Iowa 52240 Office Phone (319) 354.1800 Ext. 357 A CITY MUNICIPAL AIRPORT COMMISSION ---SPECIAL MEETING ,innUARY 29, 1981 MEMBERS PRESENT: DIETERLE, PHIPPS, REDICK, SAUEGLING, GEORGE STAFF PRESENT: ZEHR, BROWN GUESTS PRESENT: THOMAS(DI), SIEFFERT(PRESS CITIZEN), LYNCH, ABBOUD(KXIC) The lease for the corporate hangar with the U of I Air -Care was presented in two forms(one with fueling provisions and one without). After discussing the advantages and disadvantages of the two leases it was moved by Redick (in form of a resolution) and seconded by George, tint the Commission offer the Air -Care the Lease without the fuel farm provisions. All voted aye. The minimum operating standards in the lease with the Iowa City Flying service was discussed, and the possibility of seeking a Declaratory Judgement of the leases was discussed. That point will be discussed in greater depth at a special meeting February 5, 1981, in the city manager's conference room at 8:00 A.M. The meeting was adjourned at 9:00 A.M. Meeting was called to order by Chairperson Klaus at 3:30 p.m. II. Minutes of the Meeting of December 3, 1980 were approved 7/0 on a motion by Haendel, seconded by Dennis. III. Coordinator's Report - Seydel Section 8 - Seydel reported that due to poor performance on the HAP (Housing i Assistance Plan), he would be alluding to the HAP Performance Report through- out his report. He reported rents paid on 373 units for a total of $59,757.00 on January 1 and that an additional 5 starts were anticipated. He recommended 32 new applications for approval. He reported that failure to produce the an- ticipated number of units in the Section 8 Existing Program was due to no new f units allocated for this area. Ile further advised that the request for an additional increase in FMR (Fair Market Rent) will not be granted except for that portion pertaining to mobile home rents. Commissioners were advised that the NNIRO letter relative to Eviction Procedures has already been sent 6 to all the Congressmen from Iowa, and that the City Manager is writing to i the local legislators soliciting their support. The recommendation to up- date the policy statement relative to non-irmnigrant student aliens was approved with a recommendation that the Human Rights Commission be apprised of, the change. y Discussion Small Multifamily Rental Property Rehabilitation Demonstration Pro- gram - Application not due until March 6. Commission advised to review mater- ial for discussion at February meeting,. I Public Housing - Seydel reported on the new procedure for applying for public housing wherein an application can be submitted at any time for either new, rehab or existing, and when funds become available, the applicant will be requested to submit a detailed application at that time. Milkman announced that the Public Hearing on the (IAP Performance Report would be held on Tuesday, January 13th at the Council Meeting. IV. Dissolution on Task Force on revision of Housing Code - moved by Haendel, seconded by Dennis, that task force be dissolved. Approved 7/0. V. (lousing Inspections - Fee Schedule - Steinbach reviewed new fee schedule and advised previous schedule was not added to Council Agenda. He indicated that he anticipated the cost of inspections and fees generated per schedule would be equal. Ile further indicated that he believes the current level of staffing will not meet the minimum requirements of the Code, but that every- thing is on hold until budget time. Legal Staff - Klaus explained the rationale for requesting one nttomey he nssignod to work with (lousing Commlission/(lousing Board of Appeals, and in- troduced David Brown as the attorney assigned to work with the Commission. David Brown announced that he is looking forward to working with the Commis- sion, and that he will be happy to work with the members either individually or collectively. Klaus expressed concern that workshops are needed for both the Housing Com- mission and the Housing Board of Appeals. Dennis indicated she felt a con- cern that roles be defined. Brown asked if there were specific areas of concern that should be addressed in the workshops. One concern cited was "variances". Steinbach indicated he felt "right of entry" should be ad- dressed. It was the consensus of the members that the first workshop be scheduled on Wednesday, February 11 at 3:30 p.m. for an orientation on the new housing code and the role of the Housing Board of Appeals. i VII. CCN - Vander Zee i Vander Zee reported that $793,000 will be made available in entitlement funds 1 and indicated that he sees this as a crucial period of cooperation between CCN and the Housing Commission since HND wants us to use the money for housing. CIVIC CENTER CONFERENCE ROOM i MEMBERS PRESENT: Gartland, Hamilton, Hotka, Sheehan. MEMBERS ABSENT: Fett, Sanders, Schwab. STAFF PRESENT: Schmeiser, Tinklenberg. I RECOMMENDATIONS TO THE CITY COUNCIL: None. REQUESTS TO THE CITY MANAGER: None. SUMMARY OF DISCUSSION AND FORMAL ACTIONS TAKEN: Hotka called the meeting to order. Hamilton moved, Gartland seconded, to approve the minutes of the December 9, 1980 meeting as read. Approved unanimously. Energy Directory No further work was done because John Brown's internship ended mid- December. Other Business Hotka reminded the Commissioners that the election of officers will be held in February and stated his wish to see someone else be Chairperson. Proposed Zoning Ordinance, Don Schmeiser Don .reviewed the status of the proposed Zoning Ordinance. The Ordinance has been under preparation for over two years and is now undergoing Legal staff review at this time. It will be several months before the Ordinance goes back to the Planning and Zoning Commission for final action prior to sending to the City Council for adoption. Don then reviewed the recommendations, made in a November 10, 1980, memo from John Brown, with the RCC. 1. Allow variances in building and setback lines, side yard and rear yard requirements. It would be better to use the phrase "special exceptions" in place of variances. Don pointed out that there is a provision allowing any mechanical or electrical appurtenances required to operate and maintain the building to be located in any yard. So in the case of a solar collector it would be permitted by right. Also, the solar collectors would be permitted to occupy ground area and would not be considered in the ground floor area computations. A passive solar system would not be covered by this provision, since it is a part of the usable floor area. The provisions covering the ground floor/lot area ratio and the flexible front and rear yard requirements allows a greater buildable area for more flexibility. Also, the RS -8 zone (attached single family zone) allows zero lot lines. Solar access. There is presently no requirement in the Ordinance concerning solar access. The only means available now is to acquire solar access rights by means of purchasing an easement from the neighbor. There should possibly be some provision in the Ordinance. Allow mixed use development or neighborhood shopping areas to reduce travel time. The present provision in the Ordinance establishes that a Neighborhood Commercial Zone (CN -1) must occupy four to seven acres. This appears to defeat the concept of the neighborhood sized commercial area. Don suggested that the RCC make a recommendation to the Planning and Zoning Commission concerning the size of the zone and the parking area requirements. 4. The height of structures in all residential zones except for high rise multi -family is limited to 35 feet. The exception is that a structure can exceed the limit, if for each foot of height above the maximum height there is provided an additional two feet of front, rear, and side yard requirements. Yet, for a one, two, or three story residential structure (up to the 35 i foot maximum) it is necessary to have only six feet, eight feet and ten feet of side yard, respectively. That guarantees less than one foot of bui lding-to-bui 1 ding clearance for each one foot of building height. To provide for winter solar access it is necessary to have over two feet of building -to -building clearance for each foot of building height. Given that, it certainly is not possible to guarantee solar access with a north -south street orientation. It even could be difficult on the east -west orientation. Only if the homes are of the same height and uniformly placed on the lots is solar access possible for all. I The discussion led to the posing of two questions which were unresolved. Would it be better to promote summer shading to i reduce summer electric peak use than try to provide winter solar access. Permit solar energy system additions or structural alterations, to provide for solar use, to existing buildings, structures, or uses which are presently non -conforming to the zoned area's requirements. Don said that this could be addressed with item N1. 6. Permit solar energy systems to occupy air space over required parking and access areas. A mechanical device would be permitted now. 7. Allow flexible fence set backs to decrease obstruction of solar rays except where this would be adverse to the public safety or health. This was deemed to not be a serious problem in Iowa City. The limit is that a fence within five feet of a lot line cannot exceed eight feet, if more than 10% solid. Hedges could be more of a problem. 8. Increase the required amounts of shading in parking areas. Present requirements would provide a shaded area of approximately one-fourth of the parking lot at high noon when the trees are mature. Is it feasible to provide more, physically or politically? 9. Regulate the placement of shading around buildings and streets to reduce heat gain in the summer and building heat loss in the winter. This could be enforced on a complaint basis for private property. Single family dwellings are exempt from the tree regulations. The tree regulations require trees on private property for other zones. Trees are not permitted in the right- of-ways except when a special permit is obtained from the City Forester. For solar access and street shading it would be better to have the trees in the right-of-way. 10. Designate zones strictly for solar, partial solar, or low -cal housing. Don felt this would be difficult to do; if it would even be allowed by the Iowa Code. A city must establish uniform requirements for its zones (Chapter 414, Iowa Code). The RCC must now formulate recommendations and present them in written form to the Planning and Zoning Commission and meet with them to discuss the recommendations. Other Business, continued Tinklenberg reported that the FY79 energy cost for the City was $582,134.46 and the FY80 cost was $783,990.30 or an increase of $200,000. The largest increase was for gasoline and diesel fuel where the cost went from $172,314.00 to $316,177.98 in spite of an actual decrease in the gallons of fuel used. RECOMMENDATIONS TO THE STAFF Moved by Hillman, seconded by Dean to give Swim Club pool time for two hours each weekday from May 18 until June 3, and that the staff will determine which hours will be set aside for the club. Unanimous. Moved by Phelps, seconded by Crum to recommend the following: "It is the policy of the Parks and Recreation Commission to limit to five the number of consecutive reservations made for a single shelter." Unanimous. SUMMARY OF DISCUSS1014 AND FORMAL ACTION TAKEN The Parks and Recreation Plan 1981-1985 received favorable comments from the Commission. Moved by Phelps, seconded by Robertson to approve the Parks and Recreation Plan 1981-1985. Unanimous. The Plan will 90 to the Riverfront Commission, Planning and Zoning, and the City Council before being filed with the State Conservation Commission. Phelps reported that the subcommittee on park shelter policy (Phelps, Riddle, Showalter, and Ron Osborne of St. Francis Church) had met on December 17. The committee recommended the following: "It is the policy of the Parks and Recreation Commission to limit to five the number of consecutive reservations made for a single shelter." Moved by Phelps, seconded by Crum that the Commission adopt this policy. Unanimous. Doug Boothroy of the city Planning Department discussed the proposal by Schintler Brothers to dedicate parkland in a large-scale residential development west of West High and north of Rohret Road. The storm water detention areas could be used for play equipment, and the larger open area for sports fields. After discussion, it was moved by Hillman, seconded by Crum that we accept the proposed parkland from the Hunters Run subdivision. Unanimous. A discussion was held on use of the pool by the Iowa City Swim Club. This year Lhero are abuut 150 youth involved in the club, and during the winter months they work out from 5-7 p.m. They would like to use the pool for a two hour time period weekdays the last two weeks in May, either 4-6 p.m. or 5-7 p.m. After discussion, it was moved by Hillman, seconded by Dean to give Swim Club two hours each weekday from May 18 until June 3, and that the staff will determine which hours will be set aside for the club. Unanimous. COMMITTEE REPORTS Robertson had no report on the Riverfront Commission. Wooldrik will be the liaison with Riverfront for 1981. Hillman had no report on the Ralston Creek Committee. CHAIR REPORT The budget meeting with the City Council has been rescheduled for Monday, January 26, at 4:00 p.m. DIRECTOR'S REPORT The Mercer Park building probably won't be built unless we do it ourselves. The Parks Department has been looking into construction using an interlock -type concrete block. It is hoped that the building could be started in May, and finished by mid -summer. Electricians and plumbers will have to be hired to complete the building. OTHER BUSINESS Fred Riddle expressed his appreciation to the staff for their handling of scheduling of the pool and other Recreation Center facilities. Jim pointed out that it as been very difficult attempting to find someone wi,o will qualify for Cato Title II—D for the office position. The search for an eligible person will continue and all staff will participate in covering the office. Finance Iteuort Jan Lown presented the finance report for the first quarter of our fiscal year. Jan reported that a filing cabinet was donated and that editing time had been donated to Synthesis from Dyna Productions. It was also reported that state unemployment will go up to 5% for 1981. Nina moved that the finance report be accepted. 'Al seconded. Unanimous approval. New Business — Quarterly Financial Statements Peg HeLlroy proposed that the financial reports lie presented quarterly for the first three (3) quarters of our fiscal year and then monthly for the last quarter of the fiscal year. This proposal will reduce costs involved In running on computer. Quarterly reports are required from our funding agencies, therefore, it will not be a problem. Judy Helly moved that we approve t is format for financial reporting. Seconded by Al Holleman. Unanimous approval. New ::usiness — Insurance Jim Swaim will investigate costs of insurance for further coverage for employees. New :lusiness — 11nergency foster care Jim brought up ti:e scarcity of emergency foster care shelters for young people. There is only one bed utilized for this service at the Ronald street group home. Dan Bray suggests taking young people to Cedar Ilapids, however, this involves excessive time and expense. PLANNING AND ZONING Due to some confusion re the by-laws presented some time ago, the Rules Committee wishes to inform the Planning and Zoning Commission that they are prepared to deal expeditiously with the by-laws. However, they are under the understanding that the P & Z Commission is currently revising them.
