Resolutions. %3 (1) Consider a resolution authorizing an Abandoned Bicycle Sale. 9�Z ys Comment: This is a resolution authorizing the Iowa City Police Department to sell nearly 200 (two hundred) abandoned or unclaimed bicycles now in the possession of the department at public auction on Sunday, May 23, 1982. Diligent efforts have been made to locate owners of these bicycles. Efforts to locate owners will continue up to 12:00.noon, Saturday, May 22, 1982, at which time all property will be inventoried for auction. (2) Consider resolution accepting the work for the sanitary sewer improvements. Comment: See Engineer's report. e. Setting Public Hearings. (1) Consider a motion setting a Public Hearing on May 11, 1982, to receive citizens' comments regarding the proposed Noise Ordinance. Comment: A copy of this proposed ordinance will be on file for public inspection in the office of the City Clerk no later than May 3, 1982. The public hearing will be held in the City Council Chambers during the regular Council meeting on May 11, 1982. (2) Consider resolution setting Public Hearing on May 11, 1982, at 7:30 p.m., on plans, specifications, form of contract, and estimate of cost for CBD Alley Paving, Phase III, Blocks 65 and 81 O.T. Comment: This project is the result of the electrical undergrounding by Iowa -Illinois Gas and Electric Company. It involves the two east -west alleys connecting Clinton Street and Linn Street between Washington Street and College Street. The Engineer's estimate is $56,930. (3) Consider resolution setting Public Hearing on May 11, 1982, at 7:30 p.m., on plans, specifications, form of contract, and estimate of cost for the North Branch Detention Structure, Ralston Creek Stormwater Management project. Comment: Though easement and land acquisition is not entirely complete, it is essential that this project is Kept moving along to allow construction to be completed this year. (approved) END OF CONSENT CALENDAR. 4 - PLANNING AND ZONING MATTERS. Action - Action - a. Consider a recommendation of the Planning and Zoning Commission to forward no comments to the City of Coralville in regard to the final plat of Stone Ridge Subdivision. 5-8210. Comment: The Planning and Zoning Commission, at a regular meeting held April 15, 1982, recommended by a 5-0 vote that due to the location of this subdivision from Iowa City, no comment or recommendation be made to the City of Coralville. This is consistent with the staff's recommendation presented in the memo dated April 9; 1982, which is included in the Council's packet. .. .. .......... 25 b. Consider setting a public hearing on May*; 1982, on a proposed ordinance amending Section 8.10.25 of the Zoning Ordinance prohibiting off-street vehicular parking in locations other than valid parking spaces. Comment: The Planning and Zoning Commission, at a regular meeting held April 15, 1982, recommended by a 3-2 vote approval of this ordinance. The ordinance amends the Zoning Ordinance by prohibiting parking in locations other than valid parking spaces except that in nhecase ofbsingle- family and two-family dwellings, parking anywhere on the driveway. Consider setting a public hearing on May 0, 1982, on a proposed ordinance amending Sections 8.10.3, 8.10.28.C,D,F and 8.10.28.H.1.(a) and Section 8.10.29.A,B of the Zoning Ordinance concerning the interpretation of the Zoning Ordinance. Comment: The Planning and Zoning Commission, at a regular meeting held April 15, 1982, recommended by a 5-0 vote approval of this ordinance. The ordinance amends the Zoning Ordinance by making a "zoning code interpretation panel" responsible for zoning interpretations except in the case where a decision cannot be reached by that body. In that case, the City Manager will be responsible for the final interpretation. Action d. Public hearing to consider an amendment to Section 8.10.35 of the Zoning Ordinance Sign Regulations to allow awning signs in commercial zones. Comment: The Planning and Zoning Commission, at a regular meeting held March 18, 1982, recommended by a 5-1 vote approval of an amendment to Section 8.10.35 of the Zoning Ordinance to allow the use of awning signs in commercial zones. A memorandum from the Planning staff and a copy of the proposed ordinance were included in the Council's March 30 packet. Action e. Consider an ordinance rezoning certain property from M2 to C2, located at 1401 South Gilbert Street. Z-8111. (passed 3D3 % and adopted) Action - Comment: The Planning and Zoning Commission, at a regular meeting held February 4, 1982, recommended by a 3-2 vote approval of this request. This recommendation is consistent with the staff's recommendation presented in a staff report dated January 21, 1982, which was included in the Council's packet of February 16, 1982. The ordinance rezoning this property was also included in the Council's packet at that time. CEDAR RAPIDS • DES MOINES �L r I REZONING SCHEDULE COLLEGE HILL PARK AREA April 27 - The possible rezoning of "College Hill Park" area, in the vicinity of Dodge and College Streets, referred to the Planning and Zoning Commission for review and consideration. May 6 - Planning and Zoning Commission sets formal public hearing on proposed rezoning for June 3. At least 15 days notice in the paper is required prior to holding the public hearing. May 19 (orPlin& Zoning before) Notice of public hearing before the Planning Commission submitted for publication. The notice will consist of a boundary description and map of the area proposed for rezoning. May 25 - City Council sets formal public hearing for June 22. An65-dao moratorium period ending July 26 on all building pe uses, which would be prohibited by the proposed zoning, begins on this date. June 3 - Public hearing on the proposed rezoning before the Planning & Zoning Commission. The Commission will not take any action but receive all public comments for review. June 7 (or before) - Notice of public hearing before the City Council submitted for publication. The notice will consist of a boundary description and map of the area proposed for rezoning. June 17 - Formal action by the Planning & Zoning Commission taken on proposed rezoning. The Commission may recommend that all or part of the area be rezoned and may also recommend different zones for all or part of the area than initially presented. June 22 - Public hearing on the proposed rezoning before the City Council. The Council will not take any action but receive all public comments for review. July 6 - City Council gives first consideration to an ordinance to rezone College Hill Park area. Three readings and adoption of the ordinance could be given at this time if the necessary extraordinary majority vote were given to waiving the considerations. Action - Item No. 17 - CONSIDER A RESOLUTION AUTHORIZING AN AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA CITY LIBRARY BOARD OF TRUSTEES AND THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, LOCAL #182, AFL-CIO, CURRENTLY EFFECTIVE JULY 1, 1981, THROUGH JUNE 30, 1983. Comment: This amendment reflects a tentative agreement between the City and the AFSCME bargaining unit pursuant to the provision in the current contract for a wage reopener for FY83. It provides for a 7.8% across the board wage increase and approximately .75% additional allocation for implementation of recommendations from a Job ! Evaluation Study currently being conducted as a joint project by the City and the Union. It further provides for negotiated annual increases to become effective on a date which will coincide with the beginning of a pay period so that all transactions can be accomplished with the computer. Page 11 Item No. 18 - CONSIDER AN ORDINANCE AMENDING CHAPTER 9.1 OF THE CODE OF ORDINANCES OF IOWA CITY TO PROVIDE FOR THE PUBLIC AND PRIVATE USE OF CITY PLAZA, ESTABLISHING REGULATIONS GOVERNING SUCH USE, AND PRESCRIBING 30 5-8 PERMIT AND LEASE PROCEDURES FOR SUCH USE. (first consideration) Comment: Action - This ordinance has been redrafted to correct typographical errors, to clarify ambiguous language and to add items that were forgotten when this ordinance was originally adopted in 1978. If this revised ordinance is adopted, the two major changes will be: (1) the use of Zone 3 (the middle of City Plaza) for emergency/service use only; and (2) the creation of a new newspaper vending section. Item No. 19 - CONSIDER AN ORDINANCE AMENDING CERTAIN PARAGRAPHS Ur StcliuH za- 189 OF THE CODE WHICH DEALS WITH SPECIFIC SPEED LIMIT REGULATIONS 3� Sq IN THE CITY OF IOWA CITY. (first consideration) Comwnt: The proposed amendeent will change the existing 35 mile an hour speed limit to 25 miles per hour. This change is being requested to reflect the intensified commercial activity in this area. When this portion of First Avenue was originally constructed, very little commercial activity lay contiguous to the facility. In the intervening years, commercial development has increased the number of driveway approaches and the amount of traffic entering and exiting the facility has increased. Page 12 Item No. 21 - CONSIDER AN ORDINANCE AMENDING SECTIONS 34-74 AND 34-75 OF THE WEED CONTROL ORDINANCE OF THE CODE OF ORDINANCES OF IOWA CITY, 3 6 IOWA. (second consideration) Comment: Proposed changes from the existing weed ordinance are: (1) elimination of the exemption for subdivisions which are referred to in the present ordinance as "newly developed areas, as natural areas"; and (2) a change in the penalty for non-compliance for weed violations. Under the present ordinance all the City can do is file misdemeanor charges and bill the owner for weed cutting charges. This amendment permits the City to assess costs against the property for collection in the same manner as property taxes. It is expected that the proposed amendments will speed action on weed violations by putting some "teeth" into the penalty section and will also be less time consuming for City personnel. A memorandum from the City Attorney is attached to the agenda. ATC will be advised that this letter has been referred to the Broadband Telecommunications Commission for recommendation. ANNOUNCEMENT OF VACANCIES: Riverfront Commission - One vacancy for an unexpired term ending December 1, 1983 (Joann Muldoon resigned).
