NOTICE OF PUBLIC HEARING TO CONSIDER AN ORDINANCE
APPROVING THE PRELIMINARY AND FINAL PLANNED AREA
DEVELOPMENT PLAN OF LOT 6, ASPEN LAKE SUBDIVISION,
IOWA CITY, IOWA.
Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:30 p.m. on the 11th day of May , 1982, in the
Council Chambers in the Civic Center, Iowa City,
Iowa; at which hearing the Council will consider an
ordinance approving the preliminary and final
Planned Area Development plan of Lot 6, Aspen Lake
Subdivision, Iowa City, Iowa. Copies of the
proposed ordinance are on file for public
examination in the office of the City Clerk, Civic
Center, Iowa City, Iowa. This notice is given
pursuant to Section 380 of the Code of Iowa, 1981.

ANALYSIS:
The applicant is proposing a Planned Area Development (PAD)/Large Scale
Residential Development (LSRD) on Lot 6 of Aspen Lake Subdivision. This is a
5.99 acre lot which is also the site of the storm water management facility for
Aspen Lake Subdivision, Waldenwood, Part 1 (proposed development to the south),
and Regency Gardens (proposed development to the north). This detention
facility occupies a large portion of the southern half of Lot 6 and provides the
open space necessary for the proposed PAD to meet the density requirement of
3,000 square feet per unit called for in a R3 zone. The applicant is proposing a
density of 3,107 square feet per unit.
The land area used to calculate this density does not include an approximate 2.5
acres of Lot 6 located south of the detention facility. A note on the plat
states that this land will be sold to Braverman Development Company. This land
is separated from the remainder of Lot 6 by the storm water pond, such a transfer
of ownership appears to provide for the most efficient use of the land (since
access from the north would be difficult). This land would then be developed in
conjunction with the land lying to the south. However, because the split
represents the seventh division of the original tract and ownership has not
changed, the provisions of the subdivision code would apply. The split should
be added to the original Aspen Lake Subdivision prior to Council action on the
final plat (presently scheduled for March 30, 1982). Because this lot would
have no frontage, an agreement would be required to the effect that no building
permit would be issued until frontage is provided.
As part of the planned area development, the applicant is requesting that a 10
foot rear yard be approved. The requirements of the R3 zone provide for a 25
foot rear yard. Because the "rear" lot line coincides with the West High School
property line, it is unlikely that development will ever occur to the rear of
these dwelling units. Consequently, staff sees no problem in approving the rear
yard as proposed.
STAFF RECOMMENDATION
Staff recommends that the proposed PAD/LSRD be deferred. Upon resolution of the
above concerns and the deficiencies and discrepancies listed below, staff would
recommend approval.
DEFICIENCIES AND DISCREPANCIES
A. Preliminary plan:
1. A note should be included on the plat indicating that any manhole
located in a parking lot will not be covered by paving.

2. Calculations and cross sections should be provided to the
Engineering Division for overland drainage.
G. Final plan:
1. Legal papers have not been submitted. Because of recent difficulties
in dealing with legal papers, unrelated to this applicant, staff would
recommend that action not be taken "subject" to this item until, at a
minimum, a preliminary set of legal papers has been submitted.
2. A 10 foot walkway easement to the West High School property, which was
shown on the subdivision of Lot 6, should be included on the PAD/LSRD
plan.
3. A note should be included similar to that shown on the preliminary
plat regarding the detention facility and its easement.

TO THE CODE OF IOWA CITY BY ESTABLISHING CHAPTER
24.1, NOISE
Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:30 P.M. on the 11th day of May, 1982, in the
Council Chambers of the Civic Center, Iowa City,
Iowa; at which hearing the Council will consider an
amendment to the Code of Iowa City to be known as
Chapter 24.1. The purpose of this ordinance is to
establish standards for the control of noise
pollution in the City by setting maximum
permissible sound levels for various activities and
to protect the public health, safety, and general
welfare. This ordinance shall apply to the control
of noise producing activities and objects
originating within the limits of the City of Iowa
City or originating from properties lying outside
the limits of the City of Iowa City owned and
controlled by the City of Iowa City. Copies of the
proposed ordinance are on file for public
i examination in the office of the City Clerk, Civic

of the City of Iowa City, Iowa, will conduct a
public hearing on the City's FY82 STATE TRANSIT
ASSISTANCE GRANT Application for capital and
operating funds in the amount of $145,940 and on
the City's FY82 FHWA Section 18 application for
operating funds in the amount of $126,728. Said
grants will fund a portion of the capital and
operating expenses of Iowa City Transit. Said
