an application for utilities to Northwestern Bell
Telephone Company for Burlington Street eastbound
bridge.
Comment: This application is for installation of two
four inch diameter rigid steel conduits on galvanized
steel cantilever brackets mounted on the downstream
face of the eastbound bridge on Burlington Street over
the Iowa River terminating in pull boxes and thence
with concrete encased buried conduits to existing
manholes near the ends of the structure.
(2) Consider motion authorizing the City Engineer to sign
two applications for utilities R.O.W. to Iowa -Illinois
Gas and Electric Company for Melrose Avenue (County
Road F46), relocated Local Road and 518.
Comment: These applications consist of rebuilding
electrical lines on 0.62 miles of Melrose Avenue and
0.26 miles on Local Road in conjunction with interchange
of 518 and Melrose Avenue.

(1) Consider a resolution setting public hearing on August
17, 1982, for Iowa City's 1979 Hold -Harmless CDBG
--- Program Grantee Performance Report, directing the City
Clerk to publish notice of said hearing, and directing
the Director of Planning and Program Development to
place information regarding said report on file for
public inspection.
Comment: The program year extension of the City's
fifth year Hold -Harmless CDBG Program was completed as
of June 30, 1982. According to federal regulations,
the City has to complete a Grantee Performance Report
for the CDBG program year. This report is to be made
available for public comment and discussion.
f. Correspondence.
(1) Letter from Andrew Garcia -Rivera with attached petition
regarding paving of certain alleys. This letter was
furnished to the Council at the informal meeting of
July 19, 1982. The reply from the City Manager is
attached to the agenda.
(2) Letter from Della Grizel regarding Congregate Meals and
the Advisory Committee. This letter has been referred
to the City Manager for reply.
(3) Letter from Hawkeye Cab Company requesting two taxi
stands in the business district. This letter has been
referred to the City Manager for reply.
(4) Petition signed by 26 residents regarding traffic on
Clark Street. This petition has been referred to the
Traffic Engineer for recommendation.

Item No. 4 - PLANNING AND ZONING MATTERS.
a. Public hearing on a proposed ordinance establishing an
Historic Preservation Commission for the City of Iowa City,
Iowa, and providing for the establishment of historic
preservation districts, and defining powers and duties in
association therewith.
Comment: The Planning and Zoning Commission, at a regular
meeting held June 17, 1982, recommended by a 5-1-1 vote
approval of this ordinance. The proposed historic preservation
ordinance would establish a City Historic Preservation
Commission and procedures for the designation of City
historic districts, in accord with State law. The ordinance
was assembled by the City Historic Preservation Task Force
with the assistance of City Planning and Legal staff. A
copy of the proposed ordinance is included in the Council's
packet with a memorandum from the Task Force.

b. Public hearing on a proposed ordinance amending Section
8.10.35 of the Zoning Ordinance to establish a mechanism for
licensing sign installers and establishing a system of fees
for sign permits.
Comment: The Planning and Zoning Commission, at a regular
meeting held July 1, 1982, recommended by a 6-0 vote approval
of this ordinance. The ordinance amends the Zoning Ordinance
by establishing a procedure for licensing sign installers in
Iowa City and establishing a system of fees for sign permits.
All businesses currently installing signs in Iowa City have
been notified of the public hearing and sent a copy of the
ordinance. A copy of the proposed ordinance is included in
the Council's packet.
c. Public hearing on an ordinance approving a preliminary and
final Planned Area Development (PAD) plan for the Iowa City
Public Housing Project 22-4, located east of the intersection
of Scott Boulevard and Shamrock Drive. 5-8219.
Comment: The Planning and Zoning Commission, at a special
meeting held July 22, 1982, recommended by a 5-0 vote
approval of this ordinance subject to approval of construction
plans for public improvements and stormwater management, and
legal papers. This recommendation is consistent with the
staff's recommendation contained in the staff report dated
July 15, 1982, which is included in the Council's packet.
The contingencies listed above have been resolved.

d. Consider an ordinance approving the preliminary and final
Planned Area Development plan of the Iowa City Public
1 Housing Project 22-4. 5-8219, (first consideration)
Comment: Because the Department of Housing and Urban
Development requires City approval of the Planned Area
Development plan prior to granting final site approval, the
applicant (Iowa City Housing Authority) has requested that
this item be put on the agenda for consideration following
the public hearing in order to expedite its approval and
allow construction to begin this year. It is also requested
that the Council consider waiving the three required readings
and take final action on this ordinance at this time. A
copy of the proposed ordinance is included in the Council's
agenda materials.

subdivision plat of Sedlacek Addition located in the southeast
quadrant of the intersection of Prairie du Chien and Dodt Road,
approximately one and one-half miles north of the Iowa City

Action -
Comment: The Planning and Zoning Commission, at a regular
meeting held July 15, 1982, recommended by a 7-0 vote that
the preliminary and final subdivision plat of Sedlacek
Addition be approved and the preliminary platting require-
ments be waived, subject to the approval of legal papers.
This recommendation is consistent with the staff recommen-
dation contained in the staff report dated July 15, 1982,
which is included in the Council agenda material. This item
is being reviewed because of its location within Iowa City's
two mile extraterritorial jurisdiction. The legal papers
are now in order and this item is ready for Council's
consideration.

Comment: The Planning and Zoning Commission, at a regular
meeting held June 3, 1982, recommended by a 5-1 vote approval
of the final PAD, LSRD plan and subdivision plat of Walden
Wood, Part 1, subject to the following:
1. The submission and approval of legal papers;
2. An agreement with Engineering on the fire lane;
3. Signatures on all necessary documents, and
4. Homeowners' association papers providing for the
maintenance of the fire lane and walkway and escrow
account to provide for the construction of semi-public
improvements.
This recommendation is consistent with the staff's recommen-
dation contained in the staff report dated June 3, 1982,
which was included in the Council's July 20, 1982, Council

Zoning Ordinance regarding screening for commercial and
industrial uses and manufactured housing uses to be located
in the proposed RMH zone. (first consideration)
Comment: The Planning and Zoning Commission, at a regular
meeting held May 20, 1982, recommended by a 3-1 vote approval
of this ordinance. The ordinance amends the Zoning Ordinance
by requiring screening whenever a commercial/industrial use
borders existing development in an R zone and whenever uses
located in an RMH zone borders a single-family residential
use in an RIA or an RIB zone. Questions which were raised
during the public hearing regarding this item have been
investigated and resolved. A copy of the proposed ordinance
was included in the Council's July 6, 1982, packet.

been reached in quiet title action and staff recommends disposal
of the westerly portion of the vacated right-of-way adjoining
owners.

Item No. 11 - PUBLIC HEARING ON PROPOSED INDUSTRIAL DEVELOPMENT REVENUE BONDS,
SERIES 1982 (IOWA STATE BANK 8 TRUST COMPANY PROJECT).
Comment: The Council approved a Memorandum of Agreement for this project
on March 16, 1982. The public hearing was delayed until construction
plans were more complete. No additional information has been
received. The hearing will be convened and then recessed for one
month.

Item No. 12 - RECOMMENDATIONS OF BOARDS AND COMMISSIONS.

a. Consider recommendation of the Broadband Telecommunications
Commission that the Council adopt three ordinance amendments
based on the Triannual Review discussions. These include:
1) an ordinance amendment requiring cable to be buried 12
inches underground; 2) an ordinance amendment requiring
anyone doing excavation to give the cable company 24 hours
notice or face liability for damages; 3) an ordinance
amendment allowing the cable company to turn in their annual
reports on April 30 instead of the previously required March
31. More information will be provided to the Council in the
report from the Triannual Review. The ordinances will be
placed on the agenda for Council consideration at a later
date.
b. Consider resommendations of the Committee on Community
Needs:
(1) That someone with an interest in the preservation of
the north side of the City be appointed to CCN.
Council has already acted on the appointment to CCN.
(2) CCN approves the use of recaptured funds for Public
Housing in a principal reduction loan program for the
Section 8 Moderate Rehabilitation Program. Council
will review further information on this matter in a few
months, after the proposed Public Housing Site has been
sold to a developer. No action is necessary at this
time.

Comment: An employee of Micky's has pleaded guilty to a charge of selling
beer to a minor. The Code of Iowa provides that in the event of
a conviction of such an offense, the local authority shall Sf.Aeq
suspend the violator's liquor license for a 14 day period. This �� 17
is mandatory suspension, and it is unnecessary to hold a public
hearing prior to the suspension. This item was deferred from the
meeting of July 20, 1982. The suspension dates in the resolution
have been left blank so the Council can make the suspension
effective at a time the Council deems appropriate.

THE GENERAL ELECTION OF NOVEMBER 7,

Comment: This Resolution authorizes and directs the County Auditor to
place the question of the imposition of a hotel -motel tax before
the electorate to be voted upon at the general election on
November 7, 1982. The public measure is contained in paragraph 1
of the Resolution and this is the question that will appear on
the ballot. A copy of both the proposed Ordinance imposing the
tax and the chapter in the Iowa Code authorizing the imposition
of the tax will be placed in the voting booths. If the electorate
approves the tax, the Council will then proceed, after the
election, to consider the adoption of the Ordinance imposing the
tax effective July 1, 1983, which is the earliest date after
approval of the electorate that the tax can take effect.

Comment: On March 30, 1982, the Council authorized the Mayor to sign the
application for these funds. They total $137,940 in Iowa State
Transit Assistance and $126,728 in Federal Section 18 funds to be
used to operate Iowa City Transit. This resolution authorizes
the Mayor to sign the contract for these funds.

State Transit Assistance funds on behalf of CAMBUS. This contract
authorizes the pass-through of $15,500 of State funds to CAMBUS.

CONSIDER RESOLUTION AMENDING THE
COMPENSATION PLAN.
INISTRATIVE CLASSIFICATION/
Traditionally, due to pension considerations, the maximums of the
salary ranges for Police and Fire Department Administrative
Positions have been established to equal the salary of the most
highly paid employee(s) within each salary range. The proposed
adjustment will lower the salary range maximums to the actual
highest salary within the range. Prior to FY83 merit increase
allocations the salary ranges had reflected the 3.5 percent
increase allocated for merit increases by the City Council;
however, the City Manager deferred .5 percent of that amount to
be used for exceptional merit increases and bonuses for FY83.
The amended ranges reflect a three percent increase.

Item No. 20 - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST AN AGREEMENT WITH HIGHLANDER, INC., WESTINGHOUSE LEARNING
CORPORATION AND BRUCE R. AND FLORENCE E. GLASGOW REGARDING
EXTENSION OF SEWER SERVICE.
Comment: The Council is being asked to authorize the execution of a four -
party agreement whereby the City agrees to extend sanitary sewer
services to the Highlander, Westinghouse and the Glasgow properties
located near the interchange of Highway 1 and I-80. This will
also involve the construction of a lift station and the Highlander
will pay 73% of the cost, Glasgow 7%, and the City the remaining
20%. In exchange for the City's cost-sharing for the benefit of
Westinghouse, Westinghouse will agree to assume the cost of an
eventual hook-up to the new line thereby permitting the City to
close down the present lagoon serving the Westinghouse plant.
The agreement is contingent upon approval and execution by all
other parties. This agreement is the result of lengthy negotiations
that
have taken place over the past three to four years.

Item No. 21 - CONSIDER ORDINANCE AMENDING CHAPTER 4 (AIRPORT) OF THE CODE OF
ORDINANCES OF IOWA CITY. (first consideration)
Comment: This ordinance is to remove the old "Blue Laws" that no longer
apply to airport operations, to upgrade the language to current
standards and to incorporate into ordinance form the Minimum
Operating Standards that are in the leases with the Iowa City
Flying Service. This has been approved and is recommended by the
Airport Commission.

NUMBERS OF THE PREVIOUSLY ENACTED CHAPTER 24.1, NOISE, TO NOW

CODE OF ORDINANCES AND THE SECTION NUMBERS THEREUNDER SHALL ALSO
BE RENUMBERED TO CONFORM TO SAID AMENDED CHAPTER 24.4. (second
consideration)
Comment: After enactment of the noise ordinance it was discovered that the
chapter number and section numbers for insertion into the City
Code should not have been Chapter 24.1, but rather should have
been Chapter 24.4. Chapters 24.1 through 24.3 are already filled
by other ordinances and the Code editors reserved Chapter 24.4
for the addition of new ordinances. Accordingly, it will be
necessary to enact the attached amendment renumbering the noise
ordinance to comply with the City Code chapter and section
designations. �
