Comment: This agreement renews the existing annual
agreement which expired June 30, 1982. A copy of
proposed agreement is attached.
e. Setting public hearings.
(1) Consider resolution setting public hearing on August 3,
1982, to consider conveyance of a portion of vacated
Grant Court right-of-way.
Comment: This property was one of the proposed public
housing sites which was unsatisfactory because of title
problems. Settlements have been reached in quiet title
action and staff recommends disposal of the west half
of the vacated right-of-way to adjoining owners. This
will still leave the east half for public housing or
disposal.

sale of Central Junior High property. This letter has
been referred to the Legal staff for reply and any

Item No. 3 - PLANNING AND ZONING MATTERS.
a. Public hearing to consider a proposed ordinance approving a
final Planned Area Development (PAD) plan of Walden Wood,
Part 1, located in the northwest quadrant of the intersection
of Mormon Trek Boulevard and Rohret Road. S-8215.
Comment: The Planning and Zoning Commission, at a regular
meeting held June 3, 1982, recommended by a 5-1 vote approval
of the final PAD, LSRD plan and subdivision plat of Walden
Wood, Part 1, subject to the following:
1. the submission and approval of legal papers,
2. an agreement with Engineering on the fire lane,
3. signatures on all necessary documents, and
4. Homeowners Association papers providing for the maintenance
of the fire lane and walkway and escrow account to
provide for the construction of semi-public improvements.
This recommendation is consistent with the staff's recommen-
dation contained in the staff report dated June 3, 1982,
which is included in the Council's packet. The contingencies
noted above have been resolved. A copy of the proposed

ordinance is included in the Council's packet.

Action -
Comment: See Item a. above. The applicants have requested
that this item be put on the agenda for consideration
fallowing the public hearing in order to expedite its
approval and allow construction to begin this year. If
there are no objections voiced during the public hearing,
the applicant also requests that the Council consider
waiving the three required readings and take final action on
this ordinance at this time.

located east of Scott Boulevard and south of Court Street to
RIA. (second consideration)
Comment: The Planning and Zoning Commission, at a regular
meeting held May 6, 1982, recommended by a 5-0 vote approval
of the ordinance rezoning property located east of Scott
Boulevard and south of Court Street which is owned by the
City of Iowa City. The voluntary annexation of this property
was approved by the City Council and was recently approved
by the City Development Board as well. This action cleared
this item for final consideration if the City Council wishes
to do so. A copy of the proposed ordinance was included

WITH THE DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA,
�y3 FOR A GRANT UNDER THE URBAN MASS TRANSPORTATION ACT OF 1964 AS
AMENDED.

This resolution authorizes amending the original UMTA Section 3
application for a new transit facility which was submitted in
early June. This amendment is necessary in order that the
application reflect the cost estimate developed by the oroiect

CLERK TO ATTEST A 28E AGREEMENT WITH THE CITY OF CORALVILLE,
IOWA, AND THE UNIVERSITY OF IOWA REGARDING TRANSIT MAJOR MAINTENANCE
ACTIVITIES.
This agreement establishes the arrangement for transit major
maintenance activities which are anticipated to be performed on
Coralville and University buses in the new Iowa City transit
Item No. 11 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST AN AGREEMENT WITH JOHNSON COUNTY FOR THE EXTENSION
9�- 1 OF A WATER MAIN ALONG MELROSE AVENUE TO THE JOHNSON COUNTY HOME.
Comment: This water main extension is necessary to eliminate problems that
exist with the present well water system at the Johnson County
Home. A 12" main will be installed at a cost of $130,000, to
insure an adequate flow for fire protection. Johnson County will
initially pay $63,504, for a 6" main which is the size required
to provide sufficient flow for domestic use and fire protection

Item No. 12 - CONSIDER RESOLUTION ESTABLISHING A LANDFILL USE FEE AND A RESIDENTIAL
/y6 SOLID WASTE COLLECTION FEE.
Comment: This resolution increases the landfill use fee to $6.75 per ton
and the residential solid waste collection fee to $3.00 per
month. A memo is attached which provides additional information
on the increased rates.

Item No. 13 - CONSIDER RESOLUTION AUTHORIZING THE SUSPENSION OF THE CLASS C
LIQUOR LICENSE, NO. LC -13508 HELD BY IOWA CITY MICKY'S LTD., DBA
MICKY'S, 11 S. DUBUQUE STREET, IOWA CITY, IOWA.
Comment: An employee of Micky's has pleaded guilty to a charge of selling
beer to a minor. The Code of Iowa provides that in the event of
a conviction of such an offense, the local authority shall
suspend the violator's liquor license for a 14 day period. This
is mandatory suspension, and it is unnecessary to hold a public
hearing prior to the suspension. Micky's has agreed to surrender
its license on August 1, 1982.

Item No. 14 - CONSIDER AN ORDINANCE TO AMEND THE CODE OF ORDINANCES, CITY OF
IOWA CITY, FOR THE PURPOSE OF RENUMBERING THE CHAPTER AND SECTION
NUMBERS OF THE PREVIOUSLY ENACTED CHAPTER 24.1, NOISE, TO NOW
PROVIDE THAT SAID ORDINANCE SHALL BE KNOWN AS CHAPTER 24.4 OF THE
CODE OF ORDINANCES AND THE SECTION NUMBERS THEREUNDER SHALL ALSO
BE RENUMBERED TO CONFORM TO SAID AMENDED CHAPTER 24.4. (first
consideration)
Comment: After enactment of the noise ordinance it was discovered that the
chapter number and section numbers for insertion into the City
Code should not have been Chapter 24.1, but rather should have
been Chapter 24.4. Chapters 24.1 through 24.3 are already
filled by other ordinances and the Code editors reserved Chapter
24.4 for the addition of new ordinances. Accordingly, it will be
necessary to enact the attached amendment renumbering the noise
ordinance to comply with the City Code chapter and section

Comment: The purpose of this ordinance is to prescribe closing hours for
certain establishments which sell alcoholic liquor and beer to
prohibit presence on such premises by unauthorized persons when
such premises are required to be closed. Only the licensee or
permittee and his/her agents or employees may be present on such
premises after closing and only for the purposes of cleaning,
maintenance, or performing other necessary work. In addition,
the ordinance regulates additional hours when certain licensed
premises may remain open for business other than selling alcoholic
liquor or beer. The proposed ordinance has been reviewed and
approved by the attorney representing the Iowa Beer and Liquor
