Comment: The Council approved a Memorandum of Agreement for this project on March 16, 1982. The public hearing was delayed until construction plans were more complete. Detailed plans will be submitted to staff and Council for review prior to the public hearing date of August 3, 1982. f. Correspondence. Consider a recommendation of the Planning and Zoning Commission to forward no comments to the City of Coralville in regard to the preliminary subdivision plat of Lot 1, Rocca Subdivision. S-8217. Comment: The planning and Zoning Commission, at a regular meeting held July 1, 1982, recommended that due to the location of this subdivision from Iowa City, no comment or recommendation be made to the City of Coralville. Consider setting a public hearing August 3, 1982, on a proposed ordinance establishing an historic preservation commission for the City of Iowa City, Iowa, and providing for the establishment of historic preservation districts, and defining powers and duties in association therewith. Comment: The Planning and Zoning Commission, at a regular meeting held June 17, 1982, recommended by a 5-1-1 vote 'approval of this ordinance. The proposed historic preser- vation ordinance would establish a city historic preser- vation commission and procedures for the designation of City historic districts, in accord with state law. The ordinance was assembled by the City Historic Preservation Task Force with the assistance of City Planning and Legal staff. Changes suggested by the City Manager and the Planning and Zoning Commission have been incorporated into the ordinance. A copy of the proposed ordinance will be sent out in the Council's packet prior to the public hearing. Action - Lonsmaer setting a public hearing for August 3, 1982, on Proposed ordinance amending Section 8.10.35 of the Zoning Ordinance to establish a mechanism for licensing sign installers and a system of establishing fees for sign permits. Comment: The Planning and Zoning Commission discussed this item at its regular meeting on July 1, 1982. Staff will provide Council with the Commission's recommendation at the Council meeting. The ordinance amends the zoning ordinance by establishing a procedure for licensing sign installers in Iowa City and establishing a system of fees for sign permits. A copy of the proposed ordinance will be sent out in the Council's packet prior to the public hearing. Comment: The Planning and Zoning Commission will review this item at its regular meeting scheduled July 15, 1982. Because the Department of Housing and Urban Development requires City approval of the proposed development prior to letting bids, Lyle Seydel, Housing Coordinator, is requesting that the public hearing date be set at this time. Action - e. Public hearing on a proposed ordinance amending Section 8.10.18.A of the Zoning Ordinance regarding screening for commercial and industrial uses and manufactured housing uses to be located in the proposed RMH zone. Comment: The Planning b Zoning Commission, at a regular meeting held May 20, 1982, recommended by a 3-1 vote approval of this ordinance. The ordinance amends the zoning ordinance by requiring screening whenever a commercial/industrial use borders existing development in an R zone and whenever uses located in an RMH zone border a single-family residential 3 ,_use located in an R1A,zone. This item was reviewed by City %1 Council in�raft 10 m prior to Planning and Zoning Commission review. A copy of the proposed ordinance is included in the Council's agenda material. Consider an ordinance to rezone approximately 1.47 acres located west of Scott Boulevard between Muscatine Avenue and Court Street to RIB. (first consideration) Comment: The Planning and Zoning Commission, at a regular meeting held April 15, 1982, recommended by a 5-0 vote approval of the ordinange rezoning property owned by Hilfreda and Albert Hieronymus to R1B. The voluntary annexation of this property was approved by the City Council and is currently pending approval by the City Development Board. Final consideration cannot be given until this approval is received. (first consideration) Comment: The Planning and Zoning Commission, at a regular meeting held May 6, 1982, recommended by a 5-0 vote approval of the ordinance rezoning property located east of Scott Boulevard and south of Court Street which is owned by the City of Iowa City. The voluntary annexation of this property was approved by the City Council and is currently pending approval by the City Development Board. Final consideration cannot be given until this approval is received. A copy of the proposed ordinance was included with the June 22 agenda material. Action - 47, 0/ Item No. 6 - PUBLIC DISCUSSION. .l; 1 Item No. 7 - PUBLIC HEARING ON THE DISPOSITION OF PUBLIC PROPERTY (VACATED STREETS AND ALLEYS IN BLOCK 47, BLOCK 38, AND A PORTION OF VAN BUREN STREET). Comment: A portion of Van Buren Street had previously been vacated by the City in the 1960s to permit construction at Mercy Hospital of a nurses' residence hall. However, the title to all streets and alleys in the Original Town of Iowa City remained in the State. A patent is being obtained from the State to clear title to that portion of Van Buren Street and alley previously vacated. Mercy Hospital is now asking that the City convey its interest in this previously vacated street and alley along with the east -west alley (Block 38 Van Buren _Johnson) and the east 100 feet (east - west alley) Block 47. Patents from the State are also being obtained for these two additional areas. These latter two alleys were vacated in 1940 and 1968. Comment: After the public hearing, it will be necessary to approve this resolution to convey the vacated property to Mercy Hospital. Page 11 Item No. 18 - CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF AN ADDENDUM TO THE AGREEMENT WITH OUT OF DANGER, INC., OBA DOMESTIC VIOLENCE PROJECT, FOR THE PURPOSE OF MAKING SPECIFIED IMPROVEMENTS TO THE EMERGENCY SHELTER FOR VICTIMS OF SPOUSE ABUSE. Comment: On June 8, 1982, the City Council approved an amendment to the 1982 Metro Entitlement CDBG Program which included $2,610 for the emergency shelter for victims of spouse abuse. The monies to be provided under the present addendum will be used for roof and incidental repairs at the shelter. A copy of the addendum is attached to the resolution. Comment: This resolution renews Iowa City's contract with Johnson County SEATS for elderly and handicapped transportation service in FY83. The contract amount is $57,000. This is a 9.5% increase over the FY82 contract of $52,000, but also includes an increased level of service. State funding is available for part of the contract cost. Action - 7 Item No. 20 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BET'1VEEN THE CITY OF IOWA CITY AND THE CITY OF UNIVERSITY HEIGHTS FOR THE PROVISION OF TRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS. Comment: This resolution renews University Heights' contract for transit service in FY83. The University Heights contract price of $18,420 is a 2.5% increase over the FY82 contract of $17,976, and was developed by the Director of Finance from a formula based on level of service and population. Comment: The Department of Housing and Urban Development requires that the annual operating budget be adopted by formal resolution by the Housing Authority. The attached budget has been submitted to HUD and its approval is being delayed until receipt of the resolution. The staff recommends adoption of the resolution. Action - ' Pr�;i fr,'- � 7�•, i) Item No. 22 - CONSIDER AN ORDINANCE AMENDING CHAPTER 5 BY ADDING A NEW SECTION 5-10 TO THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA. Al (second consideration) Comment: The purpose of this ordinance is to prescribe closing hours for certain establishments which sell alcoholic liquor and beer to prohibit presence on such premises by.unauthorized persons when such premises are required to be closed. Only the licensee or permittee and his/her agents or employees may be present on such premises after closing and only for the purposes of cleaning, maintenance, or performing other necessary work. In addition, the ordinance regulates additional hours when certain licensed premises may remain open for business other than selling alcoholic liquor or beer. The proposed ordinance has been reviewed and approved by the attorney representing the Iowa Beer and Liquor Department. Action Item No. 23 - CONSIDER AN ORDINANCE AMENDING SECTION 35 OF THE IOWA CITY MUNICIPAL CODE BY REPEALING ARTICLE II, TAXICABS, AND ADOPTING A ,306'7 NEW SECTION IN LIEU THEREOF. (passed and adopted) Comment: This proposed ordinance was discussed at the informal Council meeting of April 26, 1982. A copy of the ordinance was attached to the agenda of June 8, 1982. (first consideration) When Rose Alley was formally named by Ordinance in 1976, the description of its location was incorrect. The purpose of this ordinance is to correct that location description. CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN A LETTER OF CONCURRENCE WITH THE IOWA DEPARTMENT OF TRANSPORTATION EXTENDING THE DEADLINE OF FOUR STATE TRANSIT ASSISTANCE CONTRACTS AND ONE FEDERAL SECTION 18 CONTRACT. This resolution authorizes the Mayor to extend the City's don - tracts with the DOT for the purchase of three transit coaches from June 30, 1982, to June 30, 1983. These coaches are expected to arrive later this summer.
