Washington Street Iowa City, Iowa 52240 Dear Mayor Neuhauser and City Council Members: I have been asked by the Johnson County Board of Supervisors to convey the actions and thoughts of the supervisors regarding recent changes to the Agreement for Main Extension to the County Care Facility. After considerable discussion the Supervisors voted unanimously to approve a motion, "to approve the revised agreement for water main extension to the Johnson County Care Facility as approved by the City of Iowa City and to authorize the Chairperson to execute the revised agreement." This agreement is still subject to minor changes that reflect a reduction in the distance that the main is to be extended and the consequent cost reductions. These figures, I believe, account for the 500-600 foot distance between the Care Facility and the Secondary Roads Maintenance Facility and are being calculated by the Iowa City Public Works Department. As part of this discussion the Supervisors indicated a very strong interest in the future provision of water service to the Secondary Roads Maintenance Facility should the existing water well fail or otherwise prove unsafe or inadequate. Along with this view of future requirements, the Supervisors expressed a desire and willingness to meet jointly with the City Council to discuss these issues in order to closely coordinate policies and actions that will be mutually satisfactory and beneficial. Sec. 4. NEW SECTION. COUNTY LAND PRESERVATION AND USE COMMISSIONS ESTABLISHED. 1. In each county a county land preservation and use commission is created composed of the following members: a. One member appointed by and from the county agricultural extension council. b. Two members appointed by the district soil conservation commissioners, one of whom must be a member of the district soil conser+ation board of commiesionere and one must be a person who is not a commissioner, but is actively operating a farm in the county. c. One member appointed by the board of supervisors from the residents of the county who may be a member of the board. d. one member appointed by and from a convention of the mayors and councilpersona of the cities of the county. If a participating city contains fifty percent or more of the total population of the participating cities, that city may appoint the member appointed under this paragraph. However, if a city contains more thnn fifty percent of the population of a county which has a population exceeding fifty thousand persons, that city shall not participate in the convention of mayors and eouncilpersone and the members Q Senate File 2218, P. 4 appointed under paragraph d shall be one member appointed by and from the mayor and couneilpersons of that city and one member appointed by and from the convention of mayors and councilpersons and the member appointed under paragraph c shall be a resident of the county engaged in actual farming operations appointed by the board of supervisors. 2. The county commission shall meet and organize by the election of a chairperson and vice chairperson from among its members by October 1, 1982. A majority of the members of the county commission constitutes a quorum. Concurrence of a quorum is required to determine any matter relating to its official duties. 3. The state agricultural extension service shall provide county commissions with technical, informational, and clerical assistance. 4. A vacancy in the county commission shall be filled in the same manner as the appointment of the member whose position is vacant. The term of a county commissioner is four years. However, in the initial appointments to the county commission, the members appointed under paragraphs a and b of subsection 1 shall be appointed to terms of two years. Members may be appointed to succeed themselves. Sec. 5. NEW SECTION. COUNTY INVENTORIES. 1. Each county commission shall compile a county land use inventory of the unincorporated areas of the county by January 1, 1984. An agricultural area, at its creation, shall include at least five hundred acres of farmland, however, a smaller area may be created if the farmland is adjacent to farmland subject to an agricultural land preservation ordinance pursuant to section 15 of thin Act. The proposal shall include a description of the proposed area, including its boundaries. The territory shall be as compact and as nearly adjacent as feasible. Land shall not be included in nth agricultural area without the consent of the owner. Agricultural areae shall not exist within the corporate limits of the city. Agricultural areae may be created in a county which has adopted zoning ordinances. Except as provided in this section, the use of the land in agricultural areas is limited to farm operations. 1. The following shall be permitted in an agricultural areas a. Residences constructed for occupation by a person engaged in farming or in a family farm operation. Nonconforming preexisting residences may be continued in residential use. b. Sec. 11. NEW SECTION. LIMITATION ON POWER OF CERTAIN PUBLIC AGENCIES TO IMPOSE PUBLIC BENEFIT ASSESSMENTS OR SPECIAL ASSESSMENTS. A political subdivision or a benefited district providing public services such as sewer, water, or lights or for nonfarm drainage shall not impose benefit assessments or special assessments on land used primarily for agricultural production within an agricultural area on the basis of frontage, acreage, or value, unless the benefit assessments or special assessments were imposed prior to the formation of the agricultural area, or unless the service is provided to the landowner on the acme basis as others having the service. Sec. 12. NEW SECTION. 'INCENTIVES FOR AGRICULTURAL LAND PRESERVATION. 1. NUISANCE RESTRICTION. A farm or fare operation located in an agricultural area shall not be found to be a nuisance regardless of the established date of operation or expansion of the agricultural activities of the farm or farm operation. The subsection does not apply if the nuisance results from the negligent operation of the farm or farm operation. This subsection does not apply to actions or proceedings arising from injury or damage to person or property caused by the farm or farm operation before the creation of the agricultural area. This subsection does not affect or defeat the right of a person to recover damages for injury or damage sustained by the parson because of the pollution or change in condition of the waters of a stress, the overflowing of the person's land, of excessive soil erosion onto another person's land. In the application for a permit to divert, store, or withdraw water and in the allocation of available water resources under a water permit system, the Iowa natural resources council shall give priority to the use of water resources by a farm or farm operations, exclusive of irrigation, located in an agricultural area over all other uses except the competing uses of water for ordinary household purposes. Sec. 13. NEW SECTION. STATE REGULATION. In order to accomplish the purposes set forth in section 2 of this Act, a rule adopted by a state agency after the effective date of this Act which would restrict or regulate farms or farm operations may contain standards which are less restrictive for farms or farm operations inside an agricultural areathan for farms or farm operations outside such an area. A rule containing such a discrimination shall not for the fact of such discrimination alone be found or held to be unreasonable, arbitrary, capricious, beyond the authority delegated to the agency, or characterized by an abuse of discretion or clearly unwarranted exercise of discretion. I am an employee of the Iowa City Public Library, Audio - Visual Department. The ICPL has significant contact with Hawkeye cable -vision through its control of channel 20 and its rental of the Commuity Programming Center. I work approximately 15*hours weekly for the ICPL. I also work 20 hours weekly for the University of Iowa, which has its own channel on the cable system. The con- nection between this organization and the cable company holding the Iowa City franchise has the potential of becoming significant. *this figure does not include hours volunteered. TWENTY UNITS TURNKEY HOUSING. COUNCIL AGENDA SEPTEMBER 14, 1982 1. Project IA22-4 is proceeding quite well. With cooperation from all parties it is possible that an October construction start can be a reality. In the event the start of construction is delayed beyond mid-October, the project may not proceed or at best may have to be delayed until next spring and this would probably require rebidding. 2. The following sequential steps must be taken if the project is to proceed in accordance with the schedule shown below: a. Developers Conference. This conference to be held in Des Moines with representatives from the Housing Authority to include legal staff and inspecting architect, the Developer and his architect and several representatives from the Department of Housing and Urban Development. This conference should result in the following: 1) tentative purchase price; 2) turnkey method to be followed; 3) time schedule; 4) changes in preliminary plans. (9 or 10 September) b. Housing Authority to submit Development Program and Cost Budget. This document is in draft form and ready for submission. May require minor changes based on results of the Developers Conference. C. The Developer submits final drawings and specifications for approval - approximately two weeks after Developers Conference (24 September). d. HUD offers Annual Contributions Contract which must be signed by the Authority and a Depository Agreement signed with the bank. e. Turnkey Contract of Sale Conference will be held after approval of final drawings, approval of the Annual Contributions Contract. (8 October) 3. To maintain the above schedule, all parties must reduce delays to the minimum. The Housing Authority has certain requirements that must be supported by resolution and there are some state code time restraints. To ensure no delays are caused by the Authority and to eliminate, if possible, the requirement for special Council meetings, it is recommended the following resolutions appear on the formal Council agenda for September 14, 1982. An offer to purchase has been extended to Plum Grove. b. Resolution setting a public hearing on the sale of the property to Frantz Construction Company, Inc. This is a state code requirement and requires a 15 day public notice. Public hearing to be held just prior to Council informal meeting on October 4. C. Resolution authorizing the sale of the property to Frantz Construction. (October 4) d. Resolution adopting the Developmental Program and Cost Budget. e. Resolution authorizing Mayor to sign Annual Contributions Contract. This document will not be available on September 14. Its form will be the same as the various contracts that we have now in effect. Dates and dollar amounts will be different. f. Resolution authorizing Mayor to sign Depository Agreement. This is a requirement for each project. This document will not be available on September 14; however, its form and content will be similar to those that we now have for other projects. The only change will be dates and dollar amounts. g. Resolution authorizing Mayor to sign the Turnkey Contract of Sale. This document will not be available on September 14. The Turnkey Contract of Sale document will be identical to the one signed previously with Southgate Development. The only difference will be j the dates and dollar amounts and the firm signing the form. 4.
