Enclosed is a letter that I have sent to Hawkeye Cablevision
on this date. Since the City Council is involved with Hawkeye
Cablevision in some trays, I thought that I should give you a copy
of the letter, since it is a complaint about them..

PS. Since this letter was written, the Muller Plumbing Co. and
City water personell were there, and they believe they can piece in
another pipe, so it will possibly not be as big of an expense as first
was given in the estimate..That is why the letter has an area that has
been deleted....

I'm sorry that I have to write this letter of dis-satisfaction,
but I believe I can save someone else some grief by doing so.
On Tuesday January 6th, my mother had cablevision installed as
a Christmas gift from me. The picture quality is really good, and
the speed with which they installed it was good. After the men
left the residence at 521 N. Van Buren Street,and after I went
back to my residence, my mother went down to the basement and
found that the men twisted the water pipe somewhat in putting
on the ground wire, and caused a major leak on the side of the
water meter that leads out of the houaa_ if�fitxarihsiFdEiFsyraf�c:Y

may have lasted a long time,
had it not been disturbed, by messing with the water that
pipes
were old. It is not a very good Christmas present, especially
since she is 74 years old and on a fixed income. Please instruct
your installers to
use ground rods outside when installing in
older houses, so that they avoid this type of happening.
While I'm complaining, I might as well tell you that I am very
upset with losing the 24 hour
entertainment channel 24 to something
like you replaced it with. Bva explained it to
me, but I sure hope
you give us something better than that. Also I hope that
you give
us the color Radar that you said we were getting. The radar that we
are now getting, is not 'worth
much. It has so much writing on the
screen that the weather service puts on there, that it is
hard to
read, besides being inacurate, As an example, since we are being
given a picture that changed every minute or so, rather than something
direct off of the radar
screen,a few weeks ago when we had a large
area of rain come over from here to Des Moines, the
same picture
was on the screen for over a week, leading a person to believe
that it
was staying the same, when in fact the weather bureau told
us the

on audio that there was no precipitation anywhere in the
State. Please
advise me of the possible solutions to these things
mentioned if any. A copy of this is also being sent to the
City
Council, so that they too are aware of these things,

Dear Mayor Balmer:
An opinion poll was conducted at the meeting of the American Asso-
ciation of Retired Persons held on January 5, 1981.
The question was: "Do you approve or disapprove of the City using
the top floor of the Senior Citizens Center for offices for City
employees?" Approve - Disapprove - Ido opinion -.

fifty-five out of the 68 members present responded. The results
were as follows:
6 or 10% approve
46 or 82s disapprove
3 or 5% no opinion
The next question was: "Give reasons for your answer."
Examples of responses from those who approved:
"City has provided funds for Sonior Citizens Center so we should
cooperate.
"We are part of the city so we should cooperate."
"Advantageous to both parties."
Most senior citizens should not use stairway."
Examples of responses from those who disapproved: (order of
frequency of response)
1. Building is supposedly for use by senior citizens - funds were

2. There will be too much traffic.
3. It might become permanent.
4. Senior citizens need space with daylight.
5. Need room to de velop and expand activities. The numbers of
senior citizens are increasing rapidly and they may need tiic space
before "3-5 years".
6. According to standard set by National Organizations for Senior
Centersadvocate keeping the facility for-0n1;r one purpose.
7. It will alter the atmosphere.
8. It should be more than just a place to eat.
9. Several members suggested that the city employees use -the
basement.

The next question was: "What suggestions do you have for the use
of this area?"
1. Use it for meetings, education classes, etc.
2. Reading rooms, music room, craft, recreation, art, language
classes, business affairs,'such as Taxaid.
3. A place to relax, a place to rest while docmtoim shopping.
4. Defer decision until it can be determined whether it is needed.
5. Allow for expansion - put in heat, cooling system, safe floors,
etc., then give the senior citizens a chance to demonstrate their
initiative, imagination, creativity.
Another observation, "douldn't it be more of a tribute to the city
and a demonstration of greater appreciation by the senior citizens if
the facility were used to its full potential instead of thanking you
through use of offices by city employees?"
Many of these answers indicate that there is a dearth of information
about the Senior Citizens Center in this community.

Re: Parking on Village Road
As directed by Section 23-16 of the Municipal Code of Iowa City, this
is to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the
City Traffic. Engineer will direct that signs be installed on both
sides of Village Road from the southwestern terminus of Village Road
to the northeastern terminus of Village Road. This action will be
taken on or shortly after 14 January, 1981.
COMMENT:
Village Road has been designed as a loop collector for the
neighborhood being developed in this quadrant of the City. It is the
Intent of the overall plan for this area that Village Road serve as a
collector for short residential streets which tie to it. Now that
single family and multiple family dwellings are being developed in
this area, it is an appropriate time to sign the intended
prohibition.

Re: Small Cities Grantee Performance Report
Attached is the Grantee Performance Report (GPR) for the first year of the
Small Cities/Lower Ralston Creek Neighborhood Project. The funding
allocation for the first year of this project was $530,000.
HUD regulations require a Public Hearing for citizen comments on both
project performance and progress on the Housing Assistance Plan (HAP).
CCN has already reviewed the GPR and recommended its acceptance for
forwarding to HUD. The Housing Commission has reviewed the HAP
performance portion of the plan.

STATUTORY NATIONAL OBJECTIVES
1. Elimination of Slums and Bliaht and Prevention of Blighting Influences
Nine parcels of land were acquired during the program year, including three
with dwellings in a deteriorated condition. These dwellings have been
demolished and the land cleared, thus removing blight and slum conditions.
One acquired parcel of land was used as a storage lot for old cars, auto
parts and junk. This parcel has also been cleared thus removing blighting
influences.
2. Elimination of Conditions Detrimental to Health, Safety and Public Welfare

" Nine homeowner and tenant households have been relocated from dwellings in
the Ralston Creek floodway and floodplain. These dwellings were subject to
� periodic flooding from the creek. All these households have relocated to
ti decent, safe and sanitary housing out of the floodplain. In addition, one
homeowner moved from a dwelling lacking bathroom facilities, hot water,
Iw proper windows and flooring and with many other health and safety hazards,
to a house which meets the standards of the City's Housing Code.
3. Conservation and Expansion of the Nations Housing Stock
Acquisition of six housing units in one portion of the revitalization area,
will permit the eventual construction of up to ten units of Public Housing
(' in this area. Construction of these units will occur after creek
1i improvements are complete and the area is no longer in the floodplain.

In addition, creek improvements (made possible by acquisition and
clearance of the land) will result in a considerable contraction of the
floodplain. As a result a number of dwellings in the project area, not
previously eligible for rehabilitation, because they were in the
floodplain, can be upgraded and conserved through technical and financial
assistance to the homeowners.

Objective 1:

To acquire 21 complete parcels and small portions of four additional
parcels along the west bank of Ralston Creek, between Harrison Street and
Kirkwood Avenue, in order to facilitate Ralston Creek channel improve-
ments, remove deteriorated structures, and allow for the assembly of
parcels for resale for land consumptive commercial reuse.

to Meet HAP Goals.

An effort was made during the last year to identify units suitable for substan-
tial rehabilitation. The most successful method of identifying these units was
developed as an offshoot of the City's emergency grant and winterization program.
During the operation of this program, units were pinpointed as being suitable

for rehabilitation, and the owners educated as to what this would entail. Later,
actual determination of eligibility was rode.

One homeowner from the project area, whose property was acquired, relocated to
a home which was in need of substantial rehabilitation. The home was rehabili-
tated using CDBG relocation benefits. The City staff will continue to watch
for similar opportunities.
c.
As part of the Small Cities Program for the Lower Ralston Creek Neighborhood,
the City of Iowa City will be acquiring a site for the development of now
rental units for our AssisUd Housing Program. It is hoped that development
of these units can take place during FY82.
d.
At this time, 5 sites for 32 units have been located and received final approval
from HUD for scattered site public housing. The developer's packet was bid dur-
ing March, 1980 and hes received preliminary approval. The proposal was sub-
mitted by Southgate Development Company of laws City and was for the develop-

ment of 32 units. Efforts will be made to reformulate and change to acquisi-
tion of existing public housing units,

A meeting was hold 1n December 1979 with ares developers to determine if any

interest existed for the Section 235 .(revised) Hoeownenhip Subsidy Program.
Fifteen developers attended the meeting, and a number of them expressed inter-
est in becoming involved in the program. A desire was also expressed to hold

another meeting with an official from HUD present to explain the program in

more detail at soma tine in the future.

There is a problem with availability of sites that meet both local and HUD
requirements. in addition site acquisition and site preparation costs have
been higher than Public Housing can support• Serious consideration wilt be
given to the use of CDBG funds to write down acquisition costs.

We feel that the HUD Omaha EMID Office is somewhat unrealistic in establish-
ing fair market rent increases for this community with its large student
renter population and extremely low vacancy rate.

2. SPECIAL ACTIVITIES TO SERVE MINORITY RESIDENTS:
The Small Cities Program addresses flooding and incompatible land use
along the Lower Ralston Creek Watershed. Since the majority of the
residents in this area are low and moderate income, improvements in
this area will benefit these individuals. These residents will be able to
maintain decent, safe, and sanitary housing after improvements are com-
pleted. Improvements in this area will substantially upgrade the en-
vironment. One minority household was relocated from the project area.

3. STUDIES UNDERTAKEN:
As part of the Small Cities Program a policy was established to involve
minority business enterprises in the program. A 6.2% NBE goal was created

for all contracts conducted in this program. Approximately 6.2% of all
contract work is expected to go to minority firms. This ratio exceeds
the actual minority population in Iowa City.
A special Small Cities Newsletter was created to involve all residents

in the Small Cities Program. The Newsletter serves as an informational

tool to notify all residents of project progress and planned activities.

1. By executing the Certificate of Assurance for Title Vill of the
Civil Rights Act of 1968, the recipient has agreed to administer
its programs relating to housing and urban development in.a man-
ner to difirmatively further fair housing. (Activities under

During the first program year the project included only one
contract. This contract was for rehabilitation of a home to
which a displaced family was relocating. The bid package sent
to contractors spells out the Section 3 regulations and con-
tractors are required to show compliance with these regulations.
A local contractor was hired for the rehabilitation project, she,
in turn, used local subcontractors, and all employees on the job
were Iowa City residents.
2.c On the rehabilitation contract totalling $6,814, all materials
were bought from local businesses and all labor costs were
paid to local residents.

Dear Mr. & Mrs. Hicks:
At its regular meeting of August 26, 1980, the City Council received
and placed on file your letter regarding the sewer encasement across
Ralston Creek just east of Evans Street Bridge. This concrete
encasement is the sanitary sewer service for your residence. All
installation, replacement, and repair costs for sanitary sewer
services are the responsibility of the property owner. With this in
mind, information was gathered as to the feasibility of lowering the
service below the creek bed or moving the service to another i
location.
It was found that the creek bed is two feet below the sewer line into
which your service ties. Therefore, it is impossible to lower the
service below the creek bed. The only other alternative would be to
install a small residence pump station and pump the sewage into the i
sanitary sewer on Woodlawn. Thi's cost would be in the neighborhood
of $3,000 to $5,000 and could be looked into further if you want to
proceed on this course of action.

One of the concerns of the Committee has been the need to re-
locate very elderly residents in the project area. The Committee

recommended that Staff and City Council consider the possibility

of life estates for two elderly residents.

The Committee also questioned the need to acquire property not
actually essential for creek improvements, and requested the
Staff to look into this matter.
CCN members were adamant in their recommendation to City Council
that the Lower Ralston Creek project be completed before any new
f,DBO projects were started. This was in response to Council's

suggmstions to fund a Housing Code Enforcement program.

Another concern of the Committee was the fact that a property
owner (a realLor) in the project area was making considerable
i
improvements on his very dilapidated and vacant property, with
the expressed purpose of raising the property value prior to
a
purchase by the City. The Committee felt that although such
q
action was apparently legal, it resulted in an unnecessary in-
crease in expenditure of funds for acquisition. They felt such
funds could more appropriately be used to benefit low and moder-
ate income persons.

The majority of comments and concerns expressed by citizens address
valid issues. Staff responds to letters and requests promptly either

in writing or at meetings.
In response to some of CCN's specific concerns, Staff and City Council

Citizens of Iowa City are effectively involved in both planning and
programming of CDBG projects, as well as monitoring and amending

specific projects.

The Committee on Community Needs (CCN) made up of eleven Iowa City
residents representing a broad cross section of the community, was
'
appointed by the City Council to gather citizen comments about
ongoing and proposed community development programs, and to make
recommendations to the Council about these programs. Over the past
five years the Committee has been active and effective. It is note-
worthy that the City Council accepts CCN's recommendations on CDRG
funding with relatively few changes.

CCN holds regular monthly meetings, monitors the performance of
projects and makes recommendations on changes or investigations

into delays to the City Council and city staff. Some CCN members
are also members of the Ralston Creek Coordinating Committee and
pass on input from residents living in the creek watershed.
Radio talk shows about the ongoing CDBG prcgrams, news releases,

newspaper ads, and individual letters to residents have been
effective in informing citizens and alerting them to public and

neighborhood meetings. Turnout at neighborhood meetings has de-
creased during the year as residents have become familiar with

the program or been relocated. Overall, citizens participate
quite actively in all phases of CDBG programs, and many donate

numerous hours of their time. Citizen participation in Iowa City

SUMMARY OF MEETING
Swisher introduced Michael Flaherty, coordinator for the Lower Ralston
Creek Neighborhood Program. Flaherty presented slides and commentary
showing the flooding problems of the area, and the properties to be
acquired and creek improvements to be made.
Flaherty also presented the proposed budget for the second year of this
three year project, explaining that HUD had approved the project as a
whole, but application for funds needed to be made each program year.
The second year budget application involves the following requests:

Demolition 75,000
Creek Improvements 232,000
Administration 90 000
Total 775,000
A brief discussion following the slide show centered on the progress of
appraisals of properties in Phase I of the program, and the possibility of
life estates for elderly residents," °property not needed for creek

ability of out-of-town appraisers to accurately assess the Iowa City
housing market. Flaherty explained that there were no certified
appraisers in Iowa City, and the Des Moines firm carrying out the

A neighborhood meeting for the Lower Ralston Creek/Small Cities
neighborhood was held on Thursday, March 13, 1980 at 7:30 p.m. in
the National Guard Armory.

Jim Hencin opened the meeting with a brief explanation of the Small
Cities project and a summary of the agenda for the meeting.
Bruce Knight presented a program report on the first year budget,
comparing the amounts budgeted to the amounts committed as of
March, 1980. He also briefly summarized the progress to date of
Phase 1 acquisition and relocation activities.
Susan Sandro gave a summary of the acquisition schedule for Phase
I1 which will be delayed roughly 2 weeks from the original schedule
published in the fall. She also indicated approximate dates for
Phase II relocation activities.
Marianne Milkman presented details of the Application for Second Year
Funds including the purpose of the application, how it fits in to the
overall Small Cities project and what the breakdown of funds will be.
Jim Hencin closed the meeting with a description of how the Small
Cities project fits in with overall plans for Ralston Creek flood
control.

Jim Hencin introduced staff and CCN members. He briefly explained the use
of the first and second year grant monies for the Lower Ralston Creek
project and detailed the amounts spent on various activities.
Status of Acquisition and Relocation
Marianne Milkman briefly gave an update on Phase I acquisition, stating
that six properties had been acquired and two were still under
negotiation. Appraisals have been carried out for Phase II acquisition,
and review appraisals are now underway. She stated that relocation had
been going well and that homeowners who had moved to new homes appeared to
be happy with their relocation. Milkman also stated that there had been
some problems in relocating businesses because of the difficulty of
finding storage and warehouse space.
Third Year Application for Funds
Bruce Knight explained the request for $770,000 funding under the Metro
Entitlement Program for the third year of the project. He detailed the
improvements to be made on Ralston Creek and pointed out their locations
on a large scale map. He also explained the cost breakdown for the
individual improvements (see attached chart).

bank but that they did not know at this time how much fill there would be,
and details would not be known until the final designs and specifications
were drawn up. Croker also inquired whether all Phase III properties

would definitely be bought. He was informed that this would be the case.

Kavanaugh asked whether the work in this portion of Ralston Creek would
help the flooding problems upstream. Hencin said yes it would have some
effect upstream since there would be a greater capacity downstream for the

water to run off. Kavanaugh also inquired whether there would be a public
housing site at Harrison and Linn Street and whether this would be a
privately owned development. Hencin said that it probably would be
I privately owned and would indeed be low income housing.

Hencin explained that some of the areas currently in the floodplain will
no longer be flood prone once the creek improvements are made. In this
way a number of houses will be eligible for rehabilitation because they

are no longer in the floodplain.

Croker asked whether a parkway or recreation area would be created along
the creek. Milkman stated that there would be a berm or dike built along

the creek with some open space but at this time she did not know how much.
Kavanaugh asked whether more money for this type of project would be

available. Knight explained that such monies should be available and that

we would be working to identify other strategy areas for future•
improvements.

Collins asked whether the acquired land that would be disposed of in the

future would be zoned commercial. Knight answered that it would be
commercial south of the Rock Island Railroad tracks and would remain mixed
residential commercial north of the tracks. Hencin explained that land

remaining after the creek improvements were made would be for resale for
commercial use.

Hall explained to the residents present that the south branch Ralston
Creek dam was now under construction and encouraged them to take a look at
it.
Hencin noted that there was a CCN meeting to discuss this third year
application on Wednesday, August 6, 1980 at 12:00 noon at the Recreation
Center and Hall invited all those present to come to the meeting and to

ON A PROPOSED CONVEYANCE OF REAL PROPERTY
RESOLUTION NO. 80-534
RESOLUTION SETTING PUBLIC HEARING ON A PROPOSED
CONVEYANCE OF REAL PROPERTY OWNED BY THE CITY OF
IOWA CITY (A PORTION OF VACATED SAND LAKE DRIVE).
WHEREAS, the City Council of the City of Iowa City
has adopted Ordinance No. 80-2990 on March 18, 1980
vacating Sand Lake Drive; and
WHEREAS, the City Council proposes to convey to
Dave Clark and Dave Cahill, dba C&C Investments,
the south 157.70 feet of vacated Sand Lake Drive;
and
WHEREAS, the proposed conveyance will be subject to
the following terms:
1. The City will be relieved of the obligation to
construct two driveways across the vacated
Sand Lake Drive to provide access from the
property owned by C&C Investments to the new
South Gilbert Street.
2. C&C Investments shall accept only one point of
access onto the new South Gilbert Street and
shall assume the obligation to construct one
driveway across the vacated Sand Lake Drive.
3. The City shall retain a utility easement over
all but the east 15 feet of the property to be
conveyed; and
WHEREAS, it is necessary to publish this proposal
and to publish notice of a public hearing on this
proposal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF IOWA CITY:
1. That the City proposes to convey the above-
described real property to Dave Clark and Dave
Cahill, dba C&C Investments, subject to the
terms described above.
2. That the City Clerk is authorized and directed
to publish notice of this proposal and
further, can publish notice that pursuant to
Section 364.7, 1979 Code of Iowa, a hearing
will be held before the City Council on the
proposed disposition on the above-described
property at the Council Chambers, Civic
Center, 410 East Washington Street, Iowa City,
Iowa, at 7:30 P.M. on the 13th day of January,
1981, and any persons having objections to

has made application for such Certificate, and,

#1. Human Rights advocacy including employment, housing, credit,

part of my law practise. I have appeared numerous times in the
State and Federal Courts and in front of many administrative agencies
litigating civil rights issues.
This experience has required a working knowledge of State,
Federal and municipal civil rights law. Also, my work, experience has
required that I develop an ability to analyze fact situations
in light of the applicable laws. In the course of this work I have
developed a strong interest in the field of advocacy of human rights.
N2 As an Iowan and a 12 year resident of Iowa City, I have had
an opportunity both as a student and later in my professional
life to observe and participate in the major human rights issues
which have faced this State and this City. I feel this experience
will allow me to be accessible to many diverse groups in the
community and I believe through my past participation in human rights
issues I have established my credibility and fairness with
many diverse groups in resolution of disputes.
