. 3. The applicant shall be responsible lot proper placing of any signs needed to warn traffic or prolecl workmen and also lot she covering or removal
signs when no longer needed. Signs will be loaned to the applicant by the Iowa Department of Transportation.
4. Operations in construction and maintenance of the locility shall be carried on in such a way so as to not interfere with or Interrupt traffic on the
highway esreps in special cases which will be covered by additiona151ipulalions.
If permission is given to do work that may interfere with the free flow of gals is, or when work is dune within 10 fees of the edge of the pavement, the
applicant shall lurnish two competent flagmen to control traffic and safely direct traffic by the work area.
5. The applicant shall seed and mulch all areas in the tight of way disturbed by the operation and be responsible for the vegetative cover until well
established.
Any surfaced areas such as driveways, shoulders, sodded waterways and planlings disturbed by the operation shall be restored to their original
condition.
6. The applicant shall maintain any drainage structure built within the right of way that is built for the benefit of the applicant and not necessary
(or highway use.
7. This permit is subject to any laws now in effect or any laws which may be hereafter enacted.
g. This permit is subject to all the rules and regulations of the Iowa Department of Transportation, and to revocation by the Iowa Department of Trans•
porlation at any time when, in the judgment of the Department it is necessary in the improvement or maintenance of the highway or for other reasonable
cause.

At its regular meeting of August 13, 1982, the City Council received
and placed on file your letter regarding the retaining wall on the
Systems Unlimited property. The City shared our concerns with
representatives of Systems Unlimited and their architect. I'm sure
you are aware that remedial action has been taken.
The City of Iowa City does not have an ordinance requiring fences or
guardrails on grade changes resulting from landscaping. The only
requirement for guardrails is in the building and housing codes and
deals (Pith grade changes that are part of a structure. The Iowa City
Zoning Ordinance regulates the construction of fences and, with the
exception of swimming pools, does not require the fencing of
property. I have referred your letter of recommendations to the
Director of Planning and Program Development for further discussion
by the Planning and Zoning Commission regarding its desire to amend
the Iowa City fence regulations to require that a fence or some other
physical barrier be erected in circumstances such as those outlined
in your letter.
Thank you for bringing this matter to the attention of the property
owners and developers directly affected as well as to the City
Council.

Dear City Council Members:
The landscaping has recently been completed for the Systems
Unlimited house constructed on the corner of Friendship
Street and Washington Street. During construction a concrete
retaining wall 10 inces thick, with a vertical drop of over
6 feet was built across the rear lot line of the property.
The purpose of this wall was to prevent soil erosion and
help in water drainage of the Systems Unlimited property.
In a recent phone conversatiomwith Mr. Benny Leonard of
Systems Unlimited, we were informed that Systems Unlimited
has no intention of erecting a fence around their property,
or, for that matter, even across the 6 foot concrete retain—
ing wall.
We find it unusual thattge city has allowed the construction
of such a potentially dangerous drop—off in a residential
neighborhood. The failure of Systems Unlimited to recognize
the danger of the situation is of even more concern.
Therefore, we would like to request that you do whatever is
necessary to insure the safety of the Systems Unlimited
property for the following reasons:
1) A 6 foot vertical drop is sufficient height to
cause serious injury and possibly death to children
or adults who venture into the area.
2) Since construction of the wall several months
ago, we have had to chase children off the wall on
numerous occasions. Thus, the safety problem is not
hypothetical but is a real danger which we do not
wish to persist any longer than necessary.
3) The Systems Unlimited home in located in an
area where there are many children under the age of 12.
It is sometimes difficult to impress upon childrne
of this aqe group the serious consequences of straying
too close to a 6 foot vertical drop.
4) During the evening hours of summer after dusk,
many children are outside playing games in the area.
It is quite possible that in the dark a child would
not realize how close he is to the wall and could
fall off without ever having seen the wall.
5) A concrete basketball area is located on the
northwest corner of the Systems Unlimited property
near the retaining wall. This basketball area might
attract a number of children to the area of greatest
danger.

6) The retaining wall may also be a danger to the
occupants of the Systems Unlimited house. to would
seem likely that some of the residents would take
occasional walks on the property and in doing so
might place themselves in considerable danger if
they venture onto the retaining wall.
We feel that your prompt consideration of our concern about
the safety aspects of the retaining wall is necessary to
alleviate the dangerous hazzard which exists on the Systems
Unlimited property. We recognize that Systems Unlimited
has a limited amount of funding for this project. However,
we feel that the cost of a fence would be justified in
light of the costs associated with an accident to one of
the residents of the area.or to one of the residents of
the Systems Unlimited house. We suggest a fence around
at least three sides of the property as the minimal de-
terrent. We realize that even a fence might not stop an
individual determined to walk along the retaining wall.
It would, however-; at least lessen the danger of someone
accidently falling off the wall.

hlumford of the Fire Department has been training city employees, especially
those who are in public contact positions. In the past, CPR training and
recertification has been offered to all City employees, and we will con-
tinue to encourage employee participation.

Dear Mayor Neuhauser and Council:
I am writing to inform you of a new community committee --the Johnson County
Committee for Citizen CPR. Although many volunteers have been teaching CPR
here in Iowa City and in the County, the efforts have been somewhat
unorganized and fragmented. The purpose of the Committee, composed of
volunteer citizens, is to assist in promoting CPR and facilitate the
training of 40% of Johnson County citizens by January 1985. CPR unquestiona-
bly saves lives; as many as 40% of victims of sudden death could survive if
the goal is met.
To meet the 40% goal, approximately 15,000 individuals will need to be
trained in the next two and one-half years. Some of the ways in which the
Committee hopes to accomplish this are as follows:
Promote public awareness of the need for learning CPR.
I
Provide a clearinghouse for instructors and courses. A CPR informa-
tion line is being established as of August 2 which provides
answering service for individuals wanting information about courses
and other CPR matters.
An assessment of the community's resources has been made --we know
who is teaching and what their needs are.
Raise funds to provide a pool of training mannequins and A-V
materials, since this is an urgent need at the moment.
In these and other ways we hope to assist the existing training groups --
among them the American Red Cross, Fire Departments, Ambulance Services,
Hospitals and Iowa National Guard in their fine efforts.
Support and suggestions from the Council would certainly be appreciated.
We would also be delighted to arrange a special CPR training session for
you. Your example would undoubtedly encourage others to follow suit!
I'm sure Jerry Mumford, who I know has trained City employees in the past,
would be willing to work with others in doing this. Thank you.

I am writing to you about a serious problem that I have been
told about regarding the contemplated median strip on Riverside
Drive. I am hoping you will honor my request to support widening
the highway to five lanes, rather than installing a raised center
strip.
As you know, until quite recently my family was a resident of
Iowa City, and we still own two buildings on Riverside Drive. I
know that my father, before his death, had many conversations with
highway and Johnson County public officials about access to our
buildings, "Pay Less Shoes" and the old "Sambo's" restaurant. He
was always assured that there would be access to the properties.
However, with a raised median strip, half of the traffic
would be totally cut off from entering those two businesses. It
will be extreemly difficult for drivers to get around the strip back
to the buildings from the
i 4 opposite side of the strip, and this
i
could have a severe effect upon on the volumn of business in the
buildings, potentially reducing it by 508. That could present
a very serious problem.
As you probably aware, Sambo's went bankrupt and the building has
been vacant since November. Recently we have talking with potential
leasees for the building but they are very concerned about the
i
median strip. I find that'`. without access to the properties from
both directions the buildings values are considerably less.
I've enclosed a copy of a letter which seems to indicate the
state's Department of Transportation acceptance of the five lane
option, and we sincerely hope you will support this solution. We
must have access to both those properties from either direction.

The detailed study to which I have referred consisted of a project
review by professional and technical staff representatives. The
subject was again discussed on June 10 and confirmed our earlier
conclusions that the raised concrete median on Riverside Drive is
the appropriate improvement. This decision is based on the necessity
to control congestion in the heavy traffic corridor by eliminating
left turns into businesses, establishing protected left turn storage
bays at Benton and Sturgis Avenue, reducing traffic conflicts, and
treating essential safety aspects of the design.
I cannot agree that this agency has an obligation beyond widening
Benton Street to accommodate intersection movements at Riverside Drive.
State participation would remain at $5,000 for the milling and resur-
facIng work on Benton Street as previously stated in my May 21 letter.
When evaluated by our design warrants, it is our opinion that a pedestrian
activated traffic signal at Riverside/Benton is not needed. This is not
to say that the request is unreasonable, but simply that our initial
concern must look to the problems that signals would generate in traffic
phasing, delay times and interconnected circuits with the proposed signals

easily be added at a later date.

This agency feels a paramount responsibility for the reconstruction
of the new U.S. 6/Iowa 1 intersection and will insist on proceeding
with the raised median concept at that location. However, we
acknowledge that the Riverside/Benton portion of the Droject is the
product of our agreement concerning relocated U.S. 218. If Iowa City
formally requests that the design be modified to substitute a five
lane operation on Riverside in lieu of the raised median controls,
our plans will be changed accordingly.
The best public interest will be served by resolving this issue and
proceeding with plan preparation for 1983 construction. If you wish
us to make the above substitution on the Riverside/Benton segment,
please let me know.

Re: Benton -Riverside Intersection
In discussions with representatives of IDOT, it appears that
agreement has been reached concerning City Council decisions at the
informal Council session of August 2, 1982.
IDOT will participate financially in the construction of the fifth
lane and the pedestrian light which the City Council has authorized.
However, the agreement to be executed between the City and IDOT will
place all responsibility for those decisions upon the City.
As for the Benton Street portion of the project, IDOT has agreed to
completely replace Benton Street east of Riverside with new concrete
pavement, and that portion west of Riverside will be reconstructed as
necessary based upon the condition of the pavement, and new concrete
sections added to the width and the whole area overlayed. While this
proposal for the Benton Street portion is a compromise, the City
staff believes that it is desirable to proceed with this project
without any further delay and recommends that the City Council
approve the proposal for the reconstruction of Benton Street.
The agreement will be received from IDOT for City Council
consideration in approximately two weeks.

Dear Mayor and Council Members:
It is my understanding that a discussion on the Riverside
Drive -Denton project is to be held on Monday, August 2nd it
4:45 P.M. Prior commitments have forced me to be unable to
attend but I am writing this letter to again reiterate to you
my position of being overwhelming against the raised median
portion of this project for Riverside Drive.
It seems uneccesary to again repeat the reasoning for our
objection. About the only reason I can see for the city to
even consider a median is for quote "safety" and past records
seem to prove that Riverside Drive has not been an accident-
prone area. With the addition of a left turning lane and the
forth -coming 518, which will remove 90% of the truck traffic,
more and more smaller vehicles replacing larger ones, the
installation of a raised median now would be a tragic mistake.
I trust that you, the Iowa City Council, will. see this in
the same light and vole to remove the median from this project.

Re: Parking on South Side of 500 Block of Bloomington St.
As directed by Section 23-16 of the Municipal Code of Iowa City, this
is to advise you of the following action:
ACTION:
Pursuant to Section 23-245, the City Traffic Engineer will establish
parking on the sidewalk on the south side of the 500 block of East
Bloomington St. This establishment will allow Mercy Hospital to
provide for emergency delivery parking in the area between the curb
and the concrete sidewalk on the south side of the 500 block of
Bloomington, from the intersection of Bloomington St. with Van Buren
St. east to a point approximately 190 feet east of the intersection.
The establishment of "parking on the sidewalk" will occur on
August 16, 198.
COMMENT:
During the Mercy Hospital construction phase of new emergency room
facilities, Mercy Hospital will lose its on-site parking for
vehicles which have delivered patients requiring emergency service.
During this construction phase, the above noted action will allow
Mercy Hospital to provide storage for these vehicles. Mercy Hospital
will remove the curb and dress the area between the curb and the
sidewalk with an asphaltic surface. They intend to install a curb -
like barrier so as to provide continued access for pedestrians to the
sidewalk. They intend to provide storage for ten vehicles. The
hospital intends to provide supervision and assistance in the use of
these parking stalls. The hospital intends to restore the area to
its present condition when new off-street parking facilities are
completed.

The Resources Conservation Commission, at its meeting on August 5,
1982, voted to recommend to the City Council that it formally endorse
the Sierra Club Community Energy Project and the participation of the
Iowa City Resources Conservation Commission in that project as a co-
sponsor. Information regarding the project is enclosed for your
review.
This recommendation would normally come to you in the minutes of the
August 5 Commission meeting. However, the Commission will not meet
until September 2, 1982, to approve and forward those minutes.
Therefore, I am sending this communication as it is the desire of the
Commission that the City Council give more timely consideration to
this request. The Charrette is tentatively scheduled for early
October, 1982. The Commission believes that this project provides a
unique opportunity for involvement in a cooperative effort to
promote community -wide interest in energy conservation and
information sharing. This item will be placed on your agenda for
August 17, 1982, and the Resources Conservation Commimssion
respectfully requests your favorable consideration. I will be
present at your August 16 informal meeting to answer any questions
you may have.

Both to solicit your support and to advise you of a program
undertaken by the Sierra Club and in cooperation with the Iowa
City Resource Conservation Commission, I am forwarding you a copy
of a release being mailed today to Iowa City news media. Also
included is brochure which discusses our national community energy
project.
Iowa City has been selected nationally as one of four sites
to demonstrate a community decisionmaking process involving energy
conservation strategies. Funding for our efforts has been supported
by a grant from the Cudahy Foundation. The other sites are Missoula,
MT; Claremore, OK; and Hanover, NH.
As noted in the news release, the specific goal of our project
is to refine and demonstrate what is called an "Energy Charette."
The intent of the charette is not to force a specific issue, but to
build an economically sustainable energy strategy reflecting a
diversity of viewpoints and concerns. The dates tentatively set
for the charette are October 8-10. We are looking for 35-40
participants including community leaders such as youself and/or
your designee(s).
The local contacts for this effort are Bob Singerman, Chair of
the Iowa City Resource Conservation Commission (home number: 338-
1874) and Barb Beaumont, Chair of the Iowa City Sierra Club group
(home number: 338-9101). We previously have discussed this project

The Sierra Club today announced the selection of Iowa City,
Iowa as one its four national sites to demonstrate and promote a
decisionmaking process that it hopes will result in a series of
community -initiated energy conservation programs. The other sites
are Missoula, MT; Hanover, NH; and Claremore, OK.
To better assist membership concern with the growing burden
of higher energy costs, the Sierra Club, last March, created its
present Community Energy Project. In Iowa City its purpose is
to devise a decision -oriented program that will enable Club members
to decide how they can help their communities reduce energy costs
given the financial, technical and social resources available to
them.
Barbara Beaumont, Chairperson of the Iowa City Sierra Club
group, stated that she was "pleased to support such an important
effort.

energy bills but can become the cornerstone of an economic
development program. This is because every dollar we can divert
from oil or electricity purchases will likely be spent on more
productive areas of the economy like agriculture or manufacturing."
Beaumont noted that while the project is being initiated by
the Sierra Club, "we fully intend to promote it as a community
activity. For that reason, we're delighted that the Iowa City
Resource Conservation Commission (RCC) has agreed to co-sponsor
the effort."
RCC Chairperson Bob Singerman stated that "the commission
has been wrestling with ways of involving Iowa Citians in
conservation strategies and the Club's pilot project is a timely
one for us. We look forward to working with them."
The focus of the Sierra Club program is to develop what is
termed an "energy charette." This is a decision -oriented program
in which community leaders analyze their energy problems and work
out a strategy to solve them.

The concept of a "charette" first originated with architects
who devised within a compressed time -period, with input from
engineers and others, plans to complete a particular project. The
term itself refers to the carts in which French architects once
delivered final plans cc the judges.'
In the late 1960's, planners and educators expanded the charette
process to include the citizens affected by a project in areas such
as land use or desegregation plans. The Sierra Club's intent is cc

Iowa City in this case, to reach a consensus on the most effective
way to solve its unique energy problems.
According to Beaumont, a steering committee consisting of
Sierra Club and RCC members has been formed. A three-day charette
is scheduled for October 8-10, 1982. Invitiations will be sent out
to wide variety of community leaders in the hope that some 30-40
of them will register for the pilot program.
Singerman underscored an important theme of the project when
he stressed that the resulting energy strategy will be successful
"only if it is built upon the diversity of views and interests
that reside in Iowa City. For that reason, we are going to make
a real effort to involve everyone from local business and labor
leaders to church and civic groups."
