Page 4 Item No. 4 - PLANNING & ZONING MATTERS. a. Consider setting a public hearing on November 9, 1982, on the proposed rezoning of certain property located in the southwest quadrant of the intersection of Rochester Avenue and Amhurst Street from RIA to RIB. Comment: The Planning & Zoning Commission will be discussing the proposed rezoning of a 1.4 acre tract located in the southwest quadrant of the intersection of Rochester Avenue and Amhurst Street at their October 7, 1982, meeting. In order to expedite the proposed rezoning, the applicant has requested that a public hearing date be set prior to Planning & Zoning Commission action at this time. A staff report on the proposed rezoning, and information on the Planning & Zoning Commission's action will be provided to the City Council prior to the date of the public hearing. Action - b. Consider setting a public hearing on November 9, 1982, on a proposed ordinance establishing an historic preservation commission for the City of Iowa City, Iowa, and providing for the establishment of historic preservation districts, and defining powers and duties in association therewith. Comment: The Planning & Zoning Commission, at a regular meeting held June 17, 1982, recommended by a 5-1-1 vote approval of this ordinance. The proposed historic preservation ordinance would establish a city historic preservation commission and procedures for the designation of city historic districts, in accord with state law. The ordinance was assembled by the City Historic Preservation Task Force with the assistance of City Planning and Legal staff. Consider setting a public hearing on November 9, 1982, on the proposed rezoning of the moratorium area which was established by ordinance and is known as the "College Hill Park/South Dodge Street Neighborhood." Comment: The Planning & Zoning Commission will be discussing the proposed rezoning of the College Hill Park/South Dodge Street neighborhood at their October 7, 1982, meeting. In order to expedite the proposed rezoning and meet the deadline set by the moratorium ordinance, this item is being placed on the Council agenda prior to the Commission's final action. Information on the proposal which the Planning & Zoning Commission recommends will be submitted to Council prior to the date of the public hearing. Action - -%w 1 M d. MICROFILMED BY J JORM MICR6LAB J 1 CEDAR RAPIDS • DES MOMES i � i Comment: The City Council of Iowa City adopted a resolution accepting and approving the final plat of Oakes Meadow Addition on March 30, 1982. On this plat, Dover Street was shown to extend from Brookside Drive to Muscatine Avenue with Perry Court intersecting that street towards the northern end. It has since been discovered that an alteration in this street name is desirable to permit more understandable addressing of the area. Therefore, staff is recommending that the northern portion of Dover Street extending from Brookside Drive to the intersection of Perry Court be renamed Perry Court. Dover Street will then have a "T" intersection with Perry Court. This change in no way alters the street configuration approved as part of the final plat. It is a minor change, and can be acted upon by City Council without additional review by the Planning & Zoning Commission. A copy of the proposed ordinance is included in the Council's agenda packet. (first consideration) Comment: The Planning & Zoning Commission, at a regular meeting held September 3, 1982, recommended by a 6-0 vote that a 15.6 acre tract located at the north end of Laura Drive and known as Forest View Court be rezoned from R1A to RMH. This recommendation is consistent with the staff's recommendation contained in the staff report dated August 19, 1982, which was included in the Council's September 14, 1982, packet. The ordinance rezoning the court was also included in the September 14, 1982, agenda material. (first consideration) Comment: The Planning & Zoning Commission, at a regular meeting held September 3, 1982, recommended by a 6-0 vote that a 7.98 acre tract located at 2312 Muscatine Avenue and known as Towncrest Mobile Home Park be rezoned from C2 to RMH. This recommendation is consistent with the staff's recommendation contained in the staff report dated August 19, 1982, which was included in the Council's September 14, 1982, packet. (first consideration) Comment: The Planning 8 Zoning Commission, at a regular meeting held September 3, 1982, recommended by a 6-0 vote that a 62.11 acre tract located east of Highway 6 and known as Bon Aire Mobile Lodge be rezoned from C2 to RMH with the exception of a 300 foot strip of land fronting on U.S. Highway 6 which is currently undeveloped. This recommendation is consistent with the staff's recommendation contained in the staff report dated August 19, 1982, which was included in the Council's September 14, 1982, packet. The ordinance rezoning the park was also included in this packet. An official objection has been filed regarding the rezoning of this area which was included in the Council's September 14, 1982, packet. o. Consider a resolution approving the amended subdivider's agreement of Lyn -Den Heights Subdivision, Part 2., as a vKsv.AeCk' Comment: The subdivider and successors and assigns in interest of lots in Lyn -Den Heights Subdivision, Part 2, have filed with the City Clerk an amended subdivider's agreement providing for the deferral of compliance with the City of Iowa City Stormwater Management Ordinance. This agreement provides the City of Iowa City an opportunity to review this deferral upon the occurrence of several events. Since that time several omissions were discovered including the elimination of Type III apartment units with their own kitchen but with shared toilet or bathroom; several areas requiring clarity of language such as the exit requirements; - as well as various minor corrections and modifications to facilitate interpretation and enforcement. Page 12 Item No. 10 - CONSIDER RESOLUTION ESTABLISHING MONTHLY FEES FOR INDIVIDUAL `;4/ ALARMS TERMINATING AT THE IOWA CITY POLICE DEPARTMENT. Comment: The City Council, at its September 28 meeting, gave final approval to an ordinance governing the installation and use of alarms. This resolution sets the monthly fees for each alarm which terminates at the Police Department. Comment: The ordinance mentioned in the above comment also provides for a fee for false alarms in excess of five in any calendar year. This resolution establishes that fee schedule. Action - R— Item No. 12 - CONSIDER A RESOLUTION ESTABLISHING FEES FOR SOUND PERMITS AND SOUND VARIANCES. C' o;Wnt Action - The Noise Ordinance recently adopted by, Council requires that fees for sound equipment permits and sound variances be established by resolution. Item No. 13 - CONSIDER RESOLUTION AUTHORIZING BIDS FOR THE CONSTRUCTION OF THE SOUTHWEST INTERCEPTOR SEWER REPAIR TO BE RECEIVED NOVEMBER 16, G. 1982, AT 10:00 A.M. Comment: This project involves the replacement of a portion of the Southwest Interceptor Sewer which is in bad repair due to septic conditions in the Hawkeye lift station. This project was bid on September 21, 1982, and the bids were rejected at the Council meeting held September 28, 1982. This project is being re -bid for construction to begin in April, 1983. The Engineer's estimate /is $116,000. Page 13 Item No. 14 - CONSIDER RESOLUTION ESTABLISHING CERTAIN FEES AND CHARGES WITH RESPECT TO THE ADMINISTRATION OF REGULATIONS FOR TAXICABS AND TAXICAB DRIVERS. Comment: This item was deferred for one month for further research on liability insurance required in other cities. No research has been done as the deputy is on leave, so we request that the item be postponed indefinitely, and when we have the information, we will again add it to the agenda. Action - Mc I I i; Item No. 15 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO AWARD A CONTRACT FOR MOTOR VEHICLE TOWING AND STORAGE SERVICES TO GORDON RUSSELL �,s % ENTERPRISES d/b/a RUSSELL'S TOWING SERVICE. Comment: Proposals were received on September 2, 1982, for a two-year contract for towing and storage of abandoned/impounded vehicles. An award is recommended to Russell's Towing based on their bid meeting all the requirements of the specifications. Action - Item No. 16 - CONSIDER AN ORDINANCE DELETING THE REFERENCES TO KIOSKS AND PERMANENT, PRIVATELY -OWNED, FREE-STANDING STRUCTURES IN CHAPTER 9.1 OF THE CODE OF ORDINANCES OF IOWA CITY PROVIDING FOR THE REGULATION OF PUBLIC AND PRIVATE USE OF CITY PLAZA. (second consideration) Comment: This proposed ordinance will delete all references to kiosks and permanent, privately -owned, free-standing structures in the City Plaza ordinance. These uses are presently permitted in Zone 2 of the City Plaza. A hearing on this proposed ordinance was held September 28, 1982, and no comments were received. The first consideration to this ordinance was also given on September 28, 1982.
