-
family home for schools and $4,000 a home for community facilities.
As,a result, he says, the homes will start at about $125,000.
The Construction Industry Research Board recently surveyed
the fees and land set -asides for parks In California. Benjamin Barto-
lotto, director of the board. says the Dark fee raneed frnm x s a
— California planners acknowledge that longer processing time
and Proposition 13 have added to housing costs, but they argue that
some of the criticism distorts the facts.
Says F.W. Olson, manager of the housing development and In-
formation office for Orange County: "We recognize that delays cost
money, but we aren't convinced that all of thedelays are on the
county's side. If developers would listen to what the county is asking
Instead of immediately arguing that things should be changed, I
think there might be fewer delays."
0 RANGE COUNTY IS TRYING to speed up processing and
hold down the cost of buying a home, Mr. Olson says. A
number of breaks are avallablp to builders who agree to
price 2506 of their units in developments low enough that
families earning 12076 of the county's median income; or less, can
afford to buy them.
In return, the county will expedite the approval process for the
builder, allow him to build at a higher density than normally permit-
ted, relax parking requirements and Issue revenue bonds to aid in
financing. Orange County also has eliminated requirements for cov-
ered parking areas, such as carports, at home sites. "That saves
52,000 to $3,000 per parking space." Air. Olson says.
Help also has come from the California legislature. Barry Law.
rence, a Los Angeles attorney specializing in real estate, notes that
developers now car, get courts to overturn communities' fees that
are "unreasonable." And groups seeking to block construction of low -
and middle -Income housing through the courts now can be required
to post security to cover added costs that developers may Incur from
the lawsuits.
Concludes Mr. Morris of the San Diego contractors group,
"There's a recognition that's starting to develop on the impact that
all of these requirements can have on housing."

HOUSE DEBATES - PASSES ACIR
The House has debated and passed on a 70-26 vote a bill to establish an Iowa Ad-
visory Commission on Intergovernmental Relations. The commission would be charged
with the responsibility to study and report on matters relating to local govern-
ment structure, allocation of resources, relationships between state and local
governments and interstate and area governmental problems. The commission would
be composed of county officers, city officers, state executive officers, two state
senators and two state representatives and school representatives. The latter
category was amended into the bill despite vigorous debate that schools were not
general purpose local governments nor was there any precedent at the national level
to support their inclusion.
The bill has now been passed out of the Senate Cities Committee to the Senatefloor
for debate. The Cities Committee has amended the bill to provide that appointed
city officials in addition to elected will be provided an opportunity to serve on
the commission.
GOVERNOR SIGNS TAX INCENTIVE BILL
The Governor has signed HF 2171, a bill designed to bring Iowa law into compliance
with new internal revenue code changes, and change the method of assessing machin-
ery and equipment used by manufacturing and industry.
Of particular interest to cities is the provision which would retroactively make
all machinery and equipment purchased after January 1, 1982 assessed for tax pur-
poses at only 300 of value. The remaining 70; would be picked up by the stateand
returned to local government to avoid any revenue loss.
Although the new assessment procedure begins on January 1, 1982, the first assess-
ment for the new equipment and machinery would not take place until 1983 and would
not be subject to tax until the fall and spring of 1984/85.
Beginning in 1985, the state would reimburse local government for the amount of
tax which would have been levied against the equipment and machinery. It is esti-
mated that the first year cost (1985) to the state would be approximately $7.Omil-
lion.
The League has expressed serious reservations about the estimated impact on the
state in 1985 and believes that the total figure could exceed the current estimate.
lie are also concerned that subsequent General Assemblies will attempt to amend the
bill and strike the state reimbursement portion because of the large commitment
this could eventually mean to the state general fund. If that happens, cities
would lose that property tax revenue.
Although this bill has been signed, debate and consideration of the impact on local
government is far from over and future General Assemblies will undoubtedly look to
amending this bill next session.
HOUSE PASSES LEGISLATION
The House has passed HF 2386, an Act relating to the status and statutory responsi-
bilities of legal or administrative entities created by 28E agreements.
The bill was submitted by the state auditor's office because of an attorney gener-
al's opinion (81-71-2(L)) which stated that there was no requirement that a con-
tract entered into by a county solid waste commission be let pursuant to rublic
bid procedures and that the only constraint on the commission was that established
by the terms of the 28E agreement.
Although the AGO dealt only with bid letting procedures, the bill adds an entire
new subsection to Chapter 28E. As passed, an entity created under a 28E agreement
shall comply with the same statutory procedural restrictions and requirements in-
cluding, but not limited to, the preparation and implementation of budgets, audit
of accounts and expenditures, competitive bidding and procurement procedures, and
conduct of meetings the same as the designated primary parent agency.
The League has raised issue with the legislation questioning whether the bill will
serve as a deterrent to future 28E organizations because of the restrictive nature
and scope of the bill being proposed. This seems counter-productive, especially
at a time when local governments are looking for increased flexibility and cost-
effective tools such as 28E agreements to consolidate services and save property
taxes.

A motion to reconsider has been filed in the House.
The companion bill in the Senate is SF 2214 by the Committee on State Government.
The League would urge you to contact your senators and make further inquiries about
the scope and nature of this bill and ask them to explain what impact it might have
on 28E organizations. If they cannot satisfactorily explain the justification and
reasoning for the bill, you should ask them to delay further debate until satis-
factory answers can be obtained.
WAYS AND MEANS DEBATES INSURANCE FUND BILL
The House Ways and Means Committee has debated HF 250, a bill which would author-
ize cities to establish a fund to protect it against past and future losses aris-
ing out of the acts or omissions of its officers or employees.
As written the bill would allow a city to establish a fund not to exceed three mil-
lion dollars to protect it from liability imposed upon it under the provisions of
Chapter 613A.
The bill originally stated that the fund may be financed out of the general fund
or a separate tax levy in excess of any tax limitation imposed by statute. The
fund could be used to pay liability claims, judgments and liability insurance pre-
mium costs arising out of or incurred because of compliance with Chapter 613A.
During debate, an amendment was offered by Rep. halter Conlon, R -Muscatine, which
changed the permissive language of "may" to a "shall" provision and prohibited the
city from levying outside the general fund. That amendment was adopted on a 16-11
vote at which time further action on the bill was delayed.
SENATE TO DEBATE LAND USE
The Senate will shortly begin debate of SF 2218, an Act relating to land use in
Iowa. As written, the bill establishes a procedure for the development of recom-
mendations to the General Assembly for a state land use policy.
Those recommendations are developed by utilizing county commissions and the crea-
tion of a state land use coordinating council.
Each county commission would be charged with developing an inventory of land uses
in each county and forwarding those recommendations to the state council which in
turn would make recommendations to the General Assembly.
The county commission would be composed of district soil conservation commissioners,
representatives of the county board and representatives of the cities in each county.
The bill is less than specific about the procedure for holding a convention of
mayors and council persons for the purpose of selecting their representatives and
requires that reimbursement for necessary expenses incurred in the performance of
the members' duties shall be made by the unit of government that made that appoint-
ment rather than the state.
The bill goes beyond just an inventory of land in each county. It also authorizes
counties to establish agricultural districts through zoning ordinances and proce-
dures by which counties can establish, review, modify and terminate agricultural
areas upon the petition of landowners.
Once established, the ag districts or areas would be provided certain benefits and
protections. Limitations are placed on special assessments, availability of nui-
sance actions, condemnation and application of state and local regulations. Annex-
ation is prohibited and a water use priority is provided for ag districts and areas
and nothing else.
The League has objected to various provisions in the bill which infringe on city
authority regarding zoning, eminent domain, annexation, provisions which go far
beyond the basic bill which is to undertake an inventory of land for furtherstudy.
It is uncertain at this time what the House will do with this version of land use
although it's almost certain that they will amend it.
The basic purpose of the bill - to inventory land and its uses - is acceptable and
desirable but the limitations on local government powers should be resisted.
Legislators should be contacted and urged to amend the bill to provide only for a
procedure to undertake an inventory of land and make recommendations to the General
Assembly.
CIVIL SERVICE BILL STILL AWAITING ACTION
SB 722 and SF 354, bills to reform Chapter 400, the civil service laws for cities,
are still awaiting action by the full House Cities Committee. Although successful
in obtaining subcommittee approval on the House side; the League was advised that
further action was uncertain unless the Senate provided assurances th-t they would
debate the issue this session.

The League has attempted to obtain final action by the Senate Cities subcommittee
but to date has been unsuccessful.
One last try is needed on the Senate side to get the bill out of committee. Speci-
fically, Sen. Carney (R -Sioux City) should be contacted and urged to support pas-
sage out of committee.
HOUSE COMMITTEE DRAFTS PENSION BILL
The House State Government Committee is completing work on its version of legisla-
tion for changes in the IPERS and public pension benefit programs for employees.
The bill, House Study Bill 559, has been designed as a "no -cost" bill in response
to SF 2178 (see last legislative bulletin) which makes sweeping changes in IPERS
and Chapter 411 without any revenue to offset the cost to cities.
Of particular importance to cities in the House version are provisions for five
cities, Pella, Eldridge, Waverly, DeWitt and Knoxville, to come under the 411
system because of population changes and a schedule of covered wages which will go
from $21,000 January 1, 1983 to $25,000 on January 1, 1987.
There are no increases in the employer contribution rates in the House version al-
though amendments are expected on the floor to include similar language to the
Senate version which would raise employer rates from 5.75% to 6.25%.
Other provisions of the bill would remove city attorneys as one of the members of
the pension board under Chapter 411 and increases the citizen members to three
(presently two).
The committee also discussed a proposal to permit some 600 police officers in cities
under 8,000 to retire on full benefits (49%) at the later of age 60 and after 25
years of service rather than satisfying the present requirement under IPERS of the
later of age 65 and after 30 years of service.
This change would have increased costs because pensions are payable over a longer
future lifetime and because the funds to pay pensions must be accumulated over a
shorter span of work years. For this group, the additional cost was estimated to
be 3.1% of salary. If this were allocated to member and employer in the same pro-
portions as the present total contribution, it would have become 4.9% for employee
and 7.65% for the employer.
Because the full cost impact on cities was not known, it was suggested that this
become the focus for an interim study.
From a cost standpoint, the House version is the preferrable of the two pension
bills and you should encourage your state representative to resist any amendments
which would mandate additional costs on local government without the state appro-
priating money to offset the cost.
SENATE DEBATES - DELAYS PENSION BILL
SF 2178, a bill to amend Chapters 97 and 411 relating to public pensions, was de-
bated and delayed because of the cost impact on the state general fund. Sen. John
Murray (R -Ames) invoked Rule 37 which automatically sent the bill to the Senate
Appropriations Committee for further study.
The bill is similar in many ways to HSB 559 (see this bulletin) which is being
prepared in the House.
The Senate version carries no state appropriation to offset any costs mandated
on cities.
The Senate version also contains language which would bring the 600 employees in
cities under 8,000 under the same pension provisions as Chapter 411. This lan-
guage was contained in an amendment by Sen. John Nystrom (R -Boone) which was
adopted before debate ended and the bill was sent to Appropriations Committee.
The League would urge you to contact Sen. Murray at the statehouse (515/281-3371)
and urge him to provide for state appropriated money for any and all costs man-
dated on cities in the bill before it's passed back out of Appropriations Committee.
HOUSE READIES FOR DEBATE ON OPEN MEETINGS
SF 438, a bill to make employment applications confidential records and allow them
to be discussed in closed session, has been placed on the House calendarfor debate.
The bill passed last session in the Senate would allow employment applications for
public positions to be maintained as confidential records and allows a govern-
mental body to go into closed session when discussing the appointment or hiring of
a person.

SENATE WAYS AND MEANS ACTS ON HOTEL -MOTEL
The Senate Ways and Means Committee has acted on legislation which would amend the
hotel -motel tax law to allow cities to extend to time limit for the selling of
bonds from 1982 until 1984.
The bill has not been assigned a number as of this printing but will be placed on
the Ways and Means Committee calendar for debate next week.
HOUSE PASSES CURB AND GUTTER BILL
The [louse has passed HF 2394, an Act relating to the replacement of curbing and
guttering through the use of special assessments in cities under 10,000 population.
The bill provides that in cities of less than 10,000 population, the replacement
of curbing and gutters may be done without the use of engineers and permits the
city council to levy the special assessments on a lineal foot basis.
GASOHOL LEGISLATION ADVANCES
The (louse and Senate Ways and Means Committees have taken action on two versions
of legislation designed to reduce the draw -down on the road use tax fund because
of the increasing sales of gasohol and the current price differential between
gasohol and regular gasoline.
The House Ways and Means proposal is a modification of the Governor's recommenda-
tion which would provide for a phaseout by increasing the tax on gasohol over the
next five years using 2 - 2 - 1 - 1 - 1 formula.
This differs from the Senate version which would mandate that all gas sold con-
tain a certain percentage of ethenol associated with its own phaseout formula.
The League has supported an earlier phaseout of the tax exemption on gasohol
because of the revenue lost to the road use tax fund and subsequent revenue to
cities under its 18% formula share.
It is expected that various amendments will be proposed to the legislation call-
ing for different phaseout formulas and each will have to be reviewed for its
impact on cities.
Please watch for furtherdevelopments on this legislation.
NEW BILLS OF INTEREST TO CITIES
SENATE
SF 2208 PUBLIC DEPOSITS (CO'T RCE CONEAIITTEE) This bill amends sections 453 and
454 to provide that the laws requiring the deposit of public funds in approved
banks and establishing the state sinking funds for public deposits by cities and
other entities by agreements under Chapters 2BE and 28F.
SF 2227 SPECIAL ASSESSMENTS (DELUHERY) Prohibits a city from commencing special
assessment proceedings for street improvements of more than two traffic lanes
effective July 1, 1982. The bill also provides that the cities may forgive exist-
ing special assessments for streets of more than two traffic lanes and provide for
their payment from other city funds.
The bill has been assigned to the Senate Cities Committee and placed in a subcom-
mittee of Holden, Readinger and Slater.
SF 2228 HAZARDOUS WASTE (ANDERSON) Provides for technical assistance on hazardous
waste issues to affected cities and counties and requires a facility that is
granted a site license to pay a sum equal to one percent of the facility's gross
receipts to the city or county in which the facility is located.
SF 2231 ROAD EQUIPMENT (TRANSPORTATION COMMITTEE) Allows the operation of road
maintenance equipment to the right-hand lane and left-hand lane while engaged in
specific maintenance operations on roads open to traffic. The bill also exempts
state and local maintenance equipment from the size, weight and load limits in
the Code.
SJR 2003 CONSTITUTIONAL TAX LIMIT (CRAFT, ET AL) Bill would add a new article to
tie constitution. A total revenue limit is established. This is one combined li-
mit on all taxes and most other revenue of the state and all local governments.
The limit is adjusted for inflation and population growth at an annual growth rate
equal to the entire annual inflation rate plus state population change shown by
federal census.
Revenues above the limit may be authorized by 1) two-thirds vote of the General
Assembly with Governor's approval or 2) by majority vote of the people in a state
or local referendum.

HF 2403 ESSENTIAL CORPORATE PURPOSE BONGS (CITIES COhAfITTEE) Bill includes in the
definitions o essential corporate purpose t e acquisition, construction, recon-
struction, improvement, repair, and equipping of waterworks, water mains and ex-
tensions, and the real and personal property, useful for providing potable water
to residents of a city.
The bill has passed the House on a 57-41 vote.
HF 2409 FIRE SERVICES (STATE GOVERNMENT COMMITTEE) Clarifies the authority of
local fire officials in the enforcement of state fire safety statutes and regula-
tions. It specifically preserves the state fire marshalts right to seekinjunctive
relief in the enforcement of fire safety regulations. The bill also removes the
requirement that the fire marshal initially inspect smoke detectors.
The bill is awaiting debate on the House calendar.

Pursuant to Iowa Code Section 441.6, the Iowa City
Examining Board met at 1:00 P.M., March 15, 1982.
At this meeting the members examined the newly certified
Register of Candidates.Eligible for Appointment as City of
Iowa City Assessor. Also reviewed at that time were the
applications received for said position by the Iowa City
Examining Board.All persons on the Register were invited to
apply for the position of Iowa City Assessor with instructions
to forward their applications and resumes to be received by
the Secertary of the Iowa City Examining Board no later than

In response to your notification of a vacancy in the position of
Iowa City Assessor, I feel I am a well qualified candidate who
will make a fine public servant for the citizens of Iowa City.
During my five years of assessment experience in the Mason City and
Cerro Gordo County Assessorsts offices, I have continued to excell
in the functions and responsibilities given me. In 1977, I began
appraising single family residences, and in 1980 1 appraised a new
industrial building in Clear Lake, Iowa. In the fall of 1980, 1
personally reappraised all commercial property in Clear Lake for
assessed values as of January 1, 1981. I also established land
values of all residential, commercial, and industrial property in
Clear Lake for 1981 assessments.
I am familiar with the use of computers and was involved with the
search and setting up of the current Burroughs 8-1800 computer
system in the Cerro Gordo County Court House. Being acquainted
with the computer in the Cerro Gordo County Court House, I have
seen the valuable use of the system in the assessment and taxa-
tion process.
I have successfully passed the Iowa Department of Revenue test for
the position of City or County Assessor and am certified until
April 4, 1983 with a score of 79%- As you can see on my data sheet,
I firmly believe in the continuing education of assessors as
mandated by the Iowa Legislature.
In July 1980, I was accepted by the International Association of
Assessing Officers as a candidate for the Certified Assessment
Evaluator (CAE) designation. This is the highest designation in
the assessment field and is recognized worldwide. I have just
completed a 73 -page narrative appraisal of a single family

Work Experience:
From October, 1974, until August, 1977, I was employed
by the Sioux County Assessor. During this time I was
in charge of personal property assessments and land
transaction assessments.
In August, 1977, I was appointed Deput Assessor for
Sioux County, amking appraisals for assessment purposes.
In the absence of an Assessor during this time, I was
acting Assessor for Sioux County.
In February, 1978, I was appointed Sioux County Assessor,
responsible for adminstration and appraisal of approx-
imately 26,000 parcels for assessment purposes. During'
this period, along with 2 full time appraisers, we completed
reappraisals of all agricultural land and buildings, all
commercial and rural residential properties, as well as
reappraising all exempt property. Although it is only in the
beginning stages a complete in-house residential reappraisal has
been partially completed.
Under my supervision, the Sioux County Assessor's
Office has maintained a staff of five. The office had
one experienced appraiser in 1978 and since that time three
more appraisers have been trained in the office.

In February, 1978, I began a training course conducted
by the Department of Revenue toward obtaining regular
assessment certification.

In August, 1978, I took the test for completion of I
Course 1 sponsored by IAAO, and received a passing grade
on the examination.

at Ames at the Iowa State University. I received a passing

My active employment began after sly discharge from the U.S. Navy
1954. I was employed at the C. L. Percival ge£rigeration Co. as a
refrigeration technician. I worked there through the summer of 1954, when
I enrolled at Boone Junior College in the fall. I continued to work part-
time at Percival's while attending school. Not being able to decide on a
major, I dropped out of school and work -ad full time at Percival's. In 1959
1 applied at the John Deere plant in Ankeny. I was employed there ap a
machinist from April of 1959 until October, 1970 when I became a multiple
line insurance agent for American Family Insurance of Madison, Wisconsin.
I had been selling part-time for that company since February, 1968 and was
offered a full-time agency with than, which I accepted. I continued selling
all lines of insurance in Boone. until October of 1976.
At that time, I was offered a position as Deputy County Assessor for Boone
County with the opportunity to succeed the then County Assessor W. A. Tea-
