Councilpersons:
There is a tract of ground located on the north side
of Iowa City measuring 60 feet in width and 1311 feet in length.
I This parcel shows up on all city maps as "Virginia Drive".
Two city streets, Buresh Street and Oaklawn Avenue, tie into
Virginia Drive from the south.
Quite some time ago Condowa, Inc. purchased 15 acres
on the north side of this:"Virginia Drive" from John Conway.
There are 4 existing homes on the south side. The City has
{ never made use of "Virginia Drive" to any extent. Among other
things, the south 30 feet of "Virginia Drive" is used as access
to a garage off oaklawn, access to a backyard used for parking
of a camper and boat storage, and use as a garden. The north
30 feet of "Virginia Drive" has always been fenced off and is
i a part of the 15 acres purchased by Condowa from John Conway.
Iowa -Illinois Gas & Electric electric transmission poles and
lines :•un along the fence line right down the center line of
this tract.
In 1976 Condowa, Inc. asked the City if they wished
to have "Virginia Drive" used as a street or if the City preferred
to have Buresh and oaklawn extended to the north and connected
to Foster Road. The decision was made by the City to vacate
Virginia Drive from oaklawn east to Prairie du Chien Road and
have Condowa do a subdivision that would extend the two streets
to the north and create the first portion of Foster Road.
At that time, Condowa could have built two houses on
its 15 acre tract. All facilities existed for construction
including sewer, water, street and electric. Condowa could
have blocked Buresh Street from ever being extended to the north,

but instead went along with the City's request for expansion.
At the time of vacation, the City staff indicated
that they would dispose of the property to the adjoining property
owners according to law. Now we know that there is no way that
a property owner who now uses the street for access to his back-
yard and his garage is going to pay for a piece of ground that
he can use freely without paying property taxes and with the
advantage of having the City responsible for maintenance. At
the same time, we also know that theproperty owner might be
swayed to accept the property as a gift.
It is now 1981. The City staff has shuffled the paper
work on the vacation and subsequent disposition of "Virginia
Drive" for 5 years. Condowa has been forced to hire legal
counsel to get the matter settled. It is about time that the
Council takes over and directs the staff to stop playing
Monopoly with "Virginia Drive" and roll the dice and move on
to Foster Road -- if they can find it.
I would ask the Council to take a personal interest
in getting this matter resolved so that the Council, staff and
I can all go back to work on something productive.

Re: Status Report on Virginia Drive ((((
This memorandum is in response to your request for a report on the
background and current status of the vacated portion of Virginia Drive
(lying between Oaklawn Avenue and Prairie du Chien Road).
As best as I can determine, the background concerning Virginia Drive is as
follows: By an application dated March 14, 1977, Condowa, Inc. formally
requested that the City vacate the north 25 feet of Virginia Drive for a
distance of 1,085.79 feet (lying contiguous with Lot 30 of Conway's
Subdivision). It was the developer's intent to obtain this vacated right-
of-way in order to allow for the development of saleable lots in a
proposed re -subdivision of Lot 30, Conway's Subdivision. In a Staff
Report dated April 21, 1977, the staff recommended vacation of the entire
60 foot right-of-way running from Oaklawn Avenue to Prairie du Chien Road,
subject to the City retaining a 10 foot wide strip at the very center of
the right-of-way for use as a pedestrian walkway. On July 12, 1977, the
City Council adopted Ordinance No. 77-2847, vacating "part of" the 60 foot
wide right-of-way of Virginia Drive. Other than an appraisal of the
vacated right of way in March, 1978, there seems to have been little if
any activity on this matter from mid -1977 to mid -1979. On July 20, 1979,
Condowa submitted a letter to the City requesting reimbursement of
$2,464.70 for the costs it incurred in paving Buresh Avenue at its
intersection with Virginia Drive.
During mid -1979, I was assigned responsibility for the disposition of
Virginia Drive. I had several conversations with other City staffinembers
and with Mr. Bruce Glasgow concerning this file. The staff developed a
proposal calling for division of the vacated portion of Virginia Drive
into seven separate parcels, with each of these parcels to be offered for
sale to adjacent property owners, including Condowa. Based on the earlier
appraisal and additional staff research, estimated sale prices were
established for each of these seven parcels. In Fall, 1979, prior to
contacting the adjacent property owners to discuss the proposed sale
prices as a preface to scheduling formal City Council action, work on the
disposition came to a halt. This occurred because part of the vacated
right-of-way was being considered at that time for public housing sites,
and because of turnover which reduced the staff of the Development
Division from three people to one.
Work on this matter resumed in August, 1980, when staff had discussions
with Mr. John Cruise, attorney for Condowa, Inc. At this time, staff
conveyed to Mr. Cruise the estimated sale prices which had been
established for parcels of right-of-way adjacent to Condowa's property.
Mr. Cruise indicated he would discuss these estimated prices with his

client. Also at this time, Mr. Cruise asserted a legal claim on behalf of
his client for title by adverse possession to portions of the vacated
right-uf-way, In November, 1980, Mr. Cruise conveyed this claim in a
letter to John Hayek. In a letter to Mr. Cruise dated December 2, 1980,
Roger Schoiten again responded in the negative to Condowa's claim of title
I through adverse possession, indicating to Mr. Cruise that the City does
have ownership of the vacated right-of-way.
The City can now attempt to move ahead with disposition of the vacated
right-of-way. I recommend that the City proceed as follows:

I. If necessary, the City Council should re-enact the actual vacation
ordinance in order to clarify what portion of the Virginia Drive
right-of-way is to be retained for a pedestrian walkway.
2. Concurrently, staff should formally contact Condowa, Inc. and other '
adjacent property owners in order to determine proposed terms for the
conveyance of vacated right-of-way to those property owners
interested in acquiring ownership from the City.
3. Once the proposed terms for conveyance are determined for the I
interested property owners, a sale proposal resolution (listing the

Dear Mr. Balmer I,, Council Members:
mu behalf of the ,Johnson County Association for Retarded Citizens, I
would like to take this opportunity to express our appreciation and
support for the Mayors Youth Employment Program. With vocational train-
ing and wort: experience as a priority for the persons we serve, the ser-
vices of Jack Robinson, Director, have been invaluable to us.
Jack has been a valuable resource in a number of ways. He has assisted
us in setting appropriate goals, providing public commentary for communi-
ty awareness, and as a resource person in and out of the classroom. He
has also placed a number of mentally retarded persons in appropriate
job settings.
Until such time as the community is fully aware of the employment poten-
tial of retarded persons, we feel it is imperative that agencies such as
Mayors Youth Employment Program continue providing job opportunities to
this community.
We commend both the program and its Director,

Dear Mayor Balmer and City Council Members,
I am writing this letter in support of the Mayor's Youth
Opportunity Program here in Iowa City. My classroom serves
Jr. and Sr. high students who are emotionally disabled. These
Iowa City students come to the Behavioral Learning Cemter from
residential programs, such as Eldora and Fort Dodge, or they
come from Iowa City schools where they have displayed behavioral
or emotional problems which cannot be maintained in the public
school.
For this type of student school is not of " primary con-
cern"; they will, however, frequently desire parttime employ-
ment. But past failure at a job, trouble with the law and poor
work attitudes do not encourage employers to " try again "

F with these troubled youth.The MYOP has given this type of stu-
dent a " second chance ". A student's interests and character-
istics are matched appropriately with the job requirements and
the personality of the pupervisor. And, because of the MYOP
requirement that the student be enrolled in school, I find that
k these students are more motivated to complete classwork. I have
also noted an improvement in the students self concept; others
see him as being-vorthwhile and this encourages him to feel the

same aay about himself.
MYOP has succeeded in obtaining parttime jobs for my students
and, more importantly, in learning responsible, mature behaviors
which are socially acceptable. I hope that MYOP will continue to

I am writing in reference to the Mayor's Youth Program, and more specifically,
its relationship to the Vocational Education Program here at the University
Hospital. This program has been an instrumental part of the Vocational Edu-
cation Program, and I would like to share with you some specific information
concerning this relationship.
The Mayor's Youth Program and the University Hospital Vocational Education Pro-
gram began joint efforts in January of 1980. Since that date, a total of nine
job sites has been funded by Mayor's Youth Program. These job sites have allow-
ed us to give trainable mentally handicapped students an opportunity to explore
the world of work within the Iowa City community. You may be aware that the
concept of job exploration is unique in the Iowa City area, even for individuals
of much higher functioning levels. Were it not for the Mayor's Youth Program,
I would assume that the entire concept of job exploration within University
Hospital School would be reserved only for one or two students, and would not,.:
be available in a consistent manner, as it has been through the..Mayor's Youth
Program.
As a direct result of job exploration, we anticipate at this time three students
will leave the University Hospital School program for competitive employment.
I feel it is fair to say that the availability of exploration through the
Mayor's Youth Program'will be directly responsible for reaching this goal. I
am sure you are aware of the potential cost to society of continuing any individ-
ual on welfare that would be required without the result of competitive employ-
ment. In addition to the direct results specified above, it was the Mayor's
Youth Program that allowed us to institute the programming and to maintain a
consistent service for our students here at University Hospital School. It was
the commitment that the Mayor's Youth Program was willing to make to our pro-
gram and the on-going cooperation and direct support of the Mayor's Youth Pro-
gram and Jack Robinson that have allowed us to provide a progressive job explora-
ation program. Three of the core job sites that we have repeatedly used since
January, 1980 were developed directly by Jack Robinson. His excellent rapport

with community employers and the excellent reputation that he has maintained
within the vocational community of Iowa City have helped us throughout the
development of our program.
I realize that the task which faces you and the Iowa City Council is monumental,
considering the continued need for programs, along with our rapidly disappearing
dollars to fund them. I would ask that you consider not only the present cost
of programs such as the Mayor's Youth Program but also that the long-term bene-
fit, including dollar savings, resulting in vocationally competent individuals
entering competitive employment as opposed to continuing on welfare rolls, will
bring about. I appreciate this opportunity to provide input into the Iowa City
Council and its deliberations.

The Mayor's Youth Program has been extremely supportive and helpful in
this year's implementation of the special education/work study program
at West High School. The goal of the vocational component of the West
High program is to develop student vocational competencies so the handi-
capped individual can function independently in the world of work. This
vocational independence is of primary -importance if the student is to
become truly independent and self-sufficient.
With Mayor's Youth help and funding, Mr. Robinson and I have jointly
placed several secondary students in jobs to develop saleable job skills,
communication skills, maturity, and a better understanding of career
options open to him/her. The wage paid to the student through the Mayor's
Youth Program allows the student the self-respect and self-reliance of
earning his/her own money and gives the individual the opportunity to
develop money -handling skills.
The Mayor's Youth Program's concern for the handicapped population of our
area helps show the city's continuing commitment to the special population
of Iowa City.

We understand that you will soon be giving consideration to the re -funding of the
Mayor's Youth Employment Program.
We urge that you continue your support of this fine program.
Several youngsters from families served by our agency have been able to profit from
inclusion in the program during the past year. For example, a young girl with severe
problems of low self-esteem was helped to find ways to earn successful experience
through her job experience with the program. A boy with learning difficulties was
given careful on the job guidance and instruction in work attitudes and behaviors
which will contribute to his later life success.
The Mayor's Youth Employment Program has repeatedly proven a necessary and helpful
assist to youngsters whose opportunities would otherwise be limited. We urge your
refunding of the program.

ANALYSIS
Procter and Gamble Manufacturing Company wishes to occupy a metal building
constructed pursuant to Chapter 27, Section 45 regarding temporary buildings.
Temporary buildings are exempt from the provisions of Chapter 27 (Large Scale
Non-residential Development Plans) and are allowed for a period of up to two
years with occupancy or use limited to services performed temporarily for the
owner, such as construction. Temporary buildings cannot be occupied by the
owner's personnel, or used to conduct the owner's business or activity. Procter
and Gamble Manufacturing Company now wishes to utilize the building, therefore,
it is necessary to file a preliminary and final Large Scale Non-residential
Development Plan for the site. The intended use of the building is for storage.
RECOMMENDATIONS

The staff recommends that the consideration of the preliminary and final Large
Scale Non-residential Development plan be deferred. Upon revision of the plan
correcting the deficiencies and discrepancies noted below, it is the staff's
recommendation that the preliminary and final Large Scale Non-residential
Development plan be approved.
