I would like to submit the following three pages of informatiom for
your Honorable Body to consider along with the material which I filed
for your February 24 meeting.
As far back as 1978, City Manager Neal Berlin assured us that if at
any time there are any irregularities in connection with programa con-
ducted in a city owned building that ttie proper authorities would be
contacted. That time is now here as, since last summer, congregate meals
have been served in the city owned Recreation Center and there appear to
be many irregularities.
For one thing, the notice regarding congregate meals which appears
each Saturday in the Press -Citizen appears to indicate that an attempt
is being made to short change those for whom the congregate meals are
intended, viz: the elderly with the greatest economic or social need.
The first sentence of that:notice now reads, "Congregate meals are
available for people age 60 or older and their epduses". Since there are
some 10,000 people in Johnson County in that catggory, and only an average
of about 153 congregatetmeals are available each day, that means that the
only persons that can be served each day are the first 153 people who make
reservation first. Since no priority or preference is mentioned, that
means that as3 personsin the County age 60 or older, and their spouses,
are in the same boat, with no distinction being made, for instance, between
a well-to-do person, age 62, physically mobile and in good health and a
low income person, age 85, with a language barrier who has had a stroke
and walks with two canes. It's just a matter of which one registers first.
(Prior to June ;26, 1980 the first sentende of the SdLturday notices read:
"Congregate meals are available for eligible persons age 60 and over....
Other apparent irregularities in connection with the congregate
meals program include the following:
1. A call to the office of the Director of Nutrition Services,
Michael ?oster (338-9294 brings the following reply, "Everyone age 60 or
older and their spouse are eligible."
2. A folder giving ineormation regarding the J.C. Congf ate Meals
Program, which is being distributed, states WHO CAN PARTICIPATV 7 Any
person 60 years of ageror older a nd their spouses (regardless of age)."
3. Mrs. Lucy Luxenberg, at the time she opened the doors of the
Elderly Services Agency said that her rsnswer. � about eligivility would
be the same as that of the Heritage Agency, whatever that might be.
4. In letters to the Johnson County Board of Sunervisors,(of which
letters I have copies) Mr. Olen Bowles of the Iowa Commission on the Aging,
wrote on November 20 as follows: "450FR Part 1321.141 (b) (1) and (2)
ELIOIBILITT appears to be straightforward in that 'a person age 60 or
older, and the spouse of such person regardless of age, are eligible to
participate in congregate nutrition services'."
On October 20 Mr. Russell Proffitt of the Heritage Agency wrote:
"The duly qualifications on eligibility mentioned in Federal Regulations
Volume 45, number 63 is found in section 1321.141 (b) Eligibility (1)
congregate nutrition services ''a person age 60 or older and the spouse
offthe person regardless of age, are eligible"."
The paragraph on eligibility that Rev. Robert Welsh asked me to include
in the "History" readeL "Eligibility. Congregate Nutrition Services. A
person age 60or older and the spouse of the person regardless of age are

You will note,, on reading the legal opinion of our County Attorneye
and the opinion of Mr. Hillis Atwell of the Department of Health and
Human Services, Administration en Aging, that their opinion is entirely
different that that of those who Bay that every person age 60 or older
and spouse are eligible to participate in the congregate meals program,
and do not mention preference or priority for the elderly with the greatest
soo210mic or social need, and it isn't difficult to figure out why. Bdfore
they wrote their opinion, the County Attorneys and Mr. Atwell read the
entire current law - _ not only the 1980 regulations, but also Title III
on which the 1980 regulations are based. Mr. Bowles, Mr. Proffitt, Rev.
Welsh and Michael Poster apparently read only a very small part of the
1980 regulation. and no part of Title III.
If they had read the entire law, they would have found that the
entire emphasis is on serving the elderly with the greatest economic or
social need. And if they had read Sections 101 and 102, they would have
found that Congress recognized that there are many >bervices that it would
be very nice for the elderly to have but that "pending the availahili+,r ,.r
Now that makes sense. It doesn't make sense to say that every
person age 60 and older, and spouse, are eligible because Johnson County
does not have sufficient meals available for some 10,000 people, nor for
any sizeable fraction thereof. And it doesn't make sense to invite some
10,000 senior citizens to come to dinner seven days a week when there
thererip an average of only about 153 meals available, as is being done
each Saturday by way of a notice in the Press -Citizen.'
DEFINITIONS
SEC. 102. For the purposes of this Act—
( I ) The term "Secretary" means the Secretary of Health, Education,
and Welfare.

Stale and local governments, with appropriate assistance from the
Federal Government."
According to the 1970 Censue, there were 1009 persons in Johnson
County age 60 or older at that time. There are more now. Just guessing,
there are no doubt at least 3,000 younger spouses. Total, about 10,000.
According to the records, there are now 1065 congregate meals available
each sevnnriayyweek in Iowa City.an average of about 153 a day. In
addition, a small number of meals are being served in Lone Tree and in Solon.

To the best of my knowledge, no attorney has challenged the legal
opinion of our County Attorneys, nor the opinion of Mr. Atwell of the
Department of Mealth and Muman Services, a copy of which was filed with
the Board of Supervisors. And I know of no attorney who has said that
those are right who say that every person in Johnson County, age 60 or
older, and their spouses are eligible to participate in the congregate
meals program.
I make no comment as to those who participate in the congregate
meals program. I have never participated and so have no first hand
knowledge as to who does participate. The objectionable part of the
program at this time is the misinformation that is being fed to the
public by the Director of Nutrition Services (and others); by way of the
folder on congregle;Dheals which is being circulated; and by way of the
notice which appears'iach Saturday in the Press -Citizen.
It is important that this be cleared up before the Senior Center
opens as this building is city owned and was acquired and remodeled with
Federal funds in the amount of some million and a half dollars. It would
seem that in a city owned building the Council would nave not only the
right but also the obligation to see to it that all programs conducted
therein are in compliance with all state and Federal rules and regulations.
The home delivered meals part of the nutrition program appears to
be well conducted in Iowa City.
I have two questions;
No. 1. What is the answer of each of you (and the City Manager too)
to the question, "What people are eligible for those congregate meals that
are being served eash Saturday and Sunday at the Recreation Center?"
No. 2 . As a group, have you decided what you will tell Ms. Lucy
Lexington to say in regard to congregate meals eligibility in her
informational and out -Teach service? Her salary is being paid By�the
funding bodies, and so the funding bodies are the boss.

Dear Neil:
I have received your letter dated April 16, 1981. I agree that the addition
of the phrase "priority will be given to those persons with the greatest eco-
nomic or social need" will not in any way change the basis upon which the
congregate meals are provided.
In 45 CFR Part 1321.109, the regulations state, "All service providers under
this part must follow priorities set by the area agency for serving older
persons such as location of services and specialization in the types of ser-
vices most needed by these groups to meet this requirement. Service provi-
ders may not use a means test." It seems clear to me that since t e regu a-
t ons prohibit the use of a means test we will never be in the position to
determine on an individual basis those persons with the greatest economic or
social need. We will, however, continue to give priority to those people in
greatest economic and social need by locating our congregate meal sites in
places that are accessible to them and we will continue to subcontract with
the Johnson County Board of Supervisors who administer programs for those
people with greatest economic and social need.
If and when space becomes a problem for serving congregate meals the deter-
mination as to who will be served will be made on the basis of the order in
which reservations were received and not based on any form of means test.
I will be speaking with Bob Welsh about this matter to see if the Board of
Supervisors will be willing to modify the newspaper notice for congregate
meals.

ANALYSIS
Approximately three years ago Mr. Bruce Glasgow inquired of the City about the
possibility of "swapping" land along the St. Anne's Drive right-of-way. Because
the future alignment of Foster Road in this area was undetermined, consideration
of this inquiry was delayed. At a meeting hold by the City Council on September
8, 1980 it was decided that Foster Road should follow a more "northerly
alignment" than that previously discussed. Attached to this report is an area
map showing this new Foster Road alignment and a vicinity map of the northerly
alignment and the previously discussed alternative. With this decision in mind,
the Commission can now consider the proposed land swap along St. Anne's Drive
and the possible reduction of the right-of-way width along the portion of St.
Anne's Drive constructed as part of the original Foster Road.
St. Anne's Drive should now be considered as a 950 foot street connecting the
northern end of Buresh Avenue with Prairie du Chien Road. Approximately 270

secondary ;arterial street. The remainder of the street is graveled and
unimproved asphalt with a right-of-wiy that is not uniform, varying between 40
to 60 feet. Both the improved and unimproved portions of St. Anne's Drive will
now functionally be considered as a local residential street eventually tying
back into the realigned Foster Road. The existing 66 foot right-of-way.provides
a parkway of 16h feet along both sides which exceeds the typical 11 foot parkway 37J?

present right-of-way width (66 feet) is greater separation between new housing
and the existing street area. However, functionally speaking there is no need
for a 16h foot wide parkway. Both Engineering and Planning concur that the
existing right-of-way should be reduced from 66 feet to 55 feet in width.
In order to obtain a clearly defined and uniform right-of-way along the
unimproved portion of Foster Road, the City and Mr. Glasgow will have to
exchange land. Unfortunately, St. Anne's Drive is constrained by existing
development located along Prairie du Chien to a 40 foot right-of-way (see
attached map). Although it is desirable to have a uniform 50 foot right-of-way
pursuant to our present standards for local streets, practically speaking it is
unlikely due to the location of the existing uses along St. Anne's Drive and
Prairie du Chien Road. Alternatively, the City should retain St. Anne's Drive
as it currently exists but redefine the existing right-of-way in a manner in
which a uniform 40 foot right-of-way would be provided. The attached location
map conceptually depicts what the staff recommends in terms of the final design
