NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA: 1. That the Police Chief is hereby authorized and directed to sell the abandoned bicycles at public auction to the highest cash bidder therefore, and that Notice of said sale shall be published in the Iowa City Press -Citizen once each week for two consecutive weeks, the date of the last publication being no more than one week prior to the day of the sale. 2. That the proceeds from the sale of these bicycles shall be paid into the Public Safety Fund portion of the budget of the City of Iowa City, after first deducting therefrom the costs of the sale. Ever since the high-rise elderly housing project opened last sum• mer, some tenants of the Capitol Tom Dubuque Apartments complex at Dubuque and Court streets have Walsh claimed the traffic signals a block o.ran. don^„^ north at Dubuque and Burlington c0 ^p a'^M streets don't allow them enough time to safely cross the busy Intersection before a light change makes anyone still In the crosswalks fair game for motorists. "Those cars come and you just shake," said I,Illis Christian, a Capitol House resident who spent two weeks In the hospital after a fall In the crosswalk. "You don't know if the car is going to hit you or not." Christian made her comments In front of a television camera. Behind it was Rod Blair, an Iowa City teen-ager who has been making films and producing television shows since he was 10. "I do a lot of horror movies and some comedies," said Blair, who twice a week for the past six months has produced his own show — "Fright Favorites" — on one of the Iowa City cable TV ayetem's public access channels. Though he may be young, he's no rookie — his show will be syndicated nationally this summer by one of the nation's largest cable television networks. "I heard about this problem at the Intersection through the Synthesis group at United Action for Youth, and then 1 went to a meeting at the Capitol House Apartments, because I wasn't going to do a show on It unless I agreed with what they were saying, later, I went down there and saw elderly people who didn't make it across." April 5, 1901 Blair combined his camera work and his production studio expert ence with some helpful advice from Synthesis coordinator Bill Newbem to produce a 13 -minute color video- tape that combines interviews with scenes of elderly pedestrians racing against a superimposed stopwatch to beat the lights. Some don't makd It. The watch shows It to be a 33 - second process, which Is 13 seconds longer than the sanctuary afforded by the lights. Blair's tape Is called "Run Don't Walk" and was first televised Friday at 4:30 p.m. on Hawkeye CableVI. slon Channel 26, and will be shown again Monday at 7 p.m. and Tuesday at 5:30 p.m. The three showings have been sandwiched together in hopes the city's seven City Council members will have a chance to tune In before those concerned about the problem descend upon the formal City Council meeting Tuesday, a meeting to be televised on cable Channel 29. "We tried to arrange it so they could see It during some meeting before Tuesday, but I guess they didn't want to," Blair said. "Hope- fully, the council will decide to provide these elderly people with more time. 1 hope, too, that the tape will help make people drive more cautiously at -the Intersection now that they know that It's used by elderly people trying to get down. town." City Manager Neal Berlin said Thursday he's well aware of the problem, but also sees It as s problem that can never be ade- quately solved. "I don't think there Is an absolute solution to the problem, because we are dealing with a very busy street, and a great amount of vehicular traffic and a great amount of pedestrian traffic, and all those uses are going to comp8te," Berlin said. "It's a case where no one Is ever going to be totally satisfied no matter what the remedy is, but I have asked (Traffic Engineer) Jim Brachtel to look Into some alterna- tives to see If we can't come up with something that perhaps more closely meets the needs of pedestrians. "It's a problem of competing needs," he said. "No one wants to be delayed and everyone wants to just scoot across. There's always been a problem on Burlington Street — there's been a problem long before that housing was there. It's always been a problem, and It will continue to be a problem and, again, there will be no Ideal solution. We're only looking for something that can help." 4613 Berlin said the city's traffic staff has not yet made Its final recom• mendations. Consequently, no effort was made to work Blair's tape into the council's agenda before Tues- day's meeting, when senior citizens organized with the help of an agency funded in part by the council will be on hand to debate the Issue. "We want the council to either add more seconds or to get rid of the turning traffic," said Lucy Luxen. burg, the director of the Elderly Services Agency, an advocacy and referral program for Johnson County senior citizens. "Jim Brachtel spoke at the Capi- tol House Apartments during what was an hour-long educational meet. Ing, where the senior citizens who attended were not the least bit shy about speaking up. Jim saw this as a chance to both explain how the signal system there works and also as a chance to inform these people how to use the crosswalk. He even had signs put up on the poles to help explain how the system works. "Appar- ently, these people feel that's not good enough, which Is why the tape was made." We're working with Elderly Services Agency and eight other mostly youth -oriented agencies, and It's going to be a phone-in pledge thing. I'm working with Lucy now to use some elderly persons for talent." It appears unlikely at this time that the City of Iowa City will be eligible for UMTA Section 5 funds during FY82 as originally anticipated. Also, as you know, a first year TSM document is being developed for this urban area by the Johnson County Council of Governments therefore Iowa City was not included in the Region X RTDP. A. The resolution concerning Income Limits is self-explanatory. Attached herewith is correspondence from HUD concerning income limits. B. The resolution concerning Development Program and the Development Cost Budget may require additional explanation. Please be aware that the figures contained on those forms have not been approved by HUD. Somf changes may be required however this will not be known until the final Negotiation Conference with HUD, the -Housing Authority and the Developer. The final Negotiation Conference is currently scheduled for May 11, 1981. The result of this conference should be an Annual Contributions Contract between the Housing Authority and HUD. Adoption and execution of the Annual Contributions Contract should permit offering a Contract of Sale to Southgate Development on or about May 25. The Development Program and Budget covers the period from June of 1978 through June 30, 1982. The project.will be completed and purchased in three phases. Phase I - Start construction June 1, 1981. Completion last week of November, 1981. Phase II - Start construction July 15, 1981. Completion second week of February, 1982. Phase III - Start construction August 3, 1981. The city of Iowa City charges for garbage collection. It is billed and collected with the water and sewage. Current policy is that the city will pick up garbage for up to 4 units. (a) Administrative Salaries. The few number of units involved do not warrant a fulltime administrator. The Program will utilize current authorized person- nel to administer this program. Costs will be prorated with the Section 8 Existing Housing program. Includes regular maintenance such as lawn mowing, snow removal at the two multi -family sites. This will be performed by City crews and charged back to this program on a direct time basis. Tools and ma- chines to be provided by the city. Other minor maintenance such as faucet re- pair, glass replacement, cleaning, etc. will be provided by city crews, if available; otherwise, it will be contracted with private industry on a job basis as necessary. (e) Insurance. This is an estimate only. Bids will not be solicited until a later date as insurance will not be required before August/September time frame. In order to finance the cost of the Project, the Bond shall be and the same is hereby authorized, determined and ordered to be issued in the principal amount of $100,000. The Bond shall be issued as a single Bond in fully registered form, and shall be dated as of the date of issuance and delivery thereof and shall be executed, shall be in such form, shall be payable, shall have such prepayment provisions, shall bear interest at such rates, and shall be subject to such other terms and conditions as are set forth in the Lender Loan Agreement and Loan Agreement. The Bond and the interest thereon does not and shall never constitute an indebtedness of or a charge against the general credit or taxing power of the Issuer, but is a limited obligation of the Issuer payable solely from revenues and other amounts derived from the Loan Agreement and the Project and shall be secured by an assignment of the Loan Agreement and the revenues derived therefrom. Forms of the Lender Loan Agreement, the Bond and the Loan Agreement are before this meeting and are by this reference incorporated in this Bond Resolution, and the City Clerk is hereby directed to insert them into the minutes of the City Council and to keep them on file. Section 3. Lender Loan Agreement; Sale of the Bond. In order to provide for the sale of the Bond to the Lender and the conditions with respect to the delivery thereof, the Mayor and City Clerk shall execute, acknowledge and deliver in the name and on behalf of the Issuer, the Lender Loan Agreement in substantially the form submitted to the City Council, which is hereby approved in all respects. The sale of the Bond to the Lender is hereby approved and the Mayor and City Clerk of the Issuer are hereby authorized and directed to deliver the Bond to the Lender. Deposit by the Lender to the credit of the j Issuer of the purchase price, namely $100,000, in immediately available funds at the office of the Lender in Iowa City, Iowa shall constitute payment in full for the Bond pursuant to Section 1.02 of the Lender Loan Agreement. (the "Company"), an Iowa corporation, for its acquisition by construction or purchase of certain equipment and leasehold improvements suitable for use in its commercial enterprise, located within the Urban Renewal Area of the Issuer (the "Project"), which the issuer has found to be consistent with the Issuer's Urban Renewal Plan, Project No. Iowa R-14, for the Urban Renewal Area designated in such plan; and WHEREAS, it is necessary and advisable that provisions be made for the issuance of an Industrial Development Revenue Bond, Series 1981 (Lenoch & Cilek, Inc.: Project) of the Issuer in the principal amount of $150,.000 (the "Bond") as authorized and permitted by the Act to finance the cost of the Project to that amount; and WHEREAS, the Issuer will loan the proceeds of the Bond to the Company pursuant to the provisions of a Loan Agreement dated as of March 1, 1981 (the "Loan Agreement") between the Issuer and the Company the obligation of which will be sufficient to pay the principal of, redemption premium, if any, and interest on the Bond as and when the same shall be due and payable; and WHEREAS, the Bond will be sold pursuant to and secured as provided by a Lender Loan Agreement to be dated as of March 1, 1981 (the "Lender Loan Agreement") by and between the Issuer and Iowa State Bank & Trust Company, Iowa City, Iowa (the "Lender"); and WHEREAS, the rights of the Issuer in and to the Loan Agreement are assigned to the Lender under the Lender Loan Agreement; and -3- 9ELIN, HARRIS, HELMICK & HEARTNEY, LAWYERS, DES MOINES, IOWA &dP.* MICROFILMED BY 'JORM MICROLAB CEDAR RAPIDS -DES MO HIES L.", WHEREAS, notice of intention to issue the Bond has been published and this Council has conducted a public hearing pursuant to such published notice, all as required by the Act, and has hereby determined that it is necessary and advisable to proceed with the financing of the Project; and WHEREAS, the Issuer has arranged for the sale of the Bond to the Lender. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Issuer, as follows: Section 1. Project Consistent with Urban Renewal Plan. That the Issuer defray the cost of acquiring, constructing, improving and equipping a commercial enterprise consisting of a retail facility located within the Urban Renewal Area of the Issuer and consistent with the Urban Renewal Plan by issuing the Bonds and loaning the proceeds from the sale of the Bonds to the Company. Section 2. Authorization of the Bond. In order to finance the cost of the Project, the Bond shall be and the same is hereby authorized, determined and ordered to be issued in the principal amount of $150,000. The Bond shall be issued as a single Bond in fully registered form, and shall be dated as of the date of issuance and delivery thereof and shall be executed, shall be in such form, shall be payable, shall have such prepayment provisions, shall bear interest at such rates, and shall be subject to such other terms and conditions as are set forth in the Lender Loan Agreement and Loan Agreement. The Bond and the interest thereon does not and shall never constitute an indebtedness of or a charge against the general credit or taxing power of the Issuer, but is a limited obligation of the Issuer payable solely from revenues and other amounts derived from the Loan Agreement and the Project and shall be secured by an assignment of the Loan Agreement and the revenues derived therefrom. Forms of the Lender Loan Agreement, the Bond and the Loan Agreement are before this meeting and are by this reference incorporated in this Bond Resolution, and the City Clerk is hereby directed to insert them into the minutes of the City Council and to keep them on file. Section 3. Lender Loan Agreement; Sale of the Bond. In order to provide for the sale of the Bond to the Lender and the conditions with respect to the delivery thereof, the Mayor and City Clerk shall execute, acknowledge and deliver in the name and on behalf of the Issuer, the Lender Loan Agreement in substantially the form submitted to the City Council, which is hereby approved in all respects. The sale of the Bond to the Lender is hereby approved and the Mayor and City Clerk of the Issuer are hereby authorized and directed to deliver the Bond to the Lender. Deposit by the Lender to the credit of the Issuer of the purchase price, namely $150,000, in immediately available funds at the office of the Lender in Iowa City, Iowa shall constitute payment in full for the Bond pursuant to Section 1.02 of the Lender Loan Agreement. Section 5. Loan Agreement. In order to provide for the loan of the proceeds of the Bond to acquire, and equip the Project and the payment by the Company of an amount sufficient to pay the principal of any premium, if any, and interest on the Bond, the Mayor and City Clerk shall execute, acknowledge and deliver in the name and on behalf of the Issuer the Loan.Agreement in substantially the form submitted to the City Council, which is hereby approved in all respects. Section 6. Miscellaneous. The Mayor and/or the City Clerk are hereby authorized and directed to execute, attest, seal and deliver any and all documents and do any and all things deemed necessary to effect the issuance and sale of the Bond and the execution and delivery of the Loan Agreement and the Lender Loan Agreement, and to carry out the intent and purposes of this resolution, including the preamble hereto. Section 7. Severability. The provisions of this resolution are hereby declared to be separable and if any section, phrase or provisions shall for any reason be declared to be invalid, such declaration shall not affect the validity of the remainder of the i sections, phrases and provisions. Section S. Repealer. All resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 9. Effective Date.
